CNN, Politico and MS NOW return to the White House after a judge blocks Trump’s media ban, ruling the outlets were likely denied due process

CNN, Politico and MS NOW back in White House after judge blocks Trump’s media ban

A US federal judge on Wednesday questioned whether President Donald Trump's decision to ban CNN, MS NOW and Politico from the White House complied with existing court rulings, but he did not immediately decide whether the news organizations should regain access. US District Judge Timothy Kelly held a hearing in Washington to consider a request from the three outlets for a temporary restraining order that would restore their White House access while their legal challenge proceeds. The outlets filed the lawsuit on Monday, arguing that the ban violates First Amendment protections for freedom of speech and a free press, as well as due process rights. Kelly pointed to two previous rulings by the US Court of Appeals for the District of Columbia Circuit concerning journalists' access to the White House. He said those precedents establish that journalists are entitled to due process before their press credentials can be revoked. The judge also questioned whether the White House had provided CNN, MS NOW and Politico with a meaningful opportunity to challenge the decision before their access was withdrawn. "The government said those cases ... were wrongly decided," Kelly said. “Maybe they were wrongly decided, maybe they weren't. But as a district court judge I have to apply them. I think it is fair to say the process the circuit laid out in those two cases wasn't followed here.” Kelly said he would issue a ruling later on the request for a temporary restraining order rather than making an immediate decision at the hearing. An attorney representing the news organizations argued that the outlets were denied advance notice and an opportunity to contest the decision before their access was revoked. "By ejecting and banning the plaintiffs from the White House without a semblance of due process here, defendants have imposed what really amounts to an unprecedented, unreasonable and severe punishment," attorney Theodore Boutrous said. Michael Velchik, a Justice Department lawyer, defended the administration's position, saying letters sent to the news organizations on Tuesday provided sufficient explanation for the revocation of their press credentials. Kelly, however, questioned that argument because the letters were delivered after the access had already been revoked and after the lawsuit had been filed. "I don't know how a letter that they got after the pass was revoked could provide them with the notice of the kind of standards that they would have to conform their conduct to, since it's a piece of paper they got saying, 'You've already violated this.'" Also Read: Open AI, Anthropic CEO urges caution over rapid AI development at UN Security Council, call for 'extreme care'
National security argument
In a filing before the hearing, the Justice Department argued that access to the White House is a privilege rather than an entitlement and maintained that the president has authority to suspend access for news organizations. Kelly ordered the White House to restore Acosta's press pass after it had been revoked following a contentious news conference with Trump. At the time, Kelly ruled that the White House had failed to use fair and clear procedures in revoking Acosta's credential, describing the process as “shrouded in mystery.” Trump later criticized Kelly on social media and expressed regret over appointing him to the federal bench in 2017 during Trump's first presidential term. The latest case has also drawn support from press freedom organizations and other news outlets. A coalition filed a legal brief on Wednesday supporting CNN, MS NOW and Politico, arguing that journalists should not lose access because of perceived editorial viewpoints. The brief was signed by the Reporters Committee for Freedom of the Press, Reuters, the Washington Post and Fox News, among others. The judge's eventual ruling on the temporary restraining order will determine whether the three organizations regain White House access while their broader legal challenge continues.

US judge questions Trump’s decision to ban CNN, MS NOW and Politico from White House

US President Donald Trump’s launch of a new helipad on the White House South Lawn on Monday was overshadowed by an awkward audio failure, with the sound of a helicopter drowning out his remarks throughout the ceremony. The incident came just hours after ABC, CBS, Fox News and NBC suspended their shared television pool coverage of Trump’s events following the White House decision to bar CNN, MS NOW and Politico from the White House grounds. Video shared by Al Jazeera showed Trump cutting a ribbon on the walkway leading to the new helipad and speaking with construction workers. However, his comments could barely be heard on the White House’s own livestream because of the helicopter noise. “This is one example of it backfiring just a little bit,” conservative outlet Newsmax said in their coverage of the event. CNN had been scheduled to provide the television pool feed for Trump’s trip to New York for the United Nations General Assembly. Following CNN’s exclusion from the White House, the other major networks declined to take over its role. Bryan Boughton, who runs the Fox News Washington bureau and was serving as the television pool chair, said in an email that the pool would not cover events designated for pool coverage. “There will be no replacement pool put in place.”

The New York Times backs affected outlets
The New York Times said it would not distribute photographs taken as part of the White House still photography pool on Monday, joining other members of the pool in showing support for outlets affected by Trump’s decision. “The New York Times will not publish or distribute any images taken as part of the White House still photography pool today, in conjunction with the other members of that pool and in a show of support for the news organizations being unfairly targeted by the president's barring of journalists from the White House.” “We remain committed to covering the president's travel to New York City today. Americans deserve a free and independent media covering their government without intimidation, as well as comprehensive coverage of newsworthy events,” Charlie Stadtlander, a spokesperson for The New York Times, said.
CNN, MS NOW and Politico sue Trump
The television pool dispute unfolded on the same day that CNN, MS NOW and Politico sued the Trump administration over their exclusion from the White House. The three outlets said they were seeking a temporary restraining order in federal court in Washington, DC, with a hearing scheduled for Wednesday. “This morning, we notified the government that we are filing a lawsuit today to protect our First Amendment rights and defend the principle that the government does not decide what the press reports or publishes,” the outlets said in a joint statement Monday. “Without notice or process, the White House revoked our journalists' credentials because it objected to our reporting,” the statement continued. “Left unchallenged, this threatens press freedom and the public's right to independent journalism free from government interference.” The lawsuit argues that the ban violates the outlets’ First Amendment rights and asks the court to restore their access to the White House. Also Read: White House TV pool halts Trump coverage after CNN barred from UNGA events

‘They never boycott me’, says Trump
Trump responded to the dispute on Truth Social, saying the White House was not targeting the free press but was instead taking aim at what he described as “FAKE NEWS.” “The White House is not instituting an assault on the Free Press, something which I cherish. It is instituting an assault on the FAKE NEWS. It is a threat to our National Security, and must be stopped, NOW!” Trump wrote Monday. The White House media standoff also surfaced during Trump’s meeting with New York Mayor Zohran Mamdani on Monday. C-SPAN shared an exchange between the two on X concerning the White House press ban. Mamdani said, "I told the president that we're gonna have all the members of the press here on the lawn." Trump responded, “They said they were gonna boycott me but they never boycott me.
