The Delhi High Court on Monday refused to grant interim relief to <a href="https://www.wionews.com/india-news/delhi-court-extends-robert-vadras-anticipatory-bail-till-march-25-ed-says-his-custodial-interrogation-required-204293">accused Robert Vadra</a> and Manoj Arora on their pleas seeking quashing of an FIR registered by the Enforcement Directorate (ED) in a money laundering case.

The court also sought a response from the Centre and then slated the matter for hearing on May 2. Vadra has challenged sections 3 (offence of money laundering), 19 (power to arrest), 24 (burden of proof) and 50 (powers of authorities regarding summons, production of documents and evidence, etc) of the PMLA.

The money laundering cases being probed by the ED relate to purchase of alleged illegal assets abroad and an alleged land scam in Bikaner, Rajasthan. The court had on February 16 extended the interim bail granted to Vadra till March 2. Vadra had filed an anticipatory bail application in the case linked to allegations of money laundering in the purchase of a London-based property at 12, Bryanston Square worth 1.9 million pounds.

The property is allegedly owned by him. Robert Vadra's interim bail was Saturday extended till March 2 in a money laundering case by a Delhi court which asked him to join the probe whenever asked to, after the Enforcement Directorate (ED) alleged that he was not cooperating in the matter.&nbsp;

ED's Special Public Prosecutors D P Singh and Nitesh Rana told the court that it needed to question Vadra in the case and opposed his anticipatory bail plea, saying that he was not cooperating in the case.

The agency also said that Vadra has been summoned for further questioning on Tuesday.

"Vadra is not cooperating and giving evasive replies," Nitesh Rana told the court.

The businessman, represented through senior advocate KTS Tulsi, however, denied the charge and said he was ready to come for questioning as and when called.

Robert Vadra, Congress chief Rahul Gandhi's brother-in-law, on Saturday appeared before the Enforcement Directorate (ED) for the third time in connection with a probe into allegations of money laundering in the purchase of assets abroad.

Vadra arrived at the central probe agency's office at Jamnagar House in central Delhi at about 10.45 am in his private vehicle.

Officials said the investigating officer (IO) of the case required Vadra to answer more questions in connection with the case and hence was asked to depose on Saturday, after his two sessions of questioning on February 6 and 7.

Robert Vadra, Congress chief Rahul Gandhi's brother-in-law, appeared before the Enforcement Directorate for the second day on Thursday in connection with a probe into allegations that he laundered money to purchase illegal foreign assets.

Vadra, who was grilled for five-and-a-half hours for the first time in the case on Wednesday, arrived at the ED office in Jamnagar House in central Delhi at about 11:25 am, about an hour after his team of lawyers.&nbsp;

Officials said Vadra was required to rejoin the probe on Thursday as he needed to answer more questions on allegedly acquiring immovable assets in the United Kingdom.

His statement will be recorded under the Prevention of Money Laundering Act (PMLA) as was done Wednesday, they added.

He was asked about a dozen questions by a team of three ED officials, including the investigating officer of the case.

Delhi court grants interim bail to Robert Vadra in money laundering case

Robert Vadra Friday moved a Delhi court seeking anticipatory bail in a money laundering case lodged by the Enforcement Directorate (ED).

A lawyer from the prosecution team confirmed that Vadra has sought anticipatory bail in the case in which his close aide Manoj Arora was granted interim protection from arrest till February 6 by the court.

The case relates to allegations of money laundering in the purchase of a London-based property -- located at 12, Bryanston Square -- worth 1.9 million pounds, which is allegedly owned by Vadra, the brother-in-law of Congress President Rahul Gandhi.&nbsp;

Vadra's anticipatory bail application is likely to be heard by the court on Saturday.

On January 19, the ED had told the court that Arora was cooperating in the probe.

Arora had earlier alleged before the court that the case was foisted on him by the NDA government out of "political vendetta".

However, the ED had refuted the allegations, asking that "should no authority investigate any political bigwig because that will be called a political vendetta?"

The agency had told the court that it lodged the money laundering case against Arora after his role came up during the probe of another case by the Income Tax Department under the newly-enacted Black Money Act and tax law against absconding arms dealer Sanjay Bhandari.

It had alleged that the London-based property was bought by Bhandari for GBP 1.9 million and sold in 2010 for the same amount despite incurring additional expenses of approximately GBP 65,900 on its renovation.

"This gives credence to the fact that Bhandari was not the actual owner of the property but it was beneficially owned by Vadra who was incurring expenditure on the renovation of this property," the ED had told the court.

Arora, an employee of Vadra's Skylight Hospitality LLP, was a key person in the case and he was aware of the latter's overseas undeclared assets and was instrumental in arranging funds, ED had alleged.

A lawyer from the prosecution team confirmed that Vadra has sought anticipatory bail in the case in which his close aide Manoj Arora was granted interim protection from arrest till February 6 by the court.

It had alleged that the London-based property was bought by Bhandari for GBP 1.9 million and sold in 2010 for the same amount despite incurring additional expenses of approximately GBP 65,900 on its renovation. "This gives credence to the fact that Bhandari was not the actual owner of the property but it was beneficially owned by Vadra who was incurring expenditure on the renovation of this property," the ED had told the court. Arora, an employee of Vadra's Skylight Hospitality LLP, was a key person in the case and he was aware of the latter's overseas undeclared assets and was instrumental in arranging funds, ED had alleged.

It said the probe was carried out under the Black Money Act.

“Vadra was beneficially controlling the property at 12, Bryanston Square, London, UK, which was valued at 1.9 million pound, and not only executing renovation work of this property but also arranging funds for the same,” the agency said in its application.

According to the agency, the property was bought by Sanjay Bhandari for GBP 1.9 million and sold in 2010 for the same amount despite incurring additional expenses of approximately GBP 65,900 on its renovation.

“This gives credence to the fact that Bhandari was not the actual owner of the property but it was beneficially owned by Vadra who was incurring expenditure on the renovation of this property,” it alleged.

The ED said in its submission that Arora has been absconding since the search of his premises by the agency.

“It is apprehended that the accused might have crossed the boundaries of the country. Hence, Red Notice through Interpol is required to be issued for which open-ended NBW is necessary,” the agency argued.

The banking court later adjourned the hearing after extending pre-arrest bail until the Supreme Court issued direction about the case in the light of JIT report.

Prime Minister Imran Khan said Friday that the Pakistani elite was involved in transferring national wealth abroad through money laundering, in a veiled attack on ousted premier Nawaz Sharif.

Sharif, his daughter Maryam Nawaz and his son-in-law retired captain Mohammad Safdar were sentenced to 11 years, eight years and one year respectively in prison in the Avenfield properties case related to their purchase of four luxury flats in London through corrupt practices.

Talking to a delegation of columnists here, Prime Minister Khan, without naming anyone, said the recent development of tracing the money stashed abroad to the tune of Rs 700 billion shows as to why the former rulers were seeking work permits.

"It is estimated that about a trillion dollars are transferred to rich countries from poor countries like Pakistan," Khan said.

The government has signed agreements with Switzerland, the UK and the US to have information about the ill-gotten money stashed in these countries by Pakistanis, he said.

Khan said his government inherited a huge deficit of current and fiscal account and was endeavouring to overcome the financial crisis.

The government decided to approach friendly countries to deal with this situation and overcame the financial crunch and balance of payments issue, Khan said, adding that his visit to China was highly successful.

"We need a permanent solution to strengthen the economy on sound footing," he said.

The government is focusing on four areas including enhancing exports, promoting investment, boosting remittances and curbing the money laundering, Khan said.

Currently, remittances worth $15 to 20 billion are being received through legal channels whereas almost the same amount is being channelised through illegal means including Hawala, he said.

The expatriate Pakistanis were being facilitated to remit money through banking channels to enhance national revenues, Khan said.

Talking about massive losses in state-owned entities, he said unfortunately no one ever made any effort to promote true democracy in the country.

Khan said "kleptocracy was promoted wherein the rulers abused their powers for their own vested interests".

Sharif, 68, was disqualified by the Supreme Court in the Panama Papers case in July, 2017 and subsequently jailed for 10 years in Avenfield corruption case. His sentence was, however, suspended. The three-time former prime minister and his family have denied any wrongdoing.&nbsp;

The Patiala House Court on Saturday will continue hearing the money laundering case filed by the Enforcement Directorate (ED) against Rashtriya Janata Dal (RJD) Chief Lalu Prasad Yadav's daughter Misa Bharti and her husband Shailesh Kumar.

The duo was granted bail on Monday by a special Central Bureau of Investigation (CBI) court in the aforementioned case, on the condition that they cannot leave the country without the Court's permission.

Nearly 10 days ago, the ED had seized a farmhouse belonging to the RJD Chief's daughter.

Misa and Shailesh's involvement is being probed in a money laundering case worth Rs. 8,000 crore, investigation for which began in July last year.

Apart from the ED, the Income Tax (I-T) department has also issued a final attachment order against Bharti and her husband in a benami assets case.

Meanwhile, the Delhi High Court earlier in January granted bail to two accused businessmen, Surendra Jain and Virender Jain in connection with the same case, and asked them to furnish personal bonds of Rs 2 lakh each.

Both businessmen brothers are allegedly involved in the black money racket being run by shell companies linked to Bharti and her husband.
