New Delhi was expecting the decision as last month, a source-based report mentioned that India's National Investigation Agency (NIA) was preparing to initiate the extradition proceedings against one of the main accused in 26/11 attacks in Mumbai by Pakistan-based Lashkar-e-Taiba (LeT) terrorists in 2008.&nbsp;

India had filed a complaint on June 10, 2020, and had sought the provisional arrest of the 62-year-old with a view towards extradition. The request for the extradition of Rana to India was supported and approved by the Biden Administration.&nbsp;

Judge Jacqueline Chooljian, US Magistrate Judge of the US District Court Central District of California, said, "The Court has reviewed and considered all of the documents submitted in support of and in opposition to the Request, and has considered the arguments presented at the hearing."&nbsp;

The 48-page court order dated May 16 was released on Wednesday.&nbsp;

The judge further wrote: "Based on such review and consideration and for the reasons discussed herein, the Court makes the findings set forth below, and CERTIFIES to the Secretary of State of the United States the extraditability of Rana on the charged offences that are the subject of the Request."&nbsp;

<h2>Court proceedings&nbsp;</h2>

During court proceedings, US Government attorneys argued that Rana was aware that his childhood friend, Pakistani-American David Coleman Headley, was involved with the terrorist organisation LeT, and that by assisting Headley and providing cover for his activities, he was supporting the terrorist organisation and its associates.

It was also said that Rana was aware of Headley's meetings, and the attack strategy, including some of the targets. The US government claimed that Rana was a member of the conspiracy and that he committed the substantive crime of commissioning a terrorist act.&nbsp;

On the other hand, Rana's attorney spoke against the extradition.&nbsp;

<h2>26/11 attacks&nbsp;</h2>

On November 26, 2008, India was rocked by a series of terrorist attacks when members of LeT carried out 12 coordinated shooting and bombing attacks in Mumbai.&nbsp;

A total of 166 people, including six Americans and more than 300 were wounded during the attacks that lasted for four days as it ended on November 29 when India's National Security Guards (NSG) conducted Operation Black Tornado to kill the remaining terrorists.&nbsp;

Out of 10 attackers, nine were killed and Ajmal Kasab was the only attacker arrested alive by police. He was hanged in Pune's Yerwada jail in secret on November 21, 2012, after he had exhausted all legal remedies.&nbsp;

The judge ruled that the extradition of Rana to India is fully under the jurisdiction of the treaty as there is also an extradition treaty in place between India and the United States.&nbsp;

The judge said that India has issued an arrest warrant and charged Rana with the following offences on which the US is proceeding:&nbsp; 
(a) conspiracy to wage war, to commit murder, to commit forgery for the purpose of cheating, to use as genuine a forged document or electronic record, and to commit a terrorist act&nbsp; 
(b) waging war,&nbsp; 
(d) murder,&nbsp; 
(e) committing a terrorist act&nbsp; 
(f) conspiracy to commit a terrorist act.&nbsp;

"The foregoing charged offences constitute extraditable offences within the meaning and scope of the Treaty and over which India has jurisdiction," the judge ruled.

"It is therefore ordered that Tahawwur Hussain Rana be and remain committed to the custody of the United States Marshal pending a final decision on extradition and surrender by the Secretary of State to India for trial of the offences as to which extradition has been granted pursuant to Title 18, United States Code, section 3186 and the Treaty," the judge ruled.&nbsp;

Assistant US attorney John J Lulejian in his submission said that the 59-year-old Rana had met all the criteria to be extradited to India to be tried.

"The United States respectfully requests that following the April 22, 2021, extradition hearing, the Court certify India's request for Rana's extradition for the Secretary of State's surrender decision," Lulejian said.

Rana, who was a childhood friend of David Coleman Headley, was re-arrested on June 10 in Los Angeles on an extradition request by India. Lulejian added that the criteria warranting certification of extradition was satisfied in this case.

Rana has been declared a fugitive by India.

"Fugitive Tahawwur Hussain Rana is wanted in India to stand trial for offences related to his role in the 2008 terrorist attacks in Mumbai, India, that resulted in the death of 166 people, the injury of 239 people, and the damage to property in excess of $ 1.5 billion," Lulejian said.

India's extradition request contains evidence to establish probable cause that the individual appearing in court is the fugitive who committed the offence for which extradition is requested, Lulejian said.

In his court submission, Rana's attorney had argued that Rana's extradition is barred under Article 6 of the United States-India extradition treaty as he had previously been acquitted of the offences for which his extradition was sought, and under Article 9 of the treaty because the government has not established probable cause to believe that Rana committed the alleged offences.

"Rana's attempts to undermine India's evidence of probable cause by questioning the credibility of the key witness, David Headley. Not only is Rana's challenge improper in this extradition proceeding but his claims are also not supported by the law or the evidence," Lulejian said.

The US district court judge in Los Angeles has scheduled Rana's extradition hearing for April 22.

In its motion on September 28, the US government supported Rana's extradition to India where he has been charged with the offenses of conspiracy to wage war, commit a terrorist act, the waging of war, the commission of murder, and a terrorist act.

Rana, in his defense, has argued that the US' decision not to extradite his co-conspirator, David Headley, to India is inconsistent and bars his extradition.

However, the US government argued differently "because Headley fulfilled the required terms, the plea agreement established that Headley would not be extradited to India," said US attorney Nicola T Hanna.

"Rana's situation is different because he neither pleaded guilty nor cooperated with the United States. As a result, cannot avail himself of the benefits afforded to Headley through his negotiated plea. Such a position is neither inconsistent nor a bar to extradition," he said.

Unlike Rana, Headley immediately accepted responsibility for his conduct and pleaded guilty to all of the charges in the Superseding Indictment, Hanna said.

As per the plea agreement, the United States agreed that it would not extradite Headley to India "for the foregoing offences, including conduct within the scope of those offences for which he has been convicted in accordance with this plea so long as he fully discloses all material facts concerning his role with respect to these offences and abides by all other aspects of this agreement."

Pakistan-born Rana completed Army Medical College there, and served in the Pakistani Army as a doctor for more than a decade, but eventually deserted.

He is currently a Canadian citizen but was a resident of Chicago where he had a business.

According to the court papers, he has also resided in and travelled to Canada, Pakistan, Germany and England and speaks seven languages.

According to the federal prosecutors, between 2006 and November 2008, Rana conspired with Headley, also known as 'Daood Gilani', and others in Pakistan to assist Lashkar-e-Taiba (LeT) and Harakat ul-Jihad-e-Islami, both US-designated terrorist organisations, to plan and carry out the Mumbai terrorist attacks.

Pakistani-American LeT terrorist Headley was involved in plotting the 2008 Mumbai terror attack.

He was made an approver in the case, and is currently serving a 35-year prison term in the US for his role in the attack.

The Indian government, with "full co-operation" from the Trump administration, is currently working on completing the necessary paperwork to ensure the extradition of the Pakistani-Canadian national before his current jail term ends in December 2021.

Rana was arrested in 2009 on the charges of plotting the 26/11 terror attack. Some 166 people, including US nationals, were killed in the attack carried out by 10 Pakistan-based Lashkar-e-Taiba (LeT) terrorists. Nine of the attackers were killed by police while lone survivor Ajmal Kasab was captured and hanged after handed down death sentence by an Indian court.

In 2013, Rana was sentenced to 14 years of imprisonment.&nbsp;

According to the US officials, he is set to be released in December 2021.

"There is a strong possibility of extradition of Rana to India on completion of his jail term here. We (US and India) are working on this," a source told PTI. 
But the "challenge" is to complete the necessary paperwork during this period and overcome the cumbersome bureaucracy of the two countries and the independent judiciary, the source said.

India's Ministry of External Affairs, Ministry of Home Affairs and Ministry of Law and Justice and the US' State Department and the Department of Justice, each of them has their own extradition procedure in place.

And they are unwilling to cut down or speed up their own process when it comes to extradition, it added.

Following a recent visit to the US by India's National Investigation Agency (NIA) team, officials from both sides have agreed to cut down on the bureaucratic procedures so that all the necessary paperwork is ready before the current jail term of Rana ends in December 2021.&nbsp;

From now on, the NIA is expected to have direct communication with their US counterparts to cut short the timeframe and bureaucratic formalities.

In case, the US government in co-operation with the Indian government is unable to complete the necessary paperwork before that, officials here said it would become very tough to ensure a smooth extradition of Rana once he is released from the jail in Chicago, where he is currently serving his sentence.

As per the existing US law, Rana, a Pakistan-born Canadian national, would most probably be deported to Canada if India and the US are unable to complete the cumbersome extradition process before his release.

However, people familiar with the matter told PTI, that there is a "desire" so there is assurance from the highest level in the Trump administration that all necessary steps would be taken in a timely fashion to ensure extradition of Rana before his release.

According to the US officials, the extradition of Rana would help in cementing the relationship between the two countries, boost up the counter-terrorism co-operation and enhance America's image among Indians.

On the 10th anniversary of the Mumbai terror attack, in November 2018, the Trump administration had reiterated its resolve to bring to justice those involved in it.&nbsp;

Vice President Mike Pence had raised this issue during his meeting with Prime Minister Narendra Modi in November.

'Strong possibility' of 26/11 accused Tahawwur Rana to be extradited to India: Sources

Rana is accused of helping Headley open an immigration firm in Mumbai with forged documents which in turn provided him with a cover for the reconnaissance of 26/11 targets.&nbsp;

The 26/11 attacks, which targetted Mumbai&#39;s key landmarks including the Chhatrapati Shivaji Terminus, the Oberoi Trident, Taj Mahal Palace Hotel and Leopold Cafe, were carried out by 10 LeT terrorists headed by Ajmal Kasab.&nbsp;
