The Delhi High Court Friday sought the response of former Telecom Minister A Raja and others on a plea by the CBI seeking an early hearing on the appeals challenging the trial court's verdict acquitting all accused in the 2G spectrum allocation case.

The Central Bureau of Investigation (CBI) sought to prepone the date of hearing of the appeals from October 24.

The court issued a notice to all the individuals and firms, who were acquitted in the case, on the CBI's plea and listed the application for hearing on July 30.

Justice A K Chawla asked the CBI's counsel as to what was so special that they are seeking early hearing of this matter.

"What is the urgency now," the court asked.

Central government standing counsel Ripu Daman Bhardwaj said the matter was of national importance with international ramifications and the hearing on the appeals be preponed from October.

The CBI has sought an early hearing in the 2G spectrum allocation case as well as in a separate case arising out of the 2G scam probe in which Essar Group promoters Ravi Kant Ruia and Anshuman Ruia and six others were acquitted by the trial court.

A special court had on December 21, 2017, acquitted Raja, DMK MP Kanimozhi and others in the CBI and ED cases.

It had acquitted 17 others, including DMK supremo M Karunanidhi's wife Dayalu Ammal, Vinod Goenka, Asif Balwa, film producer Karim Morani, P Amirtham and Sharad Kumar, Director of Kalaignar TV in the ED case.

On the same day, the trial court had acquitted Raja, Kanimozhi and 15 others, including former telecom secretary Siddharth Behura, Raja's erstwhile private secretary R K Chandolia, Unitech Ltd MD Sanjay Chandra and three top executives of Reliance Anil Dhirubhai Ambani Group (RADAG) -- Gautam

Doshi, Surendra Pipara and Hari Nair, in the CBI's 2G case.

Swan Telecom promoters Shahid Usman Balwa and Vinod Goenka and directors of Kusegaon Fruits and Vegetables Pvt Ltd Asif Balwa and Rajiv Agarwal were also acquitted in the CBI case.

On March 19 last year, the ED had approached the high court challenging the special court's order acquitting all the accused.

A day later, the CBI too had challenged in the high court the acquittal of the accused in the case.

The ED, in its charge sheet, had alleged that Rs 200 crore was paid by STPL promoters to DMK-run Kalaignar TV.

The CBI had alleged that there was a loss of Rs 30,984 crore to the exchequer in allocation of licences for the 2G spectrum which was scrapped by the top court on February 2, 2012.

Special Judge O P Saini, however, had held that the prosecution had "miserably failed" to prove the charges.

The special court, which was set up on March 14, 2011, for hearing 2G cases exclusively, had also acquitted Essar Group promoters Ravi Kant Ruia and

Anshuman Ruia and six others in a separate case arising out of the 2G scam probe.

In the CBI case, Raja, Kanimozhi and 15 others were tried under provisions of the IPC and the Prevention of Corruption Act dealing with offences of criminal conspiracy, cheating, forgery, using as genuine fake documents, abusing the official position, criminal misconduct by public servant and taking a bribe.

You will get to know: Vinod Rai on allegations made by A Raja

Former telecom minister Andimuthu Raja, who was recently acquitted in the 2G spectrum scam case, said Congress didn't not come to his rescue during the difficult times he faced during the trial.

"Congress remained aloof from this matter to save the government. They should have come forward and said nothing is wrong," Raja said in an interview to WION on Thursday.

Raja was the telecom minister in the Congress-led UPA government from May 2007 to November 2009. He resigned in 2010 after the then Comptroller and Auditor General (CAG) Vionod Rai indicted the minister for not distributing the 2G spectrum in a transparent manner leading to a loss of Rs 1.76 lakh crore to the exchequer.

Raja hit back at the former CAG. "Vinod Rai is a blatant liar. They wanted to train their guns only at me. No one came to hear my side of the story," the DMK leader said.

Explaining how he was acquitted in the 2G scam, Raja said the investigators could not corroborate the evidence. "Whatever you accuse me of, you have to present evidence for that. But all the documents were in my favour, the investigators couldn't prove anything so I was acquitted," Raja said.

He also said that members of former Prime Minister Manmohan Singh's Cabinet were not true to him. "Those who failed in court wanted to use the Prime Minister's Office (PMO). He didn't even know about spectrum availability. Dr Singh remained silence because of the Supreme Court and media," Raja said.

"There were variations within the Cabinet regarding 2G. Nobody in the government defended the policy of the government. Cut-off date was not Raja's brainchild. It was the brainchild of then secretary and officers. In fact I was against the cut-off date," he added.

The CBI, during the course of its investigation, had alleged that the decision to advance cut-off date for accepting the applications for grant of 2G spectrum licences was taken to "favour" Unitech - a charge which was never accepted by Raja.

The DMK leader also said that he will seek a ticket for 2019 Lok Sabha elections. "I will always be part of politics," Raja said.

Raja was also grateful to his party chief M Karunandhi. "Karunanidhi came to jail to console me."

After being let off, Raja wrote an emotional letter to Karunanidhi.

"I place the 2G verdict on your feet with gratitude. I'm waiting to hear your words," Raja said in the letter. He also alleged that the spectrum attack has tainted the DMK's ideological movement and questioned, "Who will punish those who tainted your 80 year public life?"

Reiterating that his actions brought a "revolution" in the telecom sector, Raja further said in the letter that as a minister in the UPA government, which was in power at the Centre when the spectrum scam happened, he gave 59 crore mobile connections against the 60 crore target set before 2012. "A shame that even UPA govt couldn't realise it was trapped in the plot to bring it down," Raja said in his letter.

Raja also hit back at the former CAG. "Vinod Rai is a blatant liar. They wanted to train their guns only at me. No one came to hear my side of the story," the DMK leader said.

2G scam verdict: A Raja, Kanimozhi, all other accused acquitted of graft charges

As a common citizen of India, I am surprised why everyone is talking about 2G scam especially when the world has advanced much ahead and now our neighbouring country has even tested 5G spectrum (despite not having any 5G enabled device made so far) after 3G and 4G.

It was just a little scam of 1.76 lakh crores. Just 1.76 lakh crores. 28 billion dollars if we convert it into the international currency. And that too this was not the money of the government. The legendary team of A Raja and Party did not loot the government or any bank. It was just the hard-earned money of the taxpayer which they enjoyed.

This money could have provided elementary education to almost 10 crore students for a year, but why worry? In India, we fight for petty causes despite being educated, prefer to send kids to madrasas instead of school, kill people for religion. So, do we really need education?

With this money, 6 crore people could have been fed two meals for a year, but why worry? We have enough people in our country, few deaths from starvation do enrage us enough.

With this money, we could have liquidated the debts of our farmers but why worry? If they don’t commit suicide then how our politicians will encash this matter in the election? They will then be bereft of an issue. After all, we need our leaders like A Raja and Kanimozhi who know how to enjoy the tax payer’s money.

With this money, we could have set up at least 50 Industrial Parks and given employment to at least 50 Lakh people for a year. But why worry? If everyone is employed, then who will listen to these politicians and be fooled? After all, we need politicians too.

Even government is not sure of the figures. Comptroller and Auditor General gave a figure of $ 27 Billion. However, the CBI in its inquiry reduced the figure to about $ 5 Billion. The government should have continued the investigation further by Interpol, Scotland Yard and the FBI. I am sure that after so many investigations, the net loss in the final report would have been just a few hundred dollars, which Mr Raja and the party will be pleased to pay from their pocket.

Not only Mr Raja, the common taxpayer of the country would have also felt good as their loss becomes low now. So, there will be a feel-good situation everywhere.

Mr Raja benefitted many multinational telecom companies. So, what if they take their profits abroad? We, the Indians, have been known for sending our wealth abroad for so many centuries. Initially, Turks and Afghans came and took away the wealth, then Mughals and then Europeans. Even after the British left, Indians have shown their prosperity to the world by having the largest number of Swiss bank accounts. So, why make so much of fuss now?

Everybody played his cards well. The case took 6 years to reach a verdict from the local court. Anticipating the way Indian judicial system works, I can surely say that it will take at least 30 more years to get a final verdict from the Supreme Court. A Raja is 54 now. By the time court will send him to jail, god knows he will be alive or not.

His other team members are also in the same age bracket.

So, when we already know that there is nothing which we can achieve in this case, then why waste our time and money on prosecution and judicial expenditures.

There have been, at least, few thousands scam since the independence. Is there even one case where the accused is prosecuted and punished? The answer is a clear no. So, why worry about this? The public always has very short memory. They even forgot our freedom fighters and many others who crafted modern India.

Don't you believe me?

Let’s have an exercise. Go to any metro town and ask any college going student about 20 personalities and let me know how many names they have heard- Dr Verghese Curien, Dr MS Swaminathan, Ashfaqulla Khan, RN Goenka, Rani Gaidinliu, Lachit Barfukan, Annie Besant, Badruddin Taiyabji, CR Das, Dadabhai Nauroji, Gopal Krishna Gokhle, Jamnalal Bajaj, KM Munshi, Khudiram Bose, Khan Abdul Gaffar Khan, Lala Hardayal, Ram Prasad Bismil, Ras Behari Bose, Vinayak Damodar Savarkar and GD Birla.

The result will open your eyes. You can try yourself too, and give yourself a rating from 0 to 20. In a country where people tend to forget their leaders and torchbearers, I am sure they will forget all these scams too.

As far as the poor taxpayer is concerned, he was paying tax, is still paying tax and will continue to pay tax in future too. His life would also remain the same.

WION news brief, December 21, 2017

A Raja, former telecom minister who is acquitted in the 2G spectrum case has said that his faith in the nations' justice was validated today.

"My firm belief in the rightfulness of my actions as well as my faith in our nation's justice system has been validated today,".

He said he had felt vindicated all along the case and added that results of his actions had benefitted the people and brought a "revolution" in the telecom sector.

"I have felt somewhat vindicated all along even prior to this judgement because the beneficial results of my actions are evident to and being enjoyed by the nation's public (especially the poor)," he said.

Raja claimed that the trial court judge had repeatedly observed that his evidence was "cogent, credible and consistent with the official records, in contrast with the evidence of the prosecution witnesses whose evidence has been rejected as untrustworthy".

2G scam: Entire case was cooked up, says A Raja

The 2G verdict was delivered on the time and date of the choosing of the judge. But what happened in the court took most of us by surprise. For the ruling party, it was a bang from the blue. A knockout punch. For the Congress Party, it was a divine intervention. The verdict removed the stigma of corruption from the party.

The matter will go up to the higher court but will give enough time for the Congress to milk it. It was this case, particularly, Kapil Sibal's famous "zero loss" statement which turned 2G into a hurricane, unsettling BJP's secured nook.

For now, the acquittal unsettles the political map. It marks the return of Manmohan Singh who was the victim of a vicious campaign.

Sympathy is a very important ingredient in Indian politics. People at large had stopped sympathising with Manmohan Singh. He was called servile and more loyal to the Congress Party than to the post of the Prime Minister.

This case changes all of that. It should worry BJP.

Manmohan Singh's credibility was in tatters and the Opposition made him the face of crony capitalism.

This verdict will enable Singh to be far more aggressive than he has ever been after 2014. Even his limited appearance in Gujarat on GST got him good coverage. This is not to say that Manmohan will regain the centre stage in the Congress. However, he has the capacity to emerge as a tool to attack BJP on many issues and gain sympathy.

For this, the former prime minister can put BJP in a dock.

Many can argue that high and mighty never get caught and 2G is going to the Bofors way. However, Manmohan Singh's ability to gather sympathy should not be underestimated. Though the case involved corporates, bureaucrats and DMK leaders, Manmohan had to face the jibe of the Prime Minister Modi where he said that people should learn from Manmohan Singh how to bath in a bathroom wearing a raincoat.

The verdict also thickens the relationship between Congress and the DMK despite the fact Prime Minister Modi made a visit to greet Karunanidhi. Today AIDMK lies in tatters despite a solid majority. There are corruption cases against its leaders and the DMK as a house looks far more disciplined. Alighari’s issue has been long settled and the verdict for some time will allow DMK to be politically very aggressive in Tamil Nadu. It will become even more acute for the ADMK as they don’t have Jayalalitha to arrest the reversal of fortune.

Coming back to the moot point of BJP’s position on corruption, the government will have to explain as to what went wrong during the argument. It will have to convince the public that it ran a genuine campaign against corruption and only the argument has gone wrong. Till then, Congress will have a field day using Manmohan Singh as a victim. After Gujarat, the 2G verdict has again opened the game for the Congress. Let’s see what it makes of it.

Opinion: With 2G verdict, Manmohan Singh returns to glory

BJP leader Subramanian Swamy, who unearthed the 2G spectrum case, on Thursday, snubbed the verdict in the multi-crore scam while saying that the government needs loyal officers, not sycophants.

All accused in the 2G spectrum allocation scam cases - including former telecom minister A Raja and Dravida Munnetra Kazhagam (DMK) MP Kanimozhi - were, earlier in the day, acquitted by a Special CBI court.

Speaking to media, the BJP leader also slammed former Attorney General Mukul Rohatgi for welcoming the verdict and said such people should not be made law officers.

"Mukul Rohatgi has welcomed this judgement. When he was appointed Attorney General, I had written to the Prime Minister opposing his appointment, as Rohatgi was an advocate of many of the accused companies, including Unitech. These people should not be made law officer because a wrong signal will go that we are not serious about corruption," he said.

The BJP leader said that today's judgment was bad and that it has to be appealed in the High Court.

"The corruption agenda has been derailed, but it can be put back on track again. We just need some honest and straightforward law officers and good lawyers, not those who do 'chamchagiri' to the ministers. We need somebody who has got stature and we need to put them together to have a team and within three months we can reverse whatever has happened," Swamy said.

He further called upon Prime Minister Narendra Modi to take a lesson from this and "set up war council for fighting corruption."

"The Judge says earlier there was a lot of enthusiasm, but later it became worse and worse. Judge also said counsels were lackadaisical. This is a big condemnation of the government controlling of the case. This is not a setback at all. It is an aberration as the law officers were not serious on fighting against corruption... We must now fight corruption on war footing," he said.

He further said that a special team should be set up, which would set aside this judgment.

The verdict was announced nearly seven years after the first arrest was made by the CBI in 2011.

The alleged scam relates to the granting of 2G spectrum licence allocations in 2007-08, which caused, according to a report by the Comptroller and Auditor General of India, a loss of Rs 1.76 lakh crore to the public exchequer.

It was among the major corruption scandals that came to light during the second term of the UPA government headed by former prime minister Manmohan Singh.

The Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) had accused the Maran brothers of helping Malaysian communications service provider Maxis acquire telecom Aircel in exchange for a kickback of approximately Rs 700 crores.
