<p>The&nbsp;<strong>Pakistani National Assembly</strong> or lower house of the Parliament passed the bill which was introduced first as an ordinance last year.&nbsp;The ordinance, issued in May, sought to implement ICJ's&nbsp;2019 verdict that called for the review of the order given out by a military court on Jadhav.</p>

<p>The spokesperson highlighted that under the bill&nbsp;"municipal courts in Pakistan to decide whether or not any prejudice has been caused to Shri Jadhav on account of the failure to provide consular access" which is "clearly a breach of the basic tenet that municipal courts cannot be the arbiter of whether a state has fulfilled its obligations in international law".</p>

<p>Last year India did try to file a petition under the ordinance but in absence of power of attorney and supporting legal documents, it&nbsp;could not be done. Pakistan later went to the <strong>Islamabad High Court </strong>to get a lawyer to file an appeal in the Jadhav case.</p>

<p>The Islamabad High Court (IHC) will hear a plea submitted by the federal government against Indian death-row prisoner Kulbhushan Jadhav's sentence on Monday.</p>

<p>The IHC on Thursday constituted a two-member bench to hear a review petition filed by the Pakistan government.</p>

<p>The bench, comprising IHC Chief Justice Athar Minallah and his fellow judge Justice Miangul Hassan Aurangzeb, &nbsp;would take up the government plea on August 3, the Pakistani media, including the Geo News, reported.</p>

<p>In a unilateral move, Pakistan filed the petition in the IHC on Jul 22, seeking appointment of a "legal representative" for Jadhav.</p>

<p>However, the main parties, including the government of India, were not consulted ahead of the filing of the application by the Ministry of Law and Justice under an ordinance which was enacted on May 20.</p>

<p>Under the 'International Court of Justice Review and Reconsideration Ordinance 2020', which was enacted on May 20, a petition for the review of a military court's decision can be made to Islamabad High Court through an application within 60 days of its promulgation.</p>

<p>The ordinance was approved by the parliament this week.</p>

<p>Jadhav, the 50-year-old retired Indian Navy officer, was sentenced to death by a Pakistani military court on charges of espionage and terrorism in April 2017. India approached the ICJ against Pakistan for denial of consular access to Jadhav and challenging the death sentence.</p>

<p>The Hague-based ICJ ruled in July 2019 that Pakistan must undertake an "effective review and reconsideration" of the conviction and sentence of Jadhav and also to grant consular access to India without further delay.</p>

<p>The Pakistan government, in the petition, has asked the IHC to appoint a legal representative for Jadhav so that Pakistan can fulfil its responsibility to see to the implementation of the ICJ's decision, local media reports said.</p>

<p>Pakistan Foreign Office spokesperson Aisha Farooqui last week said that the "necessary steps" have been taken to implement the verdict of the ICJ.</p>

<p>The Pakistan government has claimed that Jadhav refused to file a review petition or an application to reconsider the verdict.</p>

<p>In New Delhi, External affairs ministry spokesperson Anurag Srivastava last week said Pakistan has once again exposed its "farcical" approach by denying available legal remedies to Jadhav against his death sentence which is also in contravention of the ICJ verdict, and asserted that it will explore further options in the case.</p>

<p>Srivastava said Pakistan has blocked all the avenues for an effective remedy available to India in the case, while noting that New Delhi has so far requested consular access to Jadhav for 12 times over the past one year.</p>

<p>"The whole exercise of not providing documents related to the case even after repeated requests, not providing an unimpeded consular access and some reported unilateral action of approaching the High Court on part of Pakistan again exposes the farcical nature of Pakistan's approach," he said.</p>

<p>The MEA spokesperson said Pakistan is not only in violation of the judgment of ICJ, but also of its own ordinance.&nbsp;</p>

Might have to go back to ICJ over Jadhav case, says Harish Salve

<p>International Court of Justice (ICJ) President Judge Abdulqawi Yusuf at the United Nations General Assembly (UNGA) on Wednesday said that the top world court has found that Pakistan committed a violation in the Kulbhushan Jadhav case by not granting his consular access to India.&nbsp;</p>

<p>"In its judgment (in Jadhav case), the Court found that Pakistan had violated its obligations under Article 36 of the Vienna Convention and that appropriate remedies were due in this case," Yusuf said as reported by news agency ANI.</p>

<p>Yusuf said that Pakistan wrongly stated that its provisions were not applicable to prisoners suspected of espionage.</p>

<p>Pakistan, last week, said it has provided consular access to Indian national Kulbhushan Jadhav and has now initiated "logical and legal steps" in the case.</p>

<p>"Pakistan granted consular access to Kulbhushan Jadhav. Now logical and legal steps has been initiated in the matter," Pakistan foreign office spokesperson Mohammed Faisal told a press briefing.&nbsp;</p>

<p>India has rejected Pakistan's allegations about Jadhav's involvement in spying and subversive activities and said he was kidnapped by from Iranian port of Chabahar, where he was running a business.&nbsp;</p>

<p>Pakistan had announced in April 2017 that Jadhav has been given death sentence by a military court after which India moved the Indian Court of Justice.&nbsp;</p>

<p>The ICJ in July had asked Pakistan to comply with the Vienna Conventions and provide consular access to Jadhav and to ensure "effective review and reconsideration of his conviction and sentences".</p>

<p>Pakistan had first offered the consular access to Jadhav in August but India had insisted that the consular access should be "effective and unhindered."</p>

<p>On September 2, India's Deputy High Commissioner to Pakistan Gaurav Ahluwalia met Jadhav in the presence of Pakistani officials. It was a recorded meeting.&nbsp;</p>

<p>Harish Salve who had represented India in <a href="https://www.wionews.com/india-news/big-win-for-india-icj-grants-consular-access-to-kulbhushan-jadhav-236703">the Kulbhushan Jadhav case</a> said he had challenged Pakistan's conduct in the case at the international court of justice(ICJ).</p>

<p>"I express my gratitude of my country to the ICJ for the manner in which it intervened in this case. It protected Kulbhushan Jadhav from being executed in a hearing which was put together in a matter of days," Salve said at a press conference after the ICJ allowed India consular access to Jadhav.</p>

<p>"We made Pakistan adhere to the Vienna Convention," he declared. During the hearing at the ICJ, Salve had questioned the death sentence given to Jadhav by Pakistan's military court.</p>

<p>"Jadhav has&nbsp;to be allowed consular access," he said. "There has to be fair adjudication of consular access," he added.</p>

<p>"Pakistan repeatedly played slides of what it claimed was passport it had recovered from Jadhav. Not only did the court get drawn into it, the&nbsp;displaying of the passport led to the court to reject&nbsp;Pakistan's argument that Jadhav's nationality was uncertain," India's advocate&nbsp;in the Jadhav case said.</p>

<p>"I have a degree of personal satisfaction that a lot of adjectives were used by Pakistan, even in replying at court I characterise them as unfortunate."</p>

<p>"I said it's my upbringing and India's tradition which stood in my way of replying to them in that language," Salve added.</p>

<p>During the trial at the ICJ, Salve asserted that Pakistan had "extracted confession" from Jadhav on spying in Pakistan. India had filed a claim against Pakistan before the ICJ in May 2017 arguing Islamabad had breached the 1963 Vienna Convention by not allowing diplomatic assistance to Jadhav during his secretive trial.</p>

<p>Upholding India's stand, the world court said that Pakistan had violated the 1963 Vienna Convention on consular relations by "depriving India of the right to render assistance provided for by the Vienna Convention to Jadhav".</p>

<p>The court found that Pakistan had "deprived India of the right to communicate with and have access to Kulbhushan Sudhir Jadhav, to visit him in detention and to arrange for his legal representation."</p>

<p>On the death sentence delivered to Jadhav by Pakistan's military court, the ICJ said that Pakistan must provide "by the means of its own choosing, effective review and reconsideration of the conviction and sentence of Kulbhushan Sudhir Jadhav".</p>

<p>Kumar said the Pakistani press, despite prior agreement that the media would not be allowed close access, was allowed on multiple occasions to approach the family members closely, harass and hector them and hurl false and motivated accusations about Jadhav.&nbsp;</p>

<p>The Pakistan Ministry of Foreign Affairs (MoFA) clarified that the screen was placed due to security reasons and that Jadhav already knew this would be the setting.&nbsp;</p>

<p>It buttressed its stance by adding that Islamabad considered Jadhav as &quot;the face of Indian terrorism, especially in Pakistan.&quot;&nbsp;</p>

<p>In addition to this, the MoFA released another &quot;confessional&quot; video of Jadhav`s, in which the convicted alleged spy was seen confessing that he did cross from Iran to Pakistan two years back.&nbsp;</p>
