<p>This author caught up with Advocate Gulati, hours after the hearing to know more.&nbsp;</p>

<p><strong>Why have you filed the petition?&nbsp;</strong></p>

<p>“I have filed this petition to address a significant legal gap created by the Bharatiya Nyaya Sanhita (BNS), the new criminal code which has replaced IPC Section 377. This section was particularly vital for the LGBTQIA+ community, as it was the only provision that provided them with specific and effective legal safeguards. With its removal, individuals are now left without any other effective remedy.”</p>

<p><strong>Your PIL which is public interest litigation, says that it seeks legal protection against ‘non-consensual sexual acts?’ What does this mean?&nbsp;</strong></p>

<p>“Non-consensual sexual acts would be as per the apex Court’s judgement in Navtej Johar. The Supreme Court had partially read down Section 377 in the 2018 judgement. The PIL seeks to restore that protection that was lost in the repeal of Section 377 in the Bharatiya Nyaya Sanhita.”</p>

<p><strong>Section 377 before 2018 spoke about ‘unnatural acts’ that also included homosexuality, the whole gambit of queerness. What exactly did they mean by unnatural acts?&nbsp;</strong></p>

<p>'Section 377 was essentially a residual provision within the IPC. While rape was explicitly addressed under Sections 375 and 376, Section 377 had a broader scope. It encompassed bestiality, and same-sex relationships, and also offered protection to heterosexual men against certain non-consensual acts.</p>

<p><strong>Section 377 and your writ speak about bestiality and animal rights. But what now for those who are passionate about animal rights?&nbsp;&nbsp;</strong></p>

<p>The Bharatiya Nyaya Sanhita is conspicuously silent on this matter. Previously, bestiality was addressed under IPC Section 377, but with its omission, this particular protection has been removed. As a result, animals, a vulnerable class of living beings, now face increased risk without the legal safeguards that once existed</p>

<p>“It was labelled ‘unnatural’ based on the traditional biological definition of natural sex. In this context, ‘natural sex’ was narrowly defined as vaginal intercourse, excluding all other forms of sexual expression.”&nbsp;</p>

<p><strong>Anything that was not ‘that’ was termed ‘unnatural?’&nbsp;</strong></p>

<p>“Exactly!”&nbsp;</p>

<p><strong>Do you have any data to support that queer people and disadvantaged groups are more at risk than privileged sections of society?&nbsp;</strong></p>

<p>In&nbsp;<i>Naz Foundation vs. Government of NCT of Delhi,</i>&nbsp;the Delhi High Court acknowledged affidavits detailing severe harassment and abuse against LGBTQIA+ individuals. One case involved a hijra in Bangalore who was gang-raped and tortured by both hooligans and police due to their sexual identity.</p>

<p>Another incident in Tamil Nadu involved a eunuch who, after enduring police torture, immolated himself inside a police station. These cases highlighted how these particular groups are at risk of gross violations of fundamental rights and are disproportionately targeted.&nbsp;</p>

<p><strong>The narrative around this P.I.L. is that it is an issue concerning solely the queer community, that too, just men. But what about, heterosexual men? What is the BNS’ stand on this?&nbsp;</strong></p>

<p>“The BNS protection against sexual offences is framed to cover individuals broadly, but similar to the situation with the queer community, the removal of Section 377 means that there is no provision that adequately protects the heterosexual men as well in cases of non-consensual sexual acts, especially those outside the context of traditional gender norms.”</p>

<p><strong>Since you are a 23-year-old lawyer and a fairly young one. On the 13th, were you nervous, were you scared? What was it that you were expecting?&nbsp;</strong></p>

<p>“I was fairly positive about what turned out to be the bench’s reaction now. The Honourable Bench was very considerate about the matter and did acknowledge that this certain lack had created a ‘gap’ in the criminal system. As you might have observed in the proceedings as well, the notice has not been issued in the matter and it has been simply adjourned for Mr Ahluwalia i.e. the Counsel for the Respondent, to seek instructions on that. I am fairly positive that in the next hearing, the Court would issue notice and the matter would go forward.”</p>

<p><strong>Before 2018, if a consensual same-sex act is occurring in a private space, it was criminalised, did that not inherently go against the Right to Privacy?</strong></p>

<p>The criminalisation of consensual same-sex acts in private directly conflicted with the Right to Privacy, recognized in&nbsp;<i>Justice K.S. Puttaswamy vs. Union of India</i>&nbsp;as part of Article 21. This principle was central to the&nbsp;<i>Navtej Singh Johar</i>&nbsp;judgement, where the Supreme Court affirmed the right to express one’s sexual orientation, whether publicly or privately, deeming Section 377 unconstitutional in this context.&nbsp;</p>

<p><strong>What interim relief did you seek from the honourable Court?&nbsp;</strong></p>

<p>I sought interim relief to preserve the protections that were there under Section 377 until a final verdict is reached in this matter. This involved either the reinstatement of Sec 377 or a gender-neutral interpretation of existing sexual assault laws to ensure an effective remedy.&nbsp;</p>

<p><strong>What would you say to a queer person reading these words?&nbsp;</strong></p>

<p>I understand the fears and uncertainties that these legal gaps create, but please know that you are not alone. This fight is for you, for all of us, to ensure that the law respects and protects every individual, regardless of their sexual orientation or gender identity. Your voice, your existence, and your rights are central to this cause, and I will continue to advocate for the justice and equality that you are entitled to.</p>

<p>In the last 17 days, nearly 12 bridges have collapsed across&nbsp;the Indian state of Bihar and the most recent&nbsp;one fell on Thursday&nbsp;(July 4) in Saran district.<br />

<p>The cause of the bridge collapse is under investigation. However, the officials spoke about the recent desilting work happening in the area.&nbsp;</p>

<p>Among the three bridges in Saran, two were on the Gandak River, which was just a kilometre apart and had collapsed within&nbsp;two hours on Wednesday (July 3).</p>

<p>The incident occurred a day after a survey of all old bridges in the state was ordered by Chief Minister Nitish Kumar so that those with urgent repairs could be identified.</p>

<p>The chief minister had appealed for improved bridge maintenance policies from both the rural works&nbsp;and road construction departments.&nbsp;</p>

<p>The bridges have also collapsed in Siwan, Chhapra, Madhubani, Araria, East Champaran and Kishanganj districts.</p>

<p>Advocate Brajesh Singh has filed a Public Interest Litigation (PIL) in the Supreme Court which sought the Bihar government's directions for carrying out a thorough structural audit of all bridges.</p>

<p>The PIL also demanded the&nbsp;constitution of&nbsp;a high-level expert committee for identifying the weak bridges which may need to be strengthened or demolished.</p>

<p>"It is a matter of grave concern that in a state like Bihar, which is the most flood-prone state of India, the total flood-affected area in the state is 68,800 sq. km which is 73.06 per cent of the total geographical area. Hence such routine accrual of the incident of falling bridges in Bihar is more disastrous as the lives of people at large are at stake. Therefore the urgent intervention of this Hon'ble Court is required to save the lives of people, as the under-construction bridges before its accomplishment collapsed routinely," said the petitioner, in the PIL.</p>

<p>Meanwhile, Bihar Development Secretary Chaitanya Prasad said that 11 engineers of the water resources department were suspended, in the wake of the bridge collapse.&nbsp;</p>

<p>Indian Supreme Court on Monday (Feb 19) rejected a public interest litigation (PIL) seeking a court-monitored probe by government agencies into the violence in Sandeshkhali village in West Bengal state.&nbsp;</p>

<p>India's top court said that the incident that happened in Sandeshkhali could not be compared to the violence in northern eastern state of Manipur. A bench of Justices BV Nagarathna and Augustine George Masih said that the Calcutta High Court is already seized of the matter.&nbsp;</p>

<p>The bench said: "The local high court will be the best to assess the situation. Let there be no dual forums." The bench also granted the PIL petitioner the liberty to approach the high court.&nbsp;</p>

<p>This development comes amid reports that Bharatiya Janata Party (BJP) leader Suvendu Adhikari apparently said that Prime Minister Narendra Modi is likely to visit the region.&nbsp;</p>

<p>As per reports, Adhikari was granted permission by the Calcutta High Court to visit Sandehkhali. He is expected to visit the gram panchayat in Sandeshkhali Block-II on Tuesday, as directed by Justice Kaushik Chanda.&nbsp;</p>

<p>Sandeshkhali is a village in West Bengal's North 24 Parganas district. It has seen violent protests amid allegations that a local Trinamool Congress (TMC) leader and his supporters sexually abused women.&nbsp;</p>

<p>Several women have accused local TMC leader Shajahan Sheikh and his allies of land-grabbing and sexual abuse. As per the report, Sheikh has been on the run.&nbsp;</p>

<p>While talking to the media, National Commission for Women (NCW) Chairperson Rekha Sharma said that several women came forward and complained about molestation when she visited Sandeshkhali.&nbsp;</p>

<p>A PIL in the Supreme Court has sought directions for nominating central and state government representatives from among Sunni Muslims to the 'Indo Islamic Cultural Foundation' trust for building mosque in Ayodhya.</p>

<p>The apex court on November 9 last year had paved the way for the construction of a Ram Temple by a Trust at the disputed Ram Janambhoomi-Babri Masjid site at Ayodhya, and directed the Centre to allot an alternative 5-acre plot to the Sunni Waqf Board for building a new mosque at a "prominent" place in the holy town in Uttar Pradesh.</p>

<p>In a bid to put an end to the more than a century old dispute that had torn the social fabric of the nation, the top court in a unanimous 5-0 verdict ruled that the 2.77 acres of disputed land where the demolished Babri Masjid once stood will remain with a central government receiver and be handed over to a Trust within three months for the construction of the temple.</p>

<p>The plea, filed by advocates Shishir Chaturvedi and Karunesh Kumar Shukla, said that apart from private individuals and members of state Sunni Board, the presence of central and state government representatives was essential to ensure proper management of the funds.</p>

<p>According to the plea, Sunni Waqf Board on July 29, 2020 declared creating a trust under the title of 'Indo Islamic Cultural Foundation' for building a mosque, cultural and research centre and public utility facilities including a community kitchen, a hospital and a library within 5 acres land allotted to it.</p>

<p>It said there was no provision for nominating any officer of the government, like the trust created by central government.</p>

<p>It is expected that hundreds of people will visit the 'Islamic Trust' site and it will get contributions from within India as also from foreign countries, the plea said, adding that there should be proper management of the funds and the property vested in the trust.</p>

<p>"It is in public interest that the Central Government and the State Government may have all relevant information about the working of the trust to maintain public order and to ensure that no malpractices take place and the funds are not mis-utilised or misappropriated by any trust," the petition said.</p>

<p>It said that government may be directed to create a trust making provision for nomination of the its officers in the same manner that the provision has been made in Ayodhya Teerth Kshetra Trust created by Central Government vide order dated February 5.</p>

<p>"Issue direction in the nature of mandamus directing the Central Government to create a Trust making provision for representation of the nominees of the Central and state government belonging to Sunni Muslims in Indo Islamic Cultural Foundation Trust which may carry out construction work and manage the affairs over 5 Acres land allotted in Dhannipur Village, District Ayodhya, UP to Sunni Central Waqf Board," the plea said.</p>

<p>The disputed site in Ayodhya was occupied by the 16th century Babri mosque which was destroyed by Hindu kar sevaks on December 6, 1992.</p>

<p>The demolition had triggered communal riots.</p>

<p>"The schools are duty-bound to follow and abide the terms and conditions which are a part of school prospectus and if there is no Force Majeure clause in the school prospectus, demanding of tuition fee, without providing the actual education, is a violation of law in terms of a contract and also against the principle of natural justice," it added.</p>

<p>The plea said that it would not be out of the question to mention that the school prospectus does not contain any clause with respect to a pandemic or like situation and further that in such a condition, the school would provide online classes and charge tuition fees for the same.It also said that the entire student community is facing a lot of problems to gain knowledge through the online education system.</p>

<p>"Some homework and class tests are required to be undertaken under the guidance of trained teachers so as to achieve, through the online way of teaching. It would be important to mention that private schools are either being run by the Society or trust and are not doing any social service to society. Even otherwise, the school is a service provider and thus is covered under the Consumer Act also," the plea said.</p>

<p>The 10 agencies notified under the new order are the Intelligence Bureau, Narcotics Control Bureau, Enforcement Directorate, the Central Board of Direct Taxes (for Income Tax Department), Directorate of Revenue Intelligence, Central Bureau of Investigation, National Investigation Agency, the Research and Analysis Wing, Directorate of Signal Intelligence (in service areas of J-K, North East and Assam) and Delhi Police commissioner.</p>

<p>The plea, filed by advocate Manohar Lal Sharma, termed the notification "illegal, unconstitutional and ultra vires to the law".</p>

<p>He also sought to prohibit the agencies from initiating any criminal proceedings, enquiry or investigation against anybody under the provisions of the IT Act based on the notification.</p>

<p>The petition alleged that the notification gives the state the right to access every communication, computer and mobile and "to use it to protect political interest and object of the present executive political party".</p>

<p>The government's move set off a political storm with the opposition accusing the Centre of trying to create a "surveillance state".</p>

<p>However, the Central government said the rules for intercepting and monitoring computer data were framed in 2009 when the Congress-led UPA was in power and its new order only notified the designated authority which can carry out such action.</p>

Supreme Court to hear new PIL challenging Rafale deal on Wednesday

<p>The Supreme Court on made it clear that it cannot monitor the ongoing probe into the over Rs 11,000 crore Punjab National Bank fraud case and said it would first decide whether a PIL seeking a court-monitored SIT probe into the scam was maintainable or not.</p>

<p>The Centre, on its part, sought dismissal of the PIL from the top court by submitting that agencies such as the CBI, Enforcement Directorate (ED), Serious Fraud Investigation Office (SFIO) and Income Tax (IT) department were conducting the probe independently.</p>

<p>“We cannot monitor. They (Centre) say that so many steps have been taken,” a bench comprising Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud said.</p>

<p>“We will hear the petition on maintainability first,” the bench said when J H Dhanda, counsel for PIL petitioner Vineet Dhanda, sought issuance of notice to the Centre and others. Dhanda claimed that accused like billionaire jewellers Nirav Modi and Mehul Choksi had committed fraud and fled and “the whole country was watching that the government had not done anything” in the past in a similar case relating to Vijay Mallya.</p>

<p>Attorney General K K Venugopal, representing the Centre, said agencies have been carrying out probe “independently” and taking steps like conducting raids and confiscating properties of accused and there was no need for judicial intervention.</p>

<p>Venugopal submitted that the prayers made in the petition were impractical and hence, not manageable by “judicially standards”. Moreover, there were laws to deal with such cases. The court considered Venugopal’s submissions and fixed the PIL on April 23 to decide whether it was maintainable or not.</p>

<p>Earlier, the apex court had said the government must get a free hand to probe the PNB fraud case, allegedly involving Nirav Modi and others. It had said the court would step in only when agencies fail to carry out the probe properly. The PIL has made Punjab National Bank, Reserve Bank of India and the Ministries of Finance and Law and Justice as parties. It has sought a direction for initiation of deportation proceedings against Nirav Modi and others allegedly involved in the banking fraud, preferably within two months.</p>

<p>It has sought setting up a special investigation team (SIT) to probe the banking fraud, besides a probe into the role of the top management of the Punjab National Bank (PNB).</p>

<p>The CBI has already registered two FIRs — one on January 31 and another in March against Nirav Modi, his relative Mehul Choksi of Gitanjali Gems and others for allegedly defrauding the PNB of about Rs 11,400 crore. The plea has sought a direction to the Finance Ministry to frame guidelines on the grant and disbursal of loans involving big amounts, besides ensuring safety and recovery of such loans.</p>

<p>It has also sought the setting up of an experts’ body to deal with cases of bad bank debts in the country, besides framing of rules for recovery of loans from the defaulters within a stipulated period, even by attaching their properties and auctioning them in the open market.</p>

<p>In his PIL, Dhanda has asked for a direction to fasten liabilities on the employees of a bank for sanctioning loans on the basis of deficient documents and said loans should also be recovered by attaching the properties of such bank officials even after their retirement.</p>

<p>Another plea filed by advocate M L Sharma on a similar issue would be taken up on April 27. Sharma, in his plea, has contended that the SIT should consist of retired judges of the apex court and said the banking fraud had caused serious injury to the public and the state’s treasury. It should be investigated not by an agency “being controlled by the political leaders/authorities”, he has said. His plea has alleged that loans were issued in the case without following RBI’s financial rules and regular systems.</p>

<p>Loya had died of cardiac arrest in Nagpur on December 1, 2014, when he had gone to attend the wedding of a colleague&#39;s daughter.</p>

<p>The Caravan magazine had, after talking to Loya&#39;s family members, first reported that he had died in mysterious circumstances.&nbsp;</p>

<p>Subsequent news reports have partly corroborated the Caravan report while disagreeing with other parts of it.&nbsp;</p>

<p>Expressing displeasure over the delay in filing response to a PIL, the Allahabad High Court has imposed Rs 5,000 cost on the Prime Minister&#39;s Office (PMO) and the Law Ministry.</p>

<p>A bench of Justice Sudhir Agrawal and Justice Abdul Moin of the Lucknow bench of the high court passed the order on the PIL moved by Sunil Kandu.</p>

<p>The petitioner has claimed that the central government takes cognisance of barely 10 reports of the Comptroller and Auditor General (CAG), whereas about five thousand reports are submitted to it by the federal auditor every year.</p>

<p>The PIL also sought reform in the CAG. Apart from it, the PIL further questioned the role of the central government in not taking any action on audit objections raised by the CAG in the past 10 years.</p>

<p>Hearing the PIL, the high court had on August 1, 2017, given the PMO and the Law Ministry a month&#39;s time to file their response.</p>

<p>When the matter came up again before the bench, Assistant Solicitor General S B Pandey sought more time to file response on behalf of the PMO and the Law Ministry.</p>

<p>Expressing displeasure at this, the bench though granted one more opportunity to Pandey to file a reply , imposed Rs 5,000 cost on the PMO and Law Ministry for their lethargy in responding to the high court&#39;s direction.
