Lok Sabha passes National Investigation Agency (Amendment) Bill

The Lok Sabha on Monday took up the discussion on an amendment bill that seeks to strengthen the National Investigation Agency (NIA) by empowering it to probe offences committed outside India against Indian citizens or affecting the interests of India.

The Bill seeks to amend the NIA Act, 2008.

Reddy said that terrorists outside India had been making efforts to target India.

He said that there should be an agency to probe cases if Indian embassies, its flights or non-resident Indians are targetted by terrorists and the Bill seeks to provide such powers to NIA.

The minister said that NIA probes have yielded good results and out of the 272 cases registered, judgment has been delivered in 52 cases, while there is a conviction in 46 other cases.

"There has been a conviction in big cases. There have been 90 per cent conviction," Reddy said.

The union minister said that special courts have been constituted to decide cases probed by NIA but there is some delay if a judge is transferred, promoted or retires.

He added that the process is being simplified to avoid delay and expedite the trial process.

The Bill also seeks to strengthen powers of NIA in cases involving explosives and the responsibility in cases of human trafficking will be given to the investigation agency, Reddy said.

He stressed that the agency will be empowered to probe cases involving `prohibited arms` and powers in handling cases of cyber-terrorism will be strengthened.

Reddy said that Prime Minister Narendra Modi has stressed that there will be zero tolerance in terrorism cases.

A two-member team of India's National Investigation Agency (NIA) is in Sri Lanka to hold discussions with authorities about a probe in the Easter Sunday bombings over claims that some terrorists, owning allegiance to ISIS, had travelled to India, including Kashmir, officials said Wednesday.

The NIA team is led by Inspector General Alok Mittal, who has probed various ISIS-related cases in South India, including a conspiracy by the terror module to kill prominent leaders.

During investigations in the case, the NIA had alerted the island nation that ISIS terrorists were planning to carry out strikes there. India had been regularly sharing intelligence inputs about a possible terror attack in Sri Lanka targeting the Indian High Commission and religious places there.

The inputs to Sri Lanka were sent through diplomatic channels after a thorough investigation pertaining to the ISIS case in Coimbatore was carried out by the NIA, which has filed a charge sheet against seven people.

The Indian delegation will give a detailed briefing about its probe during which it had stumbled upon videos of National Thowheed Jamaat (NTJ) leader Zahran Hashim, which was indicative of a terror attack on religious places as well as the Indian High Commission in Colombo.

Hashim was among the nine suicide bombers, including a woman, who carried out a series of blasts in Sri Lanka in which 253 people were killed on April 21.

The videos, seized from the accused in the Coimbatore case, showed Hashim asking youths from Sri Lanka, Tamil Nadu and Kerala to establish
an Islamic rule in the region.

After the blasts in Sri Lanka, the NIA had arrested 29-year-old Riyas A, also known as Riyas Aboobacker or Abu Dujana, a resident of Palakkad. He is alleged to be in touch with Hashim on social media platforms, the officials said.

The accused had disclosed during investigations that he had been following speeches of Hashim for more than a year and has also followed the speeches delivered by controversial Islamic preacher Zakir Naik.

According to inputs with the central agencies, Hashim had spent time in India last year during which he attempted to influence youths in Tamil Nadu and Kerala to join him.

Hashim had parted ways from Sri Lankan National Thowheeth Jamaat (NTJ) to form his own outfit Nation of Thowheed Jamaat which is alleged to have carried out the Easter attack in Sri Lanka.

The team will also ask about the claims made by Lieutenant General Mahesh Senanayake, the commander of the Sri Lankan Army, that the suicide bombers had travelled to some cities in India, including Kashmir.

"They (the suspects) have gone to India, they've gone to Kashmir, Bangalore, they've travelled to Kerala state. Those are the information available with us," he had said to BBC earlier this month.

However, the Jammu and Kashmir police had denied about it and had asked the Sri Lankan authorities to share more information about it.

Some officials of the central security agencies said that about a dozen Sri Lankan nationals had come to Kashmir Valley this year and their credentials have been re-checked after the bombings in three churches and three luxury hotels killed 253 people and injured over 500 others.

However, there could be a possibility of the bombers visiting the state using pseudonym, one of the officials said, adding if Sri Lanka hands over some evidence, it can be verified from the ground.

The Sri Lankan Army chief had said that some of the suicide bombers, who carried out the country's worst terror attack, visited Kashmir and Kerala for "some sorts of training" or to "make some more links" with other foreign outfits.

Jaish-e-Mohammed (JeM) carried out infiltrations and transportation of terrorists seven times during 2017-18, the National Investigation Agency (NIA) has said in a charge-sheet.

“Pakistan based leadership of JeM illegally infiltrated armed and trained terrorists in India using the services of an organised network of Over Ground Workers (OGWs). The investigation revealed that in the period from 23rd October 2017 till September 2018, seven such infiltrations and transportations took place,” the charge-sheet, filed in a court here, said.

After the conclusion of the chase, the OGWs were arrested and a huge cache of arms ammunition, explosives and combat equipment were seized from the truck in which the three terrorists were being ferried by the arrested persons,” the NIA further stated in the charge-sheet.

The National Investigation Agency (NIA) on Wednesday took over the probe into the February 14 terror attack in Pulwama from the Jammu and Kashmir police, officials said.

The agency has re-registered the case and formed a team to investigate the terror strike in which 40 CRPF personnel were killed, an NIA spokesperson here said.

The state police had registered a case at the Awantipora police station on February 14 after a suicide bomber blew himself up next to a CRPF bus, which was part of a 78-vehicle convoy carrying over 2,500 personnel on their way from Jammu to Srinagar.

The NIA has already gathered explosive material from the blast site in Lethpora in Pulwama district of south Kashmir and has been involved in the questioning of around a dozen people detained by police following the bombing, officials said.

The agency has also met senior police, intelligence and army officers to gather whatever evidence they have, they said.

The NIA will probe the planning and execution of the terror attack, the second such in three decades of militancy in the state. In 2000, a 17-year-old Kashmiri boy had blown himself outside the Srinagar-based army cantonment in the year 2000, killing two Army men.

On Monday, three Jaish terrorists were killed in a 16-hour operation in Pulwama's Pinglan area, 12 km from the spot of the February 14 attack. An Army major and four security personnel also lost their lives.

Police and the Army announced Tuesday that these terrorists were responsible for last Thursday's attack.

In a relief to Kerala-based Hadiya, an alleged victim of love jihad, the Supreme Court today set aside the high court order annulling her marriage to a Muslim man.

A bench comprising Chief Justice Dipak Misra and justices A M Khanwilkar and D Y Chandrachud, however, said that the National Investigation Agency (NIA) may continue its investigation in the matter.

The apex court had in August last year asked the NIA to probe the case of conversion and marriage of Hadiya, as the agency claimed a "pattern" was emerging in Kerala.

The matter came to the fore when Shafin Jahan, Hadiya's husband, had challenged a Kerala High Court order annulling his marriage with her and sending the woman to her parents' custody.

On November 27 last year, the apex court had freed Hadiya from her parents' custody and sent her to college to pursue her studies, even as she had pleaded that she should be allowed to go with her husband.

The high court had in May last year annulled the marriage terming it as an instance of 'love jihad', following which Jahan had approached the apex court.

The court however said the NIA could continue its investigation into whether Hadiya's marriage to Shafin Jahan was an example of 'love jihad'

The Crime Branch of city police today brought 2008 Ahmedabad serial blasts accused Abdul Subhan Qureshi here from Delhi, over a month after the Delhi police's special cell arrested him, a top official said.

He was produced in the special court set up for conducting the trial of the blasts case, which remanded him in police custody till March 23.

Serial blasts killed 56 people and injured 240 others in Ahmedabad on July 26, 2008.

"Qureshi is one of the key conspirators of the 2008 blasts. He had been in touch with the absconding accused, such as founder leader of the banned outfit Indian Mujahideen Riyaz Bhatkal, and had worked with some of the arrested accused," Joint Commissioner of Police (Crime) J K Bhatt said here.

So far, police have arrested 81 persons in the blasts case, while thirteen are absconding.

"Qureshi stayed in Vatva locality in Ahmedabad where he trained and mentored other accused...And was in touch with IM mastermind Bhatkal. We have learnt he also attended a terrorist camp in Halol and another camp in Kerala," Bhatt said.

"We will take him to Vatva, Vadodara, Halol and another place where he had stayed before the blasts. We would like to find out how he was associated with the SIMI and IM, and who helped him," the senior police official said.

Qureshi, who holds a diploma in electronic engineering, is technology savvy, and played important role in making the explosive devices used in the blasts by getting information from the internet, Bhatt said.

He could be involved in other blasts in the country too, the official added.

"We have learnt that after the blasts in Ahmedabad, he fled to Nepal where he lived for six years and taught English. He also went to Saudi Arabia. We will try to find out what he did in Saudi Arabia and who helped him in Nepal," Bhatt said.

"We are coordinating with the Delhi Police's Special Cell. They are forming an interrogation squad so that we know more about his Nepal stay," he said.

Qureshi was arrested from Ghazipur in east Delhi in January this year.

Delhi police alleged that Qureshi was indoctrinating unemployed youth to fill the void left by the fall of top IM operatives, and planned to revive IM's terror network in Uttar Pradesh, Maharashtra, Karnataka, Gujarat and Madhya Pradesh.

He was wanted by the National Investigation Agency in the December 2007 Wagamon SIMI arms training camp case, and by Maharashtra Police in July 2011 Mumbai blasts case.

Abdul Subhan Qureshi was produced in the special court set up for conducting the trial of the blasts case, which remanded him in police custody till March 23
