The Supreme Court Thursday dismissed a plea seeking direction to the Centre and the Election Commission to debar Congress President <a href="https://www.wionews.com/india-news/rahul-gandhi-citizenship-row-supreme-court-agrees-to-examine-petition-215259">Rahul Gandhi from contesting Lok Sabha elections</a> till the issue of his citizenship is decided.

A bench headed by Chief Justice Ranjan Gogoi rejected the contention of the petitioners, who said that in a form along with the annual data of a UK-based company in 2005-06, it was allegedly mentioned that <a href="https://www.wionews.com/india-news/rahul-gandhi-tenders-unconditional-apology-to-supreme-court-for-chowkidar-chor-hai-comment-216903">Rahul Gandhi</a> is a British citizen.

"If some company in some form mentions his nationality as British, does he become a British citizen," the bench also comprising Justices Deepak Gupta and Sanjiv Khanna told the petitioners.&nbsp;

Last week, the Home Ministry had issued a notice acting on a complaint by BJP Rajya Sabha member Subramanian Swamy.

The complaint states that the Congress president had declared his nationality as British in a UK-based company.

The BJP leader demanded Rahul should dismiss these documents in a press conference and tell that he has not authenticated them.&nbsp;

The issue of Gandhi's dual citizenship was first raised by Subramanian Swamy in 2015, where he had written to the Prime Minister to deny the Congress president Indian citizenship. In November 2015, the Supreme Court has dismissed public interest litigation demanding CBI probe into the citizenship row noting that PILs were not meant to target one individual or organisation but was a medium to resolve human suffering through good governance.

A bench of then, Chief Justice of India H L Dattu and Justice Amitava Roy had rubbished the plea questioning the source and authenticity of the documents attached to the&nbsp;petition.

In 2016, Lok Sabha Speaker Sumitra Mahajan had forwarded to the parliamentary ethics committee, headed by veteran BJP leader L K Advani, Swamy's "complaint of ethical misconduct" against Gandhi that he had accessed documents in which the Congress leader had called himself "British".

In his reply to the ethics committee on the allegations of British citizenship, Gandhi had said he had never "sought or acquired British citizenship" and that his "identity is that of an Indian".

He also questioned the committee's decision to look into a "complaint that is not in order", claiming it was "an endeavour to malign" him.

The panel had issued a notice to him, seeking an explanation to whether he had once declared himself a British citizen on the legal papers of a company in the United Kingdom.

The Supreme Court Wednesday ruled that it will not extend the July 31 deadline for finalisation of the National Register of Citizens (NRC) in Assam.

A bench comprising Chief Justice Ranjan Gogoi and Justice R F Nariman also gave a "free hand" to Prateek Hajela, Assam NRC coordinator dealing with claims and objections of persons against wrong exclusion or inclusion of citizens in the NRC.

The direction came after Hajela informed the bench that many persons, who had objected to the inclusion of certain individuals in the draft NRC are not coming forward before panels which are dealing with such complaints.

The National Register of Citizens (NRC) is being updated under the direct monitoring of the Supreme Court.

The final draft of NRC was released on July 30, 2018, that included the names of 2.9 crore people out of the total applications of 3.29 crore. Around 40.7 lakh people had found their names excluded from the list.

A window ending December 31, 2018, was provided for those who wanted to file claims for re-inclusion.

Within this same period, people who suspected that foreigners have made their way to the list were also allowed to file their objections.

The first draft was published during the intervening nights of December 31, 2017, and January 1, 2018, containing 1.9 crore names.&nbsp;

UK court denies bail to Nirav Modi for third time

Over 20 Chinese have been arrested from various Pakistani cities during an ongoing crackdown for their alleged involvement in arranging illegal marriages of young Pakistani girls to Chinese nationals and forcing them into prostitution, officials said Wednesday.

The crackdown was launched this week after media reports said that several Pakistani girls were subjected to sexual exploitation by Chinese husbands after going to China.

The officials said that over 20 Chinese have been arrested from various Pakistani cities for their involvement in arranging fake marriages of Pakistani women and removing their organs and forcing them into prostitution.

The Federal Investigation Agency's (FIA) Anti-Human Trafficking Cell arrested 14 Chinese from twin cities of Islamabad and Rawalpindi and recovered three Pakistani girls, said the officials in the Ministry of Interior.

"For the first time illegal weapons were also recovered from the arrested Chinese," officials said, adding the rescued women revealed that they were being taken to China.

Hundreds of Chinese have come to live in Pakistan in connection with various development work undertaken by Chinese companies.

Earlier, Interior Minister Ijaz Shah ordered action against those involved in illegal marriages and sending women to China.

He also asked officials to get in touch with the Chinese embassy to address the issue.

Chairman of the Senate standing committee on interior Rehman Malik has sought a detailed report in three days on women trafficking to China.

The government recently ordered the FIA to take action against the gangs involved in smuggling of Pakistani girls to China on the pretext of contracting marriage.

According to the local media reports, poor Christian girls are lured with money and promises of a 'good life' by the illegal matchmaking centres to marry Chinese men who are either visiting or working in Pakistan.

These centres produce fake documents of Chinese men showing them either as Christians or Muslims. Most of the girls reportedly became victims of human trafficking and were forced into prostitution, the report said.&nbsp;

Congress president Rahul Gandhi on Wednesday tendered unconditional apology to the Supreme Court for linking its April 10 order with his remark. Gandhi had accused Prime Minister Narendra Modi of theft in the Rafale deal and based his 'chowkidar chor hai' remark on Supreme Court verdict.

The apology was offered in a fresh affidavit - the third by Congress president - filed by Gandhi's lawyer Abhishek Manu Singhvi in the court. In the affidavit, the Congress president said he holds Supreme Court in "highest esteem" and sought closure of contempt proceedings against him.

During the last hearing on April 30, the court had <a href="https://www.wionews.com/india-news/made-error-will-apologise-for-chowkidar-chor-hai-comment-rahul-gandhi-to-supreme-court-214727">lashed out at Gandhi</a> for the affidavit over his alleged contemptuous remark that the Congress president filed in connection with the court's April 10 verdict on Rafale case.

"You took 22 pages in the affidavit to express regret? We refrained from saying anything further in the last hearing but this is your second affidavit. You attributed the comment to us and now you are trying to justify?" the bench headed by Chief Justice of India Ranjan Gogoi said.

The bench asked Gandhi to file another affidavit.

After the court rap, Gandhi's lawyer Abhishek Manu Singhvi told the bench, "There's nothing wrong in the affidavit but allow me to rectify. I will apologise. I made error. For 18 months I have been trying to say that the PM and other party workers are complicit, hence the comment (chowkidar chor hai)."

Gandhi filed a second affidavit in the court last week reiterating his stand and again expressing regret on his remarks on the <a href="https://www.wionews.com/india-news/supreme-court-issues-contempt-notice-to-rahul-gandhi-for-attributing-chowkidar-chor-hai-remark-to-its-order-212836">Rafale verdict</a>. Gandhi said that unfortunate references to the court order and juxtaposition of the political slogan in the same breath ought not to be construed as suggesting that the court had given any finding or conclusion on that issue.

"It is unfortunate that this slogan got intermingled with my comments on and references to the apex court's order. My statement was made in the heat of political campaigning," he said in his affidavit.

The Congress president had claimed that the apex court has made it "clear" that Prime Minister Narendra Modi "committed a theft". He had made the statement while interacting with reporters in Amethi after filing his nomination papers.

The court is hearing a criminal contempt petition filed by BJP MP Meenakshi Lekhi against Gandhi for his remarks against PM Modi, which the apex court said was incorrectly attributed to it by the Congress chief.

The Bombay High Court Wednesday said it cannot grant bail to former media baron Peter Mukerjea, an accused in the killing of his step-daughter Sheena Bora, but directed jail authorities to take him for his post-operation cardiac rehabilitation sessions.

A vacation bench of Justice Riyaz Chagla said it was not inclined to order the release of Mukerjea at the Asian Heart Institute, where he underwent bypass surgery, submitted in a report to a special CBI court last month that he has recovered from the operation.

"I am, however, inclined to grant limited protection to the applicant (Mukerjea). It will be appropriate to permit the applicant to undergo post-operation cardiac rehabilitation sessions and physiotherapy at the Asian Heart Institute," Justice Chagla said in the order.

"The applicant shall be taken to the hospital under police escort for 26 sessions, as prescribed by the Asian Heart Institute," the court said.

Mukerjea last week approached the high court, seeking interim bail on medical ground. His lawyer Shrikant Shivade argued that Mukerjea was sent to jail without letting him undergo the post-operative care.

"Without the post-operation cardiac rehabilitation sessions and physiotherapy, he (Mukerjea) will die. Jail is not a proper place to be kept in after undergoing bypass surgery," he argued on Wednesday.

CBI counsel Ejaz Khan opposed the plea and relied on the Asian Heart Institute's report, which said Mukerjea was being discharged from the hospital as he had recovered from the surgery.

"The jail authorities shall take him (Mukerjea) to the hospital for the post-operation cardiac sessions. He need not be released on bail for this purpose," Khan argued.

Mukerjea has been in jail since his arrest in November 2015 for his alleged involvement in the killing of Sheena Bora, his wife Indrani Mukerjea's daughter from her previous relationship.

According to the Central Bureau of Investigation, Bora was killed in April 2012 but the case came to light only in August 2015 when Indrani Mukerjea's former driver Shyamwar Rai spilt the beans after being arrested in another case.

Indrani Mukerjea's former husband Sanjeev Khanna and Rai were also arrested in connection with the Sheena Bora killing the case.

However, Rai later turned an approver in the case.

Reacting to the demand of in-house committee order made by former Supreme Court woman staffer, who had alleged she was sexually harassed by Chief Justice of India (CJI) Ranjan Gogoi, sources have said it is not possible because of the mandate of the apex court's committee.

The complainant, who worked as junior court assistant (an entry level clerical rank), had expressed "shock" over the <a href="https://www.wionews.com/india-news/cji-ranjan-gogoi-gets-clean-chit-in-sexual-harassment-case-by-supreme-courts-in-house-panel-216443">clean chit</a> given to the CJI in the case and demanded a copy of the in-house committee order. The ex-staffer asserted that she had a right to it.

The ex-woman staffer had raised the Vishakha guidelines of 1997 in demanding the proof, but sources said the guidelines were superseded by the POSH Act of 2013. "It is true that the POSH Act also has the provision to a copy of the findings to the complainant but it has to be borne in mind that in-house procedure pertains to sitting high court and Supreme Court judges who are vulnerable on account of sensitivity of the issues they handle, to motivated and false complaints so as to pressurise them. The Supreme Court's in-house procedure has the sanctity of being termed as a special law which shall prevail over the general law on the shubject i.e. the POSH Act of 2013," sources said.

They also questioned why the complainant is skipping participation in the procedural inquiries repeatedly. "She participated in the proceedings for three days and when she was supposed to answer the queries about unexplained delay of more than six months, she concocted reasons to walk out," sources said.

The in-house committee led by Justice S A Bobde had on Monday given a clean chit to CJI Gogoi in the sexual harassment case. The committee, also comprises Justices Indu Malhotra and Indira Banerjee, said it found no substance in the <a href="https://www.wionews.com/india-news/ex-woman-employees-silence-hints-at-conspiracy-against-cji-say-sources-216779">sexual harassment allegations</a> against the CJI.

The Chief Justice appeared before the panel on May 1.

The Bar Council of India (BCI) had earlier said that there was <a href="https://www.wionews.com/india-news/if-one-analyses-things-carefully-you-will-find-something-fishy-bar-council-of-india-on-sexual-harassment-allegation-against-cji-216598">"something fishy"</a> in the sexual harassment allegations levelled by her against CJI Gogoi. In a statement directed to members of legal fraternity, judges and people of the country, the BCI claimed that there was some very strong support behind the complaint against the CJI.

Buoyed by its success in the Balakot air strikes against a Jaish-e-Mohammed terrorist camp in Pakistan, the Indian Air Force is now planning to buy an advanced version of the Spice-2000 bomb, which can completely destroy buildings and bunkers.

During the Balakot strikes, the Air Force had dropped Spice-2000 bombs from Mirage-2000 fighter aircraft after a pack of 12 of these fighters crossed the Line of Control to strike the Jaish facility in the Khyber Pakhtunwa province.

However, the Spice-2000 bombs used in the Balakot strikes were the penetrator version which made holes using their weight in the concrete rooftops of the buildings in the Jaish camp which don`t destroy buildings but explode inside killing people with the mix of 70-80 kg explosives with shrapnel.

"The IAF is now planning to acquire the bunker buster or the building destroyer version with Mark 84 warhead which can decimate targeted buildings," government sources told ANI.

The acquisition is likely to be done through the emergency powers granted to the three services for buying any equipment of their choice worth up to Rs 300 crore to prepare for any hostilities, they said.

Under the powers, the Army has already made up its mind to buy Spike anti-tank guided missiles deployment against any possible armoured threat posed by the enemy troops.

The Spice-2000 bombs have been acquired from Israel which is one of the main weapon and ammunition supplier of the Air Force.

The Balakot air strikes were conducted by the Air Force in response to the Pulwama terrorist attack on a CRPF convoy in which 44 personnel lost their lives.

Even as the Kohinoor continues to capture India's imagination, a diamond almost double of its size adorns a gallery at the National Museum in New Delhi.

The Jacob diamond, considered the world's fifth largest, is the main attraction of the 'Jewels of India - The Nizam's Jewellery Collection' exhibition.

Mined in South Africa in the 19th century, it was named after its seller Alexander Jacob.

More than 200 years later, it continues to shine like a newly cut stone.

Yet, the most unique thing about the Jacob diamond would be that it was used as a paperweight by the last Nizam - Mir Osman Ali Khan - who was once considered the world's richest man.

The 173 items of jewellery at the museum introduce visitors to one of the wealthiest Indian royal families.

Most of the collection comprises of the Columbine emerald. Mined in Colombia and known for its fine texture, the Columbine emerald costs more than diamonds due to its fine texture.

The collection that is owned by the government has been kept at the Reserve Bank of India.

It has come to the National Museum after nearly 12 years. The jewels were earlier displayed here in 2001 and 2007.

"Spectacular, hypnotic, mesmerising," said Tories Pass, a tourist from the US who had come to look at the collection. "For me owning any one of these jewels would be a treasure," she added.

Gagan Anand, Pass' guide, said that the exhibition was a good way to change Westerners' notion about India being a poor country.

While most visitors remained awestruck, some raised doubts.

The museum's security personnel said that people often asked them if the jewels were real or not.

After all, the display of rare gems like emerald, ruby, sapphire, diamond and pearls almost seemed inauthentic.

The jewels were passed on from one to Nizam to another over the decades. The last of the Hyderabad state's ruler had inherited ninety per cent of the jewels from his predecessors.

Nizam was the title given to the monarch of the Asaf Jahi dynasty which ruled the present day state of Telangana, and parts of Karnataka and Maharashtra from 1724 to 1948.

Even as the jewels enthralled visitors, the National Museum staff said that the collection received more footfalls during its previous displays.

Mamta Mishra, a museum employee said, "Maybe fewer people turned up because unlike the last times, the exhibition was taking place during summers."

However, Mishra said that over 500 people visit the exhibition daily.

For most visitors, the collection symbolised national pride and not superfluous spending by royal families.

"It's our national treasure," said Manju Chugh, a visitor.

Few people know that this treasure would have been lost to foreign bidders had there not been a timely intervention by the Government of India.

The Indian government fought a lengthy legal battle to prevent the jewels from going under the hammer.

In 1995, it finally bought the collection for Rs 218 crore.

But the auction had disappointed Nizam's&nbsp;heirs who felt that the jewels had been undervalued.

Some estimates suggested that the collection was worth a staggering Rs 2,500 crore.

Unbeknownst to the controversy, museum-goers continue to cherish the exhibition.

Mamta Mishra, a museum employee said, "Maybe fewer people turned up because unlike the last times, the exhibition was taking place during summers." The Bar Council of India (BCI) has opined that there was "something fishy" in the sexual harassment allegations levelled by a former employee of the Supreme Court against <a href="https://www.wionews.com/india-news/cji-ranjan-gogoi-gets-clean-chit-in-sexual-harassment-case-by-supreme-courts-in-house-panel-216443">Chief Justice of India (CJI) Ranjan Gogoi</a>.

In a statement directed to members of legal fraternity, judges and people of the country, the BCI claimed that there was some very strong support behind the complaint against the CJI.

"The common man of the country is not a fool. Mass was/is realising that there was/is some very strong backing/support behind the complaint against Chief Justice of India and complainant was/is not at all a simple lady," the BCI chairman Manan Kumar Mishra stated on Monday.

Throwing light on the incident, the BCI said, "If you examine the complaint and the annexures and see the way facts are narrated; the manner in which she claims to have recorded everything in her mobile while at police station, and the way she has been dealing with police, the Courts, CBI, IB, everyone; If one analyses these things carefully, you will find something fishy."

The council further said that one should not doubt the decision of three-judge in-house Committee of the Supreme Court, which on Monday gave a clean chit to CJI Gogoi in the sexual harassment complaint allegation against him.

"The Committee has taken the decision after examining the materials and everything carefully; it has adopted the right procedure, which was required in this case. We should not doubt the decision of our three Judges of the committee, otherwise, it will send a very wrong signal and there shall be no end to such malicious complaints against the responsible authorities/persons discharging important functions," the BCI said.

It further informed that the complainant did not opt to lodge an FIR against the CJI in the matter.

"Before questioning the validity of probe by in-house Committee of three Judges, we should not forget that the lady (Complainant) had approached and lodged her complaint to the Judges of Supreme Court only; she did not opt to lodge a complaint or FIR. She herself has opted this forum and the Judges have decided to hold in-house inquiry on her complaint before them. Even Supreme Court Bar Association had proposed for holding in-house inquiry," the BCI said.

The three-judge committee constituted to probe the allegations of sexual harassment made by the complainant against CJI Gogoi has cleared him of the charges.

The committee has concluded that there is no substance in the allegations of the former employee of the Supreme Court.

As the news broke and set off a storm about the complaint, the Chief Justice had called an extraordinary sitting of a bench headed by him and called the allegations a big conspiracy against him.

The bench also passed remarks debunking the complainant.

Later, the court constituted a three-member Committee consisting of Justices Bobde, NV Ramana and Indra Banerjee.

Justice Ramana recused from being a part of the committee after the complainant sought his recusal saying he was close the CJI. Justice Indu Malhotra replaced Ramana.

However, the constitution of the committee came under criticism with a number of jurists and lawyer including women advocates` saying the probe panel was not in accordance with the Visakha guidelines propounded by the apex court on the basis of which parliament had also passed a law.

While the SC has an in-house procedure for dealing with complaints, it has neither precedent of nor a provision for dealing with a complaint of sexual harassment against the CJI.

Meanwhile, the woman complainant appeared before the three-judge panel and later walked out of it saying she was denied assistance of a lawyer or a "support person" to help her in presenting her case as she was not a legal person.

With the procedure adopted by the Committee attracting criticism, Justice DY Chandrachud of the Supreme Court wrote to the judges in the Full Court to "remedy all the grievances" which led the woman complainant to withdraw from the probe on April 30.

On Sunday, the Secretary-General denied that Justice Chandrachud along with Justice Rohinton F Nariman had met Justice Bobde to make the demand.

However, he did not deny that Justice Chandrachud had written to all the judges in the Full Court.

The woman who came out with the allegation a fortnight ago said her complaint was in the form of an affidavit sent by her to the judges of the SC on April 19.

"I am alarmed at the conclusion arrived at by the in-house Committee, as my accusation of sexual harassment at the workplace and the consequent relentless victimization and reprisals against me and my family, are substantiated by documents and are verifiable."

She said on April 26 she had joined proceedings of the in-house committee and from the very beginning expressed serious concerns and reservations "that the manner in which the proceedings were being conducted would not mitigate the stark asymmetry of power between me and the CJI."

"On 4th May 2019, at about 8 pm I received a hard copy of my statements recorded before the In House Committee on 26th, 29th and 30th April 2019. On 6th May 2019, at around 10.30 am, I submitted corrections of some inaccuracies in my recorded statements, to the concerned registrar at the Supreme Court."&nbsp;

The US has said that it will consult New Delhi as the Afghan peace process goes forward even as it called for "inclusive and legitimate process" that preserves the gains made in the last 18 years.

A statement issued by the American embassy in Delhi on US special envoy Zalmay Khalilzad's second day India visit, said, "Ambassador Khalilzad and his counterparts also discussed that Afghanistan’s political future is for Afghans to decide through an inclusive and legitimate process."

During his second visit in 2019 to Delhi, he met, External Affairs Minister Sushma Swaraj, National Security Advisor Ajit Doval, Foreign Secretary Vijay Gokhale &amp; India’s Ambassador to Afghanistan Vinay Kumar.

The statement said during the meet they "agreed that Afghan gains of the last 18 years must be preserved and built upon."

This is an important development for New Delhi since it is not in favour of an interim administration to replace the political structure arrived in the last 18 years. This was conveyed during Foreign Secretary Vijay Gokhale's US visit in March during which he met Zalmay Khalilzad in Washington.

Taliban during its talks with the US has been calling for an interim administration in Kabul which will replace the existing govt, something India is against as it back Afghan President Ghani's govt.

Washington also "recognized the many important contributions India has made to Afghanistan’s development." This development comes months after US President Donald Trump took a jibe against development aid to Afghanistan.

US President in the 1st cabinet meet of the year in January had said even though he gets "along very well with India and Prime Minister Modi", PM Modi "is constantly telling me, he built a library in Afghanistan" but Trump "Don’t know who’s using it (the library) in Afghanistan".&nbsp;

India has built large scale infrastructure projects in Afghanistan like Parliament building in Kabul, Salma Dam in Herat to Capacity Building by providing training to 3500 afghans to connectivity by Chabahar project and India Afghanistan air corridor.
