The Delhi High Court (HC) on Friday (Sept 27) expressed its displeasure over the failure of authorities to produce before it a file containing the decision of then Indian prime minister Manmohan Singh that the Jama Masjid in the national capital should not be declared a protected monument. A bench of the high court headed by Justices Prathiba M Singh and Amit Sharma observed that despite an earlier order, “loose sheets” and other documents were tendered to it instead of the record about the mosque’s status as a monument, its current occupants etc. A final opportunity granted to ASI Granting a final opportunity, the bench sought an affidavit in the matter from a competent officer of the Archaeological Survey of India (ASI) as well as the original file on the next date of hearing in October. The bench also asked the director-general of the ASI to directly supervise the matter and hold a meeting with the central government’s counsel to ensure that a comprehensive affidavit was filed. The Delhi HC was hearing PILs (Public Interest Litigations) that sought directions to authorities to declare the Jama Masjid a protected monument and remove all encroachments in and around it. The ASI's failure to produce the file On August 28, the high court directed the Indian culture ministry and the ASI to positively produce before it a file containing Manmohan Singh's decision that the Jama Masjid should not be declared a protected monument. During the hearing on Friday, the bench questioned the ASI official present in the court over his failure to comply with the order. “Who is not giving the file? We will call the secretary. There are clear instructions,” the bench said. “A perusal of the note sheets will show that they (the documents produced) mostly relate to the writ petition and follow-up action in relation to the writ petition. Information relating to the Jamia Masjid’s status as a monument, maintenance being undertaken by the ASI, the current occupants of the Jamia Masjid and the manner in which the revenue generated is utilised is not contained in the file,” it added. “Let a short affidavit be filed by a competent officer of the ASI with respect to all aspects and the original file be produced on the next date of hearing. This will be undertaken directly in the supervision of the director general of the ASI,” the bench further said. A look at the PILs The PILs were filed by Suhail Ahmed Khan and Ajay Gautam in 2014. The pleas objected to the use of the title “Shahi Imam” by the Jama Masjid’s imam, Maulana Syed Ahmed Bukhari, and the appointment of his son as the naib (deputy) imam. The pleas also questioned why the mosque was not under the ASI’s management. The central government's counsel had earlier submitted that the Jama Masjid was a live monument where people offer prayers and there are a lot of restrictions. The ASI told the high court that Manmohan Singh in August 2015 had assured the Shahi Imam that the masjid would not be declared a protected monument. (With inputs from agencies)

High Commissioner Wong said, "We feel that even as a small country, we can work very, very closely with India on its semiconductor journey because this journey is not a one, two-year process. Is going to be a long drawn, 10-year process to grow". This comes as a pact was signed on semiconductors in developing capacity building during PM Modi’s visit.

He highlighted Singapore's investment plan of over $45 billion in the next few years in India. He also spoke on India-China ties, quad, RCEP, etc. Here’s the full interview:

WION: How do you see the India-Singapore ties, especially in the backdrop of PM Modi's recent visit to your country? 
Simon Wong: I want to thank WION, Because of your full coverage of Prime Minister Modi's visit to Singapore, many people across India and Singapore get to know the spur in that relationship between the two countries. In particular, I think the upgrading of relationship ahead of our 60th anniversary into a comprehensive strategic partnership and the visit by Prime Minister Modi ji has set the bar very high for our bilateral relationship, and we have looked into several new areas, in fact, six new areas of collaboration with India. And I feel very, very confident that this new turbo boosting of that relationship can continue.&nbsp;

WION: One of the key outcomes was the semiconductor pact. Much talked about the pact. How is this semiconductor pact going to help India with the Singaporean's know-how? 
Simon Wong: We feel very, very strongly about India's push for a semiconductor supply chain, and we feel the willingness at all levels, at the Union level and also at the state level, to push through this ambition. Singapore represents 10 per cent of all chip-making exports approval. And we have 20 per cent of the market on chip-making equipment. We feel that even as a small country, we can work very, very closely with India on its semiconductor journey because this journey is not a one, two-year process. Is going to be a long-drawn, 10-year process to grow, and for India to grow with fewer impediments, we feel that Singapore can collaborate and partake.&nbsp;

WION: So what next for the relationship?&nbsp; 
Simon Wong: I think what we want to do for next year, during the 60th anniversary, is to look beyond our concentration of investment in the southern states. The southern states are very, very welcoming of Singapore investment, and we are very familiar with them. I want to take the opportunity of the 60th anniversary to look at new areas of growth. I want to quote India's G20 sherpa, Amitabh Kant, who said that India needs 10 states as the engine of growth. In my view, 10 is a really critical mass, and we want to look at new areas. We want to look at UP, Odisha, and MP and I think increasingly we see the willingness of Rajasthan to engage us. So all these four states, we want to do some form of engagement and understanding next year. And also next year, I would like to see more green energy ports and facilities to be put online. Now we have one in Tuticorin, and we are looking at two, or three other ports. We hope that it can be lined up by next year.

WION: India hasn't joined RCEP. What is your position? And we know during the prime minister's visit, many big-ticket investments were announced. So what kind of figures are you looking at? 
Simon Wong: Of course, for Singapore, which is very, very trade-based, and we like FTAs, both sub-regional or bilateral, we always have high hopes for India to join RCEP, but we fully understand where India is coming from. We are most willing to wait for India to reconsider RCEP, but at the same time, India is looking at other FTAs, like GCC, which is really a good thing for India. Number two, I think, big-ticket investments coming up, Prime Minister Modi ji, in his roundtable with 18 of our key Singapore businesses, is kindly of pleasantly surprised when all of them basically told Prime Minister Modi ji that they will double or triple their investments in India in the next three to five years. So if I look at the figures, on the average, we do 15 billion US dollars a year of investment here. If I double or triple it, it will be very, very close to $45 billion to $50 billion. So I hope we are successful in pushing this investment.

WION: So my last question to you is, international affairs, India-China relationship. What's your view? Because Singapore has good relationships with both India and China. 
Simon Wong: My own view as a small country is that big countries should collaborate and have good relationships with each other. So as friends of both China and India, we want to see a better relationship between the two, between our two big neighbours of ours. And I feel that there are really some green shoots coming up in the discussion. There are high-level discussions between China and India. Hopefully, there is going to be a top level discussion coming up soon, and I hope some of these pain points can be resolved diplomatically.

WION: Your sense on Quad? 
Simon Wong: My sense of Quad is a work in progress, and I think many of the Quad countries are looking ahead at security collaboration, security views, and linking the Indo-Pacific area, we welcome that as a sub-regional kind of forum to talk about things. For me, for Singapore, my central point of gravity is always ASEAN, and we feel that ASEAN as the centrality is very big and important in this part of the world as an anchor point of solution.&nbsp;

ULH have been inducted along Northern borders. "They are lighter in weight and can be carried underslung by helicopters. K-9 Vajra Gun System is ideal for mechanised operations. Dhanush Guns are an electronic upgrade of Bofors Guns, while the Sharang Gun Systems have been upgraded from 130 mm to 155 mm calibre. An eight-year-old student from India’s Uttar Pradesh state has revealed how his school teachers had tried killing him as part of a black magic ritual but he survived. The student, from Hathras city, was taken by school teachers on September 6, as his parents were told that their child was having severe pain in his stomach.

News broadcaster India Today quoted the child’s grandfather as saying, “I noticed marks on his neck, and his eyes were red.”

The child later revealed that the school manager had attempted to suffocate him by pinching his nose and choking him.

Now, days after this incident, a junior class student was ‘sacrificed’ in the same school to bring ‘fame’ to the school. The action, reportedly influenced by a black magic ritual, was carried out by a school teacher. He abducted a boy named Kritarth, a class 2 student, from the school’s hostel on September 23. As he prepared the boy for the sacrificing ritual, he woke up and started crying.

News agency PTI quoted Additional Superintendent of Police (ASP) Ashok Kumar Singh as saying that the teacher murdered the student by strangulating him.

Police have now made five arrests in the case, including the owner of the school, his son, the principal and two teachers.

The arrested principal and teachers have been identified as Laxman Singh Ramprakash Solanki and Veerpal Singh.

The Indian government has slashed its goal to create thousands of new tribunals to try sex crimes speedily after states like West Bengal, where the recent brutal rape-homicide of a doctor shook the nation, fell far short of targets, according to three federal government officials and an internal document seen by Reuters.

Prime Minister Narendra Modi's government moved to establish&nbsp;fast-track special courts (FTSC) in 2019 to try exclusively sex crimes, after the Supreme Court that year criticised state governments for being slow to deliver justice to victims. The court singled out Bengal and Uttar Pradesh for taking too long to reach judgment on cases involving child victims.

Most sex crimes are tried by India's heavily burdened state courts, but Modi's government planned to incentivise state governments to establish 1,023 FTSCs by March 2021 by funding 60% of costs. Each FTSC is staffed by one judicial officer and seven support staff.

The government had projected 2,600 FTSCs by 2026 but has now revised its target to 790 due to low interest from states and a lack of judges, according to the officials and the document, an undated summary from this year of progress on the FTSC project.

Just 752 FTSCs have been established nationwide as of August, according to publicly available government data.

Some states were slow to sign up to the project, with Bengal only joining last year. The opposition-led state - whose chief minister Mamata Banerjee is under scrutiny for her handling of sex crimes - was earlier set a target of 123&nbsp;fast-track tribunals by March 2021, according to the officials and the document.

But only six tribunals are operational in Bengal, where there are some 48,600 cases of rape and other sexual offences pending judgement.&nbsp;

Details of the federal government's original target and its decision to scale back sharply are reported by Reuters for the first time.

Top West Bengal judicial bureaucrat Siddhartha Kanjilal blamed the slow response on a lack of judges but said authorities were working with the Calcutta High Court, its top tribunal, on appointing retired officials to FTSCs.

"There have been delays," he said. "We, as well as the Calcutta High Court, are seized of the matter."

The Indian law and justice ministry and the office of Banerjee, a vocal critic of Modi, did not respond to requests for comment.

Bengal has now been set a goal of 17 special tribunals by 2026, according to the undated government document and a second Aug. 30 summary on the status of FTSCs in that eastern state seen by Reuters.

India's strained judicial system has a backlog of tens of millions of cases. State courts of first instance are short of about 5,000 judicial officers, roughly 20% of the judges they have been allocated by state authorities, government data show.

In one notable instance of delay, a district court in Ajmer this August sentenced six men to life imprisonment for their role in mass rapes that occurred in the early 1990s.

One of the Ajmer victims, who cannot be named under Indian law, said she was abandoned by her husband after he learned of the assault and the sentence from a traditional court had come way too late for her:&nbsp;"I am of a grandmother's age now and have no expectations or hope left."

By contrast, FTSCs focus on specific crimes and can try them speedily. They are also allowed to hire judges on contract, including retired judicial officers.

In 2022, the last year for which comprehensive data is available, FTSCs passed judgement on 83% of cases on the docket. By contrast, Indian courts overall ruled on just 56% of the sex-crime cases taken on that year.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;

The original FTSC targets were set by the federal law and justice ministry using a formula that took into account the number of outstanding cases in each state and a target for each tribunal to conclude 165 cases annually, one of the officials said. Like his colleagues, the official spoke on condition of anonymity because he was not authorised to talk to media.

In a country where cases can drag on, FTSCs "have particular relevance in cases involving vulnerable victims and witnesses," said G.S. Bajpai, vice chancellor of the National Law University Delhi, who has advised the government on criminal law reforms.

Senior lawyer Shobha Gupta, who has represented many rape victims, said FTSCs can be useful but that appeals still go through the slow traditional court system.

"What is needed is&nbsp;fast&nbsp;tracking until the last court and final verdict and execution of the final verdict in a strict time-bound manner," she said.

There is no publicly available data on how many FTSC cases are appealed but two of the government officials said it was common for sentences from lower courts and tribunals to be appealed. Nearly 42% of the 1.7 million criminal cases pending in India's high courts are appeals.

<h2>Blame game?</h2>

Opposition-led states have generally been slower to set up FTSCs, according to government data.

Uttar Pradesh and Rajasthan, both ruled by Modi's Bharatiya Janata Party, have met their targets, according to the three officials and justice department data.

But the western state of Maharashtra, governed by a coalition that includes the BJP, has only established 14 of its target 138.

The three officials said the federal government had repeatedly urged laggard states like Bengal to sign up, but often received no response.

The Aug. 30 summary seen by Reuters said the justice department had written to Bengal on Dec. 12, 2023, advising it to hire contractual staff "in the event of an insufficient workforce."

In 2021, then-minister of law Kiren Rijiju also wrote a letter to Banerjee, seen by Reuters, in which he said his department had sent previous reminders seeking her consent to establish FTSCs.

The three officials said they received no response to the letters.

One opposition-ruled state that has met its target of 22 FTSCs is Jharkhand.

But the state of 33 million has since told the federal government it will pull out of the FTSC program, the three officials said.

Jharkhand's top law bureaucrat Rajesh Sharan Singh said officials have been conferring about running FTSCs that are entirely funded by the state, one of the poorest in India, but declined to say why.

"If the state government funds it, we will exit the central government funding," he said.

Chief Minister Hemant Soren's office didn't respond to Reuters' questions.

“We received the report around 8:15 am. His body was hanging from a roadside tree near Bhuinpur (where he lived). We sent it for postmortem around 9 am and then handed it over to the family,” said Jena.

Odisha’s Additional Director General, Law and Order, Sanjay Kumar, while speaking to The Indian Express, confirmed that they had found a suicide note in which the suspect had purportedly admitted to the crime. 
 
“The Odisha Police have already registered an unnatural death case. Based on the suicide note, the Bengaluru police have confirmed he is the accused in the gruesome murder case,” Kumar told The Indian Express.

PM Modi launches three PARAM Rudra supercomputers developed indigenously

Karnataka government withdrew open consent to the Central Bureau of Investigation (CBI) to conduct inquiries in the state, alleging that the bureau was functioning in a "motivated matter" and had a "biased approach".&nbsp;

The government announced the decision during a cabinet meeting&nbsp;chaired by Chief Minister Siddaramaiah.&nbsp;

The opposition claimed that the CBI was ordered by the Bharatiya Janata Party to target its leaders, especially before the elections. It further ruled out any link to Mysuru Urban Development Authority, or MUDA, land scam allegations against&nbsp;Chief Minister Siddaramaiah.

Law Minister HK Patil said that it was not prompted by the Karnataka High Court's ruling upholding Governor Thaawarchand Gehlot’s probe sanction against the CM in the MUDA site allotment case.

"We are withdrawing open consent for CBI investigation in the state. We are expressing our concerns about the misuse of the agency. They are biased... that is why are taking this decision," Patil said.

“The Governor, who is the highest authority in the state, has upheld a false allegation against the state government. Where are the documents to show the involvement of the CM in the MUDA case?” he said.

Patil said that the CBI and Centre have not been judiciously using their instrumentalities. "So, case-by-case, we will verify and give (consent) to the CBI, general consent has been withdrawn.”

He noted that “in the case of the CM, the court has directed a Lokayukta inquiry. The question of the withdrawal of general consent to the CBI is not linked to the MUDA case.”

‘Biased approach,’ Karnataka withdraws general consent to CBI for probing cases in state

India’s Home Minister Amit Shah on Thursday (Sep 26) took on the alliance of Congress and National Conference in Jammu and Kashmir and dared them to restore Article 370 in the Union Territory. "You will all vote not just for Chenani but make a decision for the entire Jammu and Kashmir. After independence, it is for the first time that an election is held here where there is no Article 370 or a separate flag...National Conference and Rahul Baba say that we will bring back Article 370, but I want to tell them that neither you nor the three generations of yours will be able to bring back Article 370," the home minister said.

He also took aim at the three political families of Jammu and Kashmir—“Gandhis”, “Muftis” and “Abdhullas.”

"The three families have given tickets to their own people and made only 87 MLAs. But we made more than 30,000 Panch, Sarpanch and Tehsil Panchayats... The river of corruption that they started was cleaned by Prime Minister Modi from the bottom," Shah added.

"The world is closely watching the Jammu and Kashmir elections, where two vastly different visions are at play. On one hand, the NC, Congress, and PDP parties, perpetuating terrorism in the region for around 40 years, are eyeing for power. On the other hand, the BJP, committed to rooting out terrorism entirely, offers an absolutely contrasting picture," the Bharatiya Janata Party leader said.

Shah’s remarks came a day after the second phase of polling in the UT. Assembly polls are being held in the Jammu and Kashmir after a decade and for the first time after the abrogation of Article 370 in August 2019. Ahead of the polls, Congress and National Conference entered into a seat-sharing agreement, where the former is contesting 32 seats and the latter 51.

‘Your three generations...,’ India’s home minister dares rivals to restore Article 370 in Jammu-Kashmir

At least 46 people died in the eastern Indian state of Bihar over the last 24 hours in separate drowning incidents during the celebration of the 'Jivitputrika' festival. The festival was celebrated on Wednesday (Sep 25) and deaths have been reported from at least 15 districts of the state, the government said. During the 'Jivitputrika' festival, women observe fast for the well-being of their children and both take holy dips in rivers and ponds.

A statement issued by the state Disaster Management Department (DMD) said, “A total of 43 bodies have been recovered so far. Further search operation is on."

Chief Minister Nitish Kumar&nbsp;has announced a compensation of ₹ 4 lakh ($4,800) for the next of kin of those who died. The government added that the families of eight victims have already received the compensation.

"The incidents of drowning were reported from East and West Champaran, Nalanda, Aurangabad, Kaimur, Buxar, Siwan, Rohtas, Saran, Patna, Vaishali, Muzaffarpur, Samastipur, Gopalganj and Arwal districts,” the statement said.

Most of the victims in the tragedy were children, with government putting the official toll at 37 for children and 7 for women. However, the toll is expected to rise as more bodies are recovered by the authorities.
