Anti-Citizenship Amendment Act, 2019 protests: 10 things you need to know

The Supreme Court on Monday said that it will not take suo motu cognizance of the petition filed against protests in Delhi until "violence and destruction of public properties" stops.

"Let the rioting stop. Public property is being destroyed. The court can`t do anything right now. We will determine the rights but not in the atmosphere of riots. Let this stop and then we will take suo motu cognizance. If protests violence and destruction of public properties continues, we will not hear it. Come back tomorrow," a bench headed by Chief Justice of India SA Bobde was quoted as saying.

The matter came up for hearing against the backdrop of violent protests in Delhi`s Jamia Millia Islamia University and Aligarh Muslim University yesterday over newly enacted Citizenship (Amendment) Act.

Mentioning the matter before the bench, senior advocate Indira Jaising requested the apex court to take suo motu cognizance of violence.

"Human right violence is taking place all over the country. No one can stop the peaceful protest in this country. Hundreds of students injured, buses are burnt by the police and blame is being put on students," she said.

On these contentions, the Chief Justice Bobde said the law and order situation should be handled by the police.

"Just because they happen to be students, it doesn`t mean they can take law and order in their own hands. This has to be decided when things cool down. This is not the frame of mind when we can decide anything. We will take cognizance, but let this stop. We will see what we can do. First, we want to assure that there is peace," CJI Bobde said.

He, however, clarified that the court is "not against rights and peaceful demonstration" by the protesters.

The Act provides citizenship to Hindu, Sikh, Buddhist, Jain, Parsi and Christian communities who faced religious persecution from Pakistan, Bangladesh, and Afghanistan and arrived in India before December 31, 2014.

The Union Ministry of Home Affairs (MHA) has rejected the draft of the Health and Services Personnel and Clinical Establishments (Prohibition of Violence and Damage of Property) Bill, prepared by the Union Health and Family Welfare Ministry, said a senior official on Sunday.

The proposed Bill was the key to address the issue of violence against healthcare service professionals and damage to the property of clinical establishments.

It seeks maximum 10 years of imprisonment for those who assault doctors and Rs 10 lakh fine for assaulting healthcare personnel.

This draft of the proposed legislation had been prepared by the Union Health Ministry earlier in September.

A senior Health Ministry official told ANI, "We have received comments from the MHA. They have objected to the draft of the Bill for preventing assault against doctors. As of now, we have kept it on hold."

"According to the MHA, if there is a central law for doctors, then other people will also demand the same. Hence, the central law to protect any specific fraternity will not come up for consideration and approval," said the official.

It is to be noted that the draft of the Bill states that "those who commit violence and cause grievous hurt as defined in Section 320 of the Indian Penal Code (IPC) to any healthcare service personnel, shall be upon conviction, be punished with imprisonment for a term which shall not be less than three years, but which may extend to ten years, and with fine, which shall not be less than two lakh rupees, but which may extend to ten lakh rupees."

"Hence, to protect healthcare service personnel and property of clinical establishments against violence, it is necessary to prohibit such acts of violence, to provide for punishment by making such acts of violence as cognizable and non-bailable offence and to provide compensation for injury to healthcare service personnel or for causing damage or loss to the property of clinical establishments," the draft of the Bill stated.

Bahujan Samaj Party (BSP) national president Mayawati on Sunday slammed the Congress party for supporting Shiv Sena even though it supported the Citizenship (Amendment) Bill and is opposing Rahul Gandhi's remark on Savarkar.

In a series of tweets, Mayawati urged Congress to clarify their stand on the matter.

"Shiv Sena still stands on its agenda. They supported the Central government on the Citizenship (Amendment) Bill and now they are intolerant of Congress' attitude towards Savarkar. But the Congress is still supporting Shiv Sena in Maharashtra. So is it if not the double standard of the Congress?" the BSP chief said on Twitter.

"Therefore, Congress must clarify their position on the matter. Otherwise, it will only be considered a drama to divert the people's attention from the weakness of their own party," she added.

Mayawati's comment comes a day after Congress leader Rahul Gandhi said, "My name is not Rahul Savarkar, it is Rahul Gandhi, and I will never apologise for speaking the truth".

He was responding to the BJP leaders demanding an apology for his earlier "Rape in India" remark.

After Gandhi's remark on Savarkar, Senior Shiv Sena leader Sanjay Raut had said, "we respect Pandit Nehru and Mahatma Gandhi, you don't insult Savarkar."

The Shiv Sena had also supported the Citizenship (Amendment) Bill, 2019, in the Lok Sabha. However, they had staged a walkout in the Upper House of the Parliament before the voting on the Bill.

Kejriwal led his party (AAP) to a historic win by securing 67 seats in the 70-member Delhi Assembly during 2015 polls.

Kishor has earlier successfully managed the election campaigns of Prime Minister Narendra Modi in 2014, Bihar Chief Minister Nitish Kumar in 2015 and Punjab Chief Minister Amarinder Singh in 2017. He also led YSRCP to a landslide victory in Andhra Pradesh during the 2019 Assembly polls.

However, the political strategist's association with the Congress for the 2017 Uttar Pradesh Assembly elections could not ensure a win for the party which faced a disastrous defeat with the BJP winning a three-fourth majority.

Ahead of Assembly polls due early next year in Delhi, Chief Minister Arvind Kejriwal on Saturday announced that political strategist Prashant Kishor's Indian PAC will manage the poll campaign of the ruling Aam Aadmi Party (AAP) in the national capital. "Happy to share that IndianPAC is coming on board with us," Kejriwal tweeted. Happy to share that @indianpac is coming on-board with us. Welcome aboard! — Arvind Kejriwal (@ArvindKejriwal) December 14, 2019 × Kejriwal led his party (AAP) to a historic win by securing 67 seats in the 70-member Delhi Assembly during 2015 polls. Kishor, who is currently working with Mamata Banerjee and TMC in West Bengal, has also reportedly worked with Shiv Sena in the recently concluded Maharashtra Assembly polls.
