Finding a prima facie case for murder against the accused, the trial court, while framing charges against the accused persons, had noted that the deceased, after being abducted and brought to the stadium, was given severe beatings by many of the accused persons who used sticks, baseball and hockey sticks to cause bodily injuries to him.
The judge had further noted that the victims were tortured by the accused persons for a prolonged time after putting lock at the main gate of the stadium so as to rule out any help for the deceased.
Kumar had been in judicial custody since June 2, 2021. Previously, he was granted interim bail twice&mdash;once to perform his father&rsquo;s last rites and another time for surgery on a torn ligament.
Following Dhankar&rsquo;s death, Kumar evaded authorities for 18 days, traveling across <a href="https://www.wionews.com/tags/punjab">Punjab</a>, <a href="https://www.wionews.com/tags/uttar-pradesh">Uttar Pradesh</a>, Uttarakhand, and Haryana before being arrested in Delhi&rsquo;s Mundka area while attempting to collect cash. He was also suspended from his job with the Railways after his arrest.
In October 2022, the trial court framed charges against Kumar and 17 others, initiating the legal proceedings against them.

Two-time Olympic medalist Sushil Kumar on Monday was granted an interim bail for four days by the Delhi court to perform his father's last rites. Kumar, the main accused in Sagar Dhankar murder case, was in police custody since June 2, 2021. The Rohini Court granted bail to Kumar on humanitarian grounds for an amount of INR 1 lakh and two sureties of the same amount.&nbsp;

The Additional Sessions Judge Shivaji Anand in a statement said knowing the father of accused passed away yesterday and the final rites are to be performed today, Sushil will granted an interim bail for the same from March 6th to 9th.&nbsp;

“Keeping in view the fact that the father of the accused expired yesterday and his last rites are to be carried out today itself, on humanitarian grounds, the applicant or accused be released on interim bail from March 6 to March 9 only on furnishing personal bonds of the sum of Rs 1 lakh with two sureties of the like amount,” he said.

The judge further said considering threat to the witnesses upon the accused's release and Kumar's security on the slip side of it, at least two security personals will stay alongside him all the time. He also added that the defined amount will have to be deposited in advance with the concerned jail superintendent, as per the jail rules.&nbsp;

“The entire expenditure of deployment of security persons or policemen for keeping surveillance and security of the applicant shall be borne by his family members. Applicant is directed to surrender before the Jail Superintendent concerned after expiry of interim bail period i.e, on March 10,” the court said.

However, as per stipulations related to the interim bail, Kumar cannot indulge in any of the activities such as threatening the prosecution witnesses, tampering with evidence; and if even and when required he must share his phone's live location with the investigation officer. If he fails to abide by any such rules, the court is liable to cancel his interim bail then and there.

“In case it is prima facie brought to the notice of the court that the applicant is violating the said conditions, the interim bail granted to him shall be liable to be cancelled,” the court said.

They had even gone to the point of painting a grotesque image of the present accused where he was said to be a gangster himself and even questions were raised against his antecedents,&nbsp;Kumar said in a 16-pages bail plea.

However, after filing the charge sheet, all the claims and leaks made by the investigating agency are untrue and without any footing in the reality, the plea filed through advocate Pradeep Rana said.

To buttress his contentions, he stated that the FIR was filed after a delay, and statements of witnesses were marred by improvements and contractions, and were deliberately withheld by the investigating agency to build a "false case".

The investigating agency at the fag end of the investigation cropped up a new version that the deceased had given a dying declaration to the police officials with an aim to add bite to the otherwise toothless case of the prosecution, Kumar submitted.

He also called the FIR a conjoint mix of "assumption, presumption, and malafide intentions", adding that the police arrested him in the absence of concrete evidence.

The wrestler further said that he is no more required for any custodial interrogation, much less for any recovery or discovery of incriminating material as the charge sheet has been filed which shows that the probe against him is over.

Kumar said that nothing incriminating has been recovered from him which further corroborates his innocence but the investigating agency in order to build a case against him has attributed certain vehicles and weapons to him.

The accused has received various laurels representing India and has made the nation proud by winning medals at numerous International tournaments and championships,&nbsp;the plea stated and listed out all the medals he has won over the years.

The Olympic wrestler submitted that he is confident to prove his innocence before any court of law and any detention at this stage would only be pre-trial incarceration without any fault on his part being innocent.
