Tesla CEO Elon Musk has initiated a poll on the social media platform X, formerly known as Twitter, asking users whether the electric vehicle giant should invest USD 5 billion in his artificial intelligence startup, xAI. This bold proposition comes at a critical juncture for Tesla, which recently reported its lowest profit margin in five years due to aggressive price cuts and increased spending on AI projects.

The poll, launched by Musk, quickly gained traction with over 386,000 participants in just three hours, showing a strong 70% support for the proposed investment. However, Musk was quick to clarify that this poll is merely "to test the waters," emphasising that both board approval and a shareholder vote would be necessary for any such investment to materialise.

This potential move intersects with Tesla's ongoing efforts in autonomous driving and AI integration. During Tesla's recent earnings call, Musk highlighted potential synergies between xAI and Tesla, suggesting that xAI could be "helpful in advancing full self-driving and in building up the new Tesla data centre." He also hinted at the possibility of integrating xAI's chatbot, Grok, with Tesla's software ecosystem.

The timing of this poll is particularly noteworthy, coming on the heels of Tesla's challenging financial report. The company's decision to cut prices and increase AI-related expenditures has put pressure on its profit margins, raising questions about the wisdom of a substantial investment in an external AI venture at this time.

Musk's xAI, launched in 2023, positions itself as an alternative to ChatGPT and has already attracted significant investor interest. The startup recently raised USD 6 billion in a Series B funding round, achieving a post-money valuation of USD 24 billion. Prominent backers include Andreessen Horowitz and Sequoia Capital, underscoring the high expectations for xAI in the competitive AI landscape.

Adding another layer of complexity to this potential investment is Musk's previous statement about his plans for xAI ownership. He has indicated that a quarter of xAI would be owned by investors in X, the social media platform he acquired for USD 44 billion. This interconnected ownership structure raises questions about potential conflicts of interest and the allocation of resources across Musk's various ventures.

During the Tesla earnings call, Musk addressed concerns about resource diversion from Tesla to his other companies. He dismissed these worries, though a recent CNBC report claimed that Musk had redirected thousands of AI chips originally destined for Tesla to xAI and X, citing Tesla's data centre capacity constraints.

This is not the first time Musk has used X polls to gauge public opinion on major business decisions. In 2021, he famously polled users about selling 10% of his Tesla stake, a move that preceded actual share sales just days later. This pattern of decision-making through social media polls has drawn both praise for its transparency and criticism for potentially bypassing traditional corporate governance structures.

As the poll continues to gather responses, the tech and financial worlds are closely watching the outcome and its potential implications. The proposed USD 5 billion investment, if realised, would represent a significant shift in Tesla's strategy, potentially accelerating its AI capabilities but also raising questions about resource allocation and corporate focus.

China's BYD has substantially increased its lead over Tesla in Singapore's EV market during the first half of 2023, according to recent government data. This development underscores the mounting challenge faced by Tesla, the world's largest EV manufacturer by sales volume, from its rapidly expanding Chinese competitors.

BYD's impressive performance in Singapore, despite it being one of the region's smaller automotive markets, highlights the Chinese firm's ambitious strategy to dominate the Southeast Asian EV sector. This region has traditionally been a stronghold for Japanese and South Korean gasoline car brands, with Tesla yet to establish a significant presence.

The Chinese automaker's success in Singapore is part of a broader pattern of expansion across Southeast Asia. BYD has already claimed Thailand as its largest overseas market, leveraging distribution partnerships with local conglomerates to boost its presence. The company's aggressive growth stands in stark contrast to Tesla's recent challenges, with the American EV giant reporting its lowest profit margin in over five years and missing Wall Street earnings targets in the second quarter of 2023.

BYD's sales figures in Singapore are particularly striking. In the first half of 2023, the company sold 2,587 EVs, marking an 83% increase from its total 2023 sales. Meanwhile, Tesla managed to sell just 969 vehicles during the same period, a modest increase of 28 units compared to the previous year. This significant gap in sales performance indicates a shifting preference among Singaporean consumers and potentially foreshadows trends in the broader Southeast Asian market.

The Chinese automaker's success in Singapore can be attributed, in part, to its innovative marketing strategies. BYD has opened two themed restaurants in the city-state where customers can enjoy dishes inspired by its car models and book test drives, creating a unique and immersive brand experience.

It's worth noting that the price difference between BYD and Tesla models in Singapore is minimal, given the city-state's high vehicle taxes, including a certificate of entitlement that costs around S$100,000 ($74,000). This level playing field in terms of pricing suggests that BYD's success is driven by factors beyond mere cost competitiveness.

Singapore's push towards electrification, with plans to phase out the purchase of combustion-engine cars by 2030, has created a fertile ground for EV manufacturers. In the first half of 2023, EV sales accounted for approximately one-third of total vehicle sales in the city-state, indicating a rapid transition towards electric mobility.

BYD's strong performance in Singapore is mirrored by its broader success in Southeast Asia. While Tesla saw its market share in the region fall from 6% to 4% in the first quarter of 2023 compared to the previous year, the overall EV market grew by 37% during the same period, according to data from research firm Counterpoint. This trend suggests that BYD and other competitors are capitalising on the growing demand for EVs in the region more effectively than Tesla.

The Chinese automaker's expansion is not limited to Singapore and Thailand. This week, BYD opened its first stores in Vietnam, a market where Tesla has yet to commence vehicle sales. This move further underscores BYD's aggressive approach to capturing market share across Southeast Asia.

As the EV market continues to evolve rapidly, the competition between established players like Tesla and rising challengers like BYD is likely to intensify. The success of Chinese manufacturers in Southeast Asia could potentially reshape the global EV landscape, forcing traditional automakers and Tesla alike to reassess their strategies in this crucial and growing market.

BYD surges ahead of Tesla in Singapore's EV market

Tesla, the electric vehicle giant, is poised to report its second-quarter financial results on Tuesday, with analysts anticipating the company's automotive gross margin to hit its lowest point in over five years. This expected dip in profitability comes as Tesla navigates a challenging landscape of price cuts, inventory clearance, and increased competition in the electric vehicle market.

According to a poll of 20 analysts by Visible Alpha, Tesla's automotive gross margin, excluding regulatory credits, is projected to have slipped to 16.27% in the April-June period. This figure represents the lowest margin since the first quarter of 2019 and a significant decline from the 16.36% reported in the previous quarter and the 18.14% recorded in the same period last year.

The margin pressure stems from a combination of factors, including discounts to clear inventory, price cuts, and various incentives such as cheaper financing options offered to boost EV sales. These measures, while aimed at stimulating demand, have inevitably squeezed Tesla's profitability over the past two years. Additionally, sales have been impacted as customers have shown signs of fatigue with the company's ageing model lineup.

In response to these challenges, Tesla has already taken steps to streamline its operations, including a 10% reduction in its global workforce, as revealed in a memo in April. However, as the company grapples with these near-term hurdles, investors are increasingly focused on Tesla's strategic pivot towards self-driving technology and artificial intelligence (AI) products.

CEO Elon Musk is expected to use the earnings call as an opportunity to double down on the company's ambitious plans for robotaxis and AI ventures. These initiatives are seen as potential game-changers that could once again set Tesla apart from traditional automakers and reignite the kind of investor enthusiasm that propelled the company's stock to record highs in 2021.

Earlier this year, Musk had announced plans to unveil Tesla's robotaxi on August 8. However, he recently signalled that the automaker would need more time to incorporate design changes, following reports of a potential delay to October. This development has only heightened investor interest in understanding Tesla's roadmap for self-driving technology and its potential to transform the company's business model.

While some investors view Tesla's robotaxi ambitions as a significant opportunity with little competition in the U.S. market, others point to potential challenges. These include regulatory hurdles, technical complexities, and emerging competition, particularly in China, where companies like BYD and others are rapidly advancing their own driver-assistance systems.

Paul Marino, Chief Revenue Officer of GraniteShares, which offers funds related to Tesla's stock, commented on the situation, saying, "AI and robotaxi is such a huge opportunity over the next two, three, five years. So if you're a long-term believer, you're going to take the margins like your medicine."

Beyond the focus on AI and robotaxis, investors will also be keen to hear updates on Tesla's vehicle development strategy. In April, the company announced a shift towards introducing "new models" by early 2025 using existing car platforms and production lines, a departure from previous plans for entirely new model designs.

Despite the anticipated margin pressure, some analysts expect Tesla's profitability to bottom out by the end of this year and begin to recover in 2025. This optimism is partly based on the expectation that costs associated with the production ramp-up of the Cybertruck will ease over time.

In terms of deliveries, Tesla managed to surpass analyst expectations in the second quarter, although the numbers were still about 5% lower than the same period last year. To match its 2023 delivery record of 1.81 million vehicles, Tesla needs to deliver at least 977,815 vehicles in the second half of this year.

Gene Munster, managing partner at Deepwater Asset Management, offered his perspective on Tesla's delivery outlook: "I think deliveries will grow fractionally for full year 2024 and grow around 15% in calendar 2025. The most important part is that they talk about September deliveries returning to growth."

As Tesla prepares to release its Q2 results, the company finds itself at a critical juncture. While facing short-term margin pressures and delivery challenges, it is simultaneously pushing forward with potentially transformative initiatives in AI and autonomous driving. The upcoming earnings report and accompanying commentary from Elon Musk will be closely scrutinised by investors and industry observers alike, as they seek to gauge Tesla's ability to navigate these complex dynamics and maintain its position at the forefront of the evolving automotive and technology landscape.

Tesla's Q2 margins expected to hit five-year low

Tesla's CEO Elon Musk has announced a revised timeline for the production of the company's humanoid robots. According to Musk's recent statement on the social media platform X, Tesla aims to begin "low production" of these robots for internal use by next year, with high-volume production for external companies projected to commence in 2026.

This announcement marks a shift from Musk's earlier projections. In April, he had confidently stated that the Tesla robot, known as Optimus, would be operational in factories by the end of 2023 and potentially available for sale to the public by late 2025. The revised timeline suggests a more conservative approach to the development and deployment of this cutting-edge technology.

Tesla's foray into humanoid robotics is part of a broader trend in the tech and automotive industries. Companies like Honda and Hyundai's Boston Dynamics have been developing similar technologies for several years. The primary motivation behind these efforts is to address potential labour shortages and automate repetitive, dangerous, or tedious tasks in sectors such as logistics, warehousing, and manufacturing.

The first generation of Tesla's Optimus robot, nicknamed Bumblebee, was unveiled in September 2022. Earlier this year, the company released a video showcasing a second-generation prototype folding a T-shirt, demonstrating progress in the robot's dexterity and practical applications.

However, Musk's track record of meeting ambitious deadlines has been mixed. In 2019, he predicted that Tesla would have a network of autonomous "robotaxis" operational by 2020, a goal that has yet to materialise. More recently, Musk indicated that the unveiling of the robotaxi would be further delayed due to a significant design change to the vehicle's front.

This latest announcement about the Optimus robot comes at a time when Tesla is facing challenges in its core electric vehicle (EV) business. With EV demand showing signs of tapering and accounting for over 80% of Tesla's quarterly revenue, Musk has been increasingly emphasising the company's ventures into artificial intelligence, autonomous driving software, robotaxis, and humanoid robots.

The shift in focus reflects Tesla's strategy to diversify its product offerings and revenue streams. It also underscores the company's commitment to remaining at the forefront of technological innovation, even as it navigates a competitive and rapidly evolving market landscape.

As Tesla prepares to report its second-quarter results, analysts are anticipating margins to hit a five-year low. However, investor attention is likely to be divided between these financial metrics and Musk's ambitious plans for robotaxis and AI products.

The development of humanoid robots represents a significant technological challenge, requiring advancements in areas such as artificial intelligence, machine learning, and materials science. While the potential applications are vast, ranging from industrial settings to healthcare and home assistance, the path to widespread adoption remains uncertain.

Tesla CEO Elon Musk revises timeline for Humanoid robot production

The electric vehicle (EV) market in the United States experienced a notable uptick in May, with new EV registrations rising by 9.6 per cent. This growth can be largely attributed to attractive sales promotions and favourable lease deals offered by manufacturers. However, the landscape is not uniformly positive across all brands.

Tesla, while still maintaining its position as the dominant EV sales leader, has seen a decline in new vehicle registrations for the fourth consecutive month, according to data from S&P Global Mobility. This trend suggests a shifting dynamic within the EV market.

EVs from 31 different brands collectively captured 7.5 per cent of the U.S. light vehicle market in May, showing growth from 6.8 per cent in the same period last year. The total EV registrations for the month reached 104,916 vehicles. EV registrations outperformed the broader light-vehicle market, which experienced a slight decline of 0.7 per cent, totalling just under 1.4 million vehicles.

Despite maintaining its position as the EV market leader, Tesla's performance has shown signs of weakening. The company's May registrations fell by 15 per cent to 48,587 vehicles. Consequently, Tesla's share of the EV segment dropped from 60 per cent a year earlier to 46 per cent.

In contrast, several other manufacturers demonstrated strong growth. Kia saw a remarkable 146 per cent increase in registrations, Rivian grew by 87 per cent, Hyundai increased by 40 per cent, and Nissan also showed an 87 per cent year-over-year growth.

It's worth noting that registration data serves as a proxy for automaker delivery numbers, particularly useful for companies like Tesla that don't break out U.S. sales figures specifically. However, this data typically lags behind actual sales by several weeks.

A significant factor driving the overall increase in EV sales appears to be the generous incentives offered by manufacturers. May saw automakers introducing substantial sales incentives, including subsidised financing and attractive lease deals. Some models received discounts exceeding USD 15,000, according to data from Motor Intelligence.

For instance, the Kia EV6, a compact crossover, saw incentives reaching USD 16,812 in May. The Kia EV9 midsize crossover had even higher incentives at USD 18,078 per vehicle, while the Cadillac Lyriq offered USD 17,732 in incentives. Even Tesla, known for its limited discounting, offered incentives of USD 5,570 on its Model Y.

Rivian, a relatively new player in the market, provided USD 4,060 in incentives on its R1T pickup.

These incentive levels represent a significant increase from the previous year. For example, the Cadillac Lyriq's incentives in May 2023 were just USD 761 per vehicle, while the Tesla Model Y had USD 1,195 in incentives during the same period last year.

Despite the current growth, some industry analysts believe that EV sales may be approaching a plateau. Karl Brauer, executive analyst at iSeeCars, suggests that EV makers are facing a challenging situation where they must either offer attractive deals, reduce production or remain on the sidelines of the market. Brauer had previously predicted that EV market share would reach around 7 per cent before stalling, based on a study of U.S. consumer preferences.

The current market conditions seem to align with Brauer's prediction. With the EV market share at approximately 7.5 per cent, there are signs of market saturation, including inventory build-up at dealerships, production shift cancellations, and the introduction of substantial incentives. Brauer notes that while the growth from 2 per cent to 7 per cent market share was achievable, the progression from 7 per cent to 10 per cent presents a more significant challenge.

The future trajectory of the EV market remains uncertain, and predictions are speculative at best. However, the current landscape, characterized by generous incentives, suggests that this could be an opportune time for consumers who have been considering an EV purchase to take action.

Tesla sales declined for the fourth consecutive month in the US

As per latest data, registrations of Tesla electric cars in California, the company’s biggest market, tumbled 24% in the April-June quarter, the third straight quarterly dip. This has provided a competition pressure that is increasing over time to the EV manufacturer. Cutting on interest rates and increasing competition have equally triggered the consumers to shift to other cheaper means of electric vehicles which are hybrid cars.

Potential customers in the United States have been hesitant to buy Tesla’s electric cars; owing to Musk’s unreserved persona. Specifically, Musk supporting Republicans and giving outspoken statements created issues for Tesla and its brand image, especially in Liberal places such as California that generated 10% of the company’s worldwide deliveries.

Tesla's registrations in California fell to 52,211 vehicles in the second quarter, as reported by the California New Car Dealers Association. Despite a slight 1.3% decline in the battery electric vehicle market overall, hybrid vehicle sales surged by 22% in California during the same period. A report noted, "Tesla's appeal appears to be diminishing, signaling potential challenges for the direct-to-consumer automaker."

From January to June, Tesla's registrations in California plummeted by 17%, while distant competitors such as Hyundai Motor, Kia Motors, BMW, Mercedes-Benz, Ford, and Rivian all saw double-digit percentage increases in sales. Although Tesla's Model Y crossover remains the top-selling model in the state, its market share dropped to 53.4% in the first half of the year, down from 64.6% compared to the same period last year.

Later in 2021, Tesla changed its headquarters from California to Texas. Later, Musk also stated that other companies associated with him, such as SpaceX, will also relocate from California to Texas because of a conflict with the governor Gavin Newsom and legislative measures.

Tesla Motors is due to release its earnings for the period up to the end of June on Tuesday. This is actually rather surprising given that, although Daimler was able to deliver more cars in the second quarter than Wall Street expected it to, this figure was actually down year-on-year.

While it's easy to poke fun at the Tesla Cybertruck's unconventional design and question its practicality, some owners are actually using their quirky electric pickups for traditional truck tasks. In response, Tesla has introduced a couple of new accessories designed to enhance the utility of the Cybertruck’s unique bed configuration, though it remains one of the least practical trucks on the market.

Tesla has recently started offering a USD 300 tailgate shield designed to protect the Cybertruck’s stainless steel tailgate when carrying bikes. According to Tesla’s description, “Protect your tailgate while transporting your gear. The Cybertruck tailgate shield features a custom-designed pad that shields your tailgate when carrying equipment such as road or mountain bikes over it. The pad includes molle webbing on the interior side for easy attachment of items like the Cybertruck jumpseat, plus a combo carabiner to secure everything in place.”

In addition to the tailgate shield, Tesla has introduced jumpseats as a second new accessory for the Cybertruck. These seats can be attached using the molle webbing on the tailgate shield and are designed to accommodate up to two people with their legs extending off the rear of the gate. They fold up for easy storage when the tailgate is closed and feature handles for convenient transport. Tesla prices these seats at USD 100 each.

Other accessories available for the Cybertruck include the much-discussed Cybertent, a USD 3,000 folding tent that attaches to the bed and roof of the truck. Buyers can also opt for a colored wrap for up to USD 6,500 or a clear wrap for USD 5,000. Roof rack crossbars are priced at USD 800, and there is a USD 55 window decal that commemorates the infamous window-smashing incident from the Cybertruck’s 2019 reveal event.

Although there are other electric trucks on the market that may offer greater utility, the Cybertruck still enjoys a dedicated following among Tesla enthusiasts, despite some widespread criticism. While these accessories might be expensive and their practicality limited, they play a crucial role in enhancing the value of the Cybertruck for its owners.

Tesla, the renowned electric vehicle manufacturer led by Elon Musk, has made a significant change in its legal representation for a major class action lawsuit in California. The company has replaced its longstanding legal team from Cravath, Swaine & Moore with attorneys from Wilmer Cutler Pickering Hale and Dorr. This switch, finalised last week, marks a new phase in Tesla’s ongoing battle against claims of monopolistic practices in the market for vehicle parts and services.

The decision to change legal teams appears to be a strategic move by Tesla to strengthen its defence in the face of serious allegations. The class action lawsuit accuses Tesla of monopolising the market for parts and service for its vehicles, leading to consumers paying artificially inflated prices. By bringing in Wilmer Cutler Pickering Hale and Dorr, Tesla aims to leverage fresh perspectives and expertise to tackle these complex legal challenges effectively.

Details of the Legal Change

Cravath, Swaine & Moore had been representing Tesla in this consumer antitrust case until their recent withdrawal. The new legal team from Wilmer Cutler Pickering Hale and Dorr is now tasked with defending Tesla’s position. The Wilmer team includes seasoned partners David Gringer and Ari Holtzblatt, who are expected to bring robust legal strategies to the table. On the other hand, the departing Cravath team included notable attorneys David Marriott and Vanessa Lavely.

Broader Legal Context for Tesla

This shift in legal representation is not an isolated incident but part of a broader legal context for Tesla and its CEO, Elon Musk. Musk is also embroiled in a separate litigation in Delaware, challenging his $56 billion pay package from Tesla. In this case, Musk and Cravath faced a setback earlier this year when a judge criticised and invalidated Musk's compensation package as "unfathomable." Despite Tesla shareholders voting in support of Musk’s pay in June, the Delaware case remains unresolved.

New Legal Players in the Delaware Litigation

In addition to Wilmer’s involvement in the California class action, Tesla has also enlisted lawyers from Quinn Emanuel Urquhart & Sullivan for the Delaware litigation. This high-profile legal team includes Alex Spiro, one of Musk’s most notable lawyers. The inclusion of Quinn Emanuel signifies Tesla’s intent to fortify its defence with some of the best legal minds available.

Wilmer's Broader Role in Defending Tesla

Wilmer Cutler Pickering Hale and Dorr is no stranger to defending Tesla. The firm is already representing Tesla in an ongoing antitrust battle in New Orleans. In this case, Wilmer has been actively fighting to revive Tesla’s lawsuit against Louisiana’s ban on direct-to-consumer car sales. Although Wilmer did not represent Tesla in the lower court, their involvement at the appeals level demonstrates Tesla’s confidence in their capabilities.

Tesla’s Legal Strategies and Future Implications

Tesla’s decision to switch legal teams in the California class action lawsuit underscores the company’s proactive approach to its legal challenges. By bringing in Wilmer Cutler Pickering Hale and Dorr, Tesla is likely seeking a more aggressive and innovative defence strategy. This change is particularly crucial as Tesla faces mounting legal pressures on multiple fronts, including the significant antitrust allegations and the ongoing scrutiny over Musk’s compensation.

The outcome of these legal battles will have far-reaching implications not only for Tesla but also for the broader electric vehicle market. As Tesla navigates these challenges, its legal strategies and the effectiveness of its new representation will be closely watched by industry observers, stakeholders, and consumers alike.

Tesla switches legal teams amidst ongoing antitrust battle

Tesla has begun offering a range boost for the Model Y RWD, a move that has pleased some owners while irking others. The controversy stems from the company's decision to charge for the upgrade, despite earlier suspicions that the vehicle already had a software-locked Long Range battery.

For some time, it was believed that Tesla was producing the entry-level Model Y RWD with a software-locked Long Range battery to ensure all variants of the electric crossover qualified for the federal tax credit. This led many Model Y RWD owners to search for ways to unlock the full battery capacity. In May, Elon Musk addressed these suspicions, promising that Tesla was working through regulatory approvals for a range unlock. He indicated that the Model Y RWD, which originally offered a 260-mile (418-km) range, could gain an additional 40 to 60 miles (64 to 97 km), depending on the battery cells, with an estimated cost of $1,500 to $2,000.

Recent developments and pricing adjustments

In the past months, Tesla's actions confirmed the software-lock theory. The company discontinued the Model Y RWD trim and introduced a Long Range (LR) RWD variant with 320 miles of range, essentially the same vehicle with a 60-mile boost. Now, Tesla offers a similar range boost to Model Y RWD owners, albeit with some differences. The range boost now offers an additional 30 to 50 miles, and the price has been adjusted to $1,000-$1,600. The offer has started appearing in the Tesla app, but it was not what many expected. Owners cannot choose the boost level, as it depends on the battery configuration. Some were offered a $1,600 upgrade for "up to 50 miles," while others were asked to pay $1,000 for "up to 30 miles."

Mixed reactions from owners

The response from Tesla owners has been mixed. While some welcomed the additional range, even as a paid upgrade, others viewed it as a money grab. The sentiment echoes past controversies, such as BMW's decision to charge for hardware features already installed in vehicles, like seat heating. Critics argue that Tesla's move is a missed opportunity to wow owners with a free upgrade. They believe that Tesla should have offered the range boost for free, especially since the hardware was already present in the vehicle.

A different perspective on value

On the other hand, some argue that Tesla never promised more range, and owners received what they paid for. Offering the range boost for free could have upset Model Y LR AWD owners, who paid more for a vehicle that already included the extended range. It’s reasonable to expect that upgrading from a standard range to a Long Range model should not come at no cost.

A new perspective suggests that the software-capped battery offers significant headroom. This allows owners to regularly charge the battery to 100% without worrying about degradation. Regularly charging the 260-mile pack to 100% provides the same range as a Model Y LR RWD, essentially offering a free upgrade with the exception that the vehicle won't achieve 320 miles on a road trip.

Implications for software-defined vehicles

This debate highlights the ongoing division among consumers regarding software-defined vehicles. While software upgrades offer flexibility and potential cost savings, they also raise questions about value and fairness. Tesla's approach underscores the complexities of balancing innovation with customer expectations. As the automotive industry continues to evolve, finding the right balance will be crucial for maintaining consumer trust and satisfaction.

Tesla’s decision to offer a paid range boost for the Model Y RWD has sparked a lively debate among owners. While some appreciate the additional range, others feel it should have been a complimentary upgrade. This controversy underscores the challenges and opportunities associated with software-defined vehicles. As Tesla and other automakers continue to push the boundaries of automotive technology, they must navigate the delicate balance between innovation and customer satisfaction.

Tesla’s range boost for Model Y RWD sparks debate among owners

It would be the largest fee ever for three law firms who have achieved what was considered impossible – defeating Elon Musk’s USD 56 billion pay package at Tesla, in order to turn the tables and explain to corporate boards why they have to constantly worry about having lawyers on their back, as was stated in the Delaware court on Monday.

The legal teams for both the plaintiff and the defendants spent six hours arguing about compensation for representing shareholder Richard Tornetta who owned nine Tesla shares when he filed the lawsuit in April 2018. Tornetta’s counsel sought fees of approximately $7. Market value 3 billion at the current price of TSLA and amounts to roughly $370 000 per hour for the combined efforts of 37 lawyers, associates and paralegals as disclosed in the legal papers.

Tesla’s lawyer, John Reed, criticised the fee petition, and, referring to it as a ‘real-life lawyer joke,’ staunchly opposed its approval to the Chancellor Kathaleen McCormick of the Court of Chancery.

The fee, which is a fraction of the value claimed to have been created for Tesla after January’s court ruling that terminated Musk’s compensation package, has provoked resistance from Tesla’s lawyers and thousands of shareholders. Reed further argued that the ruling had in fact lessened the value of Tesla through provoking stock price fluctuations brought about by the uncertainty over Musk’s position.

Greg Varallo, representing Tornetta, argued for the requested fee by stating that it is quite reasonable in light of legal standards that permit up to 33% for the benefit conferred and the company’s role in the transaction. He emphasised the historical significance of the January ruling which was the largest non-Punitive damages award by an American Court and recommended a fee award that will ensure lawyers protect small investors.

The issues discussed in the cases prior to Chancellor McCormick remain significant in shareholder litigation and corporate governance with referencing en masse the Enron class action case. Concerning the legal developments, the consequent of this and similar cases of fees might give precedential value for upcoming disagreements between shareholders or similar corporate responsibility cases.

Public policy favors USD 7 billion fee award in Elon Musk pay case

Tesla shares have experienced an impressive eight-day winning streak, pushing the world’s most valuable automaker into positive territory for the first time this year. Closing up 2.1 percent on Friday, Tesla marked its longest stretch of consecutive daily gains in nearly a year.

Tesla stock surges 38%

Tesla's ambitions to penetrate the Indian market have encountered significant obstacles, with recent reports indicating that communication between the electric vehicle (EV) giant and Indian government officials has stalled. Sources familiar with the situation suggest that the cooling of Tesla's interest follows a series of strategic and operational challenges faced by the company.

Missed opportunity: Musk's postponed visit

Elon Musk's anticipated visit to New Delhi in April, which many hoped would herald substantial investments in India, was unexpectedly postponed. Instead, Musk was seen in China, sparking speculation about Tesla's commitment to the Indian market. The visit was expected to include announcements of key investments, possibly even the establishment of an EV battery factory. However, the sudden change in plans has cast doubt on Tesla's immediate intentions.

Financial constraints and global setbacks

Media reports indicate that Tesla may be grappling with financial constraints, impacting its ability to invest heavily in new markets like India. The company has faced two consecutive quarters of declining deliveries, partly due to intensified competition from domestic EV manufacturers in China. Additionally, Tesla announced job cuts in April and has struggled with slow production ramp-ups for its latest model, the Cybertruck. Delays in constructing its planned factory in Mexico further complicate the company's expansion plans.

Government incentives and domestic focus

In an effort to attract foreign investment, the Indian government recently reduced import taxes on EVs for carmakers willing to invest at least $500 million and commence local production within three years. Despite this incentive, Tesla's apparent withdrawal has shifted the government's focus toward supporting domestic manufacturers like Tata Motors and Mahindra & Mahindra.

Tata Motors is actively developing several EV models, while Mahindra plans to launch its first purpose-built electric vehicles in August, utilising technology sourced from the Volkswagen group. This shift in focus underscores India's commitment to fostering a robust domestic EV industry, even in the absence of major foreign players like Tesla.

Market challenges and potential growth

India's EV market remains in its infancy, with battery-powered cars comprising just 1.3 per cent of vehicles on the road. High entry costs, limited charging infrastructure, and concerns about battery longevity continue to deter consumers. However, the sector shows signs of potential, especially in public transport.

Ride-hailing services such as BluSmart and Evera are increasingly adopting EVs manufactured by local companies. This trend suggests a growing acceptance of electric vehicles, which could eventually translate to broader market adoption. Indian officials remain optimistic, stating that Tesla would be welcomed should it choose to re-engage with the Indian market.

The strategic landscape

Tesla's global challenges and the strategic decision to focus on other markets like China reflect the complexities of navigating international expansion. For India, the government's emphasis on domestic EV production aligns with its broader goals of reducing pollution and dependence on fossil fuels. By supporting local manufacturers, India aims to build a self-reliant EV ecosystem capable of competing on a global scale.

A delicate balancing act

Tesla's roadblock in India highlights the intricate balance between global ambitions and local realities. While Tesla faces hurdles, India's EV sector is gradually evolving, driven by domestic players and government support. As the market matures, the potential for collaboration and competition will likely shape the future of electric mobility in India. The evolving dynamics between international giants and homegrown innovators will be crucial in determining the trajectory of the EV revolution in the subcontinent.

Missed opportunity: Musk's postponed visit Elon Musk's anticipated visit to New Delhi in April, which many hoped would herald substantial investments in India, was unexpectedly postponed. Instead, Musk was seen in China, sparking speculation about Tesla's commitment to the Indian market. The visit was expected to include announcements of key investments, possibly even the establishment of an EV battery factory. However, the sudden change in plans has cast doubt on Tesla's immediate intentions. Financial constraints and global setbacks Media reports indicate that Tesla may be grappling with financial constraints, impacting its ability to invest heavily in new markets like India. Also read: Ford recalls 30,735 Mustangs over potential steering issues Government incentives and domestic focus In an effort to attract foreign investment, the Indian government recently reduced import taxes on EVs for carmakers willing to invest at least $500 million and commence local production within three years. Market challenges and potential growth India's EV market remains in its infancy, with battery-powered cars comprising just 1.3 per cent of vehicles on the road. The strategic landscape Tesla's global challenges and the strategic decision to focus on other markets like China reflect the complexities of navigating international expansion. For India, the government's emphasis on domestic EV production aligns with its broader goals of reducing pollution and dependence on fossil fuels. By supporting local manufacturers, India aims to build a self-reliant EV ecosystem capable of competing on a global scale. A delicate balancing act Tesla's roadblock in India highlights the intricate balance between global ambitions and local realities.

Tesla's Indian market plans face major hurdles amidst global challenges

German regulatory bodies have only partly acceded to Elon Musk-owned Tesla for its expansion of the Gigafactory a few kilometers from Berlin while citizens protested against the plan due to perceived environmental risks. The company began building the facility in 2015 and has established it in Grünheide in the region of Brandenburg, some nine kilometers southeast of Berlin.

The proposed expansion signifies the company’s plans to increase the production from around 500,000 cars per year to hit around one million cars in the near future, making the company a vital player in the automotive sector in the region.

At first, Tesla proposed to clear at least 100 hectares of a wood land in the country, which caused massive protest among the public. Due to these drastic changes, Tesla came up with an adjusted project plan that excluded a freight depot as the community opposed it. The Brandenburg state environment ministry has made it clear and noted that Tesla has only been cleared to begin construction ‘at its own risk,’ although it has not been granted official building permission yet, but there has been a positive dialogue between the company authorities and the government.

Accepted master plan details encompass extensive projects such as new infrastructures of embedded tunnels, extra stairs, and integration of solar panels on the existing roofs. Further, the strategies also involve the construction of a new, smaller asphalted logistics area for vehicle storage and distribution, as well as an amplified production hall for better manufacturing performance and output.

After starting in Brandenburg in March 2022, Tesla’s operations provide a substantial part of employment in the region and currently supports roughly 12,000 jobs in the Grünheide location. However, there was a set back in April with the issue of laying off 400 employees which indicates that the company continues to experience some difficulties even as it makes operational changes.

In another incident that generated much public interest, the Gigafactory faced a severe power failure that occurred early this year, which was as a result of sabotage dating unnamed individuals. This forced an outrage from senior German officials concerned about Tesla's future investment in the region.

In the recent past, the factory has been associated with climate activists who tried to break the barriers, hence the embarrassment involving the police officers. All these cases demonstrate the symbiosis and tension between economic growth, environmental protection, and stakeholders’ interactions concerning Tesla’s activities in Grünheide.

Germany gives go-ahead to Tesla for Gigafactory expansion

Environmental authorities in Brandenburg, Germany, have given their approval for Tesla's plans to expand its Gruenheide Gigafactory. This decision marks a crucial step forward in the American automaker's ambitious growth strategy, while simultaneously igniting debates about environmental sustainability.

The approval, issued by Brandenburg's environmental agency, permits Tesla to proceed with initial expansion activities. These include the construction of an asphalted logistics area dedicated to new vehicle storage, the addition of stairwells to the existing pressing plant, and the installation of an access guard system. These improvements are seen as foundational steps in Tesla's broader expansion plans.

Tesla's vision for the Gruenheide facility is nothing short of revolutionary in the European automotive landscape. The company, under the leadership of tech mogul Elon Musk, aims to double the site's current capacity. This expansion would elevate the plant's battery production capabilities to an impressive 100-gigawatt hours and increase its annual vehicle output to one million units. Such a dramatic increase in production capacity could potentially position Tesla as a dominant force in Europe's rapidly growing electric vehicle market.

However, the road to expansion is not without its challenges. The decision has sparked concerns among local environmental groups and residents. Their primary worry centres on the potential impact of the expanded facility on the region's water resources. The Gigafactory's location within a designated drinking water protection area has raised red flags about the sustainability of large-scale industrial operations in such an environmentally sensitive zone.

These concerns highlight the ongoing tension between industrial development and environmental conservation, a challenge that many regions face as they transition towards greener technologies. The Brandenburg authorities' decision to approve the expansion suggests a careful balancing act between fostering economic growth and safeguarding natural resources.

As Tesla moves forward with its expansion plans, the company will likely face continued scrutiny from environmental watchdogs and local communities. The automaker's ability to address these concerns while pursuing its growth objectives will be crucial to its long-term success and acceptance in the region.

The expansion of the Gruenheide plant is not just a local issue but has broader implications for the European automotive industry. As traditional automakers race to catch up in the electric vehicle market, Tesla's increased production capacity could significantly alter the competitive landscape.

Tesla's German Gigafactory expansion gets green light

The best-selling car made by Tesla, the Model Y electric vehicle, has been included for the first time in the list of cars a local government can consider buying for its service fleet, says the Chinese media outlet The Paper.

First, Tesla owners have had a hard time in China, as their cars have not only been banned from driving on certain streets but also barred from parking lots near sensitive governmental compounds over concerns about data collection.

The Jiangsu provincial government recently announced that it will purchase new energy vehicles for the government to use, launching 56 batches of electric and plug-in hybrid models.

Other than the Volvo XC40, which is the only non-Chinese-branded car, all the others posted are produced at Tesla's Shanghai facility. The number of Model Y to be procured remains unspecified.
This would come at a time when Tesla has been finding it hard in the Chinese market. Shipments of Chinese-made Tesla's in the first half of 2024 declined 9 per cent compared with the same period in 2023.

That is most likely a multicausal plunge: from the threat of tariffs on Chinese exports to the rise of domestic competition in automaking.

Recently, the company's CEO, Elon Musk, visited China, and this is where the sun seemed to be shining. Since his meeting with Premier Li Qiang in April, he stamped approval from China for some support for the company.

Among other things, this included approval for the data training centre and a possible rollout of Tesla's Full Self-Driving software, just in case there are no strains between China and the United States.

Tesla Model Y approved for Chinese government car purchases

Tesla has made an official announcement regarding the extension of its recently introduced promotional offer for transferring Full Self-Driving (FSD) software. The company has decided to give potential car buyers an additional month to take advantage of this special opportunity.

On Tuesday, Tesla's North America account shared a post on the social media platform X (formerly known as Twitter), informing the public that the deadline for FSD transfers would be pushed back to the end of September. This extension comes after the initial promotion was set to conclude on August 31.

The FSD promotional offer allows individuals who are purchasing a new Tesla vehicle to transfer their existing FSD software to their newly acquired car at no extra cost, provided they take delivery of the vehicle before the specified deadline.

For those interested in acquiring FSD capabilities, Tesla offers two distinct options for customers in the United States and Canada. The first option is a monthly subscription model priced at USD 99 (or CAD 99 in Canada).

Alternatively, buyers can opt for a one-time purchase of the software package for USD 8,000 (or CAD 11,000 in Canada).

This recent update to the promotional offer follows a commitment made by Tesla CEO Elon Musk during the company's recent shareholder meeting. In response to a request from an audience member, Musk agreed to extend the FSD transfer option for "one more quarter."

It's worth noting that while the promotion was initially introduced as a "one-time amnesty" in the previous year, Tesla has since reintroduced the ability to transfer FSD to newly purchased vehicles on multiple occasions.

In recent months, Tesla has been aggressively promoting its FSD technology through various initiatives. These efforts include reducing both the subscription and purchase prices of the software, introducing one-month free trials for new vehicle buyers, and mandating that employees offer test drives to potential customers.

This promotional push comes in anticipation of Tesla's plans to unveil an FSD-based robotaxi platform shortly. The company has already teased a mobile application for a ride-hailing service, suggesting that autonomous transportation services may be on the horizon.

Tesla has been making strides to expand the reach of its FSD technology beyond its current markets. The company has been preparing to launch FSD in China, which represents the world's largest automotive market.

Some vehicles in China are already undergoing testing with the FSD software, indicating that Tesla is actively working towards introducing this advanced technology to new regions.

Tesla extends free FSD transfer deadline by a month

Tesla has demonstrated its resilience in the face of various challenges, reporting second-quarter delivery numbers that surpassed analyst expectations. This positive news led to a significant surge in the company's stock price, jumping 10% to close at USD 231.26 on Tuesday, although the shares remain down about 7% for the year 2024.

The Palo Alto-based automaker reported total deliveries of 443,956 vehicles for Q2 2024, comfortably beating the consensus estimate of 439,000 compiled by FactSet StreetAccount. While this figure represents a 4.8% decrease from the 466,140 vehicles delivered in the same quarter last year, it marks a substantial 14.8% increase from the first quarter of 2024. Tesla's production numbers also impressed, with 410,831 vehicles manufactured during the quarter.

These delivery figures, which serve as the closest approximation of sales disclosed by Tesla, encompass the company's entire vehicle lineup. This includes the popular Model Y crossover, Model 3 sedan, the newly introduced Cybertruck pickup, as well as the Model X SUV and the flagship Model S sedan. However, Tesla does not provide a breakdown of deliveries by individual models or specific regions.

The positive Q2 results come as a welcome rebound for Tesla, following a challenging start to the year. In April, the company reported its first annual decline in deliveries since 2020, with Q1 numbers dropping 8.5% to 386,810 vehicles. This was accompanied by a 13% year-over-year decline in revenue, which Tesla attributed primarily to lower average selling prices.

Several factors contributed to the sluggish sales earlier in the year. These included temporary factory shutdowns due to an alleged arson attack at Tesla's German facility and shipping delays resulting from conflicts in the Red Sea. However, industry analysts also pointed to Tesla's ageing vehicle lineup, increased competition from other EV manufacturers (particularly in the crucial Chinese market), and potential brand erosion linked to CEO Elon Musk's public persona.

To combat these challenges and stimulate sales, Tesla implemented a range of discounts and incentives throughout the year. In China, a key market that accounted for 22.5% of Tesla's total sales in 2023, the company is currently offering a zero-interest loan for Model 3 and Model Y purchases made by July 31.

Despite the positive Q2 delivery numbers, some analysts remain cautious about Tesla's future performance. Colin Langan of Wells Fargo issued a report recommending selling Tesla shares, citing concerns about "declining delivery growth driven by lower demand & diminished return on price cuts." The firm also anticipates a potential decrease in Tesla's automotive gross margins, excluding environmental credits, due to the likelihood of further price cuts and lower volumes as the year progresses.

Looking ahead, investor attention will now shift to Tesla's upcoming second-quarter earnings report and a special marketing event planned for August. At this event, the company is expected to unveil its design for a dedicated robotaxi or "CyberCab," potentially opening up new avenues for growth and innovation.

BYD's record earnings in June quarter

Tesla's shares have gained nearly 6% on Monday, following a key Wall Street brokerage's decision to add the stock to its watch list ahead of the automaker's quarterly production and delivery report. However, the electric vehicle (EV) market has been a challenging landscape for Tesla, with slumping demand and heightened competition from Chinese rivals like BYD.

To address these issues, Tesla has resorted to cutting prices on certain models and is now banking on autonomous driving technologies and robotaxis for future growth. The company's previous price reductions and promotions have had a "diminished" effect on sales, according to Wells Fargo analyst Colin M. Langan.

Lowered delivery expectations

Tesla is expected to report a 6% decrease in vehicle deliveries for the April to June period, compared to the same quarter last year, as per estimates from LSEG. Earlier this year, the company indicated a foreseen slowdown in delivery growth for the year and revised down its target of delivering 20 million vehicles annually by 2030 in its latest annual impact report.

Tesla remains a contender in the EV market demand challenges

While tech firms within the 'Magnificent 7' stocks are witnessing a great upswing, Tesla has experienced an equally historic downfall. The company has lost a quarter of its value in 2024 and is the worst-performing stock on the S&P 500.

Tesla's June-quarter deliveries fell 3.7 per cent, according to Reuters. This marks the first time Tesla has posted two straight quarters of decline. Tesla has faced multiple issues, along with troubles in China and slowing demand. Consumers are reportedly shifting to cheaper hybrid options, which has left Tesla's expensive inventory in the dust. To compete in this aggressive market, Tesla has tried price cuts and incentives. This has further hurt the company's balance sheets.

Tesla's CEO, Elon Musk, recently got his record $56 billion pay package approved by his shareholders. Musk had earlier announced plans to focus on robotaxis, which got investors concerned over the company's future prospects and the imperfection of autonomous technology.

Analysts are now expecting Tesla to post its first annual sales drop this year. Earlier, in the January-March quarter, deliveries dropped by the most in nearly four years. Sales are in decline across geographies, including in Europe, where sales fell 36 per cent in May.

Similarly in China, Tesla has been struggling to hold ground amid stiff competition from domestic EV makers. Elon Musk recently visited the country to improve the outlook in the largest car market in the world. Despite gaining some approvals, Musk's visit did not improve sales. Tesla's cost-cutting strategy to gain market share is surely a major shift for a brand known for its 'premium-ness'.

Tesla expects to unveil robotaxis on August 8 as it seeks to introduce its 'Full Self-Driving' software.

While tech firms within the 'Magnificent 7' stocks are witnessing a great upswing, Tesla has experienced an equally historic downfall. The company has lost a quarter of its value in 2024 and is the worst-performing stock on the S&P 500.

In what is a major overhaul to what has long been recognized as a brand’s Initial Quality Study (IQS), JD Power has incorporated franchise dealership repair visits with the Voice of the Customer (VOC) to provide a full view of vehicle quality as it pertains to the model year 2024. A report unveiled today shows that the current benchmark for problems per 100 vehicles which is abbreviated as PP100 now averages 195.

This average has been beaten by mass market brands that have collectively scored 181 PP100 in a clear indication that they are conscious of the fact that the quality of vehicles on road needs to be improved. On the other hand, complex brands with complicated supply chain networks along with heavy dependence on connections rank a higher number of 232 PP100 due to problems emanating from new mob Sent.

Senior director of Auto Benchmarking at JD Power Frank Hanley added comment that while the technology is challenging the vehicle firms to maintain better quality, it has shown the more positive trend in such areas as voice recognition and parking cameras compared to the previous years.

The survey also explores the attitudes toward Battery Electric Vehicles (BEVs) and Plug-In Hybrid Electric Vehicles (PHEVs). Interestingly, even though the sustainability literature suggested that BEVs and PHEVs would be easier to maintain than traditional gas-powered vehicles, BEVs and PHEVs have higher numbers across all repair categories than the control group of traditional gas-powered vehicles. Newer BEVs and PHEVs owners claim their vehicles than gas-powered cars three times more frequently, suggesting that the sector still faces problems, according Hanley.

Specifically, gas- and diesel-powered vehicles average 180 PP100, while BEVs exhibit a higher rate at 266 PP100. Notably, Tesla's BEV quality has aligned closely with traditional OEMs this year, both scoring 266 PP100. This marks a shift from previous years where Tesla outperformed in this category, possibly impacted by the removal of traditional feature controls like turn signals and wiper stalks, which have received mixed feedback from Tesla owners.

Some of the important conclusions made in the 2024 study involve increasing annoyance with false alerts concerning security concerns such as rear-seat reminder alerts and ADAS. Further, the matters between the smartphone connection to vehicles through the Android Auto and Apple CarPlay remain an open issue; connectivity issues are the main challenge drivers face.

The next main issue of concern raised in the study is the issue of in-vehicle controls, which appear to persist to pose serious challenges, particularly in electric vehicles. The recent change to the use of buttons positioned on the steering wheel has also been a point of criticism amongst consumers, helping to account for higher scores in PP100 in this area than those labelled gas models.

Further, new cars with more superior features are seen to give uncomfortable smells inside the car and the smell from the heating, ventilation and air conditioning systems also indicate that vehicle comfort and customer satisfaction remain a pressing issue.

The annual IQS, established in 1988, is released this year and is the 38th edition, which was based on the survey of 99,144 new vehicle owners 90 days after the initial purchase. It is the first time, that also includes the so-called repair visit information in addition to conventional VOC data, which offers car manufacturers a broader view on quality problems over the entire period of vehicle ownership.

According to the initial quality study, the masses’ market brands that dominated were Ram, Chevrolet, and Hyundai, while the premium brands that performed well were Porsche, Lexus, and Genesis. Companies with model-level awards as key awards: General Motors has achieved the highest number with six, Hyundai Motor Group and Toyota Motor Corporation with four each.

The IQS takes place between July 2023 and May 2024 and targets 10 areas of the vehicle such as Infotainment, Advanced Driver Assistance Systems, Powertrain, Climate Control and others and is a way to foster ongoing development of automotive products and quality of new vehicles as perceived by buyers.

BEVs face issues despite leveling playing field with Tesla: JD Power

Toyota, despite its cautious approach to fully electric vehicles, appears to be adapting to the changing automotive landscape. The company has announced that it will open Lexus charging stations to other electric vehicle (EV) brands in Japan, a strategy reminiscent of Tesla's approach in the United States and globally.

Lexus, Toyota's luxury brand, launched its first "rapid charging station" in Tokyo Midtown Hibiya in June 2023 as part of the Lexus Electrified Program. The initiative expanded with a second station at Karuiza Common Grounds in December 2023. These Lexus charging stations feature quick chargers capable of delivering up to 150 kW maximum power, allowing for rapid recharging similar to Tesla's Supercharger network.

For comparison, Tesla's Superchargers can provide up to 250 kW peak charging rates. Tesla has also confirmed that its upcoming V4 Supercharger will support up to 350 kW output, although it's currently capped at 250 kW.

Initially, Lexus charging stations were exclusive to Lexus owners, who could reserve charging spots up to 60 days in advance through the My Lexus app. The system offered a seamless payment experience similar to Tesla's Superchargers. Additionally, Lexus provided extra amenities such as complimentary drinks, workspaces, and discounts on nearby services.

However, Toyota has now decided to open these Lexus charging stations to all EV owners, regardless of brand. This move mirrors Tesla's strategy of opening its Supercharger network to other EV manufacturers.

In May 2023, Ford became the first automaker to announce plans to adopt Tesla's North American Charging Standard (NACS) adapter, with nearly all other car manufacturers, including Toyota and Lexus, following suit to gain access to Tesla's extensive Supercharger network in the United States.

It's worth noting the significant difference in scale between the two networks. Tesla boasts over 15,000 Superchargers in the US and Canada, and more than 50,000 globally. In contrast, Lexus aims to have approximately 100 charging stations in Japan by 2030.

Despite this move towards more open charging infrastructure, Toyota and Lexus continue to lag behind in the industry-wide shift to electric vehicles. In the first four months of 2024, Toyota, including its Lexus brand, sold 46,033 EVs globally. This figure represents only 3.4 per cent of Toyota's total car sales of 1.3 million during the same period, highlighting the company's continued reliance on traditional powertrains and hybrid technology.

This development suggests that while Toyota is taking steps to adapt to the growing EV market, it still has a considerable journey ahead to catch up with competitors who have more aggressively embraced full electrification.

Tesla's new AI supercluster was finally unveiled by CEO Elon Musk and it is expected to ramp up to over 500 MW, which will make it one of the largest if not the largest in the world. At the same time, Musk emphasised that Tesla had been leading the pack in experimenting with next-generation AI chip in auto.

Back in several months, there were signs that Tesla had been facing issues in laying the groundwork for an expansion at Gigafactory Texas to house a new giant supercomputer for training Tesla’s AI. At first to assemble a 100 MW cluster by August, Musk refocused Tesla’s construction endeavour by halting other projects.

When asked about the expansion, drone footage revealed the expansion, Musk said that it will go up to over 500 MW in the next 18 months. This year, it will be sized to the order of 130 MW of power and cooling capacity, with long-term growth plans of more than 500 MW over the stated period. Musk emphasised a split between Tesla's own AI hardware and Nvidia's technology, highlighting Tesla's competitive strategy: It should be play to win or not to play at all.

Earlier, there was confusion as Tesla was the internal moniker for the project and usually everything associated with Dojo, which is Tesla’s home-grown supercomputing hardware. Some sources pointed that Nvidia’s compute power was also going to be tapped.

Musk has now clarified that Tesla has plans to continue using Tesla-made hardware (Such as the next generation AI5, previously referred to as HW5) alongside Nvidia and other suppliers. However, Musk’s comments do imply some uncertainty about whether Tesla’s HW4 computers, which are employed for in-car uses with their proprietary chips, will be employed in the training clusters or otherwise, to what extent he is referring to Tesla’s computing strategy in general.

On balance, Tesla is set to increase computing power manifold to power its autonomous vehicles, rely on a mix of self-developed chips and those from established players in the domain, including Nvidia.

Tesla to introduce stock-based compensation for high-performing employees

In a significant development for Tesla, a U.S. judge has ruled that vehicle owners can pursue a proposed class action against the electric car giant, accusing it of monopolising the market for repairs and parts. The ruling breathes new life into a lawsuit previously dismissed last November, potentially exposing Tesla to considerable legal and financial ramifications.

The lawsuit, overseen by U.S. District Judge Trina Thompson in San Francisco, contends that Tesla coerced its customers into paying inflated prices and enduring lengthy wait times for repairs. This, according to the plaintiffs, was done under the threat of losing warranty coverage if repairs were performed by unauthorised service centres. The owners argue that this practice violates both the federal Sherman antitrust law and California antitrust law.

Judge's ruling and evidence

Judge Thompson highlighted evidence suggesting Tesla's monopolistic control over repairs and parts. She pointed out Tesla's reluctance to open sufficient authorised service centres and its design choices that necessitated proprietary diagnostic and software updates. "Tesla's actions indicate a monopoly over repairs," she noted, referring to the company's refusal to permit independent repair shops to service its vehicles.

The judge also addressed the issue of parts monopoly, citing Tesla's restrictions on original equipment manufacturers (OEMs) from selling to anyone other than Tesla. Additionally, Tesla's limited sale of parts to consumers further strengthened the monopoly claim. "Evidence suggests Tesla's practices coerced customers into undesired purchases, violating antitrust laws," Thompson said.

Plaintiff's perspective

Matt Ruan, representing the plaintiffs, expressed satisfaction with the court’s decision. "We are pleased with the court's well-reasoned and thoughtful decision and look forward to the next phase of the case," Ruan stated. The complaint consolidates five lawsuits from vehicle owners who have incurred repair and parts costs since March 2019. These owners claim that Tesla's business model, which insists on handling servicing and parts in-house, differs significantly from its rivals, who allow independent shops and third-party parts.

Tesla's defence

Tesla and its legal team have yet to respond to the recent ruling. Previously, they argued that the lawsuit was based on an "illogical theory" that suggested Tesla deliberately compromised repairs and parts to jeopardise its more profitable vehicle sales and leasing business. Tesla, known for its direct-to-consumer sales model, reported $8.3 billion in services and other automotive revenue in 2023, which constituted 9% of its $96.8 billion total revenue. Vehicle sales accounted for a substantial $78.5 billion.

Implications for the industry

This lawsuit comes at a time when Tesla's unique approach to vehicle sales and service is under scrutiny. Unlike traditional automakers who sell through franchises, Tesla's model includes direct sales and a tight grip on repair services and parts. This control is now being challenged as potentially monopolistic, raising broader questions about consumer rights and market competition in the burgeoning electric vehicle industry.

Looking ahead

The case, Lambrix v Tesla Inc, U.S. District Court, Northern District of California, No. 23-01145, could set a precedent for how EV manufacturers handle repairs and parts distribution. If the plaintiffs succeed, it may lead to increased regulatory scrutiny and potentially force Tesla to alter its business practices. This case highlights the growing pains of an industry in transition and underscores the need for clear regulatory frameworks to ensure fair competition and consumer protection.

As the legal battle unfolds, Tesla faces significant challenges that could impact its operations and market strategy. The outcome of this lawsuit will be closely watched by industry stakeholders, regulators, and consumers alike. For now, the ruling marks a critical juncture in the ongoing debate over market control and consumer rights in the electric vehicle sector.

Vehicle sales accounted for a substantial $78.5 billion. Implications for the industry This lawsuit comes at a time when Tesla's unique approach to vehicle sales and service is under scrutiny. Unlike traditional automakers who sell through franchises, Tesla's model includes direct sales and a tight grip on repair services and parts. This control is now being challenged as potentially monopolistic, raising broader questions about consumer rights and market competition in the burgeoning electric vehicle industry. Looking ahead The case, Lambrix v Tesla Inc, U.S. (Inputs from Reuters)

Tesla faces class action over repair monopolisation

Tesla has taken legal action against its former supplier, Matthews International, by filing a lawsuit in a California federal court. The allegations put forth by Tesla are serious in nature, claiming that Matthews International has misappropriated confidential trade secrets pertaining to Tesla's cutting-edge battery manufacturing process. Tesla asserts that Matthews has not only stolen these trade secrets but has also shared this proprietary information with Tesla's competitors in the electric vehicle industry.

The legal proceedings were initiated on Friday when Tesla filed the lawsuit in the United States District Court for the Northern District of California. In the court documents, Tesla has made a substantial claim for damages, stating that the company "conservatively estimates" the amount owed by Matthews to exceed a staggering USD 1 billion. This enormous sum is attributed to what Tesla alleges is the misuse of its trade secrets, specifically those related to dry electrode battery manufacturing technology.

In response to these allegations, Matthews International has not remained silent. The company issued a statement on Monday, vehemently denying Tesla's claims. Matthews characterised the lawsuit as "simply a new tactic" in what they describe as Tesla's "ongoing efforts to bully Matthews."

Furthermore, Matthews accused Tesla of attempting to "improperly take Matthews' valuable intellectual property." The company has made it clear that they intend to mount a vigorous defense against these allegations.

As of Monday, representatives from Tesla, including their attorneys and spokespersons, had not provided any immediate comments or responses to inquiries about the lawsuit.

The complaint filed by Tesla sheds light on the business relationship between the two companies. According to the document, Matthews International, a company based in Pittsburgh, began its role as a supplier to Tesla in 2019.

During this period, Tesla entrusted Matthews with sensitive information related to their innovative dry-electrode coating technology. Tesla has previously touted this technology as a game-changer in battery manufacturing, claiming it can significantly reduce the size, cost, energy consumption, and production cycle time of battery manufacturing facilities.

Tesla has stated that this technology has the potential to enhance both the energy density and power output of battery cells.

In the lawsuit, Tesla alleges that Matthews International violated their trust by sharing Tesla's ground breaking innovations with unnamed competitors in the industry. The carmaker claims that Matthews accomplished this by selling "machines and other technologies embodying Tesla's trade secrets."

But the allegations don't stop there. Tesla further accuses Matthews of attempting to claim Tesla's inventions as their own by filing patent applications that allegedly reveal confidential information belonging to Tesla.

Given the gravity of these allegations, Tesla is seeking multiple forms of relief from the court. Firstly, they are requesting an injunction to prevent Matthews from any further misuse of Tesla's trade secrets. Secondly, Tesla is demanding that Matthews surrender all patent applications that may contain Tesla's confidential information. Tesla is pursuing substantial monetary damages to compensate for the alleged misappropriation and misuse of their trade secrets.

This legal battle underscores the critical importance of intellectual property protection in the highly competitive and rapidly evolving electric vehicle industry. It also highlights the potential risks and complications that can arise from close collaborations between innovative companies and their suppliers, especially when sensitive technological information is involved.

Tesla sues former supplier Matthews over EV battery trade secrets

Tesla CEO Elon Musk is working on another strategic development being referred to as 'Master Plan Part 4'. The previous ‘master plans’ have been strategic guides for the company, defining its path to success. All in all, it can be stated that Tesla has already met most of the goals that were set in the first two master plans of the company.

In August 2006, Musk introduced his plan for the first time in the blog post called “The Secret Tesla Motors Master Plan (just between you and me).” This plan listed out certain goals that the company aimed to achieve then, like building a sports car, employing the money generated from step 1 in building an affordable car. Other goals included employing the proceeds from step 2 to construct yet a cheaper automobile and expanding zero-emission electric power generation alternatives at the same time.

Despite some missteps along the way, Tesla successfully executed these steps with the Roadster, Model S, and later the Model 3. In 2016, Musk came with with the ‘Tesla Master Plan Part 2’ during the Model 3 launch and the acquisition of SolarCity, which finalised the plan. Part 2 built upon the Tesla Energy division by discussing the combination of energy storage with renewable generation and discussing new products such as the solar roof.

The plan also emphasised advancements in self-driving technology, positioning it as a cornerstone for Tesla's future. Musk summarised Part 2 with goals that included creating solar roofs with integrated battery storage, expanding the electric vehicle lineup across all major segments, achieving superior self-driving capabilities through fleet learning, and enabling vehicles to generate income autonomously.

Among the vehicles mentioned in Part 2 were the Cybertruck, Model Y compact SUV, and the Tesla Semi, all of which have been unveiled and are in various stages of production. The vision for "high passenger-density urban transport" remains outstanding.

In 2019, Musk shared ’Master Plan Part 3’ in the form of a presentation and white paper, which was different from the previous documents that focused on products. But it described a plan for a transition of economies worldwide for electric cars and clean energy. Now, Musk has claimed that he is working on ‘Tesla Master Plan 4’, which he said is ‘epic’ and is ongoing.

Tesla unveils plans for three new EVs, but future of roadster uncertain

During Thursday's annual shareholder meeting, Tesla CEO Elon Musk described himself as a catalyst for the company’s future, as shareholders approved a USD 56 billion pay package for him based on current stock prices.

However, a critical element intended to transform the company's trajectory and reduce costs significantly, facilitating projects like a USD 25,000 Tesla EV in 2023 and mass production of the Semi in 2021, has yet to materialise in 2024: the dramatic cost saving efforts by Tesla in its 4680 cells. “We are hopeful that the way forward is going to be difficult in achieving cost parity with our own cell production by year-end,” Musk said regarding the hurdles.

Tesla had brought focus on the 4680 cells when it announced the Battery Day event in September 2020, saying that it can bring the costs down significantly compared to present suppliers on an energy basis and it could possibly sell batteries to other automobile manufacturers. In confidential information, Musk admitted that, for the present time, 4680 Tesla cells cost more than the direct supply though it was significantly more a year ago.

Musk’s more grounded outlook in 2024 is in stark contrast to the bullishness seen after Battery Day in which Tesla outlined further as far-reaching cost cutting paradigms. However, getting cost competitive remains a challenge for Tesla, even as the prices of EV batteries rose in the aftermath of Battery Day, only to drop later.

Industry experts also forecast a significant fall in the cost of batteries for EVs by 2025, which will reignite the buying force. However, the trends today look rather different from Future Day envisioned during Battery Day, as China can cover the entire demand for EV batteries across the globe.

There has been a slowdown in Tesla’s battery technology development, the 4680 cells, which are main to scaling Semi production. Nevertheless, there are problems, for example, new technologies for mass production necessary for Tesla, as well as battery cost goals that currently stand at 150 per kilowatt-hour, continue to push forward, with Tesla planning on achieving battery costs that are in alignment with industry averages by the end of the year.

In conclusion, while Musk is optimistic about eradicating the cost injustice or achieving the envisaged 50% savings today, it is as elusive as it was in 2020.

Buying EV batteries from suppliers costs less versus Tesla's own: Elon Musk

Tesla shareholders recently voted to reinstate Elon Musk's substantial pay package, but the decision has sparked mixed reactions among investors and analysts. Despite the approval, some remain sceptical about the implications for the company's future.

The vote saw 77 per cent of Tesla's shareholders supporting Musk's $56 billion compensation package, although this figure has since decreased to approximately $46 billion due to a decline in Tesla's market capitalisation. Investors holding 1.76 billion shares voted in favour, while 528.9 million shares opposed the package. Interestingly, 20.6 million shares did not participate in the vote.

Elon Musk expressed his gratitude at the shareholder meeting, stating, "I just want to start off by saying, hot damn, I love you guys." Despite this overwhelming support, the package’s reinstatement does not necessarily guarantee Musk will receive the pay, as legal challenges remain. Delaware Chancery Court Judge Kathaleen McCormick previously ruled that the package, originally approved in 2018, was not fairly negotiated. The ultimate decision could still involve the Supreme Court and Delaware Chancery Court.

Ibrahim AlHusseini, an early investor in Tesla, unenthusiastically supported the package. "The whole thing is a game of chicken and the shareholders blinked,” AlHusseini said, highlighting the psychological tactics at play. He believes the stock will remain steady until the next quarterly earnings report, which he predicts will reveal another miss on deliveries and margins, potentially leading to a decline in stock value.

New York City Comptroller Brad Lander, overseeing several pension funds holding Tesla shares, was among those urging a vote against the package. He labelled the approval as a mistake, expressing concerns over Musk's focus and the potential for distractions. Lander emphasised the need for Musk to prioritise Tesla's growth and development over personal battles and distractions.

Vanguard, Tesla’s largest outside institutional shareholder, played a pivotal role in the deal’s passage. Initially voting against the package in 2018 due to its size relative to the company's performance, Vanguard’s shift in stance surprised some investors. Longtime Tesla investor Ross Gerber, who voted against the package this time, criticised Vanguard's decision, calling the package "outrageous" given Musk's recent performance. Despite his opposition, Gerber acknowledged that the shareholders' decision should be respected.

Analysts generally view the reinstatement of Musk’s compensation package as a positive outcome for Tesla’s future. Canaccord Genuity’s George Gianarikas, who maintains a Buy rating on Tesla stock, expressed optimism, citing the vote as a strong endorsement of Musk’s leadership. He highlighted Tesla's advancements in full self-driving technology as a significant differentiator from competitors.

Wedbush analyst Dan Ives described the approval as a "pop-the-champagne moment" for Musk and Tesla shareholders. He believes this removes a substantial overhang on Tesla shares and sets the stage for continued growth. Ives forecasts Tesla's valuation could surpass $1 trillion by 2025, with Musk dedicating more time and focus to the automaker.

However, not all analysts are convinced. Dave Harden, Chief Investment Officer of Summit Global, cautioned against buying Tesla shares at this time. He pointed to significant dilution risks for shareholders and argued that Tesla’s major growth burst in electric vehicles (EVs) has already occurred. Harden recommends a cautious approach, suggesting current shareholders consider selling and potential investors wait for clearer growth signals.

The reinstatement of Elon Musk’s pay package marks a significant moment for Tesla and its shareholders. While some see it as a necessary reward for Musk's past achievements and a vote of confidence in his future leadership, others remain wary of the potential for distractions and further legal challenges. As the market navigates these developments, Tesla’s ability to sustain its growth trajectory and innovate in the rapidly evolving EV and AI sectors will be closely watched by investors and analysts alike.
