The Delhi High Court on Friday dismissed a petition by All India Students Association (AISA) national president Neha Bora challenging a notice requiring her to furnish a personal bond of ₹10,000 with one surety to maintain peace during an inquiry. Bora was detained during an anti-Chief Election Commissioner protest at Mandi House on October 16.Justice Subramonium Prasad, while pronouncing the order, said there were “adequate safeguards” in place. He directed the Special Executive Magistrate to “take care” and provide Bora with all relevant material before passing any order following the inquiry.
Why did Bora challenge the notice?
Bora approached the High Court seeking to quash the October 17 notice issued under Sections 126 and 130 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), read with Section 135(3). She also sought protection against coercive action by the authorities. The provisions allow magistrates to initiate preventive proceedings when information suggests that a person may disturb public peace. Under Section 135(3), a magistrate can require a person to execute a bond to maintain peace during an inquiry, subject to the statutory conditions. The petition argued that the notice did not identify material establishing a likelihood of breach of peace, a prerequisite for initiating proceedings under Section 126.
Arguments before the court
Senior advocate Gopal Sankaranarayanan, appearing for Bora, told the court that the October 16 gathering had been peaceful and that she had never called for violence. He also argued that seeking regime change was not objectionable in a democracy.Sankaranarayanan contended that the notice had been issued mechanically, arguing that a preliminary inquiry was necessary even before seeking an interim bond.Additional Solicitor General Sharma countered that Section 126 allowed a broad assessment based on the information received, which did not necessarily have to translate into evidence or established facts.
What happened during the protest?
According to the petition, Bora had called for a peaceful gathering at Mandi House at 5 pm on October 16 to unfurl the national flag at Central Park in Connaught Place as part of protests against the Chief Election Commissioner. She alleged that she was detained around 5:30 pm, taken to an undisclosed location and later moved to R.K. Puram Police Station. She remained there overnight and was released at 6 am on October 17.The notice, received on October 18, cited alleged sloganeering, repeated protests around Jantar Mantar despite prohibitory orders and claims that Bora had instigated people to join the Connaught Place gathering.

Delhi Traffic Police issues advisory ahead of protest Marches from Bangla Sahib to Jantar Mantar

Prime Minister Narendra Modi faces an unusual convergence of three major political and economic challenges: a persistent youth-led protest movement, strained diplomatic relations with the United States, and downward pressure on the Indian rupee.

Delhi protests: PM Modi faces three-front political challenge

Leader of Opposition in the Lok Sabha Rahul Gandhi made a series of sensational claims at a press conference in New Delhi, where he demanded the resignation of CEC Gyanesh Kumar. From claiming that 200 govt officials were in touch with the Opposition to a signal at Cockroach Janta Party-led protesters, the Congress MP sharpened his attack on the Centre.

Delhi protests: Congress leaders begin march to Supreme Court

Delhi's Saturday showdown has divided citizens into two groups: those who support the protests and those who are completely against them. India's national capital has turned into a fortress, with a massive security deployment, 57 metro stations facing a possible shutdown and borders sealed. This raises a crucial question: Is this an undeclared emergency or a much-needed safety arrangement? The Supreme Court has questioned the need to shut 57 metro stations, asking why authorities cannot simply reduce train frequency instead. Over the last three days of opposition protests, visuals have emerged showing clashes between Delhi Police and the Gandhi siblings. These include an elbow blow by Priyanka Gandhi Vadra against a woman police officer, a Congress worker removing a constable's cap and throwing it away, and police dragging Rahul Gandhi when he attempted to reach the Election Commission's office. The Constitution of India gives citizens the right to protest as well as the right to defend themselves. However, two important questions need answers. The first is for the protesters. With everyone, from the INDIA bloc to CJP and content creators such as Dhruv Rathee, coming together to fight for citizens' rights, what about the rights of those whose lives are being disrupted by these protests? If 57 metro stations shut down, how will ordinary citizens travel? What happens to people who depend on the metro to reach their workplaces and carry out their daily activities? If protesters believe that tightening security amounts to an undeclared emergency, would they take responsibility if, God forbid, an untoward incident occurs? Would they stand up and accept responsibility? The right to protest is important, but so are the rights of citizens who have to deal with the consequences of political demonstrations. Those leading the protests must also consider how their actions affect the public. The second question is for the Election Commission. Why can't it clarify the issues properly and put the matter to rest once and for all? Citizens need clarity and transparency. They do not deserve silence from an institution they look towards for answers on electoral matters. Instead of allowing the issue to escalate, the Election Commission should have communicated directly with voters and addressed their concerns. The impact of Saturday's showdown will inevitably fall on ordinary citizens. Both sides need to understand that they cannot use the name of citizens to push their own agendas while overlooking the inconvenience and uncertainty people face. Ultimately, the question is not just about protests or security arrangements. It is also about whether those claiming to defend citizens' rights are willing to consider the rights and concerns of the very people they say they represent.

Delhi's planned security measures ahead of Saturday's protests have raised questions about public safety, citizens' rights, the proposed shutdown of 57 metro stations and the Election Commission's response to concerns over electoral transparency.

The INDIA bloc on Friday (October 9) submitted a four-point memorandum to President Droupadi Murmu, alleging large-scale electoral manipulation by the Bharatiya Janata Party (BJP) and seeking sweeping changes to the election system. Leader of the Opposition in the Lok Sabha Rahul Gandhi later claimed that Murmu “did not deny” the allegations during the meeting. Instead of questioning or arguing with the Opposition leaders, she asked them to submit proof of their claims, he said. The meeting comes amid protests over alleged irregularities in the Special Intensive Revision (SIR) of electoral rolls and demands for action against Chief Election Commissioner Gyanesh Kumar.
What are the INDIA bloc’s four demands?
The memorandum accuses Prime Minister Narendra Modi and Home Minister Amit Shah of undermining India’s electoral system. As protests continue in Delhi over NEET-UG paper leak, Delhi Metro Rail Corporation (DMRC) said that 18 metro stations will remain closed in the national capital on Saturday (Jul 25) from 7:30 am. The decision has been taken in view of security concerns amid protests in Central Delhi. In a fresh escalation, Leader of Opposition Rahul Gandhi along with other key Congress leaders were detained by the Delhi Police after they staged a dharna outside PM Modi's residence. This comes a day after thousands hit the streets of Delhi to seek justice for NEET students. As Sonam Wangchuk's fast entered day 24, the Delhi High Court directed him to be shifted to a hospital of his choice.

Violent protests against the newly enforced citizenship law continued to shake the North-East states and spread to West Bengal, Delhi and parts of southern India, with police resorting to shells of lathi and tear gas to disperse demonstrators. Aligarh Muslim University has postponed examinations and announced a complete shutdown till January 5. The Jamia Millia Islamia University of Delhi has also canceled exams.

Anti- Citizenship Protests: Indian university campuses turn battlegrounds

The Supreme Court on Monday said that it will not take suo motu cognizance of the petition filed against protests in Delhi until "violence and destruction of public properties" stops.

"Let the rioting stop. Public property is being destroyed. The court can`t do anything right now. We will determine the rights but not in the atmosphere of riots. Let this stop and then we will take suo motu cognizance. If protests violence and destruction of public properties continues, we will not hear it. Come back tomorrow," a bench headed by Chief Justice of India SA Bobde was quoted as saying.

The matter came up for hearing against the backdrop of violent protests in Delhi`s Jamia Millia Islamia University and Aligarh Muslim University yesterday over newly enacted Citizenship (Amendment) Act.

Mentioning the matter before the bench, senior advocate Indira Jaising requested the apex court to take suo motu cognizance of violence.

"Human right violence is taking place all over the country. No one can stop the peaceful protest in this country. Hundreds of students injured, buses are burnt by the police and blame is being put on students," she said.

On these contentions, the Chief Justice Bobde said the law and order situation should be handled by the police.

"Just because they happen to be students, it doesn`t mean they can take law and order in their own hands. This has to be decided when things cool down. This is not the frame of mind when we can decide anything. We will take cognizance, but let this stop. We will see what we can do. First, we want to assure that there is peace," CJI Bobde said.

He, however, clarified that the court is "not against rights and peaceful demonstration" by the protesters.

The Act provides citizenship to Hindu, Sikh, Buddhist, Jain, Parsi and Christian communities who faced religious persecution from Pakistan, Bangladesh, and Afghanistan and arrived in India before December 31, 2014.

Indians were getting lynched, and India could not take it anymore. As police arrested four accused on Ballavgarh train lynching yesterday, thousands of people gathered across the country in 14 cities to protest that such heinous crimes cannot continue in the name of the people. Similar gatherings happened in Boston, London, and Toronto which boast of a large Indian diaspora. The movement popularly referred to as #notinmyname, however, started humbly with just a Facebook post from filmmaker Saba Dewan, who gave a shout out to all her friends that there should be a civil society-led protest against the lynchings. It turned out to be a galvanising moment.

What the organisers #notinmyname expected to be a small silent march of about 200 people eventually turned into a mass movement. Karuna Dayal, one of the protestors present at Jantar Mantar in New Delhi said, “This kind of a movement is a go ahead in our country, it is a democratic country and we must act against certain heinous crimes in our country in time and at the right moment." Looking at the protestors who came from all work of life, Karuna felt some sense of hope "that so many people from so many walks of life have come together to support it."

Thus, voluntarily, citizens of India marched to stand against the deaths of fellow Indians and to condole the loss of Hafiz Junaid, the 16-year-old who was killed on a moving train. On the evening of the 22nd of June, 2017, Junaid was beaten to death in a train compartment by a mob while returning from Delhi after Eid shopping. Junaid's death is not an isolated event that could be brushed aside as an aberrant act of the crazies. In the past too, a mob gathered and lynched a man to death on suspicion of carrying beef on September 28, 2015.

Such violence has not escaped the Dalit, another minority community in India. Indian Dalits have been targeted for skinning cow carcasses, a job they had been doing for time immemorial because finding other avenues of income has never been easy for them. Terrified of reprisals, several Dalit families refused to handle the dead cows though it meant cutting off the source of daily income. But it did not save them as they were beaten again.

All these events were creating a deep sense of anguish among the Indians for some time, which reached a climax with Junaid's murder. Muslims decided not to celebrate Eid and, instead, wore black armbands to protest against the violence. As so many of the participants in the protest gathering at Jantar Mantar pointed out that such acts should not be happening in India, which comes with a proud history of secularism. One of the protestors pointed out to me, India is "moving towards progressive development (hence) we must stop it (such crimes)."

Almost all the protestors I spoke to carried this sense of contradiction in them; they are deeply proud of India, the country's democratic tradition, its march towards achieving developmental goals, but at the same time there is a pervasive sense of frustration at what they see as growing intolerance. Kumar Prashant remarked, “I am here to be counted with these people that are here protesting. I want this to spread across India and to do that we all have to proclaim India as our country on each and every occasion. We are all Indians and this is our country,”

#NotInMyName has been used as in protests before, but it has been traditionally used by Muslims against terrorist attacks done in the name of Islam. The Mayor of London used the term recently after the stabbings in London on the 3rd of June, 2017. It is interesting that the same hashtag used by Muslims to condemn violence done in their name is being used against violence targeted at Muslims and Dalits.

India has a long history of protests, starting with the "protest" of the Buddhists and Jains against the Brahminical dominance in the 6th century BC, then Gandhi's historic protest movements of the early twentieth century, Ambedkar's incessant struggle against casteism. In line with this glorious tradition of protest movements in India, the citizens, after the brutal rape and torture of Nirbhaya, took to public spaces to protest violence against women and lax laws. Fasting as a form of political protests and dharnas too are common; Irom Sharmila's 16-year-long fast against the Armed Forces Special Powers Act and Anna Hazare's hunger strike against corruption gained national momentum.

At the protest meeting, there was music and poetry and posters which made it clear how the citizens felt. Those that could not make it sent messages of support on the protest page on Facebook. In a functioning democracy, there is no need for mob violence or any need for people to take the law into their own hands. But in an atmosphere of bigotry, we often tend to forget the foundational values of a democratic regime. Hopefully, as one of the protestors pointed out, movements like #notinmyname "will give rise to the nation's voice", and we will be able to remind ourselves that all lives are valuable.
