Three, Jadhav, even with the comfort of consular access, could continue to languish indefinitely in prison. Four, in prison, Jadhav would be in danger of being killed by one or more of the criminal inmates. Pakistan asked to carry out effective review of the death sentence given to Jadhav: "The Court further finds that the appropriate reparation in this case consists in the obligation of the Islamic Republic of Pakistan to provide, by the means of its own choosing, effective review and reconsideration of the conviction and sentence of Jadhav, so as to ensure that full weight is given to the effect of the violation of the rights set forth in Article 36 of the Convention," the ICJ said in its order today.

Moreover, the entire judicial process of Pakistan was found inadequate in the case. The ICJ rejected the objections put forward by Pakistan to the admissibility of India's application. "The ICJ has ruled in favour of India on merits, affirming Jadhav's right to consular access and notification," Reema Omer, international legal advisor, South Asia, of the ICJ said on Twitter.

Lastly, India can again raise the matter with the court, if review by Pakistan is considered not to be effective.

But there are issues which do worry the Indian government:

Kulbhushan Jadhav's release has not been ordered: "With regard to India's contention that it is entitled to restitutio in integrum and its request to annul the decision of the military court and to restrain Pakistan from giving effect to the sentence or conviction, and its further request to direct Pakistan to take steps to annul the decision of&nbsp; the&nbsp; military&nbsp; court, to release Mr. Jadhav and to facilitate his safe passage to India, the Court reiterates that it is not the conviction&nbsp; and sentence of Mr. Jadhav which are to be regarded as a violation of Article 36 of the Vienna Convention. The Court also recalls that "[i]t is not to be presumed... that partial or total annulment of conviction or sentence provides the necessary and sole remedy" in cases of violations of Article 36 of the Vienna Convention. Thus, the Court finds that these submissions made by India cannot be upheld," the court said in its 42-page order.

Closing the arguments, Pakistan's Attorney General Anwar Mansoor Khan said, "India seeks relief which they cannot claim from this court."

Asserting that the military court in Pakistan works according to the Constitution, he asked the ICJ to "dismiss India's request" in the case.

Khan also assured the court that the process of judicial review in Pakistan was robust and Jadhav can avail it if he chooses.

"Jadhav has been charged with terrorism for which an FIR has been registered with the police that is a civilian agency. The military courts have sufficient proof of espionage and the said military court on the available evidence and the judicial confession proceeded to convict him despite he being given the option of going for a judicial review, he has refused to do so," Khan told the court.

He said India claims consular access, "surely (it) was not allowed for good reason in terms of the agreement of 2008, specially for the reason that commander Jadhav being involved in espionage."

Khan also raked up the Kashmir issue and said Pakistan was awaiting India's response on Samjhauta train blast case and has sought evidence on his country's role in the Pulwama terror attack.

After his submission, ICJ top judge Abdulqawi Ahmed Yusuf adjourned the hearing and said a date for the judgement would be announced later.

On Wednesday, Harish Salve, who was representing India in the case, said that the time has come for the ICJ to make Article 36 a potent weapon for protecting human rights.

While India argued on Monday and Pakistan responded to India's arguments on Tuesday. India will reply on February 20 while Islamabad will make its closing submissions on February 21.

It is expected that the ICJ's decision may be delivered by the summer of 2019.

Both India and Pakistan have already submitted their detailed pleas and responses in the world court.

Pakistan claims that its security forces arrested Jadhav from restive Balochistan province on March 3, 2016, after he reportedly entered from Iran.

However, India maintains that Jadhav was kidnapped from Iran where he had business interests after retiring from the Navy. Jadhav's sentencing had evoked a sharp reaction in India.

"Iran comes to the court with unclean hands. Indeed, it is a remarkable show of bad faith," Richard Visek, a US State Department legal official, told the court.

"The actions at the root of this case centre on Iran's support for international terrorism... Iran's bad acts include supports for terrorist bombings, assassinations, kidnappings and airline hijackings," he said.

Visek also accused Iran's "most senior leaders" of the "encouragement and promotion of terrorism" and "violation of nuclear non-proliferation, ballistic missile and arms trafficking obligations".

Iran's use of the 1955 treaty to lodge the case was an "abuse of process", he added.

The ICJ was set up after World War II to rule on disputes between United Nations member states. Its rulings are binding but it has no power to enforce them.

In Washington, Secretary of State Mike Pompeo said: "We owe it to our fallen heroes, their families, and the victims of Iran’s terrorist activities to vigorously defend against the Iranian regime’s meritless claims this week in The Hague."

And "we will continue to fight against the scourge of Iran’s terrorist activities in all venues and will continue to increase the pressure on this outlaw state," Pompeo said.&nbsp;

At Monday's hearing, a 15-judge bench listened to US arguments over whether the ICJ can take up the case under its strict rules governing its procedure.

The terror attacks whose American victims were to be compensated under the April 2016 Supreme Court ruling included the 1983 bombing of a US Marine barracks in Beirut, in which 241 soldiers were killed, and the 1996 Khobar Towers bombing in Saudi Arabia. The decision affects a total of more than 1,000 Americans.

"In its opinion, the measures adopted by the United States have the potential to endanger civil aviation safety in Iran and the lives of its users to the extent that they prevent Iranian airlines from acquiring spare parts and other necessary equipment as well as from accessing associated services necessary for civil aircraft," it added.

"Unanimously both parties shall refrain from any action which might aggravate or extend the dispute before the court or make it more difficult to resolve," the UN court ordered.&nbsp;

Iran called the ruling a "clear sign" that "Iran is in the right".

The ruling by the International Court of Justice "once again shows that the US government... is day by day becoming more isolated," Iran's forign ministry said in a statement.

The UN's top court gave its judgement after Iran had filed a case against the US for imposing sanctions against it. Iran said the sanctions violated the 1955 Treaty of Amity. The US had argued that Iran was misusing the international court.

ICJ ruling on Iran meritless, says US

India on Tuesday submitted its reply in the International Court of Justice in connection with the Kulbhushan Jadhav case.

This is India's second written pleadings in the court after the <a href="http://www.wionews.com/india-news/kulbhushan-jadhav-case-india-submits-written-pleadings-to-the-international-court-of-justice-20184">first filed&nbsp;on September 12, 2017</a>.

In response to the first pleadings, Pakistan filed its counter-reply to the International court on December 13.

Pakistan claims its security forces arrested him from restive Balochistan province on March 3 in 2016 after he reportedly entered from Iran. However, India maintains that Jadhav was kidnapped from Iran where he had business interests after retiring from the Indian Navy.

India submits second reply to ICJ in Kulbhushan Jadhav case

The UN's top court said Thursday it will hold hearings in June into Malaysia's request to overturn its ruling in a decades-old dispute with Singapore over a tiny but strategic island.

The International Court of Justice (ICJ) "will hold public hearings in the case concerning the revision of the judgement of 23 May 2008 in the case concerning sovereignty over Pedra Branca/Pulau Batu Puteh."

Four days of audiences will be held starting on June 11 in the imposing tribunal housed in the Peace Palace in The Hague, the ICJ added in a statement.

Malaysia lodged its case in February 2017, calling for the court to overturn its 2008 ruling granting its neighbour sovereignty over the disputed rocky outcrop.

Kuala Lumpur maintained new documents had been discovered in British archives backing its territorial claim to the islet.

Malaysia calls the island Pulau Batu Puteh, while Singapore dubs it Pedra Branca (white rock).

The island is in a strategically important position, 7.7 nautical miles (14 kilometres) off Johor on the eastern approach to the Singapore Strait from the South China Sea.

Singapore had operated the Horsburgh Lighthouse on the granite island for more than 130 years without protest from its neighbour.

But in a map of its maritime boundaries drawn up in 1980, Kuala Lumpur staked its claim to the islet.

After years of failed negotiations, the parties turned to ICJ, which in 2008 ruled the island belonged to Singapore.&nbsp

Another rocky outcrop called Middle Rocks was found to belong to Malaysia, while a low-tide bank called South Ledge was deemed to be in overlapping territorial waters.

But in its 2017 filing, Malaysia asked the court to revise that judgement based on the discovery of three documents in the British national archives between August 2016 and late January 2017.

They included internal correspondence from the Singapore colonial authorities in 1958, a British naval incident report from 1958 and a map from the 1960s.

Kuala Lumpur maintained these documents showed that "officials at the highest levels in the British colonial and Singaporean administration appreciated that Pedra Branca/Pulau Batu Puteh did not form part of Singapore's sovereign territory," according to the ICJ.

Under the court's rules, states can ask for a judgement to be revised if new facts come to light within 10 years of the first ruling.

In a separate filing, Malaysia has also asked for an interpretation of the 2008 ruling, saying despite having formed a joint committee with Singapore the two countries have failed to delimit their maritime borders in the area.

The ICJ will also hold four days of hearings on this filing between June 18 to 22.

Pakistan has summoned India&#39;s Deputy High Commissioner J P Singh over the alleged harassment of officials and families of the Pakistan High Commission in New Delhi, according to Pakistan Foreign Affairs Ministry.

Singh was summoned after Pakistani newspaper Dawn quoted Pakistani officials of accusing India of harassing its diplomats and their families in the country and threatened to pull out the families if the intimidation did not stop.

He was summoned by Director General (South Asia &amp; SAARC) Mohammad Faisal and a strong protest was lodged at the &quot;maltreatment being meted out to the officials and families of the Pakistan High Commission in New Delhi&quot;, according to a statement by the Office of Spokesperson of Pakistan Foreign Affairs Ministry here.

Faisal emphasised that under the Vienna Convention, the safety and the security of Pakistani diplomats and their families is the responsibility of the Indian Government.

A demarche was earlier made to the Indian High Commission in Islamabad and the external affairs ministry in Delhi, a diplomatic source was quoted as saying by the Dawn.

However, sources in New Delhi said India has repeatedly requested Pakistan to mutually ensure that High Commissions are allowed to do their job in an atmosphere free of harassment and intimidation, that staff be allowed to work and that construction projects get completed on time.
