Asif Ali Zardari, the widower of former assassinated Pakistani prime minister Benazir Bhutto, took oath on Sunday (March 10) as the 14th president of the South Asian country. Zardari, backed by Pakistan Peoples' Party and Pakistan Muslim League (Nawaz) secured 411 votes against 181 votes secured by Pakistan-Tehreek-e-Insaf-backed Mahmood Khan Achakzai.

Zardari was sworn in as the Pakistani head of state for the second time. He earlier served as the 11th president of Pakistan from 2008 to 2013 after his wife's assassination that took place during the military rule of General Pervez Musharraf.

Former president Dr. Arif Alvi, PML-N supremo Nawaz Sharif, Speaker National Assembly Ayaz Sadiq, former foreign minister Bilawal Bhutto Zardari, Bakhtawar Bhutto, Asifa Bhutto, Army Chief General Asim Munir, and Chairman Joint Chiefs of Staff Committee General Sahir Shamshad Mirza also attended the event.

Zardari took over as Pakistan's president weeks over a month after the country went to polls marred by blocked internet and widespread accusations of rigging. President Alvi, in the letter, stated that he had dissolved the National Assembly on August 9 on the Prime Minister’s advice.

He also mentioned Article 48(5) of the Constitution, which he said “empowers and mandates” the president ‘to appoint a date not later than 90 days from the date of the dissolution, for the holding of a general election to the Assembly’.

Hence, “in terms of Article 48(5), the general election to the National Assembly should be held by the 89th day of the date of dissolution of the National Assembly, i.e. Monday, 6th day of November 2023”, the letter stated.

The president recalled in the letter that “in an endeavour to fulfil the constitutional obligations”, the chief election commissioner was invited for a meeting to plan the modalities of enforcing the constitutional objective and directive.

But in his reply, the CEC “took a contrary view that as per the scheme of the Constitution and framework of electoral laws, it was the domain of the election commission, and following the publication of last preceding census on August 7, duly notified delimitation of constituencies was in progress, a mandatory requirement stipulated by Article 51(5) of the Constitution and section 17 of the Elections Act, 2017”, Dawn quoted the letter.

He then conceded that it was the ECP’s responsibility to follow all the constitutional and legal steps defined under ‘Articles 51, 218, 219, 220 and the Elections Act, 2017’ for organising and conducting free and fair elections.

President Alvi suggested that the ECP, in “consultation with provincial governments and political parties under the relevant provisions of the Constitution and in view that some of these matters are already subjudice, may seek guidance from the superior judiciary for announcement of a single date for general election to the national and provincial assemblies”, Dawn reported.

In fact, not one, the president has sought two raises, first with effect from 1st July 2021 and the second with effect from 1st July 2023.

As of today, the president is entitled to have a monthly salary of $2800 (Pakistan Rupees 846,550). Dr Alvi wants it raised to $3360 (Rs 1,024,325) and $4034 (Rs 1,229,190) per month with effect from July 2021 and July 2023 respectively.

The President’s Secretariat earlier this month wrote a letter to the Secretary Cabinet through his Military Secretariat, demanding that desired amendments must be implemented. He sought an amendment in the Fourth Schedule of the President’s Salary Allowances and Privileges (Amendment) Act, 2018.

Upon receiving the request, the Secretary Cabinet forwarded the matter to the law ministry of Pakistan, which on August 18 advised the former to register the case and process a salary hike.&nbsp;

The law ministry in a statement said, “The Federal Government by virtue of section 3(2) of the same Act has the power to amend that Schedule by way of a notification in the official gazette henceforth in relation to the issue at hand the Federal Government is competent to amend the Fourth Schedule by way of gazette notification and no amendment in the Fourth Schedule is required via an amending Act to effectuate a revision in the salary of the President.”

<h2>What next?</h2>

The finance ministry also examined the matter and, on August 22, endorsed the suggested salary raise for the president. This adjustment involves amending the Fourth Schedule of the President (Salary, Allowances &amp; Privileges) Act, 1975.

The next step involves presenting this matter to the cabinet for approval. Along with the proposed increases, the president is anticipated to receive substantial arrears due to two-step raises being applicable from July 2021 and July 2023 respectively.

From $2800 to $4000: President of cash-strapped Pakistan demands massive hike in monthly salary

This comes after the country’s media reported that the president has given his assent to the Of­­ficial Secrets (Amend­m­ent) Bill 2023 and the Pakistan Army (Amend­ment) Bill 2023.&nbsp;

<h2>What did the Pakistan president say?</h2>

The Pakistan president issued the statement amid media reports of him approving the bills, on Saturday. This was weeks after the bills were approved by the Senate and National Assembly and were sent for Alvi’s final signature.&nbsp;

“I did not sign Official Secrets Amendment Bill 2023 &amp; Pakistan Army Amendment Bill 2023 as I disagreed with these laws. I asked my staff to return the bills unsigned within stipulated time to make them ineffective,” said Alvi, on X (formerly Twitter).&nbsp;

He added, “I confirmed from them many times that whether they have been returned and was assured that they were. However, I have found out today that my staff undermined my will and command. As Allah knows all, He will forgive Insha’Allah. But I ask forgiveness from those who will be affected.”&nbsp;

<h2>What are the proposed changes?</h2>

The proposed section 6-A of the Secrets Act would make unauthorised disclosure of the identities of members of intelligence agencies, informants or sources, an offence, as per Dawn. The offence would be punishable by up to three years in prison and a fine of up to Pakistani rupee 10 million ($33,759).&nbsp;

Meanwhile, the Army Act would make disclosing any information, acquired in an official capacity that is or may be prejudicial to the security and interest of Pakistan or the armed forces, punishable by up to five years imprisonment.&nbsp;

As per Pakistan media reports, one of the amendments in the act also grants more powers to the army chief and would prevent ex-servicemen from engaging in politics or opting for ventures that may be perceived as conflict with the army’s interest.&nbsp;

The bill also proposes imprisonment for defamation of the army. The proposed law would also forbid any person who has been subjected to the Army Act from engaging in any kind of political activity for two years from the date of their “retirement, release, resignation, discharge, removal or dismissal from the service,” as per the Dawn.

<h2>Pakistan government expresses 'grave concern'&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;</h2>

After the Pakistan president's post on X, the Ministry of Law and Justice released a statement saying that they had&nbsp;noted the post with "grave concern". "As per Article 75 of the Constitution, when a Bill is sent for assent, the President has two options: either give assent, or refer the matter to the parliament with specific observations. Article 75 does not provide for any third option," it added.&nbsp;&nbsp;

It also said that in this case&nbsp;neither of the requirements were fulfilled and the president instead "purposely delayed the assent." The ministry also noted that returning the bills without any&nbsp;observations or assent was unconstitutional.&nbsp; 
 
"If the President had any observations, he could have returned the bills with his observations like he did in the recent and distant past. He could have also issued a press release to that effect.&nbsp;It is a matter of concern that the President has chosen to discredit his own officials," said the Pakistan government.&nbsp; 
 
It added, "The President should take responsibility for his own actions."&nbsp;

“We had earlier decided that the caretaker PM should be someone from a smaller province and a non-controversial personality. Our aim was to remove the sense of deprivation in small provinces,” said Riaz after a meeting with the outgoing premier, as quoted by the Dawn.

He added, “We have finally reached a consensus that Anwaarul Haq Kakar will be the caretaker PM.”&nbsp;

“I had given this name and the PM has consented to this name…I and the PM have signed on the summary,” he told reporters, adding Kakar would take oath as the head of the interim set-up on Sunday, August 13.

This comes a day after Shehbaz said that the Constitution of Pakistan gives eight days to appoint the caretaker PM after the dissolution of assemblies. The National Assembly was dissolved by President Arif Alvi, on August 9 on the advice of the incumbent premier.&nbsp;

According to Pakistan law, since Pakistan’s parliament was dissolved on Wednesday, election should be held within 90 days. However, the results of the latest census released last week means more time will likely be needed to redraw constituencies.

The decision, on Saturday, also comes after the first meeting between the incumbent PM and the leader of the opposition which was held on August 10, during which they both exchanged a list of possible candidates.&nbsp;

This was followed by a second round of talks, on Friday (August 11) night during a dinner hosted by PM Shehbaz for leaders of the outgoing ruling alliance.

Kakar began his journey as an independent senator from Balochistan back in 2018 and his six-year term will conclude in March 2024. He is also the chairperson of the Senate Standing Committee on Overseas Pakistanis and Human Resource Development and a member of the Business Advisory Committee, Finance and Revenue, Foreign Affairs and Science and Technology, as per Dawn.&nbsp;

Pakistan: Balochistan lawmaker Anwar Ul Haq Kakar chosen as caretaker prime minister

In a strongly worded letter Prime Minister Shehbaz Sharif, on Sunday (March 26) responded to President Dr Arif Alvi’s letter which was sent to him two days ago. The PM said that the president’s letter was “blatantly partisan” and in parts read like “a press release” of the opposition political party Pakistan Tehreek-e-Insaf (PTI).&nbsp;

This was stated&nbsp;in reference to a letter sent by Alvi to Sharif, on Friday, asking him to direct federal and provincial authorities to assist the Election Commission of Pakistan (ECP) to hold elections in Punjab and Khyber Pakhtunkhwa. The request was reportedly in line with the Supreme Court’s orders to “avoid further complications”.&nbsp;

The president also mentioned the “use of disproportionate force” by authorities against politicians, party workers and journalists amid recent clashes with former prime minister Imran Khan’s PTI. This prompted PM Sharif to respond and “set the record of the government straight” while accusing President Alvi of constantly espousing “one-sided, anti-government views…notwithstanding your constitutional oath/office of President”.

He accused Alvi of violating his oath of office on several occasions including the order of the dissolution of the National Assembly on April 3, last year, following “illegal instructions” by the former PM Imran Khan which the Supreme Court days later also declared unconstitutional. PM Sharif also accused the president of “failure to discharge” his constitutional duty citing clause (5) of Article 91 to “call upon me to assume the office of the Prime Minister and administer the oath of office.”&nbsp;

He added, “Despite the foregoing and several other instances, where you actively worked towards undermining a constitutionally elected government, I have made all-out efforts to maintain a good working relationship with you. However, the contents of your letter, its tone, and language have compelled me to respond to it.”&nbsp;

The Pakistan PM addressing the country’s president also stated, “regrettably and ostensibly due to your party allegiance, you have failed to note the sheer isolation of laws, contumacious disregard of court orders, attacking the law enforcement agencies, damaging public property, attempts to create chaos, civil and political unrest, and in short, to bring the country to the brink of economic default and civil war by the Pakistan Tehreek-e-lnsaf (PTI).”&nbsp;

In the letter, Sharif asserted that actions by the authorities&nbsp;were in accordance with the law and that PTI’s complete disregard for the law tarnished the image of Pakistan in the international community. He also called Alvi out for not addressing the former PM’s conduct despite being the president and described Khan’s actions as an “aggressive, rather militant, attitude of a political order in complete defiance of court orders”.

The charges entail that the former President took out a loan worth Rs 1.5 billion from the National Bank of Pakistan in the name of Parathon and transferred to the company account in a private bank.

Zardari, who is already in the custody of the anti-corruption watchdog, is set to appear in front of the Accountability Court on Tuesday with regards to the allegations on him.

The investigating officer in the money laundering case will request for an extension in his remand, while another officer will request his remand in the Park Lane case.

If the court approves his physical remand in both cases then the investigating officers will have the right to question him in their respective cases, Samaa news agency reported.

Warrants for the Pakistan People's Party (PPP) co-chairman's arrest were issued after bail pleas of the accused were withdrawn earlier.

The Park Lane Estate company is a Karachi-based real estate firm. The anti-graft watchdog had initiated an inquiry against him and his son, Bilawal Bhutto Zardari, on charges that they illegally transferred forest land to the firm in collusion with some government officials. Bilawal was given a clean chit in the case on June 12.

The money laundering case, on the other hand, refers to the embezzlement of Rs 4.4 billion. NAB has accused Zardari and his sister, Member of the Provincial Assembly (MPA) from Faryal Talpur, of owning shares of the Zardari Group, a company that received some of the embezzled funds.
