Be it India's UPI for payments or China's EVs, the countries and companies have been able to defeat the incumbent only by focusing on the next-gen products and offering solutions that are 10X better than the existing products.
Coming up with next-generation products also needs to bring some of our diaspora back, which is doing cutting-edge R&amp;D in American universities and firms. These researchers won't come to the current CSIR setup for obvious reasons (some left this setup to go to the US). The Rs 1 lakh crore fund, announced during the interim budget, can be used to do pre-commercial research at universities (Institute of Brain Sciences at IISc model), academic institutions and firms (corporate labs like Bell Labs, Xerox PARC) and startups.
In the last few years, we have succeeded in building the first generation of IP-driven product companies in some sectors. In telecom equipment, there is Tejas Networks, in vaccine development, we have Bharat Biotech, in making trains, we have also made some progress with Vande Bharat, which was developed at the Integrated Coach Factory in Chennai shows that the private and public sectors can both develop IP-driven products that will be globally competitive. The mindset of the government as well as the private sector needs to change for this. 
Services companies can be built without significant government involvement, it is extremely difficult to build a product company without the support from the government on the day. The product companies need a large sum of money for pre-commercial investment before the product hits the market. Moreover, these companies also need market access, preferably from the government at an early stage, in order to iterate and improve the product. 
In most of the products, the government acts as a safe buyer. The government will buy only if the product has been used by the private sector before and the trials will be on No-Cost-No-Commitment (NCNC) basis. These steps have been taken to prevent corruption and cronyism in public procurement. For the product companies to succeed, the government needs to act as a first buyer to mitigate risk and spur innovation. 
Moreover, the government needs to fund pre-commercial research at corporations and startups instead of doing it as autonomous labs where the researchers are employed full time without any accountability on outcome. Throughout the world, the product companies, from America’s defense industrial complex to China's new energy domination, were built by public funding for private innovation. 
India also needs to bank on public funding for private innovation and government buying to build its IP-driven product companies. The public funding should be designed in a way that it could spur private investment in R&amp;D, which has been abysmally low at 0.3% of GDP.  What propelled India to become 5th and soon to be 3rd largest economy in the world from 17th in 1991 will not enable it to compete with the United States and China. We need a new way of thinking on political economy that could change the structure of the economy from shallow services and manufacturing to an IP-driven economy. It will enable the country to overcome the middle-income trap and set the path to overtake the United States and China in the coming decades.

The European Commission called on Friday on the United States and other major COVID-19 vaccine producers to export what they make as the European Union does, rather than talk about waiving intellectual property rights to the shots.&nbsp;

Commission head Ursula von der Leyen told a news conference on the sidelines of a summit of EU leaders that discussions on the waiver would not produce a single dose of COVID-19 vaccine in the short- to medium-term.&nbsp;

"We should be open to lead this discussion. But when we lead this discussion, there needs to be a 360-degree view on it because we need vaccines now for the whole world," she said.&nbsp;

"The European Union is the only continental or democratic region of this world that is exporting at large scale," von der Leyen said.&nbsp;

She said about 50% of European-produced coronavirus vaccine is exported to almost 90 countries, including those in the World Health Organization-backed COVAX programme.&nbsp;

"And we invite all those, who engage in the debate of a waiver for IP rights also to join us to commit to be willing to export a large share of what is being produced in that region," she said.&nbsp;

Only higher production, removing exports barriers and the sharing of already-ordered vaccines could immediately help fight the pandemic quickly, she said.&nbsp;

"So, what is necessary in the short term and the medium term: First of all, vaccine sharing. Secondly export of vaccines that are being produced. And the third is investment in the increasing of the capacity to manufacture vaccines."&nbsp;

Von der Leyen said the European Union had started its vaccine sharing mechanism, citing delivery of 615,000 doses to the Western Balkans as an example.&nbsp;

Currently, the United States is facing pressure from across the globe to support the temporary patent waiver which would essentially help many countries that are currently struggling with surge in cases.

India and South Africa are leading the proposal to waive the IP rights of pharmaceutical companies, which would allow developing countries to produce COVID-19 vaccines.

US reportedly considering intellectual property waiver for coronavirus vaccines

The US on Thursday placed India on its<a href="https://www.wionews.com/world/amid-trade-war-chinas-exports-fall-to-three-year-low-imports-slip-for-third-straight-month-201889"> 'Priority Watch List', alleging</a> lack of "sufficient measurable improvements" to its Intellectual Property (IP) framework on long-standing and new challenges that have negatively affected American right holders over the past year.

"Over the past year, India took steps to address intellectual property challenges and promote IP protection and enforcement. However, many of the actions have not yet translated into concrete benefits for innovators and creators, and long-standing deficiencies persist. India remains one of the world's most challenging major economies with respect to protection and enforcement of IP," an official US report said.

The US Trade Representatives (USTR) in its report identified 11 countries, including India, in its 'Priority Watch List'.&nbsp;

China, Indonesia, Russia, Saudi Arabia and Venezuela are among others. It has also placed 25 countries, including Pakistan, Turkey and the UAE, on the Watch List.

In February, Republican Senator Richard Burr, chairman of the Senate Intelligence Committee had said he worried about the spread in the United States of what he called "counterintelligence and information security risks that come prepackaged with the goods and services of certain overseas vendors."

President Donald Trump has repeatedly thrashed Beijing for what he said was the rampant theft of US know-how, through forced technology transfer and other means, and made that a central feature of ongoing trade talks.

Trade officials are due to resume talks in Beijing on April 30 and then return to Washington for another round on May 8th.

China remains at the top of the USTR "priority watch list" for the worst violators of US trade secrets and an online market run by Alibaba also features on the "notorious markets" list.

Canada was removed from the worst-offenders list after the signing of a new regional free trade agreement, which includes new provisions to protect intellectual property.&nbsp;

The report said "these commitments will substantially improve the IP environment in Canada."&nbsp;

Colombia likewise was removed from the list after signing a free trade deal with Washington, but Saudi Arabia was added "for failing to address longstanding IP concerns and further deteriorating IP protection and enforcement within its borders," especially with regards to medicines, the report said.

US places India, China among others on 'Priority Watch List' for IP rights violations

US Trade Representative(USTR) has kept India on its "Priority Watch List"&nbsp;for inadequately protecting US intellectual property rights(IPR).

The list includes 36 other countries including China, Russia, Argentina, Canada, Ukraine, Indonesia,&nbsp;Saudia Arabia, UAE, Colombia&nbsp;and Kuwait.

The Intellectual Property (IP) issues in these countries will be the subject of intense bilateral engagement during the coming year, the USTR said in its report.&nbsp;

Although India has been kept on the list, but the USTA noted that the government has taken several steps to improve its "IP environment".&nbsp;

"While these and other Modi administration initiatives have acknowledged the important role innovation and creativity play in India's development, they have failed to draw a direct link to specific IP reforms that would best help achieve these goals," the USTR said.

"India's overall levels of IP enforcement remain deficient, and the lack of uniform progress across the country threatens to undercut the positive steps that certain states have taken," the report said.

The report was especially hard on China which is on the list for the 14th consecutive year.

The "Special 301 Report on Intellectual Property Rights" said China indulged in "coercive technology transfer practices" and "trade secret theft, rampant online piracy, and counterfeit manufacturing."

As far as India was concerned, USTA said, "Although India has made some administrative improvements and others are in progress, overall levels of trademark counterfeiting remain high, and US brand owners continue to report significant challenges and excessive delays in obtaining trademarks and efficiently utilizing opposition and cancellation proceedings, as well as quality of examination issues."

The report urged India to join important international treaties and agreements that could improve aspects of India's IP regime.&nbsp;

In particular, India has yet to take steps to address longstanding patent issues that affect innovative industries, the report noted.

Companies across different sectors remain concerned about narrow patentability standards, the potential threat of compulsory licensing and patent revocations, as well as overly broad criteria for issuing such licenses and revocations under the India Patents Act, it said.
