M Nageshwar Rao undoes transfers done by Verma, situation restored to January 8

Returning to his office Wednesday after a 77-day exile, CBI Director Alok Verma annulled most of the transfers effected by M Nageshwar Rao, who was holding the charge as the interim director.

A 1979-batch AGMUT cadre IPS officer, Verma arrived the headquarters at around 10.40 am Wednesday, a day after the Supreme Court set aside a controversial government order divesting him of all powers, amidst unprecedented public spat with Special Director Rakesh Asthana, who was booked by the agency under corruption charges.

Verma and Asthana were sent on forced leave by the government along with Verma, through two separate orders issued on October 23, 2018, late evening.

Upon his arrival at the CBI headquarters, Verma was received by Rao, officials said.

Then Joint Director M Nageswar Rao, a 1986-batch Odisha cadre IPS officer who was later promoted as Additional Director, was given the duties and functions of the CBI director late night on October 23, 2018, after Verma and Asthana were divested of their powers.

The next morning, Rao had issued seven transfer orders including those probing corruption case against Asthana, like DySP A K Bassi, DIG M K Sinha, Joint Director A K Sharma, among others.

On January 3, 2019, he had transferred officers of Joint Director Rank.
Verma issued two orders Wednesday "withdrawing" all the transfers done by Rao on October 24, 2018, and January 3, 2019.

In his expansive office on the 11th floor of the imposing glass and concrete CBI headquarters building, Verma also kept a keen ear on the developments related to the meeting of high-powered selection meeting announced for the evening as a stream of senior officers kept him busy, officials said.

He remained in office till late at night, they said.

In sending Verma on leave, the government overlooked the immunity given to the CBI director by the Supreme Court ensuring a two-year minimum tenure to protect the incumbent from any political interference.

The government tried to justify its decision, saying it became necessary amid an unprecedented feud between the two senior-most officials of the agency who had levelled charges of corruption on each other, an argument rejected by the apex court Tuesday.

In its order Tuesday, the Supreme Court set aside Verma's forced leave but restrained him from taking any major policy decision till the CVC probe into corruption charges against him is over.

In the absence of any clear definition of "major policy" decisions, the grey area exists as to what extent Verma's powers will be limited.

The apex court said any further decision against Verma, who retires on January 31, would be taken by the high-powered committee which selects and appoints the CBI director.

The Supreme Court in the Vineet Narayan judgment had fixed a minimum tenure of two years for the CBI director to give him immunity from any political interference.

Later, through the Lokpal Act, the process of selecting the CBI director was handed over to a selection committee.

FM:This action was taken perfectly bonafide as there were cross-allegations made by both the officers,&in accordance with recommendations of CVC.The govt had felt that in the larger interest of fair&impartial investigation&credibility of CBI,the 2 officers must recuse themselves. — ANI (@ANI) January 8, 2019 × "The court apparently has strengthened the immunity given to the CBI director in the larger interest of the fair and impartial working of the CBI. At the same time, the court has devised an accountability mechanism. The directions of the court will obviously be complied with," he said. The Supreme Court reinstated Verma, setting aside the Centre's decision to divest him of his powers, but restrained him from taking any major policy decision till the CVC probe into corruption charges against him is over. The apex court said any further decision against Verma, who was sent on leave following the Centre's October 23 decision and retires on January 31, would be taken by the high-powered committee which selects and appoints the CBI director.

Supreme Court today reinstated Alok Verma as CBI chief overruling the government's decision.

A bench headed by Chief Justice of India(CJI) Ranjan Gogoi delivered the verdict asserting that Verma can't be stripped of his power.

The Supreme Court asked the government to go back to the selection committee.

Verma has been reinstated but cannot take policy decisions, the top court said in its verdict.

The apex court also said that any further decision against Verma would be taken by the high-powered committee which selects and appoints the CBI Director.

It said the high-powered committee will take its decision on the basis of the findings of the CVC inquiry. It said the meeting of the committee should be convened within a week.

The court also set aside the Centre's decision to appoint senior IPS officer M Nageswara Rao, who was the joint director, as the interim chief of the agency.

The bench had reserved the verdict on December 6 last year after hearing arguments of Verma, the union government, Central Vigilance Commission (CVC), NGO Common Cause and Congress leader Mallikarjun Kharge and others who were the party in the case.

The CVC had told the apex court that "extraordinary situations sometimes need extraordinary remedies."

CJI Ranjan Gogoi had earlier raised questions over the timing of the order and asked why the government took immediate steps to divest Verma of his powers without consulting the selection committee.

Attorney General KK Venugopal appearing for the DoPT had told the bench that the government was well within its jurisdiction to send both officers (Verma and CBI Special Director Rakesh Asthana) on leave by divesting them of their powers.

In October, Alok Verma and Rakesh Asthana were asked to go on leave by the government in the midst of an internal rift over bribery allegations against the latter.

The feud between Verma and Asthana was marked by allegations and counter-allegations of corruption and interference in high-profile cases.

Uttar Pradesh Deputy Chief Minister Keshav Prasad Maurya Sunday rejected former chief minister Akhilesh Yadav's allegation that the Centre was misusing the CBI.

His reaction came as Yadav attacked the BJP a day after it emerged that the CBI may quiz him in a case of illegal mining.

"I am happy that at least the BJP has shown its colours. Earlier, the Congress gave us the chance to meet the CBI, and this time it is the BJP, which has given us this opportunity," Yadav said in Lucknow.

"There is lot of difference between the cultures of the BJP and the Congress," Maurya told reporters.

He said both state and the Union governments were working with full impartiality and transparency. "If any political party thinks that there should be no probe prior to elections, it is not possible," Maurya said.

Keshav Maurya rejects Akhilesh's charge on CBI

Taking swipe at the BJP over reports that the CBI may quiz him in the illegal mining case, Samajwadi Party chief Akhilesh Yadav Sunday said that he may have to tell the probe agency details of his alliance with Mayawati.

Talking to reporters in Lucknow, he said he is ready to face the CBI, but people are also ready to answer the BJP.

"Now we have to tell the CBI as to how many seats we have distributed in the gathbandhan (alliance). I am happy that at least the BJP has shown its colours. Earlier, the Congress gave us the chance to meet the CBI, and this time it is the BJP, which has given us this opportunity," Yadav said.

"The Samajwadi Party is making efforts to win maximum Lok?Sabha seats. Those who want to stop us, have the CBI with them. Once the Congress did CBI probe, and I was questioned. If the BJP is doing all this, the CBI will question me, I will answer (them). But, the people are ready to give an answer to the BJP," he added.

The former Uttar Pradesh chief minister may face a probe by the CBI, according to the agency FIR made public Saturday, the day arch rivals Samajwadi Party and BSP indicated their intent to join hands. The agency also raided 14 locations in connection with the FIR against 11 persons to probe alleged illegal mining of minor minerals in Hamirpur district during 2012-16.

"Why is the CBI conducting raids. Whatever they want to ask, they can ask me. However, the BJP should remember that the culture it is leaving behind, it may have to face it in the future," he said.

On formal announcement of seat-sharing with Mayawati's BSP, Yadav said that it is likely to be made within a week. However, he maintained suspense on accommodating the Congress in the alliance, which also includes Ajit Singh's RLD.

The Samajwadi Party and the BSP have decided to fight the upcoming national elections together and have already worked out a seat-sharing arrangement to take on the BJP, which along with its allies won 73 seats from the state in 2014.

"You will come to know about it (alliance) in a week or so," Yadav said.
On the possibility of the Congress joining the alliance, Yadav said a decision will be taken by him and Mayawati. He declined to elaborate further.

"The BJP has taught us alliances and we are walking on the same path. We are trying to form an alliance with the BSP. The aim of the Samajwadi Party is to bag the maximum number of seats but the ones who wish to stop us, they have the CBI," he said.

Terming the raids politically motivated, Yadav also questioned the credibility of the CBI.

Hitting back, the BJP said Akhilesh Yadav's government was "hand in glove" with the accused in the illegal mining case.

Rejecting Yadav's allegation of vendetta, UP minister Sidharth Nath Singh said, "If you loot public money, then the law will take its own course."

Addressing a press conference in Delhi, Singh said instead of questioning the time of the raids, Yadav should answer why so much "loot" had happened under his government.

Congress's Kapil Sibal also attacked the BJP, saying that whoever spoke against it was raided.

The politically crucial Uttar Pradesh sends 80 lawmakers to the Lok Sabha.

By joining hands, the opposition parties had defeated the BJP in three Lok Sabha bypolls in the state last year, the first show of strength after the 2017 Assembly elections which saw the saffron party storm to power in the state after a 14-year hiatus.

The Apna Dal, a significant player in the state politics, is also in talks to be a part of the SP-BSP alliance. It is also talking to the BJP and its chief Krishna Patel said it will tie-up with like-minded parties.

"We will go with like-minded parties, the political parties, which agree with our policies and ideology. At present, we are in talks with senior leaders of different political parties including the SP, BSP, Congress and BJP," she said.

On reports of a rift between the BJP and Anupriya Patel's Apna Dal (Sonelal) and Om Prakash Rajbhar's Suheldev Bharatiya Samaj Party, she said, "I do not want to comment on it. But, as far as OP Rajbhar is concerned, he was once associated with the Apna Dal and headed the youth wing of the party."

The Apna Dal (Sonelal) is a breakaway of the Apna Dal, which was founded in 1995 by Krishna Patel's husband Sone Lal Patel. The Apna Dal (Sonelal) was founded by Jawahar Lal Patel, who was also a founding member of the Apna Dal.

The Prime Minister further dispelled the opposition`s criticism that Patel was made to leave.

"No such question arises. I acknowledge that Patel did a good job as RBI Governor," Prime Minister Modi added.

Stressing that institutions like CBI and judiciary are paramount to his government, the Prime Minister stressed that the opposition Congress party has no right to criticise the BJP by saying that the government weakened such institutions in the country.

"Congress has no right to speak on this issue. Against the PM and PMO, the NAC (National Advisory Council) was formed. What kind of empowerment of the PMO was this? Cabinet takes such a big decision and a big leader tears that Cabinet decision at a press conference. What kind of respect is for an institution?", questioned PM Modi.

"Coming to judiciary, they openly said that we will decide judiciary on the basis of ideology and senior judges were shown the door and junior judges were promoted. And you are talking about institutions? In the same RBI, several times Governors were forced to leave before their term expired. You called Planning Commission people a bunch of jokers," the Prime Minister added.

Prime Minister Modi cleared the air over the government removing the two men at the top of CBI.

In October, CBI Director Alok Verma and his deputy Rakesh Asthana, were relieved of their duties pending an inquiry, after each accused the other of corruption, following which the government sent them on leave, calling it an "extraordinary and unprecedented" situation.

''When CBI internal personal matter came to light, they were both asked to go on leave legally. Because institution is paramount for us," stressed the PM while speaking to ANI.

Opposition parties, especially the Congress, have in recent times, criticised the BJP-led Narendra Modi government of misusing the Enforcement Directorate for political vendetta, often dubbing it as Embarrassment Directorate. Prime Minister, however, allayed the criticism.

"How are these people saying this? Recently, Sohrabuddin judgement came. Just read that judgement. See how institutions were misused. Accusations on us is that Modi is not taking action against these people. And you are saying this is vendetta. ED is doing is job professionally. From a foreign country, a razdaar (confidante) has been brought in custody of India. Should not every Indian be proud of it?", said the Prime Minister, while referring to Christian Michel, the alleged middleman in the Rs 3,600-crore AgustaWestland VVIP chopper deal.

Michel, a UK citizen, was extradited to India from the UAE last month in connection with the case and was respresented by lawyer Aljo K Joseph, who happened to be a Congress party leader but was shunted after controversy over his affiliation erupted.

"If a Congress worker turns up to be Christian Michel`s lawyer, then it is a cause for worry. The countrymen should be proud that razdaar has come, now there will be proper inquiry under legal scrutiny and the truth will come out. Instead of that, you are sending lawyers from your party to support him Michel. This is a matter of concern," Prime Minister added.

Urjit Patel was telling me about resignation for the past 6-7 months: PM Modi

The BJP on Tuesday accused the Congress leadership of using the CBI to manufacture evidence in the Sohrabuddin Shaikh case to "politically destroy" its president Amit Shah who, it said, has come out of this "trial by fire" unscathed.

The ruling party fielded Smriti Irani to attack Sonia Gandhi and Congress president Rahul Gandhi, whom the Union minister accused of supporting terrorists in his tweet that said "nobody killed" Shaikh and he "just died".

Rahul Gandhi had tweeted this after a special CBI court in Mumbai on December 21 acquitted all 22 accused in the case of the killing of Shaikh, his wife Kausar Bi and his aide Tulsi Prajapati in alleged fake encounters by Gujarat police between 2005 and 2006 citing insufficient evidence.

Shah, who was the minister of state for home in Gujarat at that time, was also arrested briefly in 2010 in the case before being discharged in December 2014.

"It is now clear that the CBI had arrested Amit Shah in 2010 at the prodding of the Congress leadership," Irani said.

She alleged Shah was targeted by the CBI as a part of a "political conspiracy" of the Congress and its then-president because Prime Minister Narendra Modi, the then Gujarat chief minister, and Shah were seen as political rivals by the party.

"The Congress and its president used the CBI to manufacture evidence to politically destroy Shah. It is one of the finest examples of the length to which the Congress will go to destroy its political opponents," she said.

She described the case as a trial by fire for Shah and said he came out unscathed, as the country's verdict had shown that "truth cannot be destroyed".

There was no immediate response from the Congress to her allegations.

The Congress is always willing to trample upon justice and the Constitution to finish off its political rivals, Irani alleged.

Targeting Rahul Gandhi, she said his tweet was an expression of frustration that Shah came out of the case unscathed despite eight years of harassment.

Following the court's order acquitting the accused, Gandhi had tweeted, "No one killed Haren Pandya. Tulsiram Prajapati. Justice Loya. Prakash Thombre. Shrikant Khandalkar. Kauser Bi. Sohrabuddin Shiekh. They just died."

Irani alleged that the Congress will not spare anybody who comes in the way of its pursuit of power which it uses not to serve people but "one family".

She noted that activist Harsh Mander, who she claimed was a member of Sonia Gandhi's "kitchen cabinet", had moved the Supreme Court against Shah's discharge.

Irani read from the Mumbai court's order that criticised the CBI probe and said the agency created evidence to suit its "preconceived and premeditated" theory to implicate political leaders.

The BJP leader alleged that Shah was arrested in 2010 on the "order" of the Congress leadership and left to "rot" in jail before he was granted bail by the court.

"The court has admitted that these cases were slapped against Shah for purely political reasons. Not only in the Mumbai High Court but also in the Supreme Court, the Congress' conspiracy got defeated, " Irani told reporters.

To a question about AgustaWestland case accused Christian Michel's speaking of "Mrs Gandhi" and making other references which the BJP has linked to the Gandhi family, Irani said sarcastically that she was not in a position to explain it as she is neither Italian and nor her son's name begins with 'R'.

She alleged that the Congress had dispatched its lawyers to help Michel whose "historical relations" with the Gandhi family are established.

Congress used Sohrabuddin case to 'politically destroy' Amit Shah: BJP

Chief vigilance officers act as a distant arm of the CVC to check corruption and other fraudulent activities in an organization.

According to government data, various banks have reported an increase in cases of fraud during 2015-16 and 2017-18.

A total of 8,802 frauds have been reported by scheduled commercial banks and public sector banks in 2017-18 as against 7,794 in 2016-17 and 7,482 in 2015-16, according to a written reply given by the Finance Ministry in the Lok Sabha recently.

The Reserve Bank of India (RBI) monitors frauds reported by banks.

For management of fraud risk and to direct the focus of banks to early detection of loan frauds, prompt reporting to RBI and investigative agencies and timely initiation of staff accountability proceedings, RBI has issued a framework for dealing with loan frauds and Red Flagged Accounts (RFA). Timelines have been given for action incumbent on banks in dealing with loan frauds of Rs 50 crore and above, the ministry said.

The red flagging is done on an information technology platform where all banks report large exposure to entities/individuals so other banks can be forewarned about fraud risk, it said.

In October, the CVC completed a first-of-its-kind analysis of top 100 banking frauds, including those in the jewellery and aviation sectors, and shared its findings with the RBI, the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI) among others.

The analysis focussed on the modus operandi, the amount involved, type of lending (viz. Consortium or individual), anomalies observed, loopholes that facilitated the perpetration of the fraud concerned and the systemic improvements required to plug the gaps in the system and procedures.

The frauds were classified and analysed for 13 sectors — gems and jewellery, manufacturing and industry, agro, media, aviation, service and project, discounting of cheques, trading, information technology, export business, fixed deposits, demand loan and letter of comfort.

The modus operandi of these top 100 loans has been thoroughly analysed and various loopholes or lapses have been identified, Bhasin had said after releasing a report on the matter.

Based on the findings, various industry-specific suggestions for systemic improvement have been given in the final report. The suggestions have also been sent to the Department of Financial Services and the RBI in order to plug the loopholes observed by the Commission, he said.

Demanding special status for his state, Andhra Pradesh Chief Minister N Chandrababu Naidu held "Dharma Porata Deeksha" (struggle for justice) protest against the BJP-led NDA government at the Centre, at Srikakulam town on Saturday.

While addressing a public meeting; the Chief Minister asserted that he will not stop until justice is done to the state of Andhra Pradesh. Furious with the BJP, Naidu accused it of betraying Andhra Pradesh.

"Modi had sworn at the abode of Lord Balaji to build a capital for Andhra Pradesh, which would be greater than Delhi, to fulfil the promises of reorganization act, to give special package in the lines of Bundelkhand package. But he did not fulfil not even a single promise."He cheated by not giving special status to Andhra Pradesh, whereas the status is extended for 11 states`` he added.

He further cornered the Centre for ignoring his relentless endeavours to attain a special status for Andhra Pradesh.

"Prime Minister Modi did not respond even after reminding a number of times to stand on his word. The centre continued threatening attitude, compelling TDP to quit NDA. On the very same day, we decided that there is no way other than fighting against the centre."Our party MPs` fight against the centre has been remarkable; all parties across the country supported us. The centre gave only Rs 1500 crores for construction of capital, in fact, those funds are enough only for underground cable works. The youth of Andhra should be ready to fight against the betrayal of BJP. Special category status is the right of Andhra people and we all have to fight united for that," he added.

He also accused the BJP of meddling in the affairs of Central agencies like the CBI and the RBI among other constitutional institutions.

"BJP led NDA government has weakened CBI, RBI and all other constitutional institutions. The NDA is taking away the freedom of all the people of the country. Industrialists and business class are afraid of the Central Government."

He also touched upon the issue of EVM tampering and batted for using ballot paper to cast vote in the 2019 general elections.

"The public should be alert in the forthcoming elections. EVMs are not tampered proof, there are suspicions on the misuse of EVMs in the country. Paper ballot alone can be good. No developed country is using EVMs," he said.

Continuing his tirade, he alleged that the opposition party in the state, YS Jaganmohan Reddy-led YSRCP has colluded with the BJP to conspire against the TDP.

A special CBI court in Mumbai is likely to pronounce today the verdict in the sensational Sohrabuddin Shaikh-Tulsiram Prajapati alleged fake encounter case of 2005 in which 22 persons, most of them policemen, are on trial.

The case has attracted much attention as BJP chief Amit Shah, who was Minister of State for Home in Gujarat at the time of the incidents, was one of the accused before being discharged in 2014. During the trial, as many as 92 prosecution witnesses turned hostile.

After the final arguments were wrapped up earlier this month, Special Judge for CBI cases S J Sharma had said he will pronounce the verdict on December 21.

Most of the accused are junior-level police officials from Gujarat and Rajasthan.

The court earlier discharged, for want of evidence, 16 of the 38 persons charge-sheeted by the CBI. These included Amit Shah, the then Rajasthan home minister Gulabchand Kataria, former Gujarat police chief P C Pande and former senior Gujarat police officer D G Vanzara.

According to the CBI, Shaikh, an alleged gangster with terror links, his wife Kausar Bi and his aide Prajapati were abducted by Gujarat police from a bus when they were on their way to Sangli in Maharashtra from Hyderabad on the night of November 22 and 23, 2005.

Shaikh was killed in an alleged fake encounter on November 26, 2005 near Ahmedabad. His wife was killed three days later and her body was disposed off, the CBI said.

A year later, on December 27, 2006, Prajapati was also shot dead by Gujarat and Rajasthan police in an alleged fake encounter near Chapri on Gujarat-Rajasthan border.

The case was initially probed by the Gujarat CID before the CBI took over in 2010. The Supreme Court in 2013 directed that the trial to be shifted to Mumbai from Gujarat on the central agency's request to ensure a fair trial.

The prosecution examined 210 witnesses, of which 92 turned hostile.

Even as the trial has wound down to a close, two prosecution witnesses applied to the court Wednesday that they be re-examined.

One of them, Azam Khan, an aide of Shaikh, claimed in his plea that accused Abdul Rehman, a former police inspector who had allegedly fired on Shaikh, threatened Khan that if he did not depose as told, he would be framed up in false cases.

His wife was also threatened, Khan claimed.

Another witness, Mahendra Zala, a petrol pump owner, has alleged that the prosecution did not furnish to the court his statement recorded before a magistrate.

The court will decide both pleas Friday.

On December 11, Prasad while speaking to media refuted all claims made by complainant Satish Sana.

Vehemently denying all allegations, Prasad asserted that he had "never-ever" met Asthana.

Replying to questions from the media, Prasad while appearing in Delhi's Patiala house court, had said: "It is all a lie. Everything is fabricated. Whatever they have claimed, nothing such happened. I have never taken the money and have never-ever met Asthana. I don't know who Asthana is."

Earlier, Satish Sana, a Hyderabad based businessman who is facing a CBI probe in a corruption case involving meat exporter Moin Qureshi, had alleged to have met Prasad in Dubai. He had claimed that Prasad had allegedly informed him about having "very good connection" in CBI and assured him of helping in the case through his brother Somesh Prasad.

CBI bribery case: Alleged middleman Manoj Prasad gets bail

In a stunning development in the mid-night of October 23-24, CBI’s top two officials, Director and Special Director, were unprecedentedly divested of all their duties and sent on leave.

Before that, the prestigious headquarters of the agency, under express orders, was put under siege.

A Joint Director, given charge as “Interim Director”, reached the agency’s office in the middle night and soon after taking charge, either passed or implemented transfers orders of a number of officers handling sensitive cases.

When the matter reached the Supreme Court the next day, through the petition of CBI Director Alok Verma challenging the order, the apex court was constrained to restrain the ‘Interim Director”, from taking any major policy decisions, till further orders.

The Supreme Court has reserved its verdict on the legality of the order concerning Alok Verma and therefore, we shall refrain from saying anything till then on this subject.

But that is not the main concern. The concern is of the state in which CBI finds itself, as well as its future. This crisis is perhaps the worst of its kind since April 1, 1963, when the agency was founded by then Home Minister Lal Bahadur Shastri.

It was under Shastri’s stewardship that the investigative agency’s solid foundations were laid to make CBI a trustworthy and efficient agency to probe cases of corruption.

Soon enough, the CBI acquired a high degree of professional reputation and won the confidence of the people for integrity and impartiality. Even more than judicial enquiry, there were frequent demands for a CBI investigation to bring out the truth. Sadly, that image of the agency lies in tatters today.

The CBI, no doubt, faced the severest challenge in the years preceding and during the Emergency when Sanjay Gandhi, a law unto himself, started calling the shots.

Emergency was a period of fear, intimidation raids and arrests, often illegally and in a high-handed manner.

In such an atmosphere, the agency’s problems were compounded. Things reached such a pass that even other government agencies started to conduct searches and raids in its name.

The Rajiv era started well with his ‘Mr Clean’ image, but soon got embroiled in the Bofors controversy with its fall out evident on the CBI. The agency breathed a sigh of relief in the VP Singh era. But Singh’s tenure came to end in a short time. The CBI faced, to put it bluntly, a horrible time under the Chandrasekhar and Narsimha Rao governments, with the likes of Chandraswami calling the shots.

This writer, on a second term to the CBI, was thrown out of the agency unceremoniously for a second time for standing up to corrupt and brazen political interference in investigation work. At this point of time, even the apex court failed to provide relief for saving the honour of an individual and the organisation.

But never before has the CBI faced problems such as today. The genesis of the troubles could be traced back to September, 2016 when the then Director, CBI was scheduled to retire.

RK Datta, the senior-most Special Director, a tried and tested hand with long experience, was on the cusp of succeeding him. But the powers that be, suddenly transferred him out as Special Secretary, Ministry of Home Affairs, against a non-existent post, only a few days before the Director superannuated. Luckily, his Karnataka cadre came to his rescue and took him back as Director General of the state police.

This set off quite an avoidable controversy regarding matters of further placement as Number 1 and Number 2 in the organisation.

On October 15, the CBI registered a regular case against its own Special Director allegedly for accepting a huge bribe from someone under investigation.

The Special Director had, in turn, earlier on August 24 lodged a complaint with the Union Cabinet Secretary, making allegations of similar nature against the Director, Alok Verma. But the situation had not yet spun out of control, had the government of the day intervened and taken matters in its hand.

But it was hamstrung for two reasons. First, what was happening was largely of the government’s own making. Some provisions in the Central Vigilance Commission (CVC) Act of 2003, giving it jurisdiction over the CBI in matters of governance, has led to more problems than the government had bargained for. Neither was this overlapping envisaged by the agency’s founder Lal Bahadur Shastri.

The CVC Act, no doubt, provides some valuable safeguards for the agency, but it has also created some impediments in its work. It has vested in the Central Vigilance Commission the ‘superintendence’ of the Delhi Police Establishment, (and thus the CBI) in relation to investigating cases under the Prevention of Corruption Act, 1988.

For the remaining areas, the Act leaves ‘superintendence’ to the government. So the ‘superintendence’ over the CBI is today shared between the CVC and the government. An absurd proposition, if any existed.

Thus while the answerability ‘for CBI’s functioning’, is with the government, the power of ‘superintendence’ lies with the CVC. The present crisis owes a lot to this diarchic arrangement in the CVC Act of 2003. A lot of effort is now needed to redeem the honour and prestige of this premier investigating agency.

How to revive a dismembered CBI

CBI welcomes Vijay Mallya's extradition orders from UK court

Embattled liquor tycoon Vijay Mallya is expected to appear in a London court today to find out whether he will be extradited to his homeland, where he is accused of fraud.

Mallya, chairman of the UB Group drinks conglomerate and chief executive of the Force India Formula One team, will discover his fate at Westminster Magistrates' Court.

Mallya faces a case of loan default to the tune of Rs 9,000 crore besides allegations of money laundering and diversion of loan funds for purposes other than they were meant for. He is in self-imposed exile in London.

He left for the United Kingdom in March 2016 taking advantage of the dilution in the CBI lookout notice against him.

Indian agencies are seeking to extradite him. The case will be heard by Westminster Magistrates' Court in London on Monday.

Mallya has contested his extradition on the grounds that the case against him is "politically motivated" and the loans he has been accused of defrauding on were sought to keep his now-defunct airline afloat.

"I did not borrow a single rupee. The borrower was Kingfisher Airlines. Money was lost due to a genuine and sad business failure. Being held as guarantor is not fraud," he said in his recent Twitter post on the issue.

"I have offered to repay 100 per cent of the principal amount to them. Please take it," he had tweeted earlier.

CBI, ED teams in UK as London court to pronounce verdict on Vijay Mallya’s extradition

Britain will struggle to achieve even modest economic growth next year unless the government secures an orderly Brexit in March, the Confederation of British Industry said on Thursday.

The CBI said the world's fifth-largest economy would grow by 1.3 per cent in 2018, 1.4 per cent in 2019 and 1.6 per cent in 2020, little changed from its previous projections in June.

The forecasts were slightly weaker than those of the Bank of England.

The CBI said it was assuming that Prime Minister Theresa May wins backing in parliament for her preferred plan for leaving the European Union, something which looks unlikely at a vote due on Dec. 11.

"A no-deal scenario would blow these figures out of the water," the CBI's director-general, Carolyn Fairbairn, said, reiterating her organisation's support for May's plan.

Last week, the BoE warned that a worst-case Brexit could deal a bigger blow to Britain than the 2008 financial crisis, shrinking the economy by as much as 8 per cent in a year.

Economists at US bank JP Morgan said on Wednesday the odds of Britain staying in the EU had risen to 40 per cent from 20 per cent, following parliamentary setbacks for May and the likelihood that the European Court of Justice will rule that Britain could unilaterally revoke its EU departure notice.

Before the 2016 referendum, the CBI argued that staying in the EU would be best for Britain's economy.

Whilst the CBI expects real wage growth to recover partially, it predicts living standards will not rise much, due to Britain's failure to tackle persistently weak productivity.

"Brexit has sucked the oxygen from the domestic agenda," Fairbairn said.

UK economy risks severe damage without orderly Brexit: British industry

The Centre on Wednesday told the Supreme Court that the fight between two top officers of the CBI - Director Alok Verma and Special Director Rakesh Asthana - in public exposed the premier probe agency to ridicule.

The observation was made by Attorney General KK Venugopal during a hearing on CBI chief Alok Verma's plea challenging the government's decision which had divested him of all duties and sent him on leave.

"Dispute between CBI Director and Special Director was pulling down integrity and respect of premier institution," he told the bench.

"Two top officers, Alok Kumar Verma and Rakesh Asthana, were fighting against each other and went public which exposed CBI to ridicule," Venugopal told the bench.

The Centre's main aim was to see that confidence of the public in this premier institution is restored, he said.

While the Attorney General did acknowledge media had a field day because of the CBI debacle, he submitted in the top court that both top CBI officers did not keep their fight under wraps, hence the central government acted with caution.

At the end of his submission, Attorney General Venugopal gave an interesting analogy and called the CBI spat a "Kilkenny cat" fight.

The use of this term "Kilkenny cat" refers to an old story about two cats who fought to the death and ate each after which only their tails were left, drew a lot of attention in the top court.

In the previous hearing, senior advocate Fali S Nariman had told the top court that Verma was appointed on February 1, 2017, and "the position of law is that there will be a fixed tenure of two years and this gentleman cannot be even transferred".

The advocate said there was no basis for the Central Vigilance Commission (CVC) to pass such an order recommending to send him on leave.

In response to Verma's lawyer, the Attorney General submitted that "after carefully examining the material made available and after careful consideration of the issue, Centre was satisfied that a situation had arisen wherein Centre had to take action to divest him."

While the court is yet to hear Asthana's plea, the hearing of Verma's plea seems to have expedited the case and ASG Tushar Mehta will continue arguing for the CVC on Thursday morning.

The apex court had on November 29 said that it would first consider whether the government has the power to divest the CBI director of his duties under whatever circumstances or whether the selection committee headed by the Prime Minister should have been approached before moving against Verma on corruption allegations against him.

The court had taken this stand after making it clear that for now it was not going into the allegations and counter-allegations involving Verma and CBI's No 2 officer Asthana, both of whom have been stripped of their powers and sent on leave following their bitter feud.

Verma's two-year tenure ends on January 31. He has challenged the Centre's decision.

A court Monday extended the CBI remand of two close aides of Brajesh Thakur, the prime accused in the Muzaffarpur shelter home sex scandal, by three days.

Special judge R P Tiwari, hearing cases filed under the Protection of Children from Sexual Offences (POCSO) Act, extended the CBI remand of Madhu Kumari, who managed many of Thakur's NGOs, newspapers and other businesses, and Ashwini -- a quack attached to the shelter home as a "doctor".

The two were arrested two weeks ago and have been in the custody of the central probe agency since November 21.

Media reports have alleged that Ashwini used to administer injections
laced with sedatives to the inmates of the home with the help of Madhu, after which the girls would be subjected to sexual abuse.

The Central Bureau of Investigation (CBI), which is probing the case, produced both Madhu and Ashwini in the POCSO court after the period of their remand expired Monday.

On the probe agency's request, the court extended their remand by three days.

The alleged sexual abuse of the inmates at the Balika Grih in the Sahu Road locality came to light following a social audit of Bihar's shelter homes by the Mumbai-based Tata Institute of Social Sciences (TISS).

An FIR was lodged on May 31 against 11 persons, including Thakur, who was running the shelter home.

As the issue rocked the state legislature and Parliament, a CBI inquiry was recommended by the Nitish Kumar-led Bihar government in July.

A fortnight later, state Social Welfare Minister Manju Verma stepped down following reports of close links between her husband Chandrashekhar Verma and Thakur.

Thakur, who was initially shifted to Bhagalpur in view of the fact that he was a "renowned citizen" and his presence in Muzaffarpur could come in the way of a fair probe, is currently lodged in a jail in Punjab's Patiala following a Supreme Court order.

Accusing the NDA government of harassing political rivals through agencies like the CBI and the Income Tax department, TDP Chief N Chandrababu Naidu on Saturday said he joined hands with Congress president Rahul Gandhi and other opposition leaders to work in national interest.

Speaking during a roadshow in the city, Naidu criticised the NDA government for demonetisation, "faulty implementation" of GST and price rise and alleged that there was a feeling of insecurity.

"Today, the government led by Narendra Modiji in the country is indulging in attacking political rivals. They are harassing rivals as per will.

"If anyone questions, (they) send Enforcement Directorate, CBI, Income Tax. Attacks on media. Attacks on political leaders. By carrying out attacks on business organisations, creating fear, (they) wish to see that nobody speaks," the Andhra Pradesh Chief Minister said.

Therefore, he said, he spoke to all political parties in the country, including Congress president Rahul Gandhi, in spite of differences between the TDP and the Congress for over 30 years, to work together in national interest.

"The country should be protected. Democracy should be safeguarded. Then only we will have future. If you don't have the freedom to speak, I am asking, what is the value of democracy," he said.

Naidu, who was speaking in Rajendranagar assembly segment here as part of his roadshow in the city in support of TDP candidates, accused the NDA government at the Centre and the TRS government in Telangana of letting down people.

"One thing is common between big Modi and small Modi. That is magic trick with words. He (Modi) speaks well. Our KCR also speaks very well," he said.

Rao kept mum on NDA government over "attacks" on minorities, SCs and STs in the country, Naidu alleged.

He said that the international airport, Cyberabad (the IT hub in Hyderabad), Outer Ring Road, Krishna river water and other major development projects in Hyderabad became a reality at his initiative.

The Andhra Pradesh Chief Minister claimed that the TRS government did not implement its election promises, including double bedroom houses for poor.

Naidu's Telugu Desam Party is part of the 'People's Front' also comprising Congress, CPI and Telangana Jana Samiti (TJS).

Asserting that a Congress nominee would be the chief minister if the Front wins the December seven elections, he said the TDP would fully cooperate in the endeavour.

Telangana Assembly elections are scheduled to be held on December 7 and the results would be declared on December 11.

CBI Director Alok Verma, who has been divested of all duties by the Centre and sent on leave, told the Supreme Court on Thursday that he was appointed for a fixed tenure of two years and cannot even be transferred.

Challenging the government's decision, his counsel and senior advocate Fali S Nariman said Verma was appointed on February 1, 2017 and "the position of law is that there will be a fixed tenure of two years and this gentleman cannot be even transferred".

Making his submission before a bench comprising Chief Justice Ranjan Gogoi, Justices SK Kaul and KM Joseph, the advocate said there was no basis for the Central Vigilance Commission to pass such an order recommending to send him on leave.

"There has to be strict interpretation of the Vineet Narain judgment. This is not the transfer and Verma has been denuded of his power and duties...Otherwise there was no use of the Narain judgement and the law...," Nariman said.

The Vineet Narain decision, delivered by the apex court in 1997, relates to the investigation of allegations of corruption against high-ranking public officials in India.

Before 1997, the tenure of the CBI director was not fixed and they could be removed by the government in any manner. But the apex court in the Vineet Narain judgment fixed a tenure of a minimum of two years for the CBI director to allow the officer to work with independence.

Nariman referred to the terms and conditions of appointment and removal of the CBI director and concerned provisions of the Delhi Special Police Establishment (DSPE) Act, 1946.

At the outset, Nariman told the bench, which on November 20 had expressed deep anguish over the purported leak of CBI Director's response to the CVC's findings against him, that the court cannot prohibit the publication of the content of the petition as
Article 19 of the Constitution is paramount. He also referred to the apex court 2012 judgement in a case on the issue.

The bench was irked over the publication of allegations levelled by agency's DIG Manoj Kumar Sinha in a separate plea.

CBI Director Alok Verma, who has been divested of all duties by the Centre and sent on leave, told the Supreme Court on Thursday that he was appointed for a fixed tenure of two years and cannot even be transferred.

At the outset, Nariman told the bench, which on November 20 had expressed deep anguish over the purported leak of CBI Director's response to the CVC's findings against him, that the court cannot prohibit the publication of the content of the petition as Article 19 of the Constitution is paramount. He also referred to the apex court 2012 judgement in a case on the issue. The bench was irked over the publication of allegations levelled by agency's DIG Manoj Kumar Sinha in a separate plea. Have fixed tenure of 2 years, that cannot be changed: CBI chief Alok Verma to SC

The Delhi High Court on Wednesday allowed CBI Director Alok Verma and Joint Director A K Sharma to inspect in the CVC's office the case file relating to FIR against the agency's Special Director Rakesh Asthana.

Justice Najmi Waziri asked Verma to go to Central Vigilance Commission's office on Thursday after his counsel said that there are allegations of malafide against him in Asthana's petition.

He also allowed Sharma to go to the CVC's office on Friday for inspecting the files.

The court extended till December 7 its order directing the CBI to maintain status quo regarding proceedings against Asthana, who has sought quashing of an FIR against him in a bribery case.

The court was hearing separate pleas of Asthana, Kumar and middleman Manoj Prasad seeking quashing of the FIR against them.

In the previous hearing, the counsel for Sharma said he had incriminating evidence against Asthana and would place it before the court in a sealed cover, to which the court had asked him to file it before the CBI. The probe agency will then place the documents before it.

The high court on October 23 ordered the CBI to maintain status quo on proceedings against Asthana. That was further extended on October 29 till November 1.

On November 1, the interim order was extended till November 14 and then to November 28. The October 23 order had made it clear that the agency would not take any coercive step against Asthana.

On November 1, both CBI and Asthana had opposed the plea of Additional Superintendent of Police S S Gurm, who has been transferred from Delhi to Jabalpur in the wake of a feud between Verma and Asthana, to be heard in the matter.

The CBI in its reply to the pleas of Asthana and DSP Devender Kumar had said allegations against them and others show cognisable offences.Kumar is out on bail at present.

The CBI had filed the replies in response to the notice issued to it on the petitions filed by Asthana and Kumar, who was granted bail by the trial court, against the filing of the case.

The agency had said it was "handicapped" in its probe against them as the case files and documents have been sent to the CVC for scrutiny following the Supreme Court's order directing the vigilance body to inquire against Verma.

Kumar, earlier the investigating officer in a case involving meat exporter Moin Qureshi, was arrested on the allegations of forgery in recording the statement of businessman Sathish Babu Sana who had alleged to have paid bribe to get relief in the case.
