The Indian health ministry has ordered an investigation into Apollo Hospital in Delhi following media reports linking it to a so-called 'cash-for-kidney scam'. The alleged scam links the hospital to Myanmar nationals who illegally sold their kidneys for organ transplants. The National Organ and Tissue Transplant Organisation (NOTTO) which comes under the Indian health ministry, has directed SB Deepak Kumar, who is Delhi's Health Secretary, to "get the matter examined, take appropriate action ... and furnish an action-taken report within a week", reported Reuters citing an official document.

Media reports quoted Kumar as saying that a committee was being formed to investigate the matter and look into details of donors and patients.

The Apollo Hospital in Delhi is part of a larger hospital chain, Apollo Hospitals, which has a sizeable presence in cities across India.

Senior Counsel ARL Sundaresan, who presented the final arguments on behalf of the commission, termed the hospital's petition against going into the records on the treatment given to Jayalalithaa as a knee-jerk reaction.&nbsp;

If the prejudice argument of the hospital was to be accepted, the inquiry had to be wound up, he said.&nbsp;

The counsel said the commission was yet to prepare its final report as it had to question the politicians concerned. Till now, only doctors, officials and others have been examined.&nbsp;

The Apollo Hospitals was free to challenge the final report of the commission once it was out, but they could not challenge the proceedings at this stage, he said.&nbsp;

Rejecting the charge of bias and prejudice levelled by the hospital, he said a bundle of facts had already been collected and recommendations would be made by the commission in its report to the government, which would then take a call on accepting or rejecting those.&nbsp;

Legally, such allegations could not be levelled against a commission of inquiry since it was not an adjudicating authority, he added.&nbsp;

Sundaresan said the ultimate mandate of the commission was to find out the truth and rule out rumours regarding the circumstances leading to Jayalalithaa's death.&nbsp;

Noting that 90 per cent of the proceedings was already completed, he said the hospital could not seek to stall the proceedings without challenging the government order setting up the panel or the terms of reference, that too after participating in the hearings so far.&nbsp;

Recording the submissions, the bench directed the commission and the hospital to file their written arguments by March 12 and adjourned the matter to that date.&nbsp;

Jayalalithaa died on December 5, 2016, over two months after being treated for various complications, including infection, since September 22.&nbsp;

A petition has been filed before a Commission of Inquiry probing the death of former <a href="http://www.wionews.com/entertainment/nithya-menen-looks-strikingly-similar-to-young-jayalalitha-in-the-first-poster-of-the-iron-lady-181657">chief minister J Jayalalithaa</a> by its counsel, raising serious medical issues regarding her treatment at the Apollo Hospital.

The hospital has, however, strongly refuted the allegations against it raised in the petition.&nbsp;

Commission sources told that the plea filed by the standing counsel for the commission seeks to implead Tamil Nadu Health Secretary J Radhakrishnan and former chief secretary P Rama Mohana Rao over their statements and depositions.

A statement issued Saturday night by Apollo Hospital said it was served a copy of the petition dated December 27.&nbsp;

"It is surprising that the commission is itself filing this petition against other parties," the hospital said, adding that the proceedings before the inquiry panel cannot be "accusatorial" in nature.

The hospital said the plea before the panel referred to three senior doctors advising an<a href="http://www.wionews.com/india-news/ex-tamil-nadu-cm-j-jayalalithaa-death-probe-panel-completes-examining-100-witnesses"> angiogram on Jayalalithaa</a>.

"This is incorrect. It was only a single external doctor who on November 25, 2016, visited the late CM for a few minutes and suggested immediate angiogram without going into all the other co-morbidities, including her compromised respiratory condition, which could have potentially inhibited the desired outcome," it said.

The hospital said its team of doctors and Richard Beale, a UK-based specialist, did not think it was wise to do angiogram based on the medical opinion of that doctor who wanted to "perform the procedure and leave immediately out of the country with no commitment to her follow-up care."

Citing medical evidence in the form of depositions of multiple doctors, and related medical reports including echocardiogram and blood tests, the hospital asked why was the "commission choosing to ignore the material evidence in this regard".&nbsp;

Also, the hospital said the petition wrongly spelt 'sternotomy' as "stenotomy".&nbsp;

Complicated medical terminologies in English have been incorrectly translated into Tamil and the context and meaning of medical facts have been lost in interpretation and translation, the hospital alleged.

"This petition only strengthens our case for the immediate appointment of a medical board who will understand the complexities of the late CM's treatment," he said.

The hospital argued that without a medical board no finding of the panel would be "complete" or based on medical science. "The Supreme Court has repeatedly held that a judge cannot substitute a medical specialist's opinion with his own," it said.&nbsp;
