A Delhi court on Monday fixed February 22 for hearing a pre-summoning argument in the defamation complaint filed against 'The Caravan'&nbsp;and Congress'&nbsp;Jairam Ramesh.

The complaint was filed by National Security Advisor (NSA) Ajit Doval`s son Vivek Doval against the magazine for allegedly publishing a defamatory article and Jairam Ramesh for using content from the article.

Earlier in the day, Vivek`s business partner Amit Sharma had recorded his statement before the court.

In his statement, Sharma said, "I know Vivek Doval (complainant) since 2004 when we both were semiconductor analyst at different banks. I was at Deutsche Bank and Vivek was at Bear Stearn Bank. Since then we became friends and had been in regular contact."

"Later, Vivek and I discussed stock ideas very regularly and got along very well over the course of the next several years," he noted."In 2012, when Boyer Allen shut down. Vivek was looking for what to do next.&nbsp;This is when we came up with the idea of the launching of a fund together," Sharma said.

This development came to light after Vivek on January 30 recorded his statement before the same court.

Vivek asserted that all charges made against him were “baseless and false” and references were made in “a demeaning manner” without trying to “ascertain the facts.”He had recorded his statement before Additional Chief Metropolitan Magistrate Samar Vishal.

“I was livid after reading the article published about me in a magazine and the manner in which the events were narrated. My family was referred to as D-Companies whereas we all know that in our country the D-Company refers to Dawood Ibrahim, a known criminal, who figures in the most wanted list,” he told the court.

“Questions were also raised on the integrity of my family, especially my father who has dedicated his life to the service of the nation and fighting against Dawood,” Vivek further said.

Vivek, who obtained CFA from the US in 2006 and did CAIA from CAIA institute in 2010, said: “Allegations were levied about money laundering and converting the black money into white, without there being any basis.”It was written that Rs 8,300 crore of black money has been round tripped to India thereby tarnishing my career and my venture GNY Asia Fund,” he stated.

Calling himself a proud Overseas Citizen of India (OCI) and citizen of the UK, Doval also asserted that “the article branded him and his family as anti-national.”

Stating that Jairam Ramesh, a former Union Minister, had used the platform of the Indian National Congress (INC) to propagate these charges, he said: “There were many derogatory comments spoken which raised numerous questions on the integrity of my family.”

“Unpleasantness was bestowed upon me and my family based on falsehood and mala-fide. Without trying to ascertain facts, references were made in a demeaning manner,” he said.

He also claimed that the repercussions of the article and press conference questioned his professional integrity, which is of critical importance for his career.“It has questioned my social standing as a fund manager. If I have dubious integrity, my career is over as a Fund manager.”

On January 21, Vivek had filed a criminal defamation case against Congress leader Jairam Ramesh and two journalists, contending that they had caused “irreparable damage” to his reputation “through calculated insinuations and innuendos.”

Vivek has contended that Ramesh and the two journalists “have committed the offence of defamation punishable under Section 500 of IPC (which provides for simple imprisonment for a term which may extend to two years, or with fine, or with both) read with Section 120-B IPC (criminal conspiracy).&nbsp;

Nagaland government will file an affidavit explaining the delay in appointment of Lokayukta till next hearing while the Tamil Nadu Government was directed to complete the process of Lokayukta appointment within four months.

Chief Justice of India (CJI) Ranjan Gogoi said, "We want to be harsh but are refraining from saying anything at this stage."The petition was filed by advocate and BJP leader, Ashwini Upadhyay, seeking a direction to expeditiously appoint Lokpal at the Centre, Lokayukta in states and provide a citizen charter in every department to ensure time-bound delivery of goods and services.

As per provisions of the Lokpal and Lokayuktas Act, 2013, a Lokpal as anti-corruption authority or ombudsman would be set up at the Central level, while a Lokayukta will be set up in each state.

In July last year, the Supreme Court had expressed its displeasure over non-appointment of Lokpal by the central government.

In September, the Prime Minister Narendra Modi-led Central government had appointed a Search Committee to nominate the chairperson and members of the Lokpal.&nbsp;

Supreme Court judge Justice Ranjana Prakash Desai was nominated as chairperson of the committee.

Earlier this month, the Supreme Court asked the Lokpal Search Committee to complete its task of short-listing names for a Lokpal by February-end and submit the list for consideration to the Selection Committee. The apex court will hear the plea on March 7.

<a href="http://13.232.42.114/india-news/truth-will-always-prevail-robert-vadra-196349">Robert Vadra</a>, Congress President Rahul Gandhi's brother-in-law, is expected to make a fresh appearance before the Enforcement Directorate on Tuesday in Jaipur in connection with a probe into an alleged land scam in the Rajasthan's border town of Bikaner, officials said Monday.

Vadra's mother Maureen is also likely to appear before the<a href="http://13.232.42.114/india-news/robert-vadra-appears-before-ed-for-third-time-in-money-laundering-case-probe-196168"> central probe agency</a> at about 10 AM at its zonal office on Bhawani Singh Road in Jaipur Tuesday.

The duo landed at Jaipur airport on Monday noon.

This will be the fourth time that Vadra appears before the agency.&nbsp;

On last three occasions,<a href="http://13.232.42.114/india-news/robert-vadra-questioned-for-8-hours-on-third-day-of-appearance-before-ed-196278"> he appeared before the ED</a> in Delhi in connection with a money laundering probe against him for his alleged role in procuring assets abroad in an alleged illegal manner.

The Tuesday's appearance before the ED in Jaipur is directed by the Rajasthan High Court which asked Vadra and his mother to cooperate with the agency after they approached it seeking directions that no coercive action is taken against them by the agency.

Officials said the investigating officer (IO) of the case will record the statement of Vadra and his mother under the Prevention of Money Laundering Act (PMLA).

The agency has grilled Vadra for about 24 hours over three sessions last week in the national capital.

In the Bikaner case, the agency had summoned<a href="http://13.232.42.114/india-news/robert-vadra-questioning-bjp-lists-nine-emails-regarding-london-properties-195837"> Vadra </a>thrice but he failed to appear and later approached the court.

The ED had registered a criminal case in connection with the deal in 2015, taking cognisance of a clutch of FIRs and charge sheets filed by the Rajasthan police after the tehsildar of Bikaner complained about alleged forgery in the allotment of land in the area, considered sensitive due to its proximity to the Indo-Pak border.

The ED, it is understood, wants to question Vadra about the operations of a firm — Ms Skylight Hospitality Private Limited — allegedly linked to him, which had purchased land in the area. It also wants to confront Vadra with the statements of those said to be linked to him.

The agency was also probing the role of a big steel firm that gave loans to a company that bought the land from firms linked to Vadra at a very inflated price, official sources said.

The agency, in the past, had also raided the premises of people linked to Vadra, like Mahesh Nagar and a few others.

In December 2017, the ED had arrested Ashok Kumar, a close associate of Nagar, and another person, Jaiprakash Bagarwa.

Nagar is said to be associated with Ms Skylight Hospitality Private Limited, the firm with alleged links to Vadra.

The ED had searched the premises of both Kumar and Nagar in April 2017.

Nagar was the "authorised representative" in four cases of land purchase in Bikaner.

Kumar, the agency alleged, had purchased land in the same area, using the "power of attorney" of others.

The ED probe in the case is related to the purchase of land measuring 275 bigha&nbsp;allegedly by the company in Bikaner's Kolayat area a few years ago.
The agency has also attached assets worth Rs 1.18 crore of government officials and others in connection with the case under the provisions of the PMLA.

The ED, in the past, had also issued notices to the firm and obtained certain documents from it.

The agency, however, has not mentioned Vadra's name in its FIR filed under the PMLA. The FIR names some Rajasthan government officials and the "land mafia".

Vadra had earlier denied any wrongdoing in connection with the land deal and the Congress had claimed that the case was a result of "sheer political vendetta".

The Rajasthan government had, in January 2015, cancelled the mutations (transfer of land) of 374.44 hectares of land, after the land department claimed to have found that the allotments were made in the names of "illegal private persons".

The tehsildar had said in his complaint that the government land in 34 villages of Bikaner, to be used for expanding the Army's firing range in the area, was "grabbed" by the land mafia with the help of "forged and fabricated documents", in connivance with government officials.

The ED suspects that a huge amount of money was laundered in the case as people bought land at cheap rates through forged documents.

The state government had while cancelling the mutations, said those were not issued by the Commissioner, Colonisation, Bikaner.

Gujjar community members <a href="http://www.wionews.com/india-news/rajasthan-dm-issues-notice-to-gujjar-leader-for-not-following-high-court-guidelines-196528">blocked National Highway-11,</a> which connects Jaipur with Agra, in Rajasthan’s Dausa district on Monday, the fourth day of their agitation demanding 5 per cent reservation in government jobs and educational institutes.&nbsp;

Their protest had turned violent on Sunday when shots were fired and police vehicles were torched in Dholpur district, forcing authorities to impose prohibitory orders under CrPc section 144 in Dholpur and Karauli districts.&nbsp;

It still remains in force in the areas. On Monday, the agitators blocked NH-11 and continued their blockade from previous days at other places. Since the agitation began on Friday, it has affected the movement of more than 250 trains.

“NH-11 was blocked at Sikandara in Dausa. A state highway was blocked in Bundi district’s Nainwa on Sunday and Malarna road in Sawai Madhopur and Karauli-Hindaun road at Budla village in Karauli have also been blocked,” DGP, Law and Order, M L Lathar said. Dausa SP Prahlad Singh said vehicles heading towards the blockade area on the national highway were diverted to alternate routes.

“The traffic is being diverted and things are under control. The blockade is peaceful,” the SP said. He said efforts were being made to clear the blockade. As of now, one national highway, one state highway and two arterial roads and Delhi-Mumbai railway tracks are blocked in Rajasthan, leading to cancellation and diversion of several trains. The North Western Railway said in a bulletin four trains had to be diverted on Monday.

The trains are: Hazrat Nizamuddin-Udaipur (12963), Amritsar-Mumbai Central (12904), Firozpur-Mumbai Central (19024) and Dehradun-Kochiveli (22660). Gujjar agitation leader Kirori Singh Bainsla and his supporters began their sit-in on railway tracks in Malarna Dungar of Swai Madhopur on Friday. Bainsla is demanding 5 per cent quota for Gujjar, Raika-Rebari, Gadia Luhar, Banjara and Gadaria communities in jobs and education and has refused to clear the railway tracks.

“We will not move from the tracks if the announcement is not made. There is only one demand and that is 5 per cent reservation,” Bainsla’s son Vijay Singh said. A state government delegation, including Tourism Minister Vishvendra Singh and IAS officer Neeraj K Pawan, held talks with the protestors on Saturday but they refused to end their agitation until their demand is met through an official announcement.

Pitching for "purity" in poll funding, BJP president Amit Shah on Monday said the party must run with contributions from its workers and not on donations of "money bags, builders, contractors and those with black money".

Addressing a party event to mark the 51st death anniversary of its ideological guide Deen Dayal Upadhyay, Shah said the BJP should take up the responsibility of guiding other parties on the path of probity. Two workers from each booth in the country should contribute Rs 1,000 through the NaMo app, he said.

"BJP workers should say with pride that we run this party from our money and no industrialist, contractor, money bag or builder can run it," Shah said.

He, however, added that as party president he cannot say the BJP can fund all its organisational and election expenses from its workers' contributions. "This is not possible today," he said.

"If means are not pure, then our goals cannot be attained in a good way. If the party has to be kept pure... If the party starts running from the money of money bags, builders, contractors, those with black money, then it will malign our means to realise our goals," he said.

There should be a public discussion on how election expenses can be brought down and how to bring probity in poll funding, he said, expressing confidence that such an exercise will begin under the BJP's leadership.

The Modi government, he asserted, has taken steps to clamp down on the influence of black money in politics by limiting cash donations to Rs 2,000.

Laws against corruption have been made so stringent that those breaking it will be caught and that those who were involved in scams are sweating even in this Delhi winter, he said.

Fugitive businessmen Vijay Mallya and Nirav Modi had escaped the country because the Modi government started putting accused like them behind bars, he claimed.

Expressing support for Andhra Pradesh Chief Minister Chandrababu Naidu's daylong fast, Congress chief Rahul Gandhi on Monday alleged that Prime Minister Narendra Modi had stolen from the people of the state and given the money to industrialist Anil Ambani.

The TDP president is on a fast in Delhi demanding that the Centre fulfil all promises made during Andhra Pradesh's bifurcation in 2014 and alleging that the <a href="http://www.wionews.com/india-news/modi-did-not-follow-raj-dharma-in-andhra-pradeshs-case-chandrababu-naidu-196539">prime minister was not following 'raj dharma'</a> by denying the state special status.

"The prime minister has stolen from the people from Andhra Pradesh and he has given that money to Anil Ambani. That is the fact of the matter," Gandhi said at the venue of the hunger strike in Andhra Bhavan.

The government and Ambani have rejected Gandhi's allegations of corruption in the Rafale fighter jet deal with France.

"Mr Narendra Modi, wherever he goes, he goes to Andhra Pradesh, he lies about special status. He goes to the North-East, he tells another lie over there. He goes to Maharashtra and he tells another lie over there. He has absolutely got no credibility left," Gandhi said.&nbsp;

Vadra has denied the allegations of possessing illegal foreign assets and termed them a political witch hunt against him. He said he was being "hounded and harassed" to subserve political ends. He is also expected to depose before the ED on February 12 in Jaipur in an another money-laundering case related to an alleged land scam in Bikaner. The Rajasthan High Court has directed him to cooperate with the agency in the case.

Truth will always prevail, says Robert Vadra

The strategic Jammu-Srinagar national highway, the only all weather road linking Kashmir with rest of the country, remained closed for the fifth consecutive day on Sunday as fresh landslides at different places hit the restoration work, officials said.

However, they said efforts are on and a decision to allow traffic on the highway would be taken later in the day after reviewing the progress of the ongoing debris clearance operation.

The highway was closed for traffic on Wednesday following heavy snowfall and incessant rains which triggered avalanches and landslides at various places especially between Qazigund-Banihal-Ramban stretch including Jawahar Tunnel - the gateway to Kashmir valley.

"Over a dozen landslides were cleared despite frosty conditions and intermittent shooting of stones from the hillocks on Saturday but fresh landslides had occurred at Kela Morh, Battery cheshma, Digdole, Panthiyal and Khuni Nallah overnight leaving the road once again blocked," Ramban Deputy Superintendent of police, Traffic, Suresh Sharma told PTI.

He said the continuous shooting of stones at Panthiyal and frosty condition of the road in the snow-bound areas are posing a major challenge to the agencies involved in the clearance operation.

"The men and machinery are on the job and if the hills get stabilised and there will be no fresh landslide, the road stretch from Ramban to Banihal will be cleared for the traffic by late afternoon," he said.

Sharma, who inspected some of the landslide hit areas, said the snow clearance operation is almost complete including at Jawahar Tunnel where an avalanche had also struck on Thursday, blocking one of the tunnels on Qazigund side besides killing eight persons including six police and fire and emergency services personnel.

In view of the closure of the highway, the Indian Air Force (IAF) launched special sorties of C17 Globemaster, airlifting 538 persons including 319 GATE aspirants between Jammu and Srinagar on Friday and Saturday.

"A total of 319 students appearing in Graduate Aptitude Test in Engineering (GATE) on February 10 onwards were airlifted from Srinagar airport to Jammu airport on Friday and Saturday," a defence spokesman said.

He said while 179 students were airlifted from Srinagar to Jammu, 180 civilians struck in Jammu were airlifted to Srinagar on Friday.

Similarly, he said 179 persons comprising of 140 students and 39 locals and tourists were airlifted to Srinagar to Jammu on Saturday.

Meanwhile, the minimum temperature across the Jammu division marked an appreciable increase due to overcast conditions, though some snow-bound parts of the region continue to reel under sub-zero temperature.

The night temperature in Jammu city marked an increase of over three notches to settle at 7.1 degrees Celsius, three notches below normal, against the previous night's 4.0 degrees Celsius, a spokesman of the MeT department said.

The highway town of Banihal and Batote recorded a low of minus 1.0 and minus 0.6 degrees Celsius, respectively, while Bhaderwah town in Doda district was reeling under minus 1.8 degrees Celsius.

Katra town, the base camp for the pilgrims visiting the famous Vaishno Devi Shrine in Reasi district, recorded a minimum of 6.5 degrees Celsius, the spokesman said.

On Saturday, a section of the Gujjar community erected tents on railway tracks, a day after staging a `rasta-roko` dharna on tracks in Rajasthan`s Sawai Madhopur district.

In an appeal to the community, Rajasthan Chief Minister Ashok Gehlot has asked them not to sit on rail tracks and said they should instead submit a memorandum to Prime Minister Narendra Modi.

The Rajasthan government had on October 26 last year passed a bill which increased Other Backward Classes (OBCs) quota from 21 per cent to 26 per cent.&nbsp;

In December 2018, the state government had also approved one per cent reservation for Gujjar and four OBCs. At present, these communities are getting one per cent separate reservation under the legal limit of 50 per cent quota meant for the most-backward category in addition to OBC reservation.&nbsp;

Chit fund scams: Kolkata police chief grilled for 11 hours in second round of questioning

Issuing a threat to the BJP, one of its allies in Uttar Pradesh, Suheldev Bharatiya Samaj Party, said Sunday it will part ways with the saffron party if the recommendations of the Social Justice Committee are not implemented by February 24.

"If the BJP does not agree to the demands raised by us, we will definitely part ways with them. If the saffron party does not implement the recommendations of the Social Justice Committee by February 24, then our path would be separate, and subsequently, we will contest all 80 Lok Sabha seats in the state," Arun Rajbhar, general secretary of SBSP, told.

"We can even go with the anti-BJP alliance (of SP and BSP) if the need arises. A number of rounds of talks have been held with them," he added.

Hitting out at the BJP, Arun Rajbhar said, "It is the last warning, and after February 24, there will be no agreement with the BJP."

He said the BJP had promised that the recommendations of the Social Justice Committee would be implemented six months before Lok Sabha polls, but there has been no headway on this.

The committee, constituted in May last year, had in its recommendations to the state government, favoured division of backward castes in three categories -- 'pichda' (backward), 'ati picchda' (very backward) and 'sarvadhik picchda' (most backward).

Backward classes account for about 44 per cent of the electorate in the state and play a crucial role in making or marring political prospects of any party.

The recommendation of the committee to classify various OBC and Dalit sub-castes into three broad categories and provide quota within quota to them is likely to spice up the political scene ahead of the 2019 Lok Sabha election in caste-riddled Uttar Pradesh.

In 2017 UP Assembly elections, BJP had bagged 312 out of 403 seats, while SBSP had won 4 seats. Another ally of the coalition, Apna Dal (Sonelal), had won nine seats.

The RBI had retained Rs 13,190 crore towards risks and reserves in 2016-17. It increased to Rs 14,190 crore in 2017-18. Together, the&nbsp;retained amount is Rs 27,380 crore.

The ministry has requested the RBI to provide an interim surplus for the current fiscal on the analogy of the previous financial year and transfer the amount withheld from the surplus of 2016-17 and 2017-18, sources said.

Earlier this month, Economic Affairs Secretary Subhash Chandra Garg had said the government expects Rs 28,000 crore from the RBI as interim dividend during the current fiscal.

The RBI, which follows July-June financial year, has already transferred Rs 40,000 crore in the current fiscal.

If the central board of the RBI approves the transfer of Rs 28,000 crore requested by the government as interim dividend for the current fiscal, the total surplus transfer by the central bank would be Rs 68,000 crore in 2018-19.

According to sources, the government expects Rs 69,000 crore dividend in the next financial year.

The government has projected to mobilise Rs 82,911.56 crore as dividend or surplus from the RBI, nationalised banks and financial institutions during 2019-20.

After making provision for bad and doubtful debts, depreciation in assets, contribution to staff and superannuation fund and for all matters for which the provision is to be made by or under the Act or which are usually provided by bankers, the balance of the profits shall be paid to the central government, as per the RBI Act.
