A Delhi court Tuesday sent separatists Masarat Alam, Asiya Andrabi and Shabir Shah to 10-day NIA custody in a terror funding case involving Jama'at-ud-Da'wah (JuD) chief Hafiz Saeed, the 2008 Mumbai terror attack mastermind, a lawyer said.

Asiya and Shah were already in custody in separate cases while Alam was brought from Jammu and Kashmir on transit remand, advocate MS Khan appearing for the accused told PTI.

NIA had filed a charge sheet in 2018 against Saeed, another terror mastermind Syed Salahuddin and 10 Kashmiri separatists in a case of alleged terror funding and secessionist activities in the valley.

It said that offences for which the accused have been charge-sheeted include those punishable under sections 120B of IPC (criminal conspiracy) and various provisions of the Unlawful Activities (Prevention) Act, 1967.

According to NIA, the case was registered on May 30, 2017, and the first arrests made on July 24 last year.

Law officer of the jail also handed over a list of facilities being provided to Michel in a single cell in the jail. ''This is not isolation as he goes out to eat and is allowed to meet other inmates,'' the authorities said.

Special Public Prosecutor (SPP) DP Singh told the court, ''He is a foreigner brought through extradition. This is a responsibility of the country to ensure his security as per the treaty.''

Michel, who was extradited from the UAE in December last year, is currently lodged in Tihar Jail in connection with the CBI and ED cases against him related to the AgustaWestland deal.

Robert Vadra, facing Enforcement Directorate (ED) probe in cases of alleged money laundering, moved an application in a Delhi court Saturday, seeking a copy of documents seized by the agency in a raid conducted at his offices last year.

Special Judge Arvind Kumar posted the matter for February 25.

The application which was moved through senior advocate KTS Tulsi sought a copy of the documents seized by the agency from Vadra's office.

Vadra, who is the brother-in-law of Congress president Rahul Gandhi, said in his application that the ED has been interrogating him based on the seized documents and therefore their copies should be provided to him.

On December 7 last year, the agency had carried out raids at Vadra's offices at Delhi.&nbsp;

Vadra has appeared before the ED for questioning on multiple occasions in Delhi and Jaipur.

The money laundering cases being probed by the ED relate to purchase of alleged illegal assets abroad and an alleged land scam in Bikaner, Rajasthan.

The court had on February 16 extended the interim bail granted to Vadra till March 2.&nbsp;

"It is stated that the petitioner's (Vadra's) firm through its authorised representative Manoj Arora has already joined investigation with the ED conducting investigation into the affairs of the firm in Rajasthan with their offices at Jaipur on many occasions and has supplied all the relevant documents to the satisfaction of the officials of the ED," the plea had said.

Arora, an employee of Vadra's Skylight Hospitality LLP, was a key person in the case and he was aware of the latter's overseas undeclared assets and was instrumental in arranging funds, the ED had alleged.

Vadra had alleged that he is being "hounded and harassed" to subserve political ends.

Arora had alleged before the court that the case was foisted on him by the NDA government out of "political vendetta".

However, the ED had refuted the allegations, asking that "should no authority investigate any political bigwig because that will be called a political vendetta?"

The agency had told the court that it lodged the money laundering case against Arora after his role came to light during the probe of another case by the Income Tax Department under the newly enacted Black Money Act and tax law against absconding arms dealer Sanjay Bhandari.

Robert Vadra, facing Enforcement Directorate (ED) probe in cases of alleged money laundering, moved an application in a Delhi court Saturday, seeking a copy of documents seized by the agency in a raid conducted at his offices last year.&nbsp;

Special Judge Arvind Kumar posted the matter for February 25. The application which was moved through senior advocate KTS Tulsi sought a copy of the documents seized by the agency from Vadra’s office.

Vadra, who is the brother-in-law of Congress president Rahul Gandhi, said in his application that the ED has been interrogating him based on the seized documents and therefore their copies should be provided to him.&nbsp;

On December 7 last year, the agency had carried out raids at Vadra’s offices at Delhi. Vadra has appeared before the ED for questioning on multiple occasions in Delhi and Jaipur.

The money laundering cases being probed by the ED relate to purchase of alleged illegal assets abroad and an alleged land scam in Bikaner, Rajasthan. The court had on February 16 extended the interim bail granted to Vadra till March 2. Vadra had filed an anticipatory bail application in the case linked to allegations of money laundering in the purchase of a London-based property at 12, Bryanston Square worth 1.9 million pounds.

The property is allegedly owned by him. The agency had earlier said it has received information about various new properties in London which allegedly belong to Vadra, including two houses of five and four million pounds, each, six other flats and more properties. The plea had said Vadra’s office was raided by the ED on December 7, 2018, and, therefore, he seriously apprehends that his liberty may be curtailed by the investigating agency.

“The petitioner (Vadra) is being subjected to a farce criminal prosecution which actually is beset with nothing else except political vendetta and most, unfortunately, the respondent (ED) being the law enforcement agency is a party to the unethical and illegal exercise. “It is stated that the petitioner’s (Vadra’s) firm through its authorised representative Manoj Arora has already joined investigation with the ED conducting investigation into the affairs of the firm in Rajasthan with their offices at Jaipur on many occasions and has supplied all the relevant documents to the satisfaction of the officials of the ED,” the plea had said.

Arora, an employee of Vadra’s Skylight Hospitality LLP, was a key person in the case and he was aware of the latter’s overseas undeclared assets and was instrumental in arranging funds, the ED had alleged. Vadra had alleged that he is being “hounded and harassed” to subserve political ends. Arora had alleged before the court that the case was foisted on him by the NDA government out of “political vendetta”.

However, the ED had refuted the allegations, asking that “should no authority investigate any political bigwig because that will be called a political vendetta?” The agency had told the court that it lodged the money laundering case against Arora after his role came to light during the probe of another case by the Income Tax Department under the newly enacted Black Money Act and tax law against absconding arms dealer Sanjay Bhandari.

Sajjan Kumar is facing trial on charges of murder and rioting in the case pertaining to the killing of Surjit Singh in Delhi's Sultanpuri in 1984 during the Sikh riots.

Apart from&nbsp;Kumar, two others who are facing the charges are Brahmanand Gupta and Ved Prakash.

The case, registered by Central Bureau of Investigation on the recommendations of Nanavati Commission, was transferred from the Karkardooma court to the Patiala House court by the Delhi High Court.

On December 17, The Delhi High Court convicted Kumar and sentenced to imprisonment for "remainder of his natural life" in another 1984 anti-Sikh riots case, saying the riots were a "crime against humanity" perpetrated by those who enjoyed "political patronage" and aided by an "indifferent" law enforcement agency.

Kumar&nbsp;has to surrender by December 31, 2018.

The CBI has refused to disclose records pertaining to dilution of a lookout circular against fugitive businessman Vijay Mallya, accused of loan default of over Rs 9,000 crore, citing ongoing investigation.

In response to an RTI application filed by Pune-based Vihar Durve, the agency has cited section 8(1)(h) of the act to deny the information.

The section exempts from disclosure the information which would impede the process of investigation or apprehension or prosecution of offenders.

The Delhi High Court, however, has clarified that when a public authority invokes this clause, it has to provide detailed reasoning how disclosure will impede the process as disclosure is norm and exemption is an exception.

The CBI had issued LOC against Mallya calling for his detention if he intends to leave the country or arrive here from abroad but in a surprise move, it was diluted asking the immigration authorities to merely inform the agency in case of his travel.

Mallya appeared before the agency for questioning after the dilution and even travelled abroad and returned.

However, in March 2016 he left the country for England but did not return since and is contesting a case of extradition there.

The then CBI director Anil Sinha was not kept in the loop about the change in the nature of LoC which was done by an SP-ranked officer on the verbal instructions of a joint director officer of the agency, according to government sources.

Sinha after coming to know about the change and Mallya's escape had made detailed notings on the file admonishing the officer concerned, they had said.

While refusing the information, the CBI has also cited on the exemption given to it from the RTI Act which gives it immunity from any provision of the RTI Act.

The exemption, however, does not apply when the information sought pertains to allegations of corruption which was a case against Mallya.&nbsp;

A Delhi court Tuesday ordered attachment of liquor baron Vijay Mallya's properties in Bengaluru in a case relating to FERA violations.

Chief Metropolitan Magistrate Deepak Sherawat issued fresh directions after the Bengaluru Police, through ED's special public prosecutor N K Matta and advocate Samvedna Verma, sought more time to execute its earlier order.

The Bengaluru Police had earlier informed the court that it has identified 159 properties belonging to Mallya, but has not been able to attach any of them.

Mallya has been declared a proclaimed offender by the court on January 4 for evading its summons in the case.

The court had on 8 May directed the attachment of Mallya's properties in the case through the Bengaluru Police commissioner and sought a report on it.

It had declared Mallya a proclaimed offender for evading summons in a FERA violation case after noting that he had failed to appear despite repeated summonses.

It had on 12 April last year issued an open-ended non-bailable warrant against the liquor baron.

Unlike a non-bailable warrant, an 'open-ended NBW' does not carry a time limit for execution.

Delhi court orders attachment of Mallya's properties in Bengaluru

A Delhi court released a man convicted of stalking a class XII student on probation for a year considering his poor financial status.

A man name Raja was convicted of stalking a girl for months whenever she used to go for her tuition. He constantly expressed his love to her and asked&nbsp;to marry him despite of her saying no.

After the girl lodged a complaint in 2017, Raja was charged under section 354D of the Indian Penal Code.&nbsp;

In 2016 the court awarded Raja six months of jail-term however he appealed against the decision citing his poor condition and past record.

The court after seeing a report from the probationary officer which stated Raja having a clean record and was never involved in any other case released him on probation on bond of Rs 20,000 and directed him to maintain good behaviour.

"Keeping in view the all facts and circumstances, without expressing any opinion on the merits of this case and considering his poor financial condition, it is considered expedient to release him on probation for a period of one year on furnishing probation bond of Rs 20,000 with one surety in the like amount to appear and receive sentence as and when called upon during such period and, in the meantime the appellant shall keep peace and be of good behaviour," news agency PTI quoted judge as saying.
