The act of registering an FIR against Major Aditya Kumar in connection with last month&#39;s Shopian firing case shows the appeasing attitude of political hierarchy of Jammu and Kashmir. It shows them in poor light, more importantly, such an act actually lowers the morale of Armed Forces operating in Kashmir. It also shows the unawareness of the officials responsible for the FIR about the provisions of the AFSPA.

The incident has been covered widely by the media. Let me highlight some important issues which the nation must think in the national interest.

&bull;&nbsp; &nbsp; FIR registered against Army Major Aditya Kumar in connection with last month&#39;s Shopian firing case does not stand as the military personnel was there not by choice. They were there because the country wanted them to be there; it was their duty to protect the country in a disturbed region.&nbsp;

&nbsp;

&bull;&nbsp; &nbsp; The column was attacked by stone pelters with an intent to hurt the forces, hence, criminal force was applied against them. Why the authorities did not register FIR against the stone pelters.

&nbsp;

&bull;&nbsp; &nbsp; Major Aditya Kumar and his troops had no enmity with the persons who were killed in the incident.

&nbsp;

&bull;&nbsp; &nbsp; The Army personnel have the right of self-defence too

&nbsp;

&bull;&nbsp; &nbsp; As per the law in vogue, in a &lsquo;Disturbed Area&rsquo;, the officer is duty bound to protect his subordinates and the government property and can use force. The minimum force is to be used but the decision as to how much force is the minimum force is a decision to be taken by the commander on the spot, based on his judgement. &nbsp;

&nbsp;&nbsp;

&bull;&nbsp; &nbsp; Army after the due warning is expected to fire for effect and not in the air, unlike police, which can use measures like tear gas or firing in air.

&nbsp;

Under the circumstances in which Maj Aditya and his troops were placed, had they not taken any action, they would have been either lynched or burnt. The officer and men, in my opinion, have acted in self-defence as per powers conferred to them by law.

&nbsp;

It needs to be understood that the Army is the instrument of last resort and if they are scarred by legal actions, then the morale of young officers and men will be affected adversely. If they get overcautious, we have to blame our political hierarchy of pushing them into fortress mentality, wherein they will not come out and protect people due to fear of litigation which is exactly desired by Pakistan and militants. If we are soft towards the militants, no corner of the country will be safe. I do not understand why politicians of Kashmir for their petty gains do not understand this, despite an attack on our Parliament.

It also needs to be understood that under the AFSPA, the state has to take permission of the Central Government to proceed against the officer, which the Central Government can refuse, which has happened in many such cases earlier. Even if the permission is to be given a set procedure is to be followed.

&nbsp;

I must salute the honourable Supreme Court of India which has put a stay on the FIR registered against Army Major Aditya Kumar in connection with this&nbsp; Shopian firing case. The apex court also directed that no coercive action be taken against Major Aditya in connection with the incident in which three civilians were killed and nine others were injured.

&nbsp;

It should also be a matter of concern that Indian Army unlike most armies in the world is known to use minimum force and does not use even high calibre weapons. Nowhere in the world, you can see an example of an armed soldier being beaten by a lady, and the soldier is showing resilience to tolerate it, and taking such ill treatment from people, whom the soldiers have saved in floods a year earlier. Let us not push our soldiers to wall, the consequences can be disastrous, definitely not in the nation&#39;s interest. &nbsp;

Srinagar-based Army PRO said: &quot;We had forwarded our complaint to the police in Shopian incident and is based on the same statement that army had issued that very day. It has been mentioned in DAK PAD of police, now its to police how they name it.&quot;&nbsp;

However, the army has not named any attacker but has mentioned the injuries to soldiers and damage to vehicles in the complaint.&nbsp;

The violent crowd further closed in towards the vehicles and attempted to set them on fire. Now, the army and state police are&nbsp;face to face after the police lodged an FIR under section 336,307,302 RPC against the army unit naming army major and his unit. The&nbsp;army had lodged a counter FIR defending itself.&nbsp;

The&nbsp;incident has&nbsp;turned into a political row now after state chief minister&nbsp;Mehbooba Mufti Sayeed said that the magisterial probe in the case will be taken to the logical conclusion.

The CM told the state assembly that the government had filed the FIR only after consulting defence minister Nirmala Sitharaman.

&quot;She told me that I should take action if any carelessness or anything wrong has happened,&quot; she said.&nbsp;

On the hand, the state government and its collation partners are not on the&nbsp;same page over the Shopian firing.

BJP is of the view that FIR against the army should be withdrawn as it would&nbsp;demoralise the army, however, they are condemning the incident, but the other partner PDP is of opinion that investigation should go as per law and police will investigate the case.&nbsp;

Meanwhile, the state main opposition party National Conference said its an &quot;eyewash&quot;&nbsp;when the two parties which are running the government in the&nbsp;state are not of the&nbsp;same opinion.

The bullet-ridden dead body of a 23-year-old Territorial-Army jawan,&nbsp;Irfan Ahmad Dar, was found in a remote village of Jammu and Kashmir on November 25.

A resident of Saazan village,&nbsp;Irfan was&nbsp;posted at Guruz.&nbsp;He was in engineering regiment of the Territorial Army.&nbsp;

The army soldier was on a vacation. He went out of&nbsp;his home on Friday and did not return, reports said.

His body was found at Wuthmulla village located in the Shopian district of Jammu and Kashmir.&nbsp;

An Army lieutenant was abducted in Kashmir Tuesday night by militants, the Army said, shot and killed, and his body disposed of.&nbsp;

The officer&#39;s bullet-riddled body was found this morning in the Shopian district of South Kashmir.&nbsp;

The Army identified the officer as Lt. Ummer Fayaz.&nbsp;

Fayaz was Kashmiri. His home was in Kulgam district.&nbsp;

The Army said he was a keen sportsman, good at hockey and basketball.&nbsp;

They added that he had joined the Army last December, and that he was with the 2 Rajput Rifles. &nbsp;

&quot;The Army commits to bring the perpetrators of this heinous act to justice,&quot; news reports quoted an Army spokesman as saying.&nbsp;

The new reports added that Ummer&#39;s father was an orchard owner.

Ummer was home on leave, attending a wedding in the family, when he was abducted.

News reports said his family had been too scared to report the matter.

They had hoped that he would be returned alive.

Sadly, that was not to be.

Meanwhile, defence minister Arun Jaitley called Ummer&#39;s killing a &quot;dastardly act of cowardice&quot;.&nbsp;

Suspected terrorists barged inside a police post guarding the court complex of southern Shopian district in Jammu and Kashmir late on Tuesday night, and decamped with five service rifles.

The terrorists decamped along with five service rifles including four INSAS rifles and an AK-47 rifle.

This is the second incident in a week targeting weapons of police personnel, as on May 1st, Rajouri was put on high alert after the weapon of a policeman was stolen from the station itself.

The police said that an AK 47 rifle of a police personnel was stolen.

Last month, a large cache of arms and ammunition, including 35 assorted rifles belonging to the police went missing in south Kashmir.

Among the arms and ammunition that are still untraced are 21 INSAS rifles, 12 SLR rifles, two AK 47 rifles, one Light Machine Gun and three Carbine Machine Guns.

Incidents of gun snatching are notorious in the Valley, as several cases have been reported of terrorists or gunmen barging into police stations and wresting the weapons from the personnel.&nbsp;

Suspected terrorists barge into police post, decamp with rifles in Kashmir

Militants opened fire at a police post in the Shopian district of Jammu and Kashmir on Friday, killing one policeman and leaving one policeman and a civilian injured.

On Thursday, three Pakistani terrorists were killed after they attacked a camp at Langate in the Kupwara district, the commanding officer of the 30 Rashtriya Rifles, Colonel Rajiv Saharan, confirmed.

Three AK-47 rifles, two under barrel grenade launchers, three GPS, four radio search, maps and metric sheet, and medicines were recovered from them.&nbsp;

When asked how they identified the terrorists, Colonel Saharan said, &quot;The medicines recovered have &#39;made in Pakistan&#39; markings on them, this ascertains that these three terrorists were from Pakistan.&quot;&nbsp;

The attack comes only days after terrorists attacked a Border Security Force (BSF) camp and adjoining camps in Baramulla district, leaving one BSF soldier dead.

The attack also comes after the Indian Army conducted surgical strikes and destroyed seven terror launch pads across the Line of Control (LoC), last week, after&nbsp;terrorists attacked the army brigade headquarters at Uri, killing 19 soldiers.
