The court said that the "child was still very young - just 13 to 14 years in age". The court took note that even though the reports and records indicated that the girl was not forced, what&nbsp;happened to her was "certainly statutory rape" considering her age.

The court observed that the girl's pregnancy was nearly in its ninth&nbsp;month and that the foetus was gaining weight and fat which was getting closer to its birth weight.

"Its vital organs, like the brain and lungs, are almost fully developed, preparing for life outside the womb. Obviously, therefore, this court cannot accede to the request of the petitioner; though I am in full empathy with the condition she and her family are going through, particularly because the victim child is so young," the judge said in his order, as reported by Press Trust of India.

A medical report about the pregnancy indicated that the status was "30 weeks of gestation with a good foetal heart". The court took the medical report into consideration during the proceedings.

"The foetus has, in fact, life with heart rate, and hence, termination of the pregnancy at this stage is impossible, as also untenable," the court said.

Nationwide, Russia's health ministry has reportedly drawn up talking points for doctors&nbsp;— which&nbsp;seek to discourage medical abortions. These, as per media reports, include phrases like pregnancy is "a beautiful and natural condition for every woman." On the other hand, abortion is propagated as "harmful to your health and a risk of developing complications."

Michele Rivkin-Fish, an anthropologist at the University of North Carolina at Chapel Hill, as quoted by AP said: "It's clear that there is a gradual erosion of abortion access and rights in Russia, and this is similar to what has taken place in the US."

<h2>Abortions and Russia</h2>

Currently, laws allow women to end a pregnancy at up to 12 weeks, and for special "social reasons," like divorce, unemployment, or because of income, this can be pushed back to 22 weeks. Only in instances of rape is an abortion legally allowed between 12 and 22 weeks.&nbsp;

Historically, Russian women had access to abortions. Even back in the Soviet Union times, when getting contraceptives was difficult, women would opt for multiple abortions in their lifetimes.

After the USSR collapsed, government and health experts promoted family planning and birth control, which contributed to a decrease in abortion rates. In 1991, Russians had 4.1 million abortions, in 2021 this number fell to 517,000.

Now, women have to wait for at least 48 hours, and up to a week for the abortion — the waiting period depends on the stage of their pregnancy. Furthermore, to discourage abortions, they are offered psychological consults, as per state-issued guidelines.

Besides, a recent Health Ministry decree that takes effect on September 1, 2024, has restricted the circulation of abortion pills that terminate pregnancies in the first trimester.

A New York resident has sued the largest hospital system in&nbsp;New York over charges of discrimination.&nbsp;She claims she was denied medicine for a serious medical condition because she was of&nbsp;"childbearing age", and that the drugs could harm the hypothetical foetus.&nbsp;

In September 2022, New York resident Tara Rule went to the neurologist at Glens Falls Hospital for treatment of a debilitating condition called cluster headaches — a type of very painful one-sided headache, that can occur every day for weeks or months at a time.

Her neurologist, however, denied her the medication, saying that she was of childbearing age and that the medicine could potentially harm her hypothetical foetus.

The woman had earlier shared audio recordings of the doctor's appointment on short video format app TikTok. Now, she has sued the hospital system.

On Tuesday, three judges reduced the 28-month sentence by half and suspended 14 months. As per Sky News, the woman will have to complete up to 50 days of activity.

"This is a very sad case... It is a case that calls for compassion, not punishment, and where no useful purpose is served by detaining Ms Foster in custody," said Dame Victoria Sharp who was sitting with Lord Justice Holroyde and Mrs Justice Lambert. She was quoted by Sky News.

Foster appeared at the hearing via a video link from Foston Hall Prison. She has spent 35 days there. She is a mother of three children and has previously admitted to illegally procuring abortion medication. She aborted her pregnancy when she was 32 to 34 weeks pregnant during the Covid pandemic.

According to the law in England, Scotland and Wales, pregnancies can be terminated only up to the 24th week.

At the time of her sentencing, the court heard that Foster was given abortion pills by the charity British Pregnancy Advisory Service (BPAS). However, it was revealed during the hearing that while obtaining abortion pills, Foster has lied how far along she was in her pregnancy.

"The relief that this woman can go home to be with her children is tempered by the knowledge there are more cases to come where women in England being prosecuted and investigated for having abortions under this archaic legislation," said Stella Creasy, Labour MP, after the Court of Appeals ruling.

<h2>A widely known case</h2>

Foster's case has been widely discussed, even within the pro-abortion movement in the US. Just last month, thousands of activists held a march from the Royal Courts of Justice to Whitehall and demanded an end to the criminalisation of abortion. The march was organised after Foster's sentencing.

The chief executive of the BPAS has said that she &nbsp;"echoes the judges' statements".

Clare Murphy, the chief executive said the court had "recognised that this cruel, antiquated law does not reflect the values of society today" and urged Parliament to decriminalise abortion as a "matter of urgency". She was quoted by Sky News.

Since the overturning of Roe v. Wade, medical abortions had emerged as the predominant choice for abortion in the nation. A two-pill combination of mifepristone and another drug is as per CBS News, the most common form of abortion in the US.

In 13 US states, there are blanket bans on all forms of abortion, including abortion bills, 15 other states have limited access to medical abortions.&nbsp;

According to the pregnancy advisory service, it sent the woman the drugs in May 2020, believing her to be seven weeks pregnant. However, the court later said that it was informed that she had lied and was in fact between 32 and 34 weeks pregnant.&nbsp;

The prosecutors said her internet search history between February and May 2020 included "how to lose a baby at six months", "I need to have an abortion but I’m past 24 weeks" and "how to have an abortion without going to the doctor."

Prosecutor Robert Price told Stoke-on-Trent Crown Court in central England, "She lied to BPAS about how pregnant she was, so they sent the tablets to her. She said she had not seen a doctor about her pregnancy because she was embarrassed."

He added that while the baby was not full term, she was approaching the stage of development, and multiple-prolonged internet searches show the level of "planning."

After the sentence was announced, BPAS's chief executive said that they were shocked and appalled by the sentence and said that 19th-century laws were used to prosecute her.

She added that there has never been a clearer mandate for parliamentary action, and the need has never been so urgent. She also mentioned that over the last three years, there has been a significant&nbsp;increase in the number of females facing the trauma of lengthy police investigations and treatment with up to life imprisonment under the abortion law.&nbsp;

MPs and Campaigners disappointed with the sentence

Campaigners and UK MPs were outraged after the woman was sentenced to over two years in prison, Guardian reported.&nbsp;

A mitigation plea sent to the judge in April 2023 which was signed by groups including the Royal College of Obstetricians and Gynaecologists.

It read, "We plead to Your Honour to consider leniency in this case … we are fearful that if the case before you receives a custodial sentence it may signal to other women who access tele-medical abortion services, or who experience later gestation deliveries, that they risk imprisonment if they seek medical care."

The leader of the Women's Equality party, Manu Reid said, "I am devastated for the woman at the centre of this case, and for her children, who have been forcibly separated from their mum …This conviction serves no one, not her, not her children, not the public interest. All it does is punish a woman for seeking healthcare in the middle of a pandemic and risk deterring women who want or need an abortion from seeking that care in future. No one deserves to be criminalised for seeking healthcare, which is a human right."

British woman sentenced to 14 months in prison for abortion during Covid lockdown

The Catholic-majority country of Malta, enforcing its strict ban on abortions, on Thursday charged a woman for having terminated a pregnancy. The woman, reportedly, had a medical abortion at home which goes against the country's complete ban on the practice.&nbsp;

Local media reports stated that she was granted a conditional discharge for three years after attending the court proceeding. No additional information was provided. However, women's rights activists have dubbed it a black day in the history of the country.&nbsp;&nbsp;

“What should have never happened [has] happened today: a Maltese woman was brought to court facing charges of having a medical abortion at home," the Women’s Rights Foundation of Malta said in a statement.

Although the woman was treated with respect during the hearing, the foundation said the fact that she was charged "should have never, ever happened in the first place”.

Notably, the Mediterranean nation, located off the coast of Sicily, is the only country in the 27-nation European Union bloc that does not allow women to receive an abortion, including in cases of rape or incest.

As a result, South Carolina will revert back to a ban on abortions at approximately 20 weeks after fertilisation until the state Supreme Court reviews the measure.

Judge Newman stated that the status quo should be maintained until the Supreme Court has an opportunity to review the law. "It's going to end up there," he said.

The newly passed law is similar to a previous ban on abortions once a heartbeat is detected, which was passed in 2021.&nbsp;
