“Any movement towards Israel’s withdrawal from the West Bank and Gaza requires consideration for Israel’s very real security needs,” Richard Visek, acting legal adviser at the US State Department told the court.

He also noted that the UNGA had asked the UN court to opine on the consequences of Israeli occupation prior to Hamas’ October 7 attack on Israel.

“We were all reminded of those security needs on October 7, and they persist. Regrettably those needs have been ignored by many of the participants,” Visek added.

He called on the judges to stick to the established UN framework for the two-state solution.

Washington has been “engaging intensively” with Palestinians, Israel, and other states to not only address the current crisis in Gaza but also “a political settlement that will lead to a durable peace in the region that includes lasting security…and a path to Palestinian statehood,” said the acting legal adviser.

He added, “There is broad international support for achieving a negotiated solution to the conflict that will give rise to a Palestinian state.”

Therefore, the court “should not find that Israel is legally obligated to immediately and unconditionally withdraw from occupied territory,” said the US legal adviser.

Notably, the US amid protests and criticism of Israel’s military action in Gaza continues to back Israel, while President Joe Biden’s administration continues to insist on a two-state solution for the region. However, the leaders of the Jewish state do not agree with the same.

‘Flagrant violation of international law’

The UN top court also heard from Vladimir Tarabrin, Russia’s ambassador to the Netherlands who spoke about the suffering of Palestinians in Gaza while condemning the October 7 attack on Israel.

He went on to slam Israel’s retaliation to the attack and called it “collective punishment” which cannot be justified. Around 90 per cent of Gazans have been forced to leave their homes and they are living in inhumane conditions, said Tarabrin.

Amid the ongoing war between Israel and Hamas, the Palestinian militant group said that it estimates of losing about 6,000 of its fighters, according to news agency Reuters.

The Israeli cabinet unanimously approved a statement rejecting all “international dictates” seeking to push Palestinian statehood, which it termed as equivalent to a “massive and unprecedented prize for terror” that would prevent any future peace deal.

Israeli Prime Minister Benjamin Netanyahu on Sunday (Feb 18) said that his government would vote on a "declaratory decision" about Israel's resistance to the imposition of Palestinian independence by force.

At the start of the weekly cabinet meeting, Netanyahu said that this move comes after "recent talk in the international community about an attempt to unilaterally impose on Israel a Palestinian state."

He said the formal statement would reflect that, "Israel rejects outright international dictates regarding a permanent arrangement with the Palestinians. Such an arrangement can only be reached in direct negotiations between the sides, without preconditions."

"Israel will continue to oppose a unilateral recognition of a Palestinian state. Such a recognition, following the massacre of October 7, will give terrorism a huge reward, a reward like no other, and will prevent any future peace agreement," the Israeli prime minister said.

The ongoing war in the Gaza Strip, which raged after Hamas launched unprecedented attacks against Israel on Oct 7, is the latest in the conflicts between Israelis and Palestinians that have reverberated for over seven decades and destabilised the Middle East.

Since 2014, attempts to establish a Palestinian state alongside Israel in the West Bank and Gaza have been stalled.

Last year, 99 journalists were killed, and a majority of them — 77, lost their lives in the Israel-Hamas war. This, as per the Committee to Protect Journalists (CPJ) makes the last 12 months the deadliest for media in almost a decade.

Highest toll

As per the organisation, this is the highest toll since 2015, an approximate 44 per cent increase on the previous year's (2022) figures.

The CPJ, as cited by the news agency AFP, said that if not for the conflict in the Middle East, the killing of reporters would have dropped globally year-on-year.

"In December 2023, CPJ reported that more journalists were killed in the first three months of the Israel-Gaza war than have ever been killed in a single country over an entire year," it said in a statement.

CPJ said that of the 77 journalists killed during the Israel-Hamas war, a vast majority — 72 of them — were Palestinians. Of the remaining five, three were Lebanese and two were Israelis.
