<p>In a significant ruling, the Supreme Court of India has laid down the essentials for a Hindu marriage to be legal under the Hindu Marriage Act of 1955.&nbsp;</p>

<p>As per a ruling made by the top court on April 19 (Friday), a Hindu marriage must be performed with traditional rites and ceremonies, such as 'saptapadi' (seven steps around the sacred fire commonly known as 'saath phera') for it to be valid.</p>

<p>"Where a Hindu marriage is not performed in accordance with the applicable rites or ceremonies such as saptapadi when included, the marriage will not be construed as a Hindu marriage," the court said.&nbsp;</p>

<h2><strong>Evidence of marriage</strong></h2>

<p>The bench said that evidence of these rituals is essential in case of any disputes.</p>

<p>"For a valid marriage under the Act, the requisite ceremonies have to be performed and there must be proof of performance of the said ceremony when an issue/controversy arise. Unless the parties have undergone such ceremony, there would be no Hindu marriage according to Section 7 of the Act and a mere issuance of a certificate by an entity in the absence of the requisite ceremonies having been performed, would neither confirm any marital status to the parties nor establish a marriage under Hindu law."</p>

<p>A bench of justices B.V. Nagarathna and Augustine George Masih also observed that registration of a Hindu marriage under Section 8 of the Hindu Marriage Act facilitates proof of the marriage.</p>

<p>However, they said it does not confer legitimacy if the marriage was not solemnised according to Section 7 of the Act, which specifies the requirements for a valid Hindu marriage ceremony.</p>

<p>"A certificate of marriage is a proof of validity of Hindu marriage only when such a marriage has taken place and not in a case where there is no marriage ceremony performed at all," said the court.</p>

<h2><strong>Hindu Marriage is sacred, not an event for 'song-dance, wining-dining'</strong></h2>

<p>These observations were made as India's highest court decided on a petition filed by a wife seeking transfer of divorce proceedings against her.</p>

<p>While the case was ongoing, the couple came to a mutual understanding, filing a joint application seeking a declaration that their marriage was invalid.</p>

<p>They contended that no marriage ceremony took place, as they did not observe any customs, rites, or rituals.</p>

<p>They also said that, due to "certain exigencies and pressures", they had to obtain a certificate of solemnisation from Vadik Jankalyan Samiti (Regd.).</p>

<p>Based on this, they had then sought registration under the Uttar Pradesh Registration Rule, 2017 and a "Certificate of Marriage" was issued by the Registrar of Marriages.</p>

<p>The top court, after noting that the marriage was not solemnised, declared that there was no valid marriage.</p>

<p>"A Hindu marriage is a samskara [culture] and a sacrament which has to be accorded its status as an institution of great value in Indian society. Therefore, we urge young men and women to think deeply about the institution of marriage even before they enter upon it and as to how sacred the said institution is, in Indian society."</p>

<p>"A marriage is not an event for 'song and dance' and 'wining and dining' or an occasion to demand and exchange dowry and gifts by undue pressure leading to possible initiation of criminal proceedings thereafter," said the court.</p>

<p>In a conversation with <em>WION</em>, Neha Sonawane lawyer, founder - Vaakya&nbsp;Legal said, "Practice of Hinduism is not uniform and the customs differ as per caste culture, etc. On the one hand, we want uniformity in marriage laws for the protection of women and, on the other hand, reducing the importance of registration is counterproductive."</p>

<p>Sonawane argued that marriage registration "is the only step in Hindu law which could be said to be a commonality across castes, cultures etc. Registration of marriages not only serves as a better proof of marriage but also helps in controlling child marriage, and polygamy — marriages where the person married a second time without divorcing their first partner. It's essentially a constructive notice&nbsp;to&nbsp;the&nbsp;world."</p>

Recently, Sweety, a 30-year-old woman, wife of a businessman from Karnataka, and her&nbsp;11-year-old son Hridhan, embraced monkhood. After their Diksha ceremony, they were given new names: the mother was named Bhavshudhi Rekha Shri Ji, and the son was named Hitashay Ratanavijay Ji. For those unfamiliar, Diksha is a solemn ceremony where a person commits to living an ascetic or spiritually disciplined life.</p>

<p>As per Viveka, a relative of the family who spoke to HT, Bhavshudhi Rekha Shri Ji chose to embark on the path of monkhood while she was pregnant with her son. Concurrently, she also determined that her child would follow in her footsteps and become a Jain monk. Consequently, her son was brought up with the knowledge that he would eventually embrace the monastic lifestyle.</p>

Bomb scare in Delhi schools: More than 100 schools receive bomb threat via email

<p>Manipur police said that a big group of women-leading protesters&nbsp;confronted the Indian Army and forcefully released 11 miscreants after they were detained with arms and ammunition in the northeastern state's&nbsp;Bishnupur district on Tuesday (April 30).&nbsp;</p>

<p>The&nbsp;police said that a unit of the Mahar Regiment of the Indian Army halted and arrested&nbsp;the armed troublemakers wearing police uniforms.</p>

<p>According to PTI news agency, quoting unidentified officials, the army was conducting patrols in the Kumbi region when they intercepted two SUVs.</p>

<p>“On seeing the Army personnel, the occupants of the two vehicles fled, leaving behind their arms,” PTI quoted an official as saying.</p>

<p>The Manipur Police reported that soldiers from the Mahar Regiment confiscated three AK rifles (along with seven magazines and 210 rounds of ammunition), five INSAS rifles (with 13 magazines and 260 rounds of ammunition), two SLR rifles (including 9 magazines and 180 rounds of ammunition), two hand grenades, bulletproof jackets, and various other items from the possession of the troublemakers.</p>

<p>The police took them into custody. And then protesters ambushed them.</p>

<p>“Displaying dogged determination and intent, teams of both Manipur Police and the Indian Army were successful in breaking through a number of obstacles/ barriers created by hostile sympathisers and reach out to the the teams at Kumbi PS. The recovered weapons and ammunitions were kept in safe custody. The mob was later dispersed and the situation was brought under control. Necessary legal action is being taken up,” it added.</p>

<p>Meanwhile, several videos have appeared on social media showing hundreds of women blocking the road, preventing the Army convoy from departing the area. Allegedly, the Army is seen firing into the air to disperse the crowd.</p>

<p>WION reached out to experts to know more about fainting episodes in high temperatures. <strong>Dr Bikky Chaurasia, Consultant, Internal Medicine at Kokilaben Dhirubhai Ambani Hospital Mumbai</strong>, said, "Fainting episodes in high temperatures can occur due to heat exhaustion or heat stroke. When the body overheats, blood vessels dilate to cool off, causing a drop in blood pressure, which can lead to fainting."&nbsp;</p>

<p>During the summertime, especially those who are going out for work must stay hydrated, and cool, and seek shade or air conditioning in hot weather to prevent fainting.&nbsp;</p>

<p><strong>Dr VV Vivekanand,&nbsp;Consultant Paediatric Pulmonologist, Bronchoscopist and Sleep Medicine specialist at Rainbow Children's Hospitals, Chennai </strong>also weighed in on the same as he told WION that fainting episodes in high temperatures are signs of a heat-related health problem, which is called heat exhaustion. It can also lead to heat stroke. This happens when your body struggles to control its temperature.&nbsp;</p>

<p>"When it's hot, your blood vessels widen to send more blood to the skin for cooling. This can lead to a temporary drop in blood pressure and blood flow to the brain, causing dizziness and fainting. Dehydration resulting from low water consumption can make one more susceptible to this issue," Dr Vivekanand added.&nbsp;</p>

<p><strong>Dr Haresh Mehta, Consultant, Interventional Cardiology at PD Hinduja Hospital and MRC, Khar</strong>, told WION that fainting episodes usually occur during the initial days of heat exposure, in unacclimatised and elderly individuals. It occurs as an inadequate blood flow to the brain, preceded by peripheral vessel dilation and dehydration, which limits total blood volume, causing the loss of consciousness.&nbsp;</p>

<p>This is commonly triggered by standing for long periods of time without movement or suddenly rising from a sitting or lying position, being orthostatic in nature. Heat syncope causes individuals to experience dizziness (vertigo) or light-headedness, weakness, tunnel vision, pale or sweaty skin, decreased or weak pulse and loss of consciousness.&nbsp;</p>

<p><strong>1) Dehydration:</strong> In hot weather, people may sweat more, leading to dehydration. When the body loses too much water and electrolytes, it can cause a drop in blood pressure, leading to fainting.&nbsp;</p>

<p><strong>2) Exhaustion:</strong> Prolonged exposure to high temperatures without proper hydration and cooling off can lead to heat exhaustion. Symptoms include dizziness, weakness, nausea, and fainting.&nbsp;</p>

<p><strong>3) Heat Stroke:</strong> This is a more severe form of heat-related illness where the body's temperature regulation system fails. Heat stroke can cause fainting, along with other symptoms like confusion, rapid pulse, and hot, dry skin.&nbsp;</p>

<p><strong>4) Vasovagal Syncope:</strong> Some people are prone to fainting in response to triggers such as heat, dehydration, standing for long periods or overreaction&nbsp;to certain triggers like&nbsp;the sight of blood or extreme emotional distress.&nbsp;This type of fainting, called vasovagal syncope, occurs due to a sudden drop in heart rate and blood pressure.<br />

<h2><strong>'Prevention remains prudent'&nbsp;</strong></h2>

<p>Meanwhile, Dr Mehta said, "Prevention remains prudent. Maintaining hydration and avoiding the outdoors or physical activity in high temperatures are first-line steps to prevention. Avoidance of alcohol and other causes of dehydration is vital as well."&nbsp;</p>

<p>Dr Mehta advised that if one experiences heat syncope, she/he must be moved to a shaded/cool area, sit/lay over the back with the legs raised, plenty of fluids with electrolytes given slowly over a period of time. It must be followed by rest and further avoidance of high temperatures.&nbsp;</p>

<p>While mentioning immediate actions that should be taken if someone faints, Dr Chaurasia said, "If someone faints, it's important to lay them down, elevate their legs, and cool them off while seeking medical help if necessary."&nbsp;</p>

<p>Dr Vivekanand suggested if fainting occurs or is accompanied by other concerning symptoms like high fever, confusion, or seizures, one must seek medical attention immediately.&nbsp;</p>

Heatwave in India WION reached out to experts to know more about fainting episodes in high temperatures. Dr Bikky Chaurasia, Consultant, Internal Medicine at Kokilaben Dhirubhai Ambani Hospital Mumbai, said, "Fainting episodes in high temperatures can occur due to heat exhaustion or heat stroke. When the body overheats, blood vessels dilate to cool off, causing a drop in blood pressure, which can lead to fainting." During the summertime, especially those who are going out for work must stay hydrated, and cool, and seek shade or air conditioning in hot weather to prevent fainting. Dr VV Vivekanand, Consultant Paediatric Pulmonologist, Bronchoscopist and Sleep Medicine specialist at Rainbow Children's Hospitals, Chennai also weighed in on the same as he told WION that fainting episodes in high temperatures are signs of a heat-related health problem, which is called heat exhaustion. It can also lead to heat stroke. This happens when your body struggles to control its temperature. "When it's hot, your blood vessels widen to send more blood to the skin for cooling. This can lead to a temporary drop in blood pressure and blood flow to the brain, causing dizziness and fainting. Dehydration resulting from low water consumption can make one more susceptible to this issue," Dr Vivekanand added. Dr Haresh Mehta, Consultant, Interventional Cardiology at PD Hinduja Hospital and MRC, Khar, told WION that fainting episodes usually occur during the initial days of heat exposure, in unacclimatised and elderly individuals. It occurs as an inadequate blood flow to the brain, preceded by peripheral vessel dilation and dehydration, which limits total blood volume, causing the loss of consciousness. This is commonly triggered by standing for long periods of time without movement or suddenly rising from a sitting or lying position, being orthostatic in nature. Heat syncope causes individuals to experience dizziness (vertigo) or light-headedness, weakness, tunnel vision, pale or sweaty skin, decreased or weak pulse and loss of consciousness. When the body loses too much water and electrolytes, it can cause a drop in blood pressure, leading to fainting. 2) Exhaustion: Prolonged exposure to high temperatures without proper hydration and cooling off can lead to heat exhaustion. Symptoms include dizziness, weakness, nausea, and fainting. 3) Heat Stroke: This is a more severe form of heat-related illness where the body's temperature regulation system fails. Heat stroke can cause fainting, along with other symptoms like confusion, rapid pulse, and hot, dry skin. 4) Vasovagal Syncope: Some people are prone to fainting in response to triggers such as heat, dehydration, standing for long periods or overreaction to certain triggers like the sight of blood or extreme emotional distress. This type of fainting, called vasovagal syncope, occurs due to a sudden drop in heart rate and blood pressure. If a patients displays any of the above symptoms kindly meet a nearby physician immediately. 'Prevention remains prudent' Meanwhile, Dr Mehta said, "Prevention remains prudent. Maintaining hydration and avoiding the outdoors or physical activity in high temperatures are first-line steps to prevention. Avoidance of alcohol and other causes of dehydration is vital as well." Dr Mehta advised that if one experiences heat syncope, she/he must be moved to a shaded/cool area, sit/lay over the back with the legs raised, plenty of fluids with electrolytes given slowly over a period of time. It must be followed by rest and further avoidance of high temperatures. While mentioning immediate actions that should be taken if someone faints, Dr Chaurasia said, "If someone faints, it's important to lay them down, elevate their legs, and cool them off while seeking medical help if necessary." Dr Vivekanand suggested if fainting occurs or is accompanied by other concerning symptoms like high fever, confusion, or seizures, one must seek medical attention immediately.
