The RSS said Monday that the Supreme Court should make an early decision on the Ram Janmabhoomi land dispute in Ayodhya and the Union government should bring a legislation to remove hurdles, if any, in the way of the construction of a Ram temple at the site.

RSS chief spokesperson Arun Kumar said the Allahabad High Court in its verdict has accepted that the site is the birthplace of Lord Ram and a temple existed there.

The high court judgment, delivered in four civil suits, had said the 2.77-acre land be divided equally among three parties — the Sunni Waqf Board, the Nirmohi Akhara and Ram Lalla.

“The Sangh believes a grand Ram temple should be constructed soon at the birthplace of Lord Ram. And land should be allotted at the birthplace for temple construction. With the construction of the temple, an atmosphere of unity and harmony will be created.

“With this in view, the Supreme Court should make an early decision and if there are any difficulties, the government should make a law to remove all hurdles in the way of giving land for the temple at the Ram Janmabhoomi site,” Kumar said in a statement. Kumar said the high court has accepted that the said site is the birthplace of Lord Ram. “Ever since this Andolan was started by saints, we have supported it and will continue to support them in their decisions in future,” he said.

The Supreme Court on Monday fixed the Ram Janmabhoomi-Babri Masjid land dispute case for the first week of January before an “appropriate bench”, which will decide the schedule of hearing. A three-judge bench, headed by Chief Justice Ranjan Gogoi, said the future course of hearing in January next year on the appeals filed against the high court verdict will be decided by that bench.

Union minister Prakash Javadekar Sunday said Congress leader Shashi Tharoor's remark on Prime Minister Narendra Modi and Shiv Linga reflected the party's mentality which had become evident when former prime minister Rajiv Gandhi dubbed the opposition a "scorpion" in 1984 polls.

He also accused the Congress of "indirectly supporting" Maoists and said the BJP governments at the Centre and in Chhattisgarh, where elections would be held next month, were determined to finish the Naxal menace in the coming years.

No Congress leader was available for comments.

"When Chhattisgarh was formed and the Congress was in power in the state, Naxalism was at its peak. Now it has come down to one-third of the total area which was in control of Naxalites earlier," the human resource development minister said in a press conference in Raipur.

Javadekar criticised Tharoor for his reported remark Saturday in which he claimed that an unnamed RSS source had told a journalist that "Prime Minister Modi was like a scorpion sitting on a Shiv Linga who cannot be removed by hand or hit with a chappal (slipper)".

When asked about the remark, Javadekar said, "The Congress is wondering on how to take on Modi at the political level and therefore it has resorted to abusing. Rahul baba keeps on abusing daily. People will do only those things which they know. Shashi Tharoor is a bit sophisticated but he has also come down to the 'bichhu' remark."

"This was the Congress' advertisement in 1984. Rajiv Gandhi had brought this advertisement of calling the opposition a scorpion in the 1984 elections. It reflects the mentality of Congress," the Bhartiya Janata Party (BJP) leader claimed.

On Naxalism, he said 350 ultras were gunned down in the last five years in Chhattisgarh.

"Not only that, around 5,000 misguided tribals have surrendered while thousands of Naxals have been arrested," he said.

Hitting back at Congress leader Abhishek Manu Sanghvi who Sunday accused the Chhattisgarh government of being weak in tackling Naxalism, Javadekar said on the contrary the menace was at its peak during the Congress' rule in Chhattisgarh between 2000 and 2003.

"The Congress gave birth to Naxalism and it is the party which has encouraged it. The senior Congress leader indirectly supports Maoists. The party had appointed overground supporters of Maoist to the planning commission. It is the record of the Congress," he alleged.

Accusing the Congress of adopting "double standards", Javadekar alleged the party had backed overground supporters of Maoists.

"Their sympathy towards Maoist is not hidden. No decisive action was taken by the previous UPA government against Naxals. However, the action has been taken against Maoists since the last four years under Modi government and very soon the menace will be neutralised," he claimed.

"Chhattisgarh will be free from Maoist activities in the next three years. We are determined to finish the Maoist challenge in the next couple of years which is totally violent and undemocratic. Our policy is clear," the minister said.

Slamming Tharoor, Javadekar said the Congress leader had recently said Ram Mandir should not be built in Ramjanmabhoomi in Ayodhya because a mosque existed at that place.

"Tharoor has forgotten that Lord Ram was born in Ayodhya and his temple existed at the spot. A mosque was built after demolishing the temple.

"A public protest for Ram temple has been on from last 500 years. No BJP or Congress were there in the movement. It was a public protest. Now, the Supreme Court has fixed the dates of hearing (the Ayodhya title suit). We are hopeful that soon justice will be done and Ram Mandir will be built in Ramjanmabhoomi," he said.

When asked if Ram Mandir will be the BJP's agenda for Lok Sabha elections in 2019, Javdekar said, "Ram Mandir had never been an agenda of our politics or election but the temple should be built in Ramjanmabhoomi because people of the country want it. This is a national demand and sentiments of people are attached with it. This is a matter of faith of people and we never do politics over it."

Responding to a query on a row over a Supreme Court judgment allowing women of all age to visit Sabarimala shrine in Kerala, Javadekar said people reacted because orders were passed against public sentiments.

"Despite peaceful opposition by the devotees, the brutal treatment meted against them by the incumbent Communist government is severely criticised by the Bharatiya Janata Party," he added.

Rajiv Gandhi had dubbed opposition scorpion in 1984: Prakash Javadekar

BJP president Amit Shah, who has pledged his party’s support to devotees protesting the entry of women of all ages into Ayyappa temple, has expressed wish to offer prayers at the hill shrine in Sabarimala during the annual pilgrim season starting on November 17, a party leader said Monday. “The BJP president has expressed a desire to visit the Sabarimala temple. But no decision has been taken so far,” a senior Kerala unit BJP leader told PTI in Thiruvananthapuram.

Shah’s wish to trek the hills comes days after he declared BJP’s full support to the agitation by the devotees against CPI(M)-led Left Democratic Front government’s decision to implement the Supreme Court order lifting the ban on entry of women in 10-50 age group from offering prayers at the shrine.

In a scathing criticism of Chief Minister Pinarayi Vijayan for taking action against Sabarimala protesters, Shah last week claimed an “Emergency-like” situation was prevailing in the state and accused the government of “playing with fire”. If the state government does not stop hurting the devotees, BJP workers would be forced to bring it down, Shah said, drawing a strong reaction from Vijayan, who termed the BJP president’s warning an “attack” on the Supreme Court, Constitution and the country’s judicial system.

Police have arrested over 3,500 people till Sunday in connection with the protests that rocked the state earlier this month. A large number of frenzied devotees staying put at the temple complex and base camps had prevented at least a dozen women of menstrual age from entering the temple when it opened for monthly pujas between October 17 and 22.

Protests were also held in several other parts of Kerala by the devotees, who included a large number of women, seeking to protect the tradition of the shrine whose deity, Lord Ayyappa, is celibate. Intensifying the agitation, the BJP-led NDA Sunday announced a six-day ‘Rath Yatra’ from Kasaragod to Sabarimala from November 8 to save the customs and traditions of the famous temple.

Various other agitation programmes, including a fast in front of the state DGP’s office Thiruvananthapuram, had also been planned. The BJP is apparently seeing the Sabarimala issue as an opportunity to widen its support base in the southern state.

The party has so far failed to make a strong presence in the bi-polar polity in the state, dominated by the LDF and the opposition Congress-headed United Democratic Front (UDF). In 2016 assembly polls, the BJP had scripted history by winning the Nemom seat and garnered 14.65 per cent votes.

US President Donald Trump is unlikely to accept India's invitation to be the chief guest at the Republic Day celebrations, sources said Sunday.

The US is understood to have conveyed to New Delhi that Trump may not be able to honour the invitation as he will have pressing engagements, including his State of The Union (SOTU) address, around the time India will celebrate its Republic Day.

This comes at a time when Indo-US ties have witnessed some strain after India went ahead and sealed a deal with Russia to procure a batch of S-400 air defence missile systems, notwithstanding US threat of punitive action under CAATSA (Countering America's Adversaries Through Sanctions Act).

The sources said India has already shortlisted names of two-three heads of states for extending invitation to be chief guest at the Republic Day parade.

Earlier this year, the US announced sanctions against Russia under CAATSA for its alleged meddling in the American presidential election in 2016.

Under CAATSA, the US can punish entities and governments engaged in a transaction with the defence or intelligence establishment of Russia.

India and the US were in touch with each other over New Delhi's invite to Trump to visit the country.

The sources indicated that India was not exclusively looking at Trump's presence at the Republic Day celebrations and that various other options were also being explored.

In July, White House Press Secretary Sarah Sanders said that Trump has received an invitation to visit India, but no decision has been taken yet.

"I know that the invitation has been extended, but I do not believe that a final decision has been made," Sanders had told reporters.

Prime Minister Narendra Modi had invited President Trump for a bilateral visit to India during their talks in Washington in June 2017.

In 2015, the then US president Barack Obama had attended it as the chief guest which was his second visit to India as American president.

Trump unlikely to accept India's Republic Day invite: Sources

Senior Congress leader and MP, Adhir Ranjan Chowdhury Monday questioned the TMC leadership for keeping mum on the Rafale deal and said there is no difference in the functioning of CBI and the CID in West Bengal under BJP and TMC regimes respectively. Chowdhury, who is the former West Bengal PCC president, questioned TMC’s silence on the Rafale deal even as several opposition parties have spoken out against it.

Congress chief Rahul Gandhi stepping up offensive against the government for forcing the CBI director to go on leave had dubbed the action as “illegal” and a “panic reaction” to cover up Rafale deal evidence “The functioning of CBI under the BJP regime at the Centre and the CID in the state under the TMC have no difference. Both the agencies are being used by the ruling parties respectively to serve their own political purposes,” Chowdhury said.

He said, “When opposition parties have spoken out against the Rafale scam, TMC has maintained a silence on this issue. Why are they (TMC) not speaking out against the scam? Why isn’t TMC and its supremo Mamata Banerjee attacking BJP and CBI in the same language as other opposition parties and the Congress? What is stopping them from doing so? Is it the fear of Narada and Saradha scam investigation ?”

Banerjee last week had alleged that the Central Bureau of Investigation (CBI) has become the BJP’s policing agency. “CBI has now become so-called BBI (BJP Bureau of Investigation) – very unfortunate!” Banerjee had tweeted. Her remarks came amid the ongoing spat between two top officers of the agency. Asked about Banerjee’s comment on CBI, Chowdhury said “Just one-liners won’t do, they (TMC) have to clear their stand. Is it the fear of Narada and Saradha scam investigation ?” Banerjee last week had alleged that the Central Bureau of Investigation (CBI) has become the BJP’s policing agency. The TMC leadership declined to give much importance to his comment and said the party “does not need any lessons from others”.

PM Narendra Modi’s CBI and Mamata Banerjee’s CID have no difference, says Adhir Ranjan Chowdhury

The Supreme Court Monday prohibited the plying of 15-year-old petrol and 10-year-old diesel vehicles in the national capital region and directed the transport departments concerned to announce that such vehicles would be impounded if found plying in Delhi-NCR.

Terming as "very critical" and "horrible" the prevailing pollution situation in Delhi-NCR region, the apex court directed that a list of 15-year-old petrol and 10-year-old diesel vehicles be published on the website of Central Pollution Control Board (CPCB) and transport department.

A bench of Justices Madan B Lokur, S Abdul Nazeer and Deepak Gupta said that advertisement on this should also be published in the newspapers.

The bench directed the CPCB to immediately create a social media account on which citizens could lodge their complaint directly about pollution on which appropriate action could be taken by the authorities concerned.

It permitted the court-mandated Environment Pollution Control Authority (EPCA) to take pre-emptive steps under the Graded Response Action Plan (GRAP) without strict adherence to pollution stages delineated in the plan.

GRAP is aimed at tackling air pollution in Delhi-NCR and adjoining areas and it is designed to take urgent remedial action when air quality deteriorates.

The apex court passed these directions on a note placed before it by advocate Aparajita Singh, assisting the court as an amicus curiae in the air pollution matter, seeking urgent directions to correct the prevailing situation of pollution.

Earlier, the National Green Tribunal had also banned the plying of 15-year-old petrol and 10-year-old diesel vehicles in the Delhi-NCR.

The apex court had earlier rejected a plea against the NGT's order banning plying of 15-year-old petrol and 10-year-old diesel vehicles on Delhi roads.

During the hearing on Monday, the bench referred to media reports that people should not go on morning walk due to the high levels of pollution.

"Have you gone to old Delhi railway station? Poor people there have to work to earn their livelihood. The kind of exertion they undergo is much more than those walking in the morning at Lodhi Gardens," the bench told Additional Solicitor General (ASG) A N S Nadkarni, appearing for the Centre.

"They are doing heavy duty manual work. You cannot tell them that you stop your work because it is unsafe for you to work in the morning. This is a very critical situation," the bench said, adding, "It is horrible".

The bench told Nadkarni that authorities would have to do their work properly and find out solutions to avoid such situation as prevailing in Delhi.

Nadkarni told the court that he supports the suggestion given by the amicus about creating a social media account so that citizens could lodge complaints about pollution.

The amicus referred to a note prepared by EPCA chairman which contained details and photographs of garbage burning in several parts of Delhi, including Bawana, Narela, Dwarka, Nangloi and Mundka.

The bench, after perusing the photographs, termed it as "terrible state of affairs" and asked the Delhi government and Delhi State Industrial and Infrastructure Development Corporation Ltd (DSIIDC) to file their affidavits in this regard within two days.

The court has posted the matter for hearing on November 1.

Singh told the bench that citizens in the national capital are facing health emergency due to pollution and currently the air quality was under "very poor" level.

She said that Badarpur power plant and coal-based power plants have been closed in Delhi and EPCA has given directions which are meant to deal with "severe" air quality level.

"The problem is always of implementation (of directions passed by the court). Implementation is at such a dismal pace. They (authorities) have got a good excuse in crop burning today. But in Delhi, people will continue to drive their luxury diesel vehicles. Farmers who are in distress are forced to buy farm equipment but people in Delhi will continue to maintain luxury," she added.

She further said that only farmers cannot be blamed for pollution due to crop burning as the Ministry of Earth Sciences has said that pollution load from transport was around 41 per cent.

She referred to the issue of garbage burning, including that of plastics, in several parts of Delhi and told the bench that every year, the same issue was raised before the court.

Singh said that social media account should be created on Facebook or Twitter so that people could lodge complaints about pollution.

"Mere talking is not enough. When pollution is a serious level, they (authorities) talk but after that, they go on sleeping," the amicus said, adding that the use of colour-coded stickers which would indicate the nature of fuel being used in the vehicles have not been implemented yet.

The counsel appearing for the transport department of Delhi government said no 15-year-old petrol and 10-year-old diesel vehicles should ply on roads and no fitness certificate was issued to such vehicles beyond this period.

The amicus told the bench that EPCA wanted liberty from the court to take pre-emptive steps under the GRAP without waiting for the time indicated in the plan.

The top court is seized of matters in which several issues related to air pollution in the Delhi-NCR have been raised.

About 98 per cent of children under the age of five years in low- and middle-income countries, which include nations like India, were exposed to air pollution caused by finer particulate matters in 2016, according to a World Health Organisation study released Monday. In the report, titled ‘Air Pollution and Child Health: Prescribing Clean Air’, deaths of about 600,000 children under 15 years of age in 2016 were attributed to the joint effects of ambient and household air pollution.

The report said household air pollution from cooking and ambient air pollution caused more than 50 per cent of acute lower respiratory infections in children under 5 years of age in low- and middle-income countries. The WHO report examines the heavy toll of both ambient (outside) and household air pollution on the health of the children across the world, particularly in low- and middle-income countries, like India.

“In low- and middle-income countries around the world, 98% of all children under 5 are exposed to PM2.5 levels above WHO air quality guidelines. In comparison, in high-income countries, 52% of children under 5 are exposed to levels above WHO air quality guidelines,” the study says.

“Globally, 93 per cent of the world’s children under 18 years of age are exposed to ambient fine particulate matter (PM2.5) levels above WHO air quality guidelines, which include the 630 million of children under 5 years of age, and 1.8 billion of children under 15 years,” the report said.

The PM2.5 (or particles with a diameter of fewer than 2.5 micrometres present in the air), also called “fine particulates”, can be a matter of more serious health concern than PM10 (those with a diameter of fewer than 10 micrometres). PM2.5 poses greater harm as being finer, it can easily be inhaled into the respiratory tract.

The PM2.5 has reached dangerous levels in New Delhi in the last two weeks. A thick blanket of haze engulfed the city Monday, and an overall Air Quality Index of 348 was recorded, which falls in the very poor category, according to data of the Central Pollution Control Board. Air pollution is one of the leading threats to child health, accounting for almost 1 in 10 deaths in children under five years of age, the report noted.

The WHO report cited a case study that investigated whether exposure to PM2.5 during pregnancy was associated with low birth weight in an integrated rural-urban, mother-child cohort in Tamil Nadu. “The researchers recruited 1285 women in the first trimester of pregnancy in primary health care centres and urban health posts and followed them until the birth of their child to collect data on maternal health, prenatal care, exposure to air pollution during pregnancy and the birthweight of the child,” the study said.

They found that a 10 µg/m3 increase in exposure to PM2.5 during pregnancy was associated with a decrease in birth weight of 4 g and a 2 per cent increase in the prevalence of low birth weight. “This study provided some of the first quantitative estimates of the effects of exposure to PM2.5 in India to birth weight. It contributed evidence of this association that is relevant for high-exposure settings in LMICs that experience the dual health burdens of ambient air pollution and household air pollution,” it said.

The findings indicate that maternal exposure to PM2.5 should be considered with other risk factors for low birth weight in India. The study also provided baseline information for a new multi-country HAP intervention trial underway in Guatemala, India, Peru and Rwanda on the effects of clean fuel (in this case, LPG) use on maternal and child health The report quoted a case-control study in India which showed a correlation between exposure to HAP from solid fuel combustion and the risk of contracting TB in children less than 5 years of age.

“The evidence suggests a positive association between exposure to air pollution and TB infection in children, although further research is needed,” the report said.

Hitting out at the Congress President, BJP spokesperson Sambit Patra asked Rahul Gandhi about his "gotra" on Monday.

While addressing an election rally in the poll-bound state Madhya Pradesh, Patra said, "If Rahul wears a "janeu", what type of "janeu" does he wear, what is his "gotra"?

Patra's comment came in the wake of the ongoing temple visits undertaken by Rahul Gandhi.

Congress President Rahul Gandhi offered prayers at Mahakaleshwar temple in Ujjain, Madhya Pradesh on Monday. The visit was also accompanied by Congress leader Kamal Nath and Jyotiraditya Scindia.

Calling his temple visit an election gimmick to woo Hindu votes, the Bhartiya Janata Party has often criticised Gandhi.

Rahul Gandhi had invoked Lord Shiva while responding to the BJP's criticism of his visits during the Gujarat assembly elections last year.

"Main Shiv ka bhakt hoon, sachaai mein believe karta hoon. BJP jo bhi bole main apni sachaai mein believe karta hu (I am a devotee of Shiv. The BJP may say anything, but I will remain honest.)," Gandhi had retorted.

BJP jo bhi bole main apni sachaai mein believe karta hu (I am a devotee of Shiv. The BJP may say anything, but I will remain honest.)," Gandhi had retorted. After labelling them as betrayers, the AIADMK has extended an olive branch to its 18 disqualified MLAs, asking them to jump on to the ruling party bandwagon and flayed AMMK leader T T V Dhinakaran for "misleading" them.

Asking the debarred MLAs and other Dhinakaran loyalists who moved away from AIADMK to revert to the parent party, the top leadership Saturday asked them to "understand the reality" of the Madras High Court judgement that upheld their disqualification.

The court's fair judgement has enthused party workers and the people of Tamil Nadu, the party said.

People were confident that the AIADMK government would continue to roll out welfare measures and "the angel of justice has paved a path for us to work together (again)" to meet the aspirations of the people, it said.

"We invite you with love and affection to again join the massive people's movement nurtured by Puratchi Thalaivar MGR and Puratchi Thalaivi Amma," party coordinator and co-ordinator O Panneerselvam and K Palaniswami respectively said.

In an open letter to cadres, the top duo, refraining from naming Dhinakaran or his loyalists, including the 18 debarred MLAs, said party functionaries had chosen to travel in an "alternative path as a result of being misled and due to some bitterness."

Seeking to assuage feathers ruffled by the legal wrangle, the Chief Minister and his deputy quoted a Tamil proverb which says love does not erode, despite quarrels or fights and added that all of them were "children of one mother, bonded by brotherhood and love."

When party workers ignored differences and worked together, the AIADMK would grow manifold and vanquish its political rivals, they said.

Both the party and the power of governance were only tools to serve the people and "none of us have a thought of working for posts. Our only goal is to serve the people. Since the court ruling helps us achieve our goal, we welcome and celebrate it."

Palaniswami, speaking to reporters at Coimbatore earlier on Saturday had said that (without naming the disqualified MLAs) 'betrayers' and 'enemies' had been given a befitting lesson by the Madras High Court.

A key Dhinakaran loyalist and one of the disqualified MLAs, P Vetrivel, ruled out considering going back to the ruling camp.

He told PTI that they would retrieve the AIADMK by going to the people and facing the polls.

The Supreme Court is likely to hear Monday a batch of pleas challenging the Allahabad High Court's 2010 verdict by which the disputed land on the Ram Janmabhoomi-Babri Masjid area in Ayodhya was divided into three parts.

A bench of Chief Justice Ranjan Gogoi and justices Sanjay Kishan Kaul and KM Joseph would hear the appeals filed in the matter.

On 27 September, the apex court had declined to refer to a five-judge constitution bench the issue of reconsideration of the observations in its 1994 judgment that a mosque was not integral to Islam which had arisen during the hearing of the Ayodhya land dispute.

In a majority verdict of 2:1, a three-judge bench headed by then chief justice Dipak Misra had said the civil suit has to be decided on the basis of evidence and the previous verdict has no relevance to this issue.

Justice Ashok Bhushan, who had penned the judgment for himself and the Chief Justice of India, had said it has to find out the context in which the five-judge bench had delivered the 1994 verdict.

However, Justice S Abdul Nazeer had disagreed with the two judges and had said whether a mosque is integral to Islam has to be decided considering religious belief which requires detailed consideration.

The court had on 27 September said the civil suit on land dispute would be heard by a three-judge bench on 29 October.

The issue of whether a mosque is integral to Islam had cropped up when the three-judge bench was hearing the appeals filed against the Allahabad High Court's verdict.

The three-judge high court bench, in a 2:1 majority ruling, had ordered that the 2.77 acres of land be partitioned equally among three parties - the Sunni Waqf Board, the Nirmohi Akhara and Ram Lalla.

Aam Aadmi Party national convenor Arvind Kejriwal on Sunday targeted Prime Minister Narendra Modi over alleged corruption in the multi-crore Rafale jet deal with France, saying he should not fear a CBI probe if he is honest.

Referring to the Union government’s mid-night decision to send CBI chief Alok Verma on indefinite leave last week, Kejriwal claimed Verma was “suspended” as Modi feared he was to register an FIR in connection with the deal and launch an investigation.

“It is a Rs 36,000-crore fighter aircraft scam. An honest CBI chief was removed at 3 am as he wanted to lodge FIR against the prime minister the next morning. The prime minister should not be afraid of a CBI probe, if he is honest,” Kejriwal said at a public meeting in Jaipur in poll-bound Rajasthan.

His supporters chanted that Modi is a “thief”. Verma was sent on leave after a feud erupted between him and his deputy, Special Director Rakesh Asthana, with the government saying the decision was taken to protect institutional integrity of the agency.

The government has also repeatedly denied allegations of corruption in the Rafale deal.
Referring to himself, Kejriwal said the people of New Delhi can proudly say that their chief minister is honest. Can they say the prime minister is “honest”, he asked the crowd.

“The CBI conducted the raid at my residence. I cooperated with the sleuths, offered them tea and sweets. All they found were four mufflers. People of the New Delhi can proudly say their chief minister is honest,” he said.

Kejriwal asked the people whether they have got the quality education, better healthcare, free water and cheaper electricity under the rule of the BJP or the Congress, whom they have voted to power in Rajasthan alternately in recent elections.

Making a case for his AAP, he suggested to the people that they should vote for the party, like the people of Delhi have done, and dislodge both BJP and Congress from governance in Rajasthan.

“We do not vote to make any party win but to defeat the other. BJP and Congress had done a setting in New Delhi to loot people but the people through both the national parties out of power and it can happen in Rajasthan as well,” Kejriwal said.

He claimed the AAP government in Delhi has done what the two national parties could not do in 70 years. The success rate of Delhi government-run schools was 10 per cent better than private schools, people get free medicines, treatment, water under government schemes and cheaper electricity, he said.

Talking about farm distress, he criticised Centre’s crop loan insurance scheme, saying it was meant to benefit insurance firms and not farmers. “Crop insurance scheme is a scheme to loot farmers. Premium amount is directly deducted from their bank accounts, and when it comes to raising claims farmers have to run from pillar to post,” he alleged, seeking an end to the central government scheme.

The party, which will be contesting the assembly election, scheduled on December 7, for the first time in the state, on Sunday also released its draft manifesto and sought suggestions from people.

Kejriwal said people decide the fate of democracy and AAP would work for the betterment of all sections of society.

The Centre has justified before the Supreme Court the amendments brought in the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act to overcome the controversial apex court’s order diluting the provision of arrest under the law.

The government also said Parliament has the power to bring such amendment.

Parliament had on August 9 passed the bill to overturn the apex court’s March 20 order concerning safeguards against arrest under the SC/ST Act.

The Supreme Court had passed a slew of directions and said a public servant could be arrested in cases lodged under the SC/ST Act only after prior approval by the competent authority.

The amendments rule out any provision for anticipatory bail for a person accused of atrocities against SC/STs, notwithstanding any court order.

In its affidavit filed in the top court, the Centre said it would be “incorrect” to assume that high acquittal rates in cases under the act were due to false cases and there was misuse of the law.

The government referred to statistics and said there was no decrease in the atrocities committed on the members of the Scheduled Castes and Scheduled Tribes communities.

The affidavit was filed in pursuance to the court’s direction asking the Centre to respond on a batch of petitions challenging the new amendments in the SC/ST Act.

“It is incorrect to assume that high rate of acquittal under the SC/ST Act is largely on account of false cases and misuse of provisions of the act,” the government said in its affidavit.

Giving the number of cases lodged under the act, the Centre said in 2014, 47,124 cases were registered under the SC/ST Act followed by 44,839 and 47,338 cases in 2015 and 2016 respectively.

It said the rate of conviction was 28.8 per cent in the year 2014, 25.8 per cent in 2015 and 24.9 per cent in 2016.

Referring to the factors which led to acquittal in cases registered under the act, the government said delay in lodging of the FIRs, lack of corroborative evidence and witnesses turning hostile were some of the reasons behind it.

“Therefore, it is misconceived and misleading to suggest that acquittals singularly take place owing to either false cases or that the provisions of the SC/ST Act are being misused,” the affidavit said.

It said amendments to the act were made following the apex court order diluting the provision of arrest and it was based on “well reasoned objective” to strengthen the statutory framework to give protection to the members of SC and ST communities.

The amendments provide that no preliminary inquiry would be required for registering a criminal case and an arrest under this law would not be subject to any approval.

The apex court is seized of a batch of pleas which has alleged the two Houses of Parliament had “arbitrarily” decided to amend the law and restored the previous provisions in such a manner so that an innocent cannot avail the right of anticipatory bail.

The court is scheduled to hear the matter next month.

The BJP on October 28 hit out at Congress leader Shashi Tharoor over his remarks on Prime Minister Narendra Modi and Shiv Linga, asking Congress chief Rahul Gandhi whether he supports his party leader's comments. The party, seeking a response from Gandhi, said he should apologise to Hindus, if he does not support the statements made by his party MP Tharoor.

The BJP's reaction came a day after Tharoor reportedly claimed an unnamed RSS source had told a journalist that Prime Minister Modi was like a scorpion sitting on a Shiv Linga who cannot be removed by hand or hit with a chappal (slipper).

"The Congress claims to represent the heritage of Mahatma Gandhi, Jawaharlal Nehru and Indira Gandhi. Today, under the presidentship of Rahul Gandhi it has been reduced to hurling abuses and the worst form of civil discourse," BJP leader and Union minister Ravi Shankar Prasad said here.

He said while he would not like to comment on Tharoor's remarks "against whom a charge sheet has been filed in a murder case", but he would like to know where Rahul Gandhi, who claims to be a Shiv Bhakt, stands on the issue.
