Vacation judge Niyay Bindu of the court while granting the bail observed that ED believed the evidence on record was not sufficient to proceed against the Delhi CM, it was taking time to procure the same in any manner, LiveLaw reported. “The court has to take a pause to consider this argument which is not a potable submission that investigation is an art because if it is so, then, any person can be implicated and kept behind bars by artistically procuring the material against him after artistically avoiding/withdrawing exculpatory material from the record," the court said. "This very scenario constrains the court to draw an inference against the investigating agency that it is not acting without bias,” it added and urged the ED to be prompt and fair. After the announcement, the Enforcement Directorate (ED) requested that the signing of the bail bond be deferred by 48 hours so that the order may be challenged before the appellate court. But the judge refused to stay the order and the trial court added that the bail bond is to be produced before the duty judge on Friday.&nbsp;

The decision comes a day after Kejriwal's judicial custody was extended till July 3 by the Rouse Avenue Court.

"Kejriwal says my phone is sacrosanct. Mai password nahi dunga. (I will not give my password). We had to resort to the phone of Vinod Chauhan. He is sitting quiet. Many times it has happened that accused says I will not... An adverse inference has to be drawn from the fact that Kejriwal has refused to give his password. This is a ground for refusing bail under ordinary bail law, forget section 45 PMLA for the time being," ASG said.&nbsp;

Meanwhile, senior advocate Vikram Chaudhari appearing for Kejriwal, dismissed all the claims and again highlighted lack of evidence in the case. Chaudhari again asked why Kejriwal was arrested on March 21 and questioned&nbsp;whether or not ED was playing in the hands of some "political masters".&nbsp;

Aam Admi Party's Rajya Sabha MP Swati Maliwal on Tuesday wrote an open letter to the leaders of the INDIA bloc, seeking time for a meeting to discuss the alleged assault against her by Delhi Chief Minister Arvind Kejriwal's aide Bibhav Kumar.&nbsp;

Maliwal accused Kejriwal's personal aide of assaulting her when she visited the chief minister's residence. She had even filed a first information report (FIR) and Kumar was taken into custody by Delhi Police.

Delhi's Tis Hazari court last week extended Bibhav Kumar's judicial custody till June 22.&nbsp;

The alleged assault occurred on May 13 at AAP supremo&nbsp;Arvind Kejriwal's residence.&nbsp;

"Instead of finding support, I was confronted with incessant attacks on my character and victim shaming orchestrated by the leaders and volunteers of my own party," she wrote.&nbsp;

"Over the past one month, I have encountered first-hand pain and isolation a survivor faces when she fights for justice. I would like to seek your time to discuss this pertinent issue," she added.&nbsp;

The Delhi chief minister was produced before the court through video conference from Tihar Jail on the expiry of his judicial custody. The court also extended the judicial custody of Vinod Chauhan till July 3.&nbsp;

Representing the Enforcement Directorate, Additional Solicitor General (ASG) SV Raju argued that Kejriwal had not been summoned as an accused in the case. He added that now a prosecution complaint has been filed and cognisance of the money laundering offence has been taken by the Special Court.

The probing agency told the court that it had evidence of Kejriwal demanding ₹100 crore (approx $12 million) as kickbacks in the now-withdrawn liquor policy. ASG Raju weighed in on Kejriwal's alleged role in the case, saying that he was liable in a personal capacity and also as the chief of AAP.&nbsp;

"He demanded a bribe of ₹100 crore, how can you say he is not prima facie guilty of the offence?," the ED asked.

The counsel appearing for Kejriwal opposed the ED's application seeking an extension of his judicial custody, saying there were no grounds justifying an extension of his custody.&nbsp;

Lok Sabha Elections 2024: Modi to take oath as prime minister of India on June 9

Aam Aadmi Party (AAP)'s Delhi state convener Gopal Rai on Thursday (Jun 6) clarified that his party's alliance with Congress was only for the Lok Sabha elections 2024 and that it will contest the Delhi assembly polls alone.

"This is clear from the very first day that the INDIA alliance was formed for Lok Sabha elections. As far as Vidhan Sabha is concerned, no alliance has been formed. AAP will fight elections with its full strength," Rai said.

He further said that the opposition parties had come together as the Indian National Developmental Inclusive Alliance (INDIA) to take on the Bharatiya Janata Party (BJP) in the general elections and that there was no alliance for assembly polls that are scheduled to take place early next year.

“It is clear from the beginning that the INDIA alliance was formed for the Lok Sabha elections. We fought Lok Sabha elections together but in the Delhi Vidhan Sabha elections, there is no alliance. We will fight the Vidhan Sabha elections together with the people of Delhi,” he said.&nbsp;

A Delhi court on Wednesday (June 5) rejected Aam Aadmi Party (AAP) supremo Arvind Kejriwal's interim bail plea in the excise policy scam case.

The Delhi chief minister had moved an application for interim bail citing medical concerns.

While dismissing the bail plea, the Rouse Avenue Court directed the Tihar Jail Authorities to take care of Kejriwal's medical requirements.&nbsp;

The court extended his judicial custody until June 19. He was produced before the court via virtual mode.

During arguments, Senior Advocate N Hariharan, who appeared for Kejriwal, submitted that "the interim bail was for the purpose of campaigning for my party, which is a national party...I am out for 20 days and had I not done it, you would've said he didn't campaign and fell ill. It was a lot of stress due to the campaigning, and you know that stress is an aggravator of diabetes. What was alarming was that KETO levels rose in the urine. The aspect of concern is high level of sugar and the keto numbers."

The Rouse Avenue Court had reserved its ruling on Kejriwal's bail extension plea on Jun 1.

The AAP chief had surrendered on June 2 after the interim bail granted by the Supreme Court ended.

The Delhi court had earlier rejected Kejriwal’s request for a seven-day extension of bail in the excise policy scam case. He was initially released from jail on May 10 on interim bail granted by the Supreme Court which allowed him to campaign for the Lok Sabha Elections 2024, voting for which concluded on June 1.

He was arrested in connection with a money laundering case linked to the alleged Delhi liquor policy scam in March.

<h2>'Going back to jail for saving country from dictatorship'</h2>

Before surrendering to the police, Kejriwal said that he was "proud" of going back to jail as he was doing it "to save the country from dictatorship."

“I have to surrender on June 2 and I do not know how long I will stay in jail this time. I am going to jail for saving this country from dictatorship and I am proud of it,” the chief minister told a virtual press conference.

“They tried to break me. They stopped my medicines while I was in jail. My weight reduced by six kg after being arrested. My weight was 70 kg when I was arrested. I have not gained weight after coming out of jail,” Kejriwal further said.

Doctors have advised several tests and “they feel this could be a sign of some underlying medical condition”, he added.&nbsp;

Upon his release, Kejriwal launched Opposition's strongest-ever election-time assault on Prime Minister Modi. The Delhi chief minister claimed that if re-elected, Modi will remain prime minister just for a year &nbsp;— as he will turn 75 in September 2026 and Modi in past is credited to have ensured that leaders beyond 75 years of age no longer get elected designations of power. Kejriwal added that after Modi turns 75, Union Home Minister Amit Shah will be allowed to remain&nbsp;PM for the rest of the tenure of the 18th Lok Sabha.&nbsp;

Kejriwal's claim immediately put the BJP on defensive as it ended up showing off PM Modi as BJP's leader in control even "after 2029".&nbsp;

Arvind Kejriwal's Aam Aadmi Party lost all seven Lok Sabha seats of Delhi, where his party is in power for over a decade. In Punjab, the AAP won just two seats with Chief Minister Bhagwant Mann conceding&nbsp;defeat of the party, stating that the AAP accepts people's verdict with grace.

But in Punjab, the contradictions within the Opposition's 'INDIA' bloc hurt the AAP. Of the seven seats won by the Congress party, it defeated&nbsp;AAP candidates across four constituencies in one-on-one contests; in Fatehgarh Sahib, Firozpur, Patiala and Amritsar.&nbsp;

In terms of seats in Lok Sabha, India's lower house of parliament directly elected by people, the AAP has done better in the past. In their first Lok Sabha election in 2014, they won four seats, all in Punjab. In 2019, the tally came down to one. Despite sweeping Delhi assembly with 67 and 62 of 70 seats in last two elections, the party has failed to open its account in Lok Sabha constituencies of&nbsp;the national capital so far.&nbsp;

But the silver-lining for India's latest national political party came&nbsp;in terms of the vote share.&nbsp;

"In this great festival of democracy, the country will vote in the last phase today. All of you are requested to exercise your right to vote in large numbers to protect democracy and the Constitution," Kejriwal posted on X.

"Go to vote yourself and take your neighbours along with you. Dictatorship will lose, and democracy will win," he added.

The AAP supremo's remarks came as the voting in the seventh and final phase of the 2024 Lok Sabha election&nbsp;on Saturday (June 1) was underway.

I will soon start providing Rs 1,000 to my mothers and sisters,” he said, referring to a scheme to give Rs 1,000 monthly honorarium.&nbsp;

Kejriwal, accompanied by his family members and party leaders, visited Rajghat in New Delhi on Sunday (June 2) to pay tributes to Mahatma Gandhi.

However, Kejriwal's visit to Rajghat was not without controversy. BJP leaders, including Delhi BJP chief Virendraa Sachdeva staged a protest there and&nbsp;were detained by police.

Virendraa Sachdeva criticised Kejriwal, saying, "He removed Mahatma Gandhi's portrait from his office and is now visiting Rajghat. The people of Delhi are suffering because of water shortage and he is doing drama here."

Ahead of surrendering himself at Tihar jail, Kejriwal also held a meeting with the members of the Aam Aadmi Party's Political Affairs Committee.

The chief minister also offered prayers at Hanuman temple in Connaught Place in the Indian capital.&nbsp;

After his visit to the temple, AAP national convenor Kejriwal arrived at his Delhi party office.&nbsp;Before surrendering in jail, he addressed all the public representatives, workers and all the people of Delhi at the party office.

Kejriwal said, "Supreme Court granted me bail for 21 days to campaign for elections. I want to thank SC for that. Today, I am going to Tihar Jail again. I did not waste even a minute of these 21 days. I did not campaign only for AAP but for various parties. I went to Mumbai, Haryana, UP, Jharkhand...AAP is not important, for us the country is important."

He said that he is going back to jail not because he has "done a scam but because I have raised my voice against dictatorship...PM Modi accepted this in front of the country that he does not have any evidence against me..."

"Bhagat Singh said that when the power becomes a dictatorship, then jail becomes a responsibility...Bhagat Singh was hanged to free the country. This time when I am going to jail, I don't know when I will come back...If Bhagat Singh was hanged, I am also ready to be hanged," he added.&nbsp;

Delhi court sends CM Arvind Kejriwal to judicial custody till June 5

Delhi Chief Minister Arvind Kejriwal will go back to Tihar jail on Sunday (June 2) after his interim bail ended on Saturday (June 1).

The AAP supremo was arrested in connection with a money laundering case linked to the alleged Delhi liquor policy scam in March.

He was released from the jail on May 10 on interim bail granted by the Supreme Court for campaigning in the Lok Sabha polls.

Kejriwal took to his official X handle and said that he will surrender to the police and leave his house at 3 pm today.

"Today I will surrender by going to Tihar. I will leave home at 3 pm. First I will go to Rajghat and pay tribute to Mahatma Gandhi. From there I will go to Hanuman temple in Connaught Place to seek blessings of Hanuman ji. And from there I will go to the party office and meet all the workers and party leaders. From there I will again leave for Tihar," wrote Kejriwal.

Metropolitan Magistrate Gaurav Goyal allowed the Delhi Police’s plea seeking judicial custody for Kumar, who was produced before him on expiry of his three- day police custody.

Delhi Chief Minister Arvind Kejriwal on Thursday (May 30)&nbsp;&nbsp;moved a court in the national capital seeking regular bail in the money laundering case related to the excise scam. A report by Bar and Bench said that Chief Minister Kejriwal also filed a plea seeking interim bail&nbsp;for seven days on medical grounds.

The report said that both these pleas would be taken up for hearing by the Rouse Avenue court later on Thursday.&nbsp;

Kejriwal&nbsp;was arrested&nbsp;in the Delhi excise policy case on March 21. On May 10, the Supreme Court granted Kejriwal interim bail till June 1. The Supreme Court asked Kejriwal to surrender on June 2.

The apex court had imposed certain conditions while granting interim bail to Kejriwal on May 10.&nbsp;The court said&nbsp;he would not interact with any&nbsp;of the&nbsp;witnesses or have access to&nbsp;any&nbsp;official files connected to the excise policy case.

Kejriwal would not make any comment concerning his role in the case.

The Supreme Court also said that the CM "shall be bound by the statement made on his behalf that he shall not sign official files unless it is required and necessary for obtaining clearance/ approval of the Lieutenant Governor of Delhi."

A Delhi court noted its "bonafide requirements" and sentenced Kumar to three days of police imprisonment the next day.

The police "cannot be deprived of its right," the court said, to retrieve the cell phone he was holding at the time of Maliwal's alleged attack.

"The presence of the accused in a room where NVRs (network video recorders) are installed is not denied by him or his lawyer. To the mind of this court, the reason for remaining there for a sufficient time is obviously a question which needs to be investigated for which custodial interrogation is necessary," Metropolitan Magistrate Gaurav Goyal said, as quoted by PTI.

Kumar's requests for medication and for regular visits with his advocates, his wife and daughter were approved by the court in the interim.

After Maliwal accused Kumar in a formal complaint of assaulting her on May 13 at Kejriwal's house, Kumar was taken into custody on May 18. The FIR said that Kumar repeatedly kicked her in the stomach and pelvic area after slapping her multiple times.

Sections 354, 506, 509, and 323 of the IPC, which address offences like assault or criminal force on a lady with intent to insult her modesty and criminal intimidation, are where the police filed a FIR against Kumar after receiving the complaint.

"In view of health complications, a medical examination is necessary to protect the Delhi CM from possible long-term harm during his prison term," advocate Abhishek Manu Singhvi, who is representing Arvind Kejriwal, said.

In fresh trouble for Aam Aadmi Party, the party's Punjab Minister Balkar Singh found himself in hot waters after a purported video of him coercing a woman to perform sexual favours on the pretext of a job has surfaced on the internet.

The alleged video showed the AAP minister forcing a 21-year-old woman to strip on a video call where he flashed his private parts.&nbsp;

Bharatiya Janata Party (BJP) leader Tajinder Bagga, who first shared the video, called for AAP and its supremo Arvind Kejriwal to sack Singh immediately.

"Prime Minister Modi is giving a signal of national unity by going to Kanyakumari," added another leader, remarking that the visit also shows the PM's deep commitment and affection for Tamil Nadu.

The Supreme Court vacation bench on Tuesday (May 28) rejected an urgent hearing of Delhi Chief Minister Arvind Kejriwal's plea for the extension of his interim bail by seven days on medical grounds.

A vacation bench, comprising Justices JK Maheshwari and KV Viswanathan, acknowledged the arguments presented by senior advocate Abhishek Singhvi, who was representing the Delhi chief minister, and stated that the decision regarding the interim plea's listing could be made by the "Honourable CJI" since the judgment in the main matter has been reserved.

The bench questioned Abhishek Singhvi why the plea of Delhi CM was not mentioned for urgent listing last week when Justice Dipankar Datta, one of the judges of the main bench headed by Justice Sanjiv Khanna which had granted the interim bail to the chief minister, was sitting on the vacation bench.

The Supreme Court granted Arvind Kejriwal interim bail for 21 days on May 10, allowing him to campaign for the Lok Sabha elections.

However, it banned him from accessing his office or the Delhi secretariat and signing official documents unless absolutely necessary and approved by the lieutenant governor.
