The Delhi High Court on Thursday granted time to former Wrestling Federation of India (WFI) chief and ex-BJP MP Brij Bhushan Sharan Singh to file contentions for seeking quashing of the FIR and charges framed against him in a sexual harassment case lodged by several women wrestlers.

Justice Neena Bansal Krishna granted two weeks to Singh and listed the matter for further hearing on September 26.

“Petitioner seeks time to prepare a short note raising all the contentions for seeking quashing of the charge sheet and all other proceedings emanating therefrom. Two weeks are granted to do so,” the court said.

The plea was opposed by the counsel for the State and the victims who contended that it was not maintainable.

The complaints were made by six women wrestlers and the trial court found that the complaint of one of them was time barred so it framed charges based on the complaints of five victims, senior advocate Rebecca John submitted, adding that, “this shows there was a deep application of mind”.

During the hearing, the court questioned Singh for filing a single petition for challenging the order framing charges against him and also seeking quashing of FIR and charge sheet and all other proceedings.

“There can’t be an omnibus order for everything,” the court said and added that he was challenging everything after the trial has commenced.

“This is nothing but an oblique way,” it said.

Advocate Rajiv Mohan, appearing for Singh, submitted there was no commonality between the causes and there was no continuity in the instances stated by the alleged victims.

He contended that the allegations levelled against Singh were “motivated” and since he was the chief of WFI at that time, the common agenda behind all the complaints was to remove him from the post of WFI chief.

The high court opined that all the averments now being made by the petitioner must have been considered by the trial court at the time of framing of charges.

Singh, in his plea, contended that the investigation was done in a biased manner as only the version of the victims, who were interested in taking revenge against him, was considered and the charge sheet was filed before the trial court without taking care of the falsehood of allegation.

The former WFI chief claimed that he has been falsely implicated in this case and no offence as alleged by the prosecution has been committed by him.

On May 21, the trial court had framed charges of sexual harassment, intimidation and outraging the modesty of women.

The court had also framed the charge of criminal intimidation against co-accused and former WFI assistant secretary Vinod Tomar in the case.

The Delhi Police filed an FIR against Singh after the intervention of the Supreme Court in May 2023.

The charge sheet was filed on June 15 in Delhi Court after a strong plea from the wrestlers.

The wrestlers had been protesting in different parts of north India including Haridwar (210 km north of the national capital New Delhi) and the site of the new parliament building of India.

The charge sheet accused the duo of Singh and Vinod Tomar,&nbsp;former assistant secretary of the WFI, with the offence of criminal intimidation for the offence against Victim No 1 under sections 354 (assault or criminal force to woman with intent to outrage her modesty), 354A (sexual harassment), 354D (stalking) and 506 (criminal intimidation) of the IPC.

It mentioned that Tomar is accused of helping to commit the crime. Therefore, he is also facing trial for his involvement under certain sections of the IPC.

United World Wrestling (UWW), the apex body of wrestling in the world, has lifted the suspension placed on Wrestling Federation of India (WFI) with immediate effect. UWW had suspended the WFI on August 23 last year for failing to hold the elections in due course. The suspension, however, has been revoked under some conditions.

"On February 9, the UWW Bureau met to review the suspension and decided to lift the suspension under some conditions, like the WFI has to re-convene the elections of its Athletes’ Commission. The candidates for this commission shall be active athletes or retired for no longer than four years. The voters shall be exclusively athletes. These elections shall take place during trials or any senior national championships where this operation can take place, but no later than July 1, 2024," read a statement from world wrestling body.

This non-discrimination includes the three athletes who protested against alleged wrongdoings by the former President," the statement further read.

Notably, in December last year, the WFI had conducted the election in which Sanjay Singh had won. Singh is the supporter of former WFI chief Brij Bhushan Singh against whom several athletes, including Bajrang Puniya, Vinesh Phogat and Sakshi Malik, were protesting.

The Ministry of Sports, India then suspended the newly elected WFI body headed by chief Sanjay Singh on December 24. The suspension came after WFI failed to follow the provisions of the constitution of WFI while announcing a hasty plan to host the wrestling nationals.

The ministry also observed that the newly elected body "appears to be in complete control of former office bearers in complete disregard to the Sports Code."

Soon after, Sakshi announced her retirement from wrestling as Sanjay is a close aide of former WFI president Brij Bhushan Sharan Singh. It is to be noted that Sakshi and many other top wrestlers, such as Vinesh Phogat and Bajrang Punia, charged Brij Bhushan with sexually harassing female wrestlers in early 2023. Thus, Sanjay's appointment led to Sakshi quitting the sport altogether. Later, the newly-elected Wrestling Federation of India governing body, along with its chief Sanjay, got suspended soon. Sanjay Singh, who took over the president’s post following Brij Bhushan Singh’s retirement, said he does not accept this committee formed on December 27.

On the orders of the Sports Ministry, the Indian Olympic Association (IOA) formed a three-member ad-hoc committee, chaired by Bhupendra Singh Bajwa, with MM Somaya and Manjusha Kanwar as&nbsp;members.&nbsp;

Speaking to India Today in an exclusive chat, Sanjay Singh said he opposes the formation of this committee and will urge the ministry to dissolve it; if they don’t listen to his appeals, he will take the legal route.

"I don't accept this ad-hoc committee; I will speak to the minister, and if the matter is still not resolved will seek legal opinion," Sanjay Singh told India Today.
