A Patna Court on Saturday summoned Congress president Rahul Gandhi to appear before it on May 20, in connection with a defamation suit filed against him by Bihar deputy chief minister and BJP leader Sushil Modi.

Congress on Saturday accused the Election Commission (EC) of ignoring the party's complaints against Prime Minister Narendra Modi and BJP chief Amit Shah on model code violations and said it may consider moving court if no action is initiated by the poll body.

"We are astonished and sadly compelled to say that the Model Code of Conduct has become Modi code of conduct," Congress leader Abhishek Manu Singhvi told a press conference here.

He said, "We are also saddened to say that it is as if in the second word of the Election Commission, the letter 'C' has been dropped and it has become the 'Election omission' as far as the Modi and Shah duo is concerned."

Congress charged the poll watchdog with not taking action against Modi as well as the BJP president for their "hateful, virulent and divisive" speeches and “politicisation of the valour” of the armed forces at election rallies for "cheap electoral gains".

Singhvi said, "In the last 20 days, the Modi-Shah duo has made statements with divisive tone so many times. They have politicised the valour of our armed forces. Modi held rallies before and after casting vote (in Ahmedabad on Tuesday). This scale of violation has never happened in the last 72 years."

A Congress delegation had on Tuesday met with Election Commission officials and demanded a 48 to 72-hour ban on speeches by the Prime Minister and Shah.

Singhvi said, "We are not surprised by the violations of the MCC by BJP leaders. They are resorting to all tactics because they know they are losing the polls. But we cannot understand why the election policeman is silent on this matter. Its silence somehow means it is endorsing the acts of the BJP leaders."

At the same time, he acknowledged the EC actions on Congress' complaints against UP Chief Minister Yogi Adityanath and Himachal Pradesh BJP chief Satpal Singh Satti who were banned from making public speeches for 72 and 48 hours respectively.

He said,&nbsp;"The EC acted on some of our complaints and we praise them for that but it not acting against the Modi-Shah duo. Do the two leaders not come within the ambit of the EC rule book?"

PM Modi is expected to be accompanied by seniormost leaders of the Bharatiya Janata Party including Union ministers Nitin Gadkari, Sushma Swaraj, Piyush Goyal and others.

Chief Ministers of BJP-ruled states are expected to be in Varanasi. The Central Administrative Tribunal (CAT) bench in Bengaluru&nbsp;Thursday stayed the Election Commission order suspending IAS officer Mohammed Mohsin for checking prime minister Narendra Modi's helicopter in Odisha.

The officer from Karnataka cadre, deployed in Odisha as a general observer, was suspended on April 17 for checking Modi's helicopter in Odisha's Sambalpur in "violation" of norms for dealing with SPG protectees and sent back to the state.

The CAT maintained that during an election process while reasonable assurances of protection and security must be made available to SPG protectees, it cannot be said "they are eligible for anything and everything."&nbsp;

The bench also ordered issue of notice to the EC and "four others" and posted the matter for further hearing on June 6.

Mohsin had tried to check some luggage in the convoy of the Prime Minister during his campaign visit and the EC had said he had acted in violation of its existing instructions.

In its order, CAT member (Judicial) Dr K B Suresh noted there was a circular regarding the SPG protectees that they are exempted from certain examinations on certain grounds.

"We will not go into the SPG protectees guidelines as per the bluebook right now, but the rule of law must prevail," he said.

The CAT also took note of the plea of the applicant's counsel who said there were news about heavy packages unloaded from prime minister's cavalcade being taken away in other vehicle.&nbsp;

Questions were raised but apparently no action followed, it said.

Noting that under the Constitutional process of federal structure, even though the EC has the supervisory powers over the employees under its control at that moment of time, the CAT said once they are out of it, the commission's powers would cease.

The tribunal said&nbsp;"Therefore the suspension order issued by the election commission cannot, on the face of it, lie. It is hereby stayed."

However, the CAT said it would look into this matter afresh once it received the response from the EC.

The tribunal said the applicant will be eligible to rejoin his former position under the Karnataka government "without any further ado about it".

Following the suspension, an EC source had said,&nbsp;"It has been laid down that SPG protectees are exempted from checking. He (the officer) should have known the instruction being an observer. The reason for suspension is dereliction of duty."&nbsp;

"We conducted a press conference and warned Pakistan that if anything happened to our pilot, you will keep telling the world that Modi did this to you," he said.

"A senior American official said on the second day that Modi has kept ready 12 missiles and might attack and the situation will deteriorate. Pakistan announced to return the pilot on the second day, else it was going to be a "qatal ki raat'," Modi said.

"This was said by America, I have nothing to say about this now, I will speak about it when the time will come," he added.

Asserting his government's commitment towards national security, Modi said whether the prime minister's chair remains or not, he has decided that either he will be alive or terrorists will remain alive.

He also took a swipe at Pawar, who on Saturday said he was "terribly afraid" as to what Modi, who once called Pawar his mentor in politics, would do next.

He has not seen who is Hindu and who is Muslim but laid down his life for Hindustan," said Owaisi adding that the "Prime Minister should now break his silence". In a controversial remark, Sadhvi Pragya had said: "I called Hemant Karkare and asked him to let me go if there is no evidence (against me). He (Karkare) said that he will bring evidence but will not leave me. I told him -- You will be ruined." Karkare was killed along with two other senior police officers while fighting terrorists during the 26/11 attacks in Mumbai in November 2008.BJP was quick to distance itself from Sadhvi Pragya`s statement. "The BJP is working to correct the damages inflicted by the Congress towards the north east... The region is finally coming into the mainstream," Modi said.

The central government has strengthened the expansion of the all-women market in the state, and generated employment for the youth, the PM said.

The Congress did not fulfil its pre-election promise to make the region a manufacturing hub, Modi said, adding, the grand old party is actually an "expert in manufacturing lies and false assurances".

Hailing Manipur for producing a number of talented sports-persons over the years, he said the BJP government has decided to make the state a sports hub and set up a national sports university.

Acknowledging the state's football prowess, the prime minister took a dig at the Congress, saying, "The party has made a foul, and just as in football, it should be shown a red card."

Polling for the two Lok Sabha seats in Manipur will be held on April 11 and April 18.

Bihar Deputy Chief Minister Sushil Kumar Modi on Tuesday announced that he will file a defamation case against Congress president Rahul Gandhi for his alleged "all thieves have Modi in their surnames" comment.

"I will file a defamation case against Rahul Gandhi in Patna High Court within two days," Modi told reporters here.

The BJP leader claimed that Gandhi has hurt the sentiments of crores of people with Modi surname. The Deputy Chief Minister said, "He (Rahul Gandhi) has referred to crores of people with 'Modi'&nbsp;surname as 'chor'&nbsp;and hurt their sentiments."

He asked whether it is a crime to have used the title. "Is it a crime to have `Modi` surname?" he asked. Rahul Gandhi, while addressing a rally in Maharashtra on Monday, asked how come all "thieves" have Modi as the common surname as he attacked Prime Minister Narendra Modi over the issue of corruption.

"But tell me one thing... Nirav Modi, Lalit Modi, Narendra Modi... how come they all have Modi as a common name. How come all the thieves have Modi as the common name?" Gandhi had asked.

In a separate case, the Supreme Court on Monday issued a notice to the Congress president on a petition filed against him by BJP leader Meenakshi Lekhi for allegedly making contemptuous remarks in connection with its order on the admissibility of the certain document in the Rafale deal.

The contempt petition accused Rahul Gandhi of misquoting the order when he said the apex court had accepted that "chowkidar" (a reference to PM Narendra Modi), is a "chor (thief)".&nbsp;

Recently Pawar had claimed that Parrikar returned to Goa and quit as defence minister as he did not agree with the Rafale deal, in which the opposition has alleged corruption.

Parrikar, who died last month of cancer, had said that he always wanted to work in Goa. He returned as the state's chief minister after the assembly polls in 2017 amid demands by BJP's allies that he should be leading the alliance government.

People want to get rid of terrorism, those in 'maha milawat' want to remove Modi: PM

Prime Minister Narendra Modi on Sunday launched a scathing attack on Congress alleging that the previous government led by it used to only lament after a terrorist attack but the BJP-led dispensation "killed terrorists inside their home".

Addressing an election rally, the Prime Minister said, "What used to happen earlier was terrorists would come from Pakistan, attack us and the Congress government would only lament before the world that we have been attacked. But in this new India when terrorists attacked Uri, our brave soldiers conducted a surgical strike."

"The second big mistake the terrorists made was in Pulwama after which we killed them in their home through air strikes,`Modi said.

He said, "Only those who have strength are heard in this world. The one who always keeps crying does not get anyone`s attention. Be it the United Nation, Russia, Saudi Arabia, the UAE or Afghanistan, India is being given importance."

Modi said that the capacity to shoot down a satellite was with India for about a decade but the Congress government did not support it.

"However, after our government was formed we immediately gave go-ahead to the project," he said.

He alleged that it is not in the agenda of SP-BSP or Congress to strengthen the country and they only hurl abuses at him.

"Have they ever shared their vision for the country? Did they ever talk about strengthening the country? They have only a one-point agenda and it is to abuse Modi. I have two decades of listening to the abuses and now I am immune to such things," the Prime Minister said.

He said that the Bill against triple talaq will be once again brought in Parliament if his party is elected to power.

Modi also took a jibe at SP chief Akhilesh Yadav and BSP supremo Mayawati for forming an alliance and said, "The `nephew` has in past made many comments against his `aunt` including saying that she had looted Uttar Pradesh... The nephew has also forgotten the days when the aunt used to advice Netaji (Mulayam Singh Yadav) to go to a mental asylum. The elephant is riding cycle now to target the chowkidar. The real danger is on their identity and hence the past has been forgotten."
