Former Union minister P Chidambaram's son Karti controlled two firms which allegedly received Rs. 1.16 crore as bribe money in the Aircel-Maxis money laundering case, the Enforcement Directorate (ED) on Wednesday said in its charge sheet filed before a Delhi court.

Though the name of P Chidambaram, who was also questioned recently by the CBI and the ED in the INX media and the Aircel-Maxis money laundering cases respectively, was mentioned in the charge sheet, the Congress veteran has not been arrayed as an accused in the probe report which would now be considered by the court on July 4.

The ED filed the charge sheet before Additional Sessions Judge Ruby Alka Gupta for consideration and subsequent issuance of summons to the accused including Karti.

Reacting to the filing of the charge sheet, which is called prosecution complaint in official parlance, P Chidambaram said that it would be "vigorously contested" before the special court.

"The complaint filed by ED against Karti Chidambaram and others is seriously flawed. Since the matter is in Court, I shall not make a public comment. The complaint will be vigorously contested before the Special Court," the former minister tweeted.

The ED probe report said the payments of Rs. 26 lakh to Advantage Strategic Consultancies Private Limited (ASCPL) and Rs. 90 lakh to Chess Management Services Pvt Limited (CMSPL) respectively were made as alleged bribe money by parent company of Aircel Ltd, namely Aircel Televentures Ltd (ATVL) and Maxis and its associate Malaysian companies respectively.

Referring to contents of the charge sheet, special public prosecutors Nitesh Rana and NK Matta said that Karti Chidambaram was controlling ASCPL and CMSPL, the alleged beneficiaries of bribe amount of Rs. 1.16 crore, and Karti Chidambaram was trying to project this as untainted money.

The probe agency also made clear that it may file supplementary charge sheets in the case which apparently keeps open the chances of arraying more persons as accused.

Apart from Karti Chidambaram, the agency has also named ASCPL and its directors Padma Bhaskararamana and Ravi Viswanathan, and CMSPL and its director Annamalai Palaniappa in the charge sheet under section 4 (punishment for money laundering) of the Prevention of Money Laundering Act (PMLA).

"Investigation carried out under the PMLA so far as revealed that Karti P Chidambaram is linked with individuals and companies involved in financial transaction and companies holding such companies as per diagram...

"Investigation has revealed that ASCPL and CMSPL are controlled and owned by Karti Chidambaram and his close associate S Bhaskararaman. The investigation has further revealed that ASCPL received money from ATVL, parent company of Aircel Ltd., in close proximity to receipt to FIPB (Foreign Investment Promotion Board)," the charge sheet, filed through advocate AR Aditya, said.

It alleged that Karti Chidambaram received Rs. 26 lakh from ATVL in ASCPL, on April 11, 2006, immediately after the approval under the head of payment of consultancy services, it said.

"Similarly CMSPL received an amount of approximately USD 2,02,447 between period 2007-11 against invoices raised between 2007-09. The payments were received from Maxis and its associates in the guise of charges for a software which was designed for use by an Indian company and could not at all of any use by a Malaysian company," it said.

The ED had registered the case under the sections of PMLA on February 7, 2012 on basis of an FIR registered by the CBI.

It said that during the investigation it was found that ASCPL was already in a financial transaction with the other companies namely Chess Healthcare Care Solutions Pvt LTD, M/s Chess Management Services Pvt LTD (CMSPL) and M/s Halidon Marketing Pvt LTD since the financial year 2005-06.

The agency said that a total of Rs. 1.16 crore allegedly belonging to Karti Chidambaram has already been attached by it so far.

The agency mentioned that the former Union minister's son has been linked with various individuals and companies involved in the Foreign Investment Promotion Board (FIPB) approval given to the Aircel-Maxis deal.

It also alleged that Karti Chidambaram was in the process of alienating the property involved in the money laundering in order to frustrate the proceedings under PMLA.

The agency told the court that it might file a supplementary charge sheet in the case.

The court has already granted interim protection from arrest till July 10 to Karti Chidambaram in two cases filed by the CBI and the ED in 2011 and 2012, respectively in the Aircel-Maxis matter arising out of 2G spectrum cases, while his anticipatory bail plea is pending before the court.

P Chidambaram has also been granted protection from arrest till July 10 by a court here in the present money laundering case while his anticipatory bail is pending before the court.

The matter pertains to grant of FIPB clearance to M/s Global Communication Holding Services Ltd for investment in Aircel.

INX media money laundering case: Karti Chidambaram sent to 5-day police custody

A long legal battle is in the offing for senior Congress leader P Chidambaram and his son Karti Chidambaram as the father-son duo are in the radar of the probe agencies in another case concerning the Aircel-Maxis deal.

While Karti was arrested in connection with the INX Media case in which the CBI has alleged that he was paid USD one million bribe by the media company through foreign entities, Chidambaram's role in granting FIPB approval to a offshore firm in the Aircel-Maxis deal is also under investigation by the agency.

Karti is fighting legal battles in the Supreme Court, the Madras High Court and the trial court here, while Chidambaram has knocked at the doors of the apex court apprehending "continued harassment" to him and his family members through investigations being conducted by the CBI and Enforcement Directorate (ED) in these two cases.

Chidambaram's plea in the apex court assumes significance as the CBI, in its charge sheet before a special court here in 2014 in the Aircel-Maxis case against former telecom minister Dayanidhi Maran and others, had said it was probing how the then Finance Minister (Chidambaram himself) had granted Foreign Investement Promotion Board (FIPB) approval to a deal involving a foreign firm when only the Cabinet Committee on Economic Affairs (CCEA) was empowered to do so.

However, the CBI and ED cases in the Aircel-Maxis deal could not withhold judicial scrutiny as the special court had in February last year discharged Dayanidhi Maran, his industrialist brother Kalanithi Maran and others saying the alleged charges were based on "misreading of official files", speculation and surmises of the complainant.

In April last year, the CBI had informed the Supreme Court that it was probing Chidambaram's role in the alleged irregularities in grant of FIPB approval in Aircel-Maxis case.

During the hearing before the top court, BJP leader Subramanian Swamy, who has filed a petition in the top court in this regard, had said he had received a reply from CBI stating it was probing "all angles", including the FIPB clearance given to the deal by Chidambaram.

Swamy had filed a private complaint in the 2G spectrum allocation case and the alleged scam in the Aircel-Maxis deal that had cropped up during the CBI probe.
On January 4 this year, the apex court had directed the Centre to file a status report on the probe being conducted in the Aircel-Maxis deal case.

The CBI had said in its charge sheet in the Aircel-Maxis case that Chidambaram had granted FIPB approval in March 2006 to Mauritius-based M/s Global Communication Services Holdings Ltd, a subsidiary of Maxis, owned by Malaysian business tycoon T Ananda Krishnan, who is also an accused in the case.

The CBI had claimed that M/s Global Communication Services Holdings Ltd had sought FIPB approval for 800 million USD for which only the CCEA was competent, but Chidambaram had given approval to the firm in March 2006.

"Further investigation is being carried out into the circumstances of said FIPB approval granted by the then Finance Minister. The related issues are also being investigated," the agency had said in its charge sheet.

Though the court has discharged Marans and others in the case, further probe by CBI regarding FIPB approval is still going on. Similarly, the ED is carrying out separate probe in the Aircel-Maxis deal.

An FIR, filed by the CBI on May 15 last year, had alleged irregularities in FIPB clearance to INX Media for receiving overseas funds to the tune of Rs 305 crore in 2007 when Chidambaram was the Union finance minister.

While the CBI has alleged that Karti had received funds to the tune of Rs 10 lakh in the INX Media case, the ED has also registered a money laundering case in the matter.

Chidambaram, in his petition before the apex court, has said that his fundamental rights were being violated due to "illegal" investigations being carried out by the CBI and the ED and the central government has been "misusing" its probe agencies.

He has said that being the Finance Minister then, he had granted FIPB approvals in the INX Media case and the Aircel-Maxis case in the "normal course of official business"and in discharge of his functions, he has "never allowed any member of his family, including his son, or any other person to interfere with or influence the conduct of official business".

INX Media & Aircel-Maxis: Long legal battle awaits Chidambarams

Senior Congress leader P Chidambaram's apprehension of continued harassment to him and his family members turned out to be true with CBI arresting his son Karti Chidambaram in connection with the probe into the grant of FIPB approval in INX Media case.

Chidambaram, who was closely monitoring the case of his son in the Supreme Court which was argued by his party colleague and senior advocate Kapil Sibal, had sprung a surprise last week by filing a petition on his own accusing the CBI and the ED of carrying out a political vendetta against him and his family.

In his petition, Chidambaram has sought the apex court's direction prohibiting the CBI and Enforcement Directorate (ED) from continuing their "illegal investigations" and from acting in any manner "causing repeated harassment" to him and his family members, including his son.

However, the CBI swung into action even before his petition could come up for hearing before the top court by arresting Karti today.

In his plea, Chidambaram, himself a senior advocate, has said that the position in the INX Media case was "worse" as, though the CBI had lodged an FIR in May 2017, the probe agencies have not filed any report "concluding that any criminal offence had been committed or that any proceeds of crime had arisen out of that criminal offence".

Chidambaram has said that the CBI and ED cannot "harass" Karti and others, who were totally unconnected with the FIPB approval by issuing repeated summons to them.

"The petitioner (Chidambaram) feels sad that his son and his business friends are being targeted," the plea said, adding, "The entire investigation being conducted by the CBI and ED is a total farce and is being made only to malign the name of the petitioner and his son in the eyes of the public".

He has also sought the apex court's direction declaring that the proceedings emanating from FIR registered by CBI in the INX Media case as well as the "premature investigation" being conducted by the ED, were "without jurisdiction, an abuse of authority, and violative of Articles 14 (equality before law), 19 (freedom of speech and expression) and 21 (right to life and personal liberty) of the Constitution which inhere in the petitioner and the members of his family, and declare the said proceedings and investigations as null and void".

INX Media: P Chidambaram's fear of harassment of his family turns true

CBI today presented former finance minister P Chidambaram's son Karti Chidambaram in front of the magistrate in Patiala House Court in Delhi.

Before the commencement of the proceedings, Abhishek Manu Singhvi spoke to Karti Chidambaram for ten minutes after taking permission from the magistrate.

The court proceedings started at 5:10 pm on Wednesday.

The CBI lawyer told the court that Karti Chidambaram is not cooperating. The agency requested 15 days remand in order to question Karti.

The court was informed that on February 17 an accused had stated before the magistrate that Karti Chidambaram had asked for a million dollars in a hotel.

Abhishek Manu Singhvi while defending his client, said that two summons were given for interrogating Karti and he appeared on both occasions.

Karti went twice last year when he was summoned for questioning which lasted for 22 hours, Singhvi informed the court.

Singhvi added further that since the last inquiry was made six months ago and till date, no summons were received, so CBI's contention that his client did not cooperate does not hold true.

Karti's lawyer said CBI's second argument for remand that he is constantly touring abroad does not hold ground. Did he run away, Singhvi asked the court.

Karti has travelled abroad so far with the permission of the court, he asserted, adding that he had told the court about his arrival date and left after the court's permission and returned back as well.

WION news brief, February 28, 2018

Senior Congress leader P Chidambaram has approached the Supreme Court seeking protection of his fundamental rights, including the right to privacy, amid summons to his son Karti Chidambaram and raids by the CBI and the ED in connection with cases related to Aircel-Maxis and INX Media.

Chidambaram, who is also a senior advocate, has claimed in his plea that as part of "political vendetta", the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) have made "vexatious" searches and issued the repeated summons in these cases.

"The writ petition is being filed to defend and protect the petitioner?s fundamental rights under Article 14 (equality before law), 19 (freedom of speech and expression) and 21 (right to life and personal liberty) of the Constitution and to defend his right to privacy and the right to live, along with members of his family, in dignity," the petition said.

"The CBI and the ED, as part of political vendetta, have made vexatious searches, issued repeated summons, unreasonably questioned persons for unconscionably long hours, unlawfully attached fixed deposits, maliciously leaked false information to the media and otherwise caused extreme harassment, anguish and humiliation to me and my son, and to other persons who are normal business and social friends of my son,? Chidambaram said.

The Congress leader said that both he and his son have categorically denied any wrongdoing in the Foreign Investment Promotion Board (FIPB) approvals in these cases.

"Every government officer who has been examined by the CBI/ED has categorically stated that the approvals granted in these two cases were entirely in order,? he said.

The former Union finance minister also said that he was the "real target" of these "motivated actions" of the CBI and the ED, but these agencies have not accused him or other public servants of any offence in these cases.

Chidambaram raised a legal issue asking whether without an FIR naming him or his son, the CBI or the ED could probe the alleged offences against them.

He sought the top court's direction to prohibit these two agencies from continuing with "illegal" probe and acting in any manner causing repeated harassment to him, his son and family members.
