Religion is a personal belief and whether to convert to a different faith or not is an individual's choice, the Delhi High Court said on Friday while declining to entertain a plea for stopping or regulating religious conversions.

A bench of Chief Justice D N Patel and Justice C Hari Shankar asked the petitioner, a lawyer, to withdraw the petition as it did not want to reject it.

"Why don't you withdraw it? Why should we reject it," the court said.

Subsequently, the petitioner BJP leader and lawyer Ashwini Kumar Upadhyay sought permission to withdraw the matter and the bench allowed him to do so.

When the petition came up for hearing, the court said, professing a religion was a matter of personal belief and whether to convert to a different religion was an individual's choice.

"Tell us how can we regulate it? What will we regulate? If someone is threatening someone or intimidating someone, it is an offence under the Indian Penal Code," the bench said and added there was no reason for an individual to succumb to threats, intimidation or allurement to convert to a different faith.

Upadhyay, in his plea, had contended that many individuals, NGOs and institutions are converting downtrodden persons, particularly of the Scheduled Caste/Scheduled Tribe community, by "intimidating, threatening, luring by monetary benefits and by other acts, including miracle healing, black magic and more".

"Many individuals/organisations have started conversions of SC/STs in rural areas and the situation is very alarming. The mass religious conversion of the socially economically downtrodden men, women and children, and, in particular of the scheduled caste and scheduled tribe community, is on the rise in the last 20 years," the petition had claimed.

It had also claimed that as per the 2011 census, Hindus constitute 79 per cent of the population down from 86 per cent in 2001 and if no action is taken "Hindus will become minority in India".

Upadhyay had suggested enacting of a law to prevent conversions by force or deceit and to award jail term for any violation.

Giving a farewell speech on Thursday in the Delhi High Court where he addressed the lawyers, Justice Murlidhar talked about the incidents and communication on his transfer to another court.

Murlidhar quoted that "he was informed about his transfer on February 17 and had no problem with it. He also said that he has received a message from CJI, SA Bobde, about the decision taken by the collegium for my transfers.

Accepting the transfer order the Judge said that he was not having any objection to go to the preferred Court.

Earlier, Justice Muralidhar had slammed the Delhi police over the lack of action in Delhi violence incidents.

He had said that another 1984 situation cannot be allowed to happen in the city under its watch.

A Division Bench headed by Chief Justice <a href="https://www.wionews.com/india-news/supreme-court-collegium-recommends-justice-dn-patel-as-next-chief-justice-of-delhi-high-court-218328">DN Patel </a>asked the government to decide the issue as per law.

"There is no need for further guidelines. There are enough guidelines. No reason to constitute a high power committee. Govt has enough number of officers. As far as <a href="https://www.wionews.com/india-news/jnu-executive-council-approves-recommendations-of-high-level-committee-on-revised-hostel-manual-charges-264573">JNU </a>sloganeering case is concerned, the petitioner has requested directions to the Delhi government to grant sanction. The government may act as per rules and regulations," the court observed.

Petitioner Nand Kishore Garg, a former BJP MLA, through his counsel, advocate Shashank Deo Sudhi, prayed for an immediate grant of sanction for the trial of Kanhaiya Kumar and others and argued that Delhi government is harboring political prejudices by not granting the sanction in the case since one year. 
The counsel further argued that the Delhi government is guilty of obstruction of justice in such serious criminal cases which are clearly opposed to the constitutional commitment made by the government at the time of taking an oath.

The counsel further argued the oath obliges the government to act in accordance with the letter and spirit of the Constitution of India.

There is already a growing perception among the common people that law is differently applied to different people in our country and finally counsel argued that a high powered committee may be instituted to look into the lapses on the part of government officials in the issuance of said sanction for the prosecution of accused, the petitioner contended.

The plea had sought directions for issuance of guidelines for expeditious prosecutions in respect of all sensitive criminal and corruption-related cases where the allegations are serious in nature and are having widespread ramifications on the community. 
The public prosecutor had recently informed Patiala House court, where the case is pending, that the matter regarding grant of sanction is still pending to prosecute Kanhaiya Kumar and others in the JNU sedition case.

Court had adjourned the matter after the prosecutor informed that the sanction of the charge sheet is still pending and that the Home Department has not given the sanction yet. 
The Chief Metropolitan Magistrate (CMM) court had issued the summons to the investigating officer of the case and slated the matter for December 11.

In the charge sheet filed in the court in January, Delhi Police had said there was video footage wherein Kumar is "seen leading the students who were raising anti-national slogans" and that he had been identified by the witnesses in the videos.

"The location of mobile phone at the place of occurrence" was also cited as evidence against Kumar in the 1200-page charge sheet. 
As part of other evidence, the police said the Forensic Science Laboratory had retrieved an SMS sent by Khalid to Kumar asking him to "arrive at Sabarmati Dhaba, JNU, as their permission had been canceled by the JNU administration".

Mehta said that Karti is not on bail in the money laundering case being probed by the ED but in the corruption case investigated by the CBI.

The ED made contentions before the apex court which was hearing Chidambaram's petition challenging the Delhi High Court November 15 verdict which denied him bail in the case being probed by the ED. It has reserved the judgment on his petition.

INX Media case pertains to the Foreign Investment Promotion Board (FIPB) clearance given to INX Media to the tune of Rs 305 crore in 2007 during P Chidambaram's tenure as the finance minister.

CBI had registered a corruption case in this regard in May 2017. Later that year, the ED also lodged a money laundering case.

The CBI recently filed a charge sheet against fourteen accused, including P Chidambaram, Karti and a handful of bureaucrats in the case.

In its charge sheet, the CBI revealed that Karti influenced public servants to extend favors to the INX Media and also used false invoices as a genuine document to demand an illegal gratification of Rs 10 lakh from the company.

P Chidambaram was first arrested by the CBI on August 21 in the corruption case but was granted bail by the Supreme Court two months later.

He was arrested by the ED in the money laundering case on October 16. A special court yesterday extended his judicial custody in Tihar jail till December 11.

Ivana Smit tumbled from the 20th floor of a Kuala Lumpur condominium and landed on a sixth-floor balcony in December 2017.

Her death made headlines after claims emerged that 18-year-old Smit, the American living there and his Kazakh wife consumed large quantities of drugs and alcohol and had group sex.

Police at first dismissed suggestions of foul play and a coroner ruled earlier this year that no one was criminally involved while conceding there was likely a struggle before she fell.

But Smit's family lodged a legal challenge and the High Court last week overturned the coroner's decision, ruling that "persons knew or unknown" were involved and ordered a new probe.

Police announced Wednesday that the death of Smit, who reportedly lived in Malaysia since childhood, had been reclassified as murder and they were re-opening investigations.

A task force will be formed for the case, said Huzir Mohamed, head of the police's criminal investigation department.

"We will recall witnesses from whom we have taken statements, and call witnesses who were not previously interviewed," he said.

Police did not say who they planned to question. The couple linked to the case are reported to have left the country.

Dutch model's death plunge was murder, say Malaysian police

Justice Suresh Kait of Delhi High Court on Friday dismissed the bail plea of former Finance Minister and Indian National Congress veteran leader P Chidambaram, who is lodged in Tihar jail in the INX Media case, related to alleged irregularities in the Foreign Investment Promotion Board during his watch.

A Special Court had ordered judicial custody of the high-profile politician till November 27, 2019, in the case.

Central Bureau of Investigation had registered an FIR in May 2017 over alleged graft in the FIPB clearance to INX Media for receiving overseas funds of Rs 305 crore in 2007, when Chidambaram was Finance Minister.

"No doubt bail is his right, but if granted in such cases, it is against the interest of the public at large," the court stated.&nbsp;

The Enforcement Directorate (ED), which is probing the money laundering case, had arrested Chidambaram last month. He is currently lodged in judicial custody in Tihar jail.&nbsp;

The Congress leader had sought a regular bail by asserting that no part of the triple test, which includes flight risk, influencing witnesses and tampering with evidence, has been made out against him. His bail plea was opposed by the ED.&nbsp;

The agency asserted that Chidambaram used the high office of the country "for his personal gains".

"Proceeds of crime were generated on the act done by P Chidambaram in his capacity as the finance minister. Considering the gravity of the offences against him, bail should not be granted," the agency submitted.&nbsp;

The case pertains to an FIR registered by the CBI for alleged irregularities in the Foreign Investment Promotion Board (FIPB) clearance given to INX Media to the tune of Rs 305 crore in 2007 by Chidambaram when he was the Finance Minister.&nbsp;

Thereafter, a case was registered by the ED. Chidambaram was granted bail by the Supreme Court on October 22 in the INX Media corruption case being probed by the Central Bureau of Investigation (CBI).&nbsp;

Justice Suresh Kait of Delhi High Court on Friday dismissed the bail plea of former Finance Minister and Indian National Congress veteran leader P Chidambaram, who is lodged in Tihar jail in the INX Media case, related to alleged irregularities in the Foreign Investment Promotion Board during his watch. A Special Court had ordered judicial custody of the high-profile politician till November 27, 2019, in the case. Central Bureau of Investigation had registered an FIR in May 2017 over alleged graft in the FIPB clearance to INX Media for receiving overseas funds of Rs 305 crore in 2007, when Chidambaram was Finance Minister. "No doubt bail is his right, but if granted in such cases, it is against the interest of the public at large," the court stated. The Enforcement Directorate (ED), which is probing the money laundering case, had arrested Chidambaram last month. He is currently lodged in judicial custody in Tihar jail. The Congress leader had sought a regular bail by asserting that no part of the triple test, which includes flight risk, influencing witnesses and tampering with evidence, has been made out against him. His bail plea was opposed by the ED. The agency asserted that Chidambaram used the high office of the country "for his personal gains". "Proceeds of crime were generated on the act done by P Chidambaram in his capacity as the finance minister. Considering the gravity of the offences against him, bail should not be granted," the agency submitted. The case pertains to an FIR registered by the CBI for alleged irregularities in the Foreign Investment Promotion Board (FIPB) clearance given to INX Media to the tune of Rs 305 crore in 2007 by Chidambaram when he was the Finance Minister. Thereafter, a case was registered by the ED. He approached the High Court after a special court dismissed his bail plea by observing that the accusations against him are "serious in nature".

The bail plea has been filed on the ground that he has been in the custody since January and the charge sheet has also been filed by both CBI and by ED in April this year.

Earlier, in the special court, both the investigating agencies had opposed the bail plea of Michel.

The agencies submitted that they would file a supplementary charge sheet in the case since sufficient evidence attributing to the criminality against other public servants and private persons had surfaced during the ongoing probe.

The agencies also submitted that Michel was a flight risk and could possibly flee the country.

Michel was extradited from Dubai last year and is currently lodged in Tihar Jail in connection with alleged irregularities in the chopper deal.

While the CBI is probing his alleged role as a 'middleman' in the deal, the ED is investigating money laundering charges against him.

Citing a WHO study, the plea said one in five Indians may suffer from depression in their lifetime and submitted that most people who experience mental health problems can recover fully if they get appropriate treatment.

"Due to the social stigma attached to mental ill-health, people with mental health problems can experience discrimination in all aspects of their lives. Many people`s problems are made worse by the stigma and discrimination they experience - not only from society but also from families, friends, and employers," the plea read.

"The Act asserts that no person or authority shall classify an individual as a person with mental illness unless indirectly about the treatment of the illness," it added.&nbsp;

The Act has decriminalized attempted suicide which was punishable under Section 309 of the Indian Penal Code.

Delhi High Court seeks state government, police's response on mental health plea

The Bombay High Court on Thursday upheld the constitutional validity of reservation for the Maratha community in government jobs and education.

A division bench of Justices Ranjit More and Bharati Dangre, however, said the quota percentage should be reduced from 16 per cent to 12 to 13 per cent, as recommended by the State Backward Classes Commission.

"We hold and declare that the state government possesses legislative competence to create a separate category of the Socially and Educationally Backward Class (SEBC) and grant reservation," the court said.

On November 30, 2018, the Maharashtra legislature passed a bill granting 16 per cent reservation in education and government jobs for the Marathas, declared a socially and educationally backward class by the state government.

The reservation will be in addition to the existing 52 per cent overall reservation in the state. With the 16 per cent reservation for Marathas, the reservation quantum in the state was expected to rise to 68 per cent.

Several petitions were filed in the court challenging the reservation, while a few others were filed in its support.

The petitions challenging the quota decision had argued that it was violative of Supreme Court's orders which say that reservation in any state should not exceed more than 50 per cent.

The government, while defending its decision, had said that it was meant to alleviate the Maratha community, which it said was socially and economically backward.

"There is no room for ifs and buts, under the Salaries and Allowances of Leaders of Opposition in Parliament Act, 1977, the duty of the Speaker is to recognise the eligible person," the petitioner submitted.

He said that recognising a member of the house as the Leader of Opposition is not a political or arithmetical decision but a statutory decision.&nbsp;

"The Speaker has to merely ascertain whether the party claiming this post is the largest party in the opposition," the petition stated. On June 18, senior Congress leader and West Bengal MP Adhir Ranjan Chowdhury was named by the Congress as its leader in the Lok Sabha. The newly-appointed Speaker Om Birla has, however, not appointed him as the Leader of Opposition yet.&nbsp;

Nalini, who has been in prison for over 27 years, wanted the court to direct the superintendent of police, Special Prison for Women in Vellore, to produce her before the court so that she could argue her case for leave as party-in-person.

The court had on June 11 observed that the right of Nalini to appear in person to argue on her plea cannot be denied.

According to Nalini, a life convict is entitled to one-month leave once in two years and since she had never availed such ordinary leave for more than 27 years, she made a representation to prison authorities on February 25 seeking six-month leave to make arrangement for her daughter's marriage.

Subsequently, Nalini's mother also made a similar representation on March 22. As the authorities failed to consider her representation, she moved the high court.

Nalini was initially sentenced to death for her involvement in the Rajiv Gandhi assassination case. However, her death sentence was commuted to life imprisonment by the Tamil Nadu government on April 24, 2000.

She claimed that after commutation of her death sentence, around 3,700 life convicts, who had served 10 years of imprisonment and less, were released by the Tamil Nadu government.

"My request to the state for premature release under the 1994 scheme of premature release of life convicts was cleared by the council of ministers and on September 9, 2018, the council advised the governor to release me and other six life convicts in the case. But it has been over six months and the decision of the state is still yet to be implemented," she had submitted.

The AIADMK government had adopted a resolution recommending Governor Banwarilal Purohit the release of seven convicts -- Murugan, Santhan, Perarivalan, Jayakumar, Ravichandran, Robert Payas and Nalini -- serving life terms.

Chief Minister K Palaniswami had said his government was committed to the release of the convicts and expressed hope the governor would act on the cabinet recommendation for setting them free.

His statement came amid renewed calls, both from the opposition and Tamil groups, for the release of the convicts, after the Supreme Court disposed of a plea of the relatives of those killed along with Rajiv Gandhi opposing their release.

Calcutta High Court refuses to pass interim order on doctors' strike

The Delhi High Court Friday granted four more months to the CBI to complete its probe in a bribery case involving the agency's former special director Rakesh Asthana.

Justice Mukta Gupta allowed the CBI's plea seeking an extension of time to complete its investigation in the case lodged against Asthana, DSP Devender Kumar and middleman Manoj Prasad.

On January 11, the court had granted 10 weeks to the probe agency to complete its investigation. The CBI had approached the high court after completion of 10 weeks time.

Asthana was booked on the allegations of criminal conspiracy, corruption and criminal misconduct under relevant sections of the Prevention of Corruption Act.

Kumar, earlier the investigating officer in a case involving meat exporter Moin Qureshi, was arrested on the allegations of forgery in recording the statement of Hyderabad-based businessman Sathish Babu Sana, who had allegedly paid a bribe to get relief in the case.&nbsp;

He was arrested on October 22, 2018, and granted bail on October 31.

The CBI had sought more time to complete its probe in the case so as to conduct the probe in a free, fair and transparent manner.

The high court was earlier informed that Kumar has filed an appeal before the Supreme Court against the high court's order dismissing his and others' plea to quash the FIR against them.

The court had also questioned the CBI for not sending Letters Rogatory (LRs) to various countries till mid of April even though it had passed in January the order dismissing the pleas to quash the FIR.

LRs are a formal request from a court to a foreign court for some judicial assistance.

The high court in January had disposed of three petitions of Asthana, Kumar and Prasad by a common order in which the CBI was directed to complete investigation in the case within ten weeks.&nbsp;

Pakistan's jailed former prime minister Nawaz Sharif on Monday moved the Islamabad High Court (IHC) seeking bail on medical grounds in the Al-Azizia corruption case.

The Supreme Court earlier this month dismissed the 69-year-old three-time prime minister's review petition seeking permanent bail on medical grounds and the permission to go abroad for treatment.

"According to the medical board, Nawaz is suffering from numerous diseases," the petition said.

According to the reports, doctors recommended that Sharif's condition is life-threatening. Tension and stress can prove to be threatening to his life, it added.

Even Sharif's blood and sugar levels have not normalised, the petition went on to add.

The petition stated that all members of the special medical board, along with doctors associated with doctors hospital Lahore, Sheikh Zayed Hospital Lahore and National Hospital Lahore as well as medical specialists from UK, USA and Switzerland were unanimous that Sharif's treatment is not possible in jail premises.

The former premier, who has been serving a seven-year prison term at Lahore's Kot Lakhpat Jail since December 24, 2018, was granted a six-week bail on March 26 to get medical treatment. However, Sharif filed a civil review petition against the order on April 27.

The petition requested the court to allow Sharif get medical treatment abroad, claiming that the former prime minister was suffering from acute anxiety and depression that would lead to sudden death.

It said the medical professionals seeing the former premier in Pakistan recommend that he should be treated by his regular practitioners in the United Kingdom. It also said that there was a difference between the apex court's March 26 oral order and the written order.

However, a three-judge special bench, headed by Pakistan Chief Justice Asif Saeed Khosa and comprising Justice Sajjad Ali Shah and Justice Yahya Afridi, dismissed the petition.&nbsp;

Sharif was convicted by an accountability court in one of the three corruption cases filed in the wake of the apex court's July 28, 2017 order in Panama Papers case.

Sharif and his family have denied any wrongdoing and allege that the corruption cases against them were politically motivated.

"The issue is serious. We want some lawyer from the state government to inform us what measures the government proposes to take (to tackle the issue)," the court said.
