The Madras High Court today dismissed a petition seeking to revoke the censor certificate issued to Vijay-starrer &#39;Mersal&#39; over certain controversial dialogues relating to GST, holding that people&#39;s right to freedom of expression applies to films also.

The petitioner in his PIL had contended that the movie contained scenes and dialogues, which were against the interests of the country&#39;s sovereignty and integrity and the security of the state.

&quot;This is a democracy and people have their right to freedom of expression, and this applies to films as well,&quot; a division bench comprising Justices MM Sundresh and M Sundar observed dismissing the plea by advocate A Ashvathaman.

&quot;Even today the media has reported that the Leader of Opposition in the state has criticised demonetisation, can the court pass a gag order against him from making such statements,&quot; the bench said.

The petition contended there was apparent false information about GST and Digital India Scheme, which would encourage people to indulge in tax evasion.

Wondering how the Censor Board had issued certification for the above movie, the petitioner had said &quot;the film was full of wrong propaganda about India and fake dialogues and scenes which obviously lead to misconception about the new taxation system (Goods and Service Tax).&quot;

Coming down on the petitioner, the bench said, &quot;if you were really concerned about public and the society you should have started campaigns against various social evils like untouchability and safety of women. But you choose to target a particular movie.&quot;

Noting that the PIL had in fact helped the film get more publicity, the court dismissed the plea as devoid of merit.

The movie released on October 18, Diwali day, had kicked up a row with the BJP&#39;s Tamil Nadu unit taking exception to references on GST and &#39;Digital India&#39;.

The Supreme Court of India on Monday overruled a Madras High Court order staying the lookout notice against Karti Chidambaram, son of former finance minister P Chidambaram, to prevent him from leaving the country.

The lookout circulars were issued by the central government over a corruption case filed by the Central Bureau of Investigation (CBI).

The top court has asked Karti Chidambaram, a businessman and Congress member, to join the CBI investigation in the corruption case against him. The court has directed him to appear before the CBI and has forbidden him from travelling abroad.

The court also asked the Madras High Court to decide on Karti&rsquo;s plea seeking quashing of the FIR against him.

A bench of Chief Justice JS Khehar and Justice DY Chandrachud stayed the August 10 order till the next date of hearing which it fixed for Friday.

The top court order came on a petition by the CBI that the Madras High Court did not have any territorial jurisdiction to entertain the plea and stay the lookout notice.

The CBI told the court that the lookout notice was only to prevent Karti Chidambaram from leaving the country.

The Madras High Court had granted an interim stay on the look out circulars.&nbsp;

In his petition to the high court, Karti said that the circular was part of the central government&#39;s &ldquo;political vendetta&rdquo; which was issued &ldquo;arbitrarily&rdquo;.

The Foreigner Regional Registration Officer and the Bureau of Immigration had issued these circulars against Karti on June 16 and against the four others on July 18

Karti Chidambaram moves Madras High Court against lookout notice against him

The Supreme Court of India tiday&nbsp;asked the Central Board of Secondary Education (CBSE)&nbsp; to declare the results of the National Eligibility-cum-Entrance Test&nbsp;(NEET) examination for admission to MBBS and BDS courses by putting a stay on the Madras High Court order restraining publication of results.

The CBSE has&nbsp;set in motion the process for declaring the result of NEET-2017 after the Supreme Court&#39;s go-ahead.

The apex court order comes as a relief for 12 lakh medical aspirants who had given the exam.

The apex court directed the authorities concerned to proceed with the process of declaration of results, subsequent counselling and admission as per the schedule fixed by it earlier.

However, a vacation bench of Justices P C Pant and Deepak Gupta said the declaration of results as well as the subsequent counselling and admission will be subject to the decision of the apex court in the matter pending before it.

The bench also requested all the high courts not to entertain petitions in the matters relating to the (NEET) examination 2017.

The order came on the plea by the&nbsp;CBSE&nbsp;and others challenging the May 24 order of the Madras High Court which had restrained the Board from publishing the results of NEET examination 2017 in which around 12 lakh aspirants had appeared.

Additional solicitor general (ASG) Maninder Singh, appearing for the CBSE, told the bench that due to high court&#39;s order the process of declaration of results and subsequent admission have stalled and the order was in conflict with the schedule fixed by the apex court earlier.

The bench also observed that the high court&#39;s order was &quot;indirectly diluting the schedule&quot; fixed by the apex court.

&quot;On one ground we are inclined to stay the high court&#39;s order. What indirectly this order is doing is that it is diluting the schedule fixed by the Supreme Court,&quot; the bench said while staying the high court&#39;s order.

&quot;In view of the above, the interim order is stayed and it is directed that the authorities concerned will proceed further with declaration of results for the NEET 2017 examination subject to decision of this court,&quot; the bench said while listing the matter for further proceedings after summer vacation.

In a significant order, the Madras High Court today directed the Tamil Nadu government to waive loans of all drought-hit farmers and restrained cooperative societies and banks from recovering their dues.

In this difficult situation, the central government cannot be a silent spectator and should come forward to extend help to the state government to share the burden, the court said.

It directed the cooperation, food and consumer protection department and registrar of cooperative societies to extend the crop loan waiver scheme under two Government Orders of 2016, to all farmers, including those whose landholding was more than five acres.

&quot;We further direct the department to issue necessary consequential order extending the impugned scheme to all farmers. The order shall be issued within three months from today,&quot; the bench said.

The Association alleged that government has shown discrimination in classifying farmers as small and medium and sought a direction to quash the GOs as illegal and to direct authorities to give relief to all farmers for loans taken from cooperative societies, irrespective of the&nbsp;extent of land owned.

The court, which had heard the petition in Madurai Bench, delivered its judgement today at the principal seat here.

&quot;In view of the foregoing discussions and conclusions arrived therein, we are of the view that the denial of benefit of crop loan to the farmers who had cultivated lands exceeding five acres is a clear discrimination, violative of Article 14 of the Constitution.

&quot;Consequently, we restrain the respondents from initiating action against the farmers for recovery of crop loans and outstanding dues to cooperative societies/banks, as on March 31, 2016,&quot; it said.&nbsp;

More than three weeks after the demise of former AIADMK supremo J Jayalalithaa, the Madras High Court on Thursday raised questions over the death of the former Tamil Nadu Chief Minister and asked why her body can&#39;t be exhumed.

Petitioner PA Joseph, a city resident, listed the sequence of events since Jayalalithaa&rsquo;s admission to Apollo Hospital here on September 22 and claimed that the &ldquo;secrecy&rdquo; preceding her death gave rise to &ldquo;grave doubts&rdquo; in the minds of the people.

The public interest litigation, which listed 12 respondents, including the Apollo Hospitals chairman, is likely to be taken up for hearing by the vacation bench of the court on December 29.

The petitioner pleaded that the commission must peruse all the records, reports and documents that are in possession of the government as well as the hospital and look into &ldquo;several questionable incidents&rdquo;, including her sudden hospitalisation, reported recovery and the subsequent cardiac arrest resulting in her death on December 5.

The court, however, allowed the Rashtriya Swayamsevak Sangh (RSS) to carry out &quot;route marches&quot;&nbsp;at 14 areas in the state, from November onwards, the Press Trust of India reported.&nbsp;

According to the court&#39;s verdict,&nbsp;RSS cadres cannot raise slogans which may hurt the&nbsp;sentiments of others or&nbsp;carry out unlawful activities. The court has told the police they can impose other laws as required.&nbsp;

The cadres must maintain &quot;dress code&quot;&nbsp;(full pant) during processions, according to the court&#39;s verdict. Presently, RSS cadres&#39;&nbsp;uniform includes Khaki shorts and white shirt.&nbsp;

The RSS had appealed to the Court to conduct &quot;route marches&quot;&nbsp;October 9 to mark the 1000th birth anniversary of philosopher Ramanuja, after police had denied permission.&nbsp;

The police had refused permission because civic polls will be held on October 17 and 19 and a Hindu Munnani leader had been murdered in Coimbatore on September 22, so the situation was tense.&nbsp;

&quot;The law enforcement machinery is completely overstretched to contain the volatile communal unrest in addition to maintaining public order in view of local body elections,&quot; the counter affidavit by the police said.&nbsp;
