Opposition parties led by the Congress will meet today to give final shape to the proposed impeachment motion against Chief Justice of India Dipak Misra and are likely to submit it to Vice President M Venkaiah Naidu.

According to sources, opposition parties including the Congress, the NCP, the Left parties, the Samajwadi Party (SP), the Bahujan Samaj Party (BSP) and some others will meet in Parliament to give final shape to the proposed impeachment motion.

Thereafter, the opposition parties will meet the Chairman of Rajya Sabha and are likely to submit the same today itself, the sources said.

A time has already been sought from the Chairman, they said.

“We will meet today to give final shape to the impeachment motion to be moved against the Chief Justice of India,” an opposition leader said.

Sources said the Trinamool Congress and the DMK, which were initially in favour of the impeachment against the CJI, are no longer part of it.

The impeachment notice comes a day after the Supreme Court rejected a bunch of petitions seeking an independent probe into the death of Judge B H Loya, who was hearing the Sohrabuddin Sheikh encounter case.

The SC judgement was delivered by a bench headed by the Chief Justice of India.

An impeachment motion in the Rajya Sabha has to be supported by a total of at least 50 MPs of the Upper House, while the number of MPs supporting such a motion in the Lok Sabha is 100.

Once the notice of an impeachment motion is submitted to the Rajya Sabha chairman, he will ascertain whether there is merit or ground for moving such a motion.

In case he finds merit, then he may form a committee to look into it, else he can reject it.

If moved, this will be the first time ever in the country's history that an impeachment would be moved against the Chief Justice of India.

Chief Justice has not asserted the independence of the judiciary: Kapil Sibal

Kapil Sibal said that the Opposition parties did not have any option apart from filing an impeachment notice. He said that the Chief Justice had not asserted the independence of the judiciary.

"We only wish to state that anyone occupying the office of Chief Justice of India must be judged on the basis of highest standards of integrity. The first charge relates to the conspiracy to pay illegal gratifications," Sibal said.

Ghulam Nabi Azad, in a press conference, said that Opposition parties had moved impeachment motion under five grounds of misbehaviour.

SC terms public statements on the impeachment of judges 'unfortunate'

The Supreme Court termed as very unfortunate the public statements, including those made by lawmakers, on the impeachment of judges.

"We are all very disturbed about it," a bench comprising Justices AK Sikri and Ashok Bhushan said after the counsel appearing for the petitioner raised the issue of politicians making public statements on the impeachment of judges.

The apex court asked Attorney General KK Venugopal to assist it to deal with the plea, which has also sought a gag on the media from reporting such statements.

Opposition parties meet vice president, give notice for impeachment of CJI Dipak Misra

The Supreme Court is likely to pronounce its verdict on Thursday on a batch of pleas seeking an independent probe into the alleged mysterious death of special CBI judge BH Loya, who was hearing the high-profile Sohrabuddin Sheikh fake encounter case.

Loya had allegedly died of cardiac arrest in Nagpur on December 1, 2014 when he had gone to attend the wedding of a colleague's daughter.

A bench comprising Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud had on March 16 reserved the judgment on the pleas.

The Maharashtra government had argued in the apex court that all pleas seeking an independent probe into Loya's death were motivated and aimed at targeting "one individual" in the guise of upholding the rule of law.

It had come down heavily on alleged accusations, bullying and browbeating of judges in the top court by some activist lawyers in the Loya case and said that the judiciary and judicial officers need to be saved from such averments.

Meanwhile, those seeking an independent probe into the matter had referred to the sequence of events to highlight that a fair investigation was needed to rule out any foul play in the death.

The issue of Loya's death had come under spotlight in November last year after media reports quoting his sister had fuelled suspicion about the circumstances surrounding it and its link to the Sohrabuddin case. But Loya's son had on January 14 said in Mumbai that his father had died of natural causes.&nbsp

In the Sohrabuddin Sheikh fake encounter case, BJP president Amit Shah along with Rajasthan home minister Gulabchand Kataria, Rajasthan-based businessman Vimal Patni, former Gujarat police chief P C Pande, additional director general of police Geeta Johri and Gujarat police officers Abhay Chudasama and N K Amin have already been discharged.

Several accused, including police personnel, are currently facing trial for their involvement in the alleged fake encounter of Sohrabuddin Shaikh, his wife Kausar Bi and their associate Tulsiram Prajapati in Gujarat in November 2005. The case was later transferred to CBI and the trial shifted to Mumbai.

The Sohrabbudin case refers to the killing of Sohrabbudin Sheikh by a Gujarat Police team on November 26, 2005. Gujarat Police claimed at the time that Sheikh was a &quot;dreaded terrorist&quot; on a mission to kill a high-ranking Gujarat politician, presumably Narendra Modi.&nbsp;

The claim was challenged in court by Sohrabbudin&#39;s brother, who alleged the encounter had been fake.&nbsp;

BJP President Amit Shah, who was Gujarat home minister at the time, was named in the FIR. Shah however was later discharged from the case by the Gujarat court.

'Sohrabuddin case claims yet another judge,' says Rahul Gandhi

The Supreme Court will today hear pleas filed by three petitioners seeking probe by a Special Investigation Tribunal (SIT) into the alleged mysterious death of CBI judge Justice BH Loya in 2014.

A three-judge bench, headed by Chief Justice of India (CJI) Dipak Misra, will hear the petitions.

The assignment of the case was also one of&nbsp;the causes of the recent rift between the Chief Justice of India and four senior&nbsp;judges of the Supreme Court who wanted it to be heard by a senior judge.

The two other judges who will hear the case today are Justice DY Chandrachud and Justice AM Khanwilkar.

It was previously being heard by Justice Arun Mishra, a relatively junior judge in the top court, and Justice MM Shantanagoudar.&nbsp;

Earlier this month, the top court had asked the <a href="http://www.wionews.com/india-news/hand-over-all-documents-connected-to-justice-loyas-death-supreme-court-to-maharashtra-government-29678">Maharashtra government to submit the postmortem report </a>of the CBI judge, who had died in alleged suspicious circumstances, stating that the &quot;matter was very serious.&quot;

The report was handed over to the Supreme Court in a sealed envelope on January 16.

The report into Justice BH Loya&#39;s death says there was no foul play in the judge&#39;s death, sources in the Maharashtra home ministry have told the Zee Group.&nbsp;

The Supreme Court will today hear pleas filed by three petitioners seeking probe by a Special Investigation Tribunal (SIT) into the alleged mysterious death of CBI judge Justice BH Loya in 2014. A three-judge bench, headed by Chief Justice of India (CJI) Dipak Misra, will hear the petitions. The assignment of the case was also one of the causes of the recent rift between the Chief Justice of India and four senior judges of the Supreme Court who wanted it to be heard by a senior judge. The two other judges who will hear the case today are Justice DY Chandrachud and Justice AM Khanwilkar. It was previously being heard by Justice Arun Mishra, a relatively junior judge in the top court, and Justice MM Shantanagoudar. Earlier this month, the top court had asked the Maharashtra government to submit the postmortem report of the CBI judge, who had died in alleged suspicious circumstances, stating that the "matter was very serious." The report was handed over to the Supreme Court in a sealed envelope on January 16. The report into Justice BH Loya's death says there was no foul play in the judge's death, sources in the Maharashtra home ministry have told the Zee Group. Judge Loya had died of cardiac arrest in Nagpur on December 1, 2014, when he had gone to attend the wedding of a colleague's daughter. At that time was hearing the Sohrabuddin Sheikh fake encounter case, in which Bharatiya Janata Party (BJP) president Amit Shah is an accused. The judge who replaced judge Loya, had ruled that there was no evidence against the BJP chief to be put on trial. Foul play in the judge's death, after speaking to his family, was first alleged by a magazine. Loya's family has since said that they no longer believe foul play was involved in his death. Anuj Loya, the son of special CBI judge, said on January 14 that the family has no complaints against anyone. "Have no suspicion over father's death. Had suspicion earlier but now it is over," Anuj said at a press conference in Mumbai Maharashtra-based journalist Lone and activist Tehseen Poonavala had filed independent pleas seeking a fair probe into the death of Justice Loya, media reports said.
