British pharmaceutical company&nbsp;GlaxoSmithKline (GSK) has opened up a front against American pharma giant Pfizer by filing a lawsuit in a Delaware court on Wednesday (August 2). GSK&nbsp;has alleged that Pfizer infringed on its patent for the Respiratory Syncytial Cirus (RSV) vaccine.&nbsp;

According to the lawsuit, GSK said the New York-based company's RSV vaccine, Abrysvo, infringes four of its patents related to the antigen its shots use to fight the respiratory disease.&nbsp;

“Upon information and belief, Pfizer knowingly uses GSK’s claimed inventions in Abrysvo without permission,” GSK wrote in the complaint.&nbsp;&nbsp;

According to the complaint, GSK noted that its vaccine was in development seven years prior to Pfizer's. The company is now demanding a jury trial and seeking monetary damages, including lost profits and royalties resulting from Pfizer’s alleged patent infringement. It has requested the judge to prevent Pfizer from manufacturing and&nbsp;selling its vaccine in the US.&nbsp;

The company argued that intellectual property protections are the "foundation of research-based companies' ability to drive innovation," and that the lawsuit should not affect GSK's ability to launch its vaccine Arexvy.

After the lawsuit, a Pfizer spokesperson told CNBC that the company is&nbsp;“confident in its intellectual property position and will strongly defend its right to bring its innovative” RSV shot to patients.&nbsp;

<h2>Race to secure the market</h2>

Notably, both companies have been competing in the tight race to tap into the RSV vaccine market which could easily exceed $10 billion by 2030, according to experts. Both companies received approval for their vaccines from the&nbsp;US Food and Drug Administration in May for use in adults over age 60.

Both are the first vaccines approved to prevent RSV which causes an estimated 14,000 annual deaths in adults 65 or older in the US alone.&nbsp;

Notably, this is not the first instance when GSK has waged a legal battle against Pfizer over patent rights. In 2016, the British company sued Pfizer in a court in Ireland, alleging patent infringement over the&nbsp;meningitis vaccine.&nbsp;

Last year, Moderna sued Pfizer and its German partner&nbsp;BioNTech for patent infringement over its Covid vaccine. Later in the same year, Pfizer countersued Moderna.&nbsp;

The judgement against apple was upheld last year by the US Court of Appeals for the Federal Circuit in Washington. During the hearings, Apple and other tech titans requested a review of the validity of VirnetX patents by a tribunal of the US Patent and Trademark Office. Techno View IP, a Newport Beach, California-based technology licensing firm, sued Facebook and Oculus for infringing a 3D imaging patent owned by the VR headset maker ImmersiON-VRelia.

According to the complaint filed in federal court in Delaware, ImmersiON-VRelia, which has offices in Spain and California, agreed to let Techno View litigate the patent on its behalf.

The lawsuit comes as Facebook weighs its options following a $500 million verdict in an unrelated lawsuit brought over its VR technology by video game developer ZeniMax Media. A Dallas federal jury in February found Oculus used copyrighted computer code developed by video game designer John Carmack while employed at ZeniMax.

Lawyers for Oculus and Facebook have said they will seek to have the verdict set aside.

ImmersiON-VRelia makes VR headsets similar to the Oculus Rift, as well as a VR device for use with smartphones. Techno View said in its lawsuit ImmersiON-VRelia&#39;s chief executive, Manuel Gutierrez Novelo, attained several patents between 2003 and 2006 on various aspects of VR technology.

Nokia Corp said on Wednesday it had filed a number of lawsuits against Apple Inc for violating 32 technology patents, striking back at the iPhone maker&#39;s legal action targeting the one-time cellphone industry leader a day earlier.

Nokia&#39;s lawsuits, filed in courts in Dusseldorf, Mannheim and Munich, Germany, and the US&nbsp;District Court for the Eastern District of Texas, cover patents for displays, user interfaces, software, antennas, chipsets and video coding.

&quot;Since agreeing a license covering some patents from the Nokia Technologies portfolio in 2011, Apple has declined subsequent offers made by Nokia to license other of its patented inventions which are used by many of Apple&#39;s products,&quot; Nokia said in a statement.

Apple on Tuesday had taken legal action against Acacia Research Corp and Conversant Intellectual Property Management Inc, accusing them of colluding with Nokia to extract and extort exorbitant revenues unfairly from Apple.

Apple&#39;s lawsuit against Acacia, Conversant and Nokia was filed only one day after Ottawa-based Conversant named Boris Teksler as its new chief executive. He had worked as Apple&#39;s director of patent licensing and strategy from 2009 to 2013, the latter half of his tenure overlapping with the lawsuits against Samsung.

Acacia is a publicly traded patent licensing firm based in Newport Beach, California. One of its subsidiaries sued Apple for patent infringement and was awarded $22 million by a Texas jury in September.

Similarly, Conversant, which claims to own thousands of patents, announced last week that a Silicon Valley jury had awarded one of its units a $7.3 million settlement in an infringement case against Apple involving two smartphone patents.

Nokia, once the world&#39;s dominant cellphone maker, missed out on the transition to smartphones triggered by Apple&#39;s introduction of the iPhone in 2007.

The Finnish company sold its handset business to Microsoft Corp two years ago, leaving it with its telecom network equipment business and a bulging portfolio of mobile equipment patents. But this year, Microsoft sold its Nokia-feature phone business to a new company called HMD Global.

Nokia agreed to a 10-year licensing deal with HMD, which continues to market low-cost Nokia phones and plans to introduce new Nokia smartphone models next year.
