Alwar lynching case: Supreme Court agrees to hear plea to shift trial from Rajasthan

As opposition parties led by the Congress stage a Bharat Bandh against a rise in the retail prices of petrol and diesel, the NDA government is fashionably blaming international developments for its plight, but anyone with a sense of how prices move up and down in cycles in modern market economics would say that the government has only to blame itself because it did not spot a lurking threat while it feasted on an opportunity.

Petroleum Minister Dharmendra Pradhan's contention that a depreciation of the Indian rupee against the US dollar and a global rise in crude oil prices have caused local prices to surge is technically correct, but it is important to ask why the government did not take any countercyclical measures or set up an early buffer to cushion ordinary customers during the phase when oil prices were soft and the rupee was strong.

Developments in economies such as Venezuela, Turkey and Argentina have indeed caused concerns about emerging markets in international trade, and India cannot escape being clubbed together for no fault of its own.

But it is time to ask Mr Pradhan some questions: why did your government rest smugly and claim efficient fiscal management when it was essentially a result of easier oil prices worldwide? Why did your government raise excise duties on petroleum products and keep them out of the goods and services tax (GST)?

Studies show that the central government is estimated to have collected a whopping Rs 10 lakh crore (an amount tantalising close to the level of bad loans piled up in the Indian banking system) from levies on petrol and diesel between 2014-15 and 2018-19, the five-year tenure of the Modi government. Taking advantage of soft oil prices the government quietly raised duties on petroleum products during its reign.&nbsp

Excise duty on unbranded petrol rose from Rs 9.24 per litre in late 2014 to Rs 19.48 this year, helping the government keep the fiscal deficit in control, and boast about it to foreign investors and international financial agencies. The Centre also currently levies an excise duty on Rs 15.33 per litre on diesel, which has witnessed a steady increase but for a small cut in the intervening period. Keeping a central government leash on oil-based fuels while keeping it out of the GST was evidently an opportunity that has now become a political threat.

Perhaps no Indian government in recent times has enjoyed such a sweet spot in global oil prices as Prime Minister Narendra Modi's. Thanks to that, both inflation and the fiscal deficit have been in control. Consumer price inflation has been under 6 per cent for most of the NDA government's reign on account of global factors. As a result, interest rates have also been lower, helping the average middle class citizen's home loan instalments stay under control.&nbsp

Those were 'achhe din' (good days) for both the government and the citizens. Not any more, it seems. India's external account, reflected in the current account deficit, has been steadily deteriorating. With oil prices on the rise again, the current account deficit is expected to rise to 2.8 per cent&nbspof the GDP in the current year from 1.9 per cent in 2017/18.

Oil prices plunged from $100 levels when the NDA government took charge in 2014 to merely one third of that level one year later. The NDA government could have taken some extra efforts to anticipate a turn in the cycle of oil prices and taken precautionary measures. Alas, it did not.

As the Hindi proverb goes: "Bahti Ganga me sab haath dho lete hain" (Everybody washes his hands when the Ganga flows -- equivalent to making hay while the sun shines or jumping on the bandwagon).

The sun was shining all these years and clouds are out again. The government must now take responsibility for both or maybe rue the fact that you cannot be pleasing international financial agencies and local voters at the same time. In an election year, the local mood can bite a ruling party more.

The Economic Survey 2017-18 identifies two sources which can deliver sustained growth and economy: Private investment and exports. While sluggish growth of private investments stems from Twin Balance Sheet problem of over-leveraged corporations and NPA-ridden banks, weak export growth is the result of domestic and external factors.

Exports registered a negative growth rate of -15 per cent in 2015-16 before recovering to 12 per cent in 2017-18.

India’s exports primarily consist of agricultural and engineering goods, capital goods, textiles and Petroleum, Oil and Lubricant (POL) products, while a lion’s share of its imports is made up of crude oil and gold. The other important export item is services exports, including revenues from Information-Technology Business Process Outsourcing (IT-BPM) services. Of late, all these items have faced issues and challenges, hampering our export growth. A drop in oil prices from 2013-14 onwards led to a fall in our POL revenues, as oil is their most important component.

Engineering goods have seen tough competition, especially from China. Agricultural exports have fallen by two-thirds since 2014-15, mainly due to crashing international prices brought about by a glut in supply. IT-BPM services are not only facing competition China and Mexico, they have also been hit hard by tougher immigration norms in the US and rising automation. The textile sector is reeling under skill shortage, labour law rigidities and state taxes.

India needs a concerted effort to raise its export growth and generate necessary jobs. A few suggestions are in order. First, focus on labour intensive exports. This includes textile, leather and agro-processing sectors. The government has taken a number of steps, like rebate on state levies for ready-made garments, SAMPADA scheme for agro-processing, MUDRA Yojana to provide refinancing of credit to MSMEs which can boost export growth. The crux lies in carrying these schemes forward.

Second, logistics and export infrastructure need a boost. Third, many countries reject Indian exports due to quality concerns arising from sanitary and phyto-sanitary conditions. This requires India to enter into Mutual Recognition Agreements with other countries so that quality concerns are taken care of. India needs a concerted effort to raise its export growth and generate necessary jobs.

In fact, a trade representative should be posted in every Indian mission abroad to further the interests and concerns of the Indian businesses in those countries. Fourth, Indian firms need to integrate with global value chains (GVCs), especially in textiles and apparel where it has an advantage. This would require setting up some anchor firms, which can be MNCs, which have the forward linkages with the GVC and also the backward linkages with the suppliers in India. Finally, India needs to identify the sectors where an inverted duty structure exists, and correct the anomalies. (This article was first published on The DNA. Read the original article.)
Just a few days after the Supreme Court gave a landmark judgment by decriminalising homosexuality, Chief Justice of India (CJI), Dipak Misra said that each individual has the right to life as well as the right to live with dignity, but cases involving conflicting interest have to be dealt with in a balanced manner.

Delivering the Dr Patangrao Kadam Memorial Public Lecture Series at Pune's Bharti Vidyapeeth, the CJI, while referring to the Aruna Shanbaug case, touched upon the issue of conflict between two fundamental rights, and said that the verdict in such cases should be given after thoroughly studying the facts of the case and the fundamental structure of the Constitution.

The Aruna Shanbaug case led to a change in euthanasia laws of the country. The bench handling this case in 2017, recognised a living will by a terminally-ill patient for passive euthanasia and drafted new guidelines clarifying the way to execute the will and the role of the medical board in giving assent to the will.

"Everyone has a right to life but at the same time, he or she has a right to life with dignity. If he/she is unable to live with dignity because of prolonged illness, from which he/she will not overcome then in such cases he/she has the right to die with dignity. This is what balancing of rights mean. Adjustment, acceptance, compromise, and settlement comes in the balancing of rights and for the coexistence of rights. We have to balance them for the well being of mankind," Mr Misra added.

Citing the Mazdur Krishna Shakti Sangathan case, the Chief Justice said that in situations where conflict arises between two fundamental rights or intra-fundamental rights in respect of some person, it becomes slightly difficult for a bench to give out the verdict. "No particular parameter can be fixed but yet the courts try and endeavor to fix certain parameters, it has to be judged on facts of each case, taking care of certain constitutional concepts," he noted.

Furthermore, Dipak Misra noted that it is important for an individual to exercise rights granted by the constitution in order to develop the society and strengthen the democracy.

"We have a constitutional democracy and it is conceded with a singular and a sole mission and purpose of securing its citizen's rights and liberties which foster and strengthen the spirit and growth of development in a society. Rights protected and guaranteed under a constitution are the fulcrum of any free society. We ought to live in a democratic and free society. As far as that concept is concerned there is no compromise. We have the rights and must exercise them within the constitutional parameters. These rights are interest recognised and protected by a rule of justice. If the rule of justice collapses, rule of law will automatically collapse. I must respect your freedom, you must respect mine and this is how we can build up a societal fraternity in a true sense," the Chief Justice said.

Speaking further on the importance of individual's right in a democratic country, CJI Misra said, "In a democratic setup, every right matters and no right is absolute. There is no hierarchical order in rights. A particular fundamental right cannot exist in isolation."

The CJI also cited an example of the 1975 Narendra Prasad case and said that in this case, the judicature observed that "A particular fundamental right cannot exist in isolation in a watertight compartment and one fundamental right of a person may have to coexist in harmony with the exercise of another fundamental right by others. "So, we have to co-exist, therefore the rights have to balanced."

Dalit leader Jignesh Mevani demanded that the BJP government in Gujarat talk to Hardik Patel, whose indefinite fast for quota for the Patidar community and farm loan waiver entered the 17th day Monday.

Mevani, an independent MLA, met Patel and extended support to his agitation. He is on fast at his house on the outskirts of the city since August 25 for quota and farm loan waiver.

"The government should put aside its ego and hold talks with Hardik on the issue of farm loan waiver. I urged Hardik to explore other means of agitation if the government does not pay heed. But Hardik is firm on continuing the fast," said Mevani.

Before Mevani's arrival, Patel had a spat with policemen when one of his relatives was allegedly stopped from meeting him.

"People are observing fast at 4,670 villages across the state in my support. I urge these youths to end their fast. I am confident that people are now awakened about the issues of reservation and farm loan waiver. This is the beginning of a mass revolution," he said in a statement.

He also accused the police of preventing Patel's supporters from meeting their leader. Before Mevani's arrival, Patel had a spat with policemen when one of his relatives was allegedly stopped from meeting him. Learning that his relative was stopped at the main entrance of the colony, Patel sat in a car and reached there and ticked off the policemen saying "never stop my relatives". Patel also urged his supporters who are fasting to show solidarity with him to end their hunger strike. "People are observing fast at 4,670 villages across the state in my support. I urge these youths to end their fast. I am confident that people are now awakened about the issues of reservation and farm loan waiver. This is the beginning of a mass revolution," he said in a statement. Patel was admitted to a hospital after his health deteriorated Friday, on the 14th day of the fast. After spending two days in the hospital, he returned to his house and continued the hunger strike. While he had started taking liquids and was administered glucose at the hospital, he has claimed that he has not taken any solid food.
