Reports stated that a new box of ammunition had arrived from an uncertain source earlier that morning.&nbsp; 
 
Baldwin was reportedly handed the gun by assistant director Halls who took it from the prop cart and handed it to the actor. The scene involved Baldwin's character removing a gun from its holster and pointing it toward the camera. Halls reportedly had mentioned to Baldwin that it was a cold gun. When Baldwin removed the gun from the holster, B-camera operator Reid Russel, director Joel Souza and Hutchins were huddled behind the monitor position about two feet away from where the shot was filed.&nbsp; 
 
The projectile flew towards the three behind the monitor, striking Hutchins in the chest and Souza in the shoulder. Hutchins was flown by helicopter to the University of New Mexico Hospital in Albuquerque, where she was pronounced dead. Souza was treated by EMS and transported by ambulance to Christus St. Vincent Regional Medical Center in Santa Fe, where he was admitted and released by the following morning.

On January 23, 2022, Baldwin and other producers filed a memorandum that asked a California judge to dismiss the November 17, 2021 lawsuit by Mitchell. 
 
In January 2022, Gutierrez-Reed filed a lawsuit against armourer Seth Kennedy and his company PDQ Arm and prop for providing live rounds on set. Lawsuits were also filed against the crew for negligence on set. On February 15, Hutchins's family filed a wrongful death suit against Baldwin, Halls, , Gutierrez-Reed, prop master Sarah Zachry, and others as defendants and sought unspecified damages.&nbsp;

Filming of 'Rust' to resume&nbsp; 
 
It was announced in late 2022 that the filming of 'Rust' was to resume in January with Matthew Hutchins as an executive producer. "The production of 'Rust' will not return to New Mexico," Melina Spadone, attorney for the film told news channels. "The production is considering other locations, including in California, but no decisions have been made." 
 
It isn't yet clear if Baldwin would rejoin the production although it is being claimed that the original principal players would resume their work on the project.&nbsp;

Baldwin said&nbsp;that for the last ten months, he has been repeatedly thinking about the&nbsp;events leading up to the tragedy. While&nbsp;saying&nbsp;that he does not wish to "condemn" Hannah Gutierrez-Reed the film set's armourer and props assistant, Baldwin blamed her and the assistant director Dave Halls, who gave him the gun just before the incident.

"Someone put a live bullet in the gun who should have known better," he said, adding "That was (Gutierrez-Reed's) job. Her job was to look at the ammunition and put in the dummy round or the blank round, and there wasn't supposed to be any live rounds on the set."

"There are two people who didn't do what they were supposed to do."

As per AFP, the actor said that he does not "want them to, you know, go to prison," or "want their lives to be hell" but he wants everyone to know that they are responsible for the accident.

Following the interview, attorneys for Gutierrez-Reed and Halls said that the actor was attempting to shift responsibility away from himself.

Baldwin also addressed former US President Donald Trump's assertion that he might have killed Hutchins on purpose during the CNN interview.

Hutchins was killed in October when a revolver that actor Alec Baldwin was rehearsing with during filming in New Mexico fired a live round that hit her and movie director Joel Souza. Souza was wounded but survived.

"We`re confident we`ll be able to complete the movie," Anjul Nigam, one of the producers, was quoted as saying by Hollywood Reporter.

A representative of Nigam did not immediately respond to a request for comment.

"For a criminal case, you`re going to need some sort of actual intent, or criminal negligence, gross negligence. That`s ... something more than pointing the gun," said former federal prosecutor Neama Rahmani in Los Angeles. 
 
The criminal investigation will likely focus instead on how the gun came to be loaded. "I think having live ballistic rounds on a movie set is inexcusable and rises to the level of gross negligence that you see in a criminal charge," said lawyer Jeff Harris of Harris Lowry Manton. 
 
WHAT COULD THE GROUNDS FOR LAWSUITS BE? 
 
Hutchins'&nbsp;family and Souza could file civil lawsuits for financial damages, legal experts said. 
 
These lawsuits would most likely argue negligence, legally defined as a failure to exercise a reasonable level of care. 
 
Such claims got a boost from the revelation by Santa Fe County Sheriff Adan Mendoza on Wednesday that the gun handed to Baldwin contained a live round despite having been inspected and declared safe by two people, armorer Hannah Gutierrez and assistant director David Halls, and that other live rounds were found on the set. 
 
"It`s pretty obvious; somebody had to be negligent," said University of Southern California law professor Gregory Keating. 
 
WHO COULD BE SUED? 
 
Harris, who represented the family of a stuntman on AMC`s "The Walking Dead" in a wrongful death case, said both Gutierrez and Halls could be sued. Bryan Sullivan of Early Sullivan, a Los Angeles entertainment attorney, agreed. 
 
Harris said the 'Rust'&nbsp;production company, people in supervisory roles and people involved in hiring decisions could also be targeted. 
 
Allocating liability could take years of litigation. The outcome would determine who might have to pay financial damages and how much. 
 
"It`s very common to have multiple defendants whose negligence intermingles with each other," Harris said. 
 
Baldwin probably will not be held civilly liable for firing the gun after being told it was safe. However, he could face liability as one of the film`s producers, said Sullivan. 
 
A court "would look at who had ultimate authority to ensure the safety of the set," he said.

Defendants in a civil lawsuit would likely argue the shooting was a workplace accident, meaning that the victims could only seek payment through workers` compensation insurance.
