A woman who said Bill Cosby sexually assaulted her when she was a young comedy writer more than 50 years ago filed a lawsuit against the actor Thursday under a soon-to-expire New York law that gave victims of sexual abuse a one-year window for claims that would otherwise be barred by time limits.

Joan Tarshis initially came forward with allegations against Cosby in 2014 that are repeated in the new lawsuit. Tarshis said Cosby drugged her and forced her to perform oral sex on him in 1969 or 1970, and then drugged and raped her during another encounter a year or two later.

The New York resident was living in California at the time of the first assault and had met Cosby through a mutual friend while he was starring in “The Bill Cosby Show,” according to the lawsuit, filed in state Supreme Court in New York City.

A spokesperson for Cosby did not address the specifics of Tarshis’s claims.

“Diddy, LA Reid, Steven Tyler, and now they circle back to this,” spokesperson Andrew Wyatt said, referring to others recently sued under New York’s Adult Survivors Act. “When is it going to stop?”

Cosby, 86, has been accused of rape, sexual assault and sexual harassment by more than 60 women. He has denied all allegations involving sex crimes. He was the first celebrity tried and convicted in the #MeToo era and spent nearly three years at a state prison near Philadelphia before a higher court overturned the conviction and released him in 2021.

Tarshis was among the first accusers to speak publicly about Cosby, whom she met when she was 19 and just breaking into comedy writing. An interview she did with CNN newsman Don Lemon soon after she came forward drew a flurry of attention on social media, and an apology from Lemon. While on-air, the host suggested Tarshis could have bitten Cosby on his genitals during the first assault, something Tarshis said she hadn’t thought of.

Tarshis previously sued Cosby in Massachusetts, where Cosby had a home. She was among seven women who filed defamation claims after Cosby branded them liars. The cases were settled in 2019.

The new lawsuit alleges assault, battery, intentional infliction of emotional distress and false imprisonment. It seeks unspecified damages.

In it, Tarshis said Cosby invited her to meet with him at the studio lot where he was filming his show, under the pretense of working on a skit she was writing. Once in his bungalow, Tarshis said she fell unconscious after accepting a drink from Cosby and awoke to find him undressing her before forcing her to perform oral sex.

“Ms Tarshis was mortified and feared for her life,” and returned to New York without telling anyone what happened, according to the lawsuit.

She next heard from Cosby in 1971, when he called her home, spoke with her mother, and invited her to his show at Westbury Music Fair, the lawsuit said.

“Though Ms. Tarshis was fearful at the prospect of seeing Cosby again, she had not yet told anyone, including her mother, of the prior sexual assault and she reluctantly agreed to meet with Cosby at the insistence of her mother,” according to the lawsuit.

She said she lost consciousness in a limousine Cosby had arranged for them and awoke the next morning in a bed next to Cosby, who she said had undressed and raped her.

The Adult Survivors Act is set to expire next week.

Antonio “L.A.” Reid, a music executive, was sued last week by an executive who alleges that Reid sexually assaulted her twice in 2001. Email and telephone messages left for Joel Katz, an attorney who represented Reid when the allegations surfaced in 2017, weren’t immediately returned Friday night.

Sean “Diddy” Combs has denied allegations of rape and abuse brought by a former girlfriend earlier this week.

Aerosmith frontman Steven Tyler has not publicly responded to a lawsuit filed earlier this month.

Bill Cosby accuser files new lawsuit under expiring New York survivors law

Bill Cosby, the comedian once celebrated as America's Dad, is now the subject of another civil lawsuit alleging sexual battery. Donna Motsinger, a resident of New Mexico, has come forward with claims that Cosby drugged and raped her over five decades ago when she worked as a waitress at a Bay Area restaurant.

In the 11-page complaint filed in Los Angeles Superior Court, Motsinger detailed her encounter with Cosby in 1972. According to her account, she met Cosby at The Trident in Sausalito, a restaurant where he was a regular patron. Afterward, Cosby allegedly followed Motsinger to her home in Mill Valley and invited her to his stand-up show at the Circle Star Theater in San Carlos, where he was recording what would become the LP Inside the Mind of Bill Cosby.

The lawsuit states that Cosby picked up Motsinger in a limousine and gave her a glass of wine during the ride. At the theater, Motsinger began to feel ill, and Cosby purportedly provided her with what she believed was an aspirin. Her recollection goes on to describe her drifting in and out of consciousness while two men attending to Cosby placed her in the limousine with him. Motsinger woke up at her house with all her clothes removed except her underwear.

This latest civil suit adds to the significant legal challenges that Bill Cosby has faced in recent years. Triggered by a viral stand-up routine by comedian Hannibal Buress in 2014, numerous women have accused Cosby of rape, sexual battery, or misconduct. In 2018, he was convicted of the 2004 rape of Andrea Constand, a former Temple University athletics administrator. However, his conviction was later overturned by the Pennsylvania Supreme Court in June 2021, leading to his release from prison.

Aside from legal consequences, Cosby has also faced professional fallout. He was removed from the TV Academy Hall of Fame, lost prestigious honours such as the Kennedy Center Honor and Mark Twain Comedy Prize, and became the first individual in Yale University's 300-year history to have an honorary degree revoked.

In addition to Bill Cosby, the lawsuit names production company Jemmin Inc., the now-dissolved MCA Inc., and Circle Star Theater Corp. as defendants. Attorneys representing Donna Motsinger are seeking unspecified damages, alleging that these organisations facilitated Cosby's fame and, in doing so, neglected the safety of their female guests by turning a blind eye to his alleged sexual assaults.

Bill Cosby faces new civil suit alleging sexual battery dating back to 1972

Victoria Valentino, an 80-year-old former Playboy model, has filed a lawsuit against comedian and actor Bill Cosby. She has alleged that he drugged and sexually assaulted her and one more woman at his home in 1969. This lawsuit has been made possible thanks to a new California law that suspends the statute of limitations on sex abuse claims, giving victims like Valentino the opportunity to seek justice long after the alleged incidents occurred. At the time of the alleged assault, Valentino was working as an actress and singer, and she claims that Cosby approached her at a Los Angeles café where she was mourning the death of her six-year-old son.

According to the court documents, Cosby offered to pay for a spa treatment for Valentino and a friend and later arranged for a chauffeured car to pick them up for dinner. It was during this evening at a steakhouse that Cosby allegedly gave both women a pill, claiming it would make them feel better. The lawsuit asserts that Cosby then drove them to his house, where Valentino eventually passed out on a couch. Upon regaining consciousness, she alleges witnessing Cosby sexually assaulting her unnamed friend. Furthermore, the court filings claim that Cosby engaged in forced sexual intercourse with Valentino while she was incapacitated by the effects of the drug.

The latest in similar lawsuits by Bill Cosby accusers

Valentino's lawsuit is the latest in a series of legal actions taken by women who have accused Cosby of sexual misconduct. Last year, six Cosby accusers in New York filed lawsuits under a similar "lookback" law, which allows adults to bring forth sexual abuse claims that had previously been barred by the statute of limitations. Throughout these legal battles, Cosby, who gained fame through his role on The Cosby Show, has consistently denied all allegations of rape, sexual assault, and sexual harassment made against him by at least 60 women.

Bill Cosby's response

In response to Valentino's lawsuit, Cosby's spokesperson, Andrew Wyatt, dismissed the claims, stating that they lack evidence and facts. Wyatt also criticised the use of lookback laws, arguing that they violate constitutional rights intended to protect both crime victims and those accused of crimes. He raised concerns about the challenge of gathering witnesses to testify on Cosby's behalf, suggesting that this could be a deliberate attempt to hinder the achievements of Black men in America, referencing Cosby's success and the American Dream he embodied.

It is worth noting that Bill Cosby's 2018 sexual assault conviction was overturned by the Pennsylvania Supreme Court, leading to his release from prison in 2021. The court found that Cosby had given self-incriminating testimony during a deposition, mistakenly believing he had immunity from prosecution. This decision came after Cosby had spent nearly three years in a state prison near Philadelphia, becoming the first high-profile figure to be tried and convicted in the #MeToo era.

Former Playboy model alleges Bill Cosby drugged and sexually assaulted her in 1969

Not all’s well for Bill Cosby as he could soon be back in court fighting his longstanding case of sexual assault after it seems likely that his 2018 rape conviction can be overturned.

The comedian’s lawyers have lashed out at “#metoo mob” for their “pathetic last-ditch effort” by the Montgomery County’s District Attorney.

Bill Cosby was let go scot free in late June this year by Keystone State’s top court in a 10-year sentence for the 2004 rape of Andrea Constand.

Bill Cosby slams “#MeToo mob” on wanting to overturn rape conviction

A trio of Pennsylvania judges on Monday appeared deeply sceptical of Bill Cosby's effort to have his sexual assault conviction overturned, as the comedian's lawyers argued in court that the trial judge had deprived him of a fair trial.

The judicial panel in Superior Court in Harrisburg, the state capital, posed their toughest questions to Cosby's lawyers during a hearing that lasted less than an hour while state prosecutors seemed to receive a much warmer reception.

Cosby, known for his role as the lovable father in the 1980s television series 'The Cosby Show,' saw his family-friendly reputation shattered after dozens of women accused him of sexual assault over decades.

He became the first celebrity to be convicted in the '#MeToo' era when a jury found him guilty in April 2018 of drugging and sexually assaulting Andrea Constand at his home in 2004.

The 82-year-old, who is serving a prison sentence of three-to-10 years, did not attend Monday's hearing.

The appeal focused on the decision by Montgomery County Judge Steven O'Neill to allow five accusers to testify at trial that Cosby had drugged and sexually assaulted them years previously, just as Constand claimed he had done.

The trial concerned only Constand's allegation; the other accusers' claims were too old to lead to criminal charges.

Under Pennsylvania law, such "prior bad acts" witnesses are seen as potentially prejudicial and can be admitted only under rare exceptions, such as to prove a defendant engaged in a specific pattern of behaviour or could not have mistaken incapacitation for consent.

Cosby's lawyers argued that the women's stories were too dissimilar to be permitted as pattern evidence and essentially guaranteed the jury would view him as guilty.

But Judge John Bender, the presiding judge on the panel, expressed doubt about that assertion.

"He gives them drugs and then he has sex with them," the judge said. "That's the pattern, isn't it?"

Cosby's lawyers also said O'Neill wrongly dismissed testimony from a former Montgomery County district attorney, Bruce Castor, who said he had promised Cosby not to bring charges related to Constand if Cosby agreed to testify in a deposition as part of her civil lawsuit against him.

Cosby settled the civil case for millions of dollars. Nearly a decade later, the unsealing of his sworn deposition - in which he acknowledged giving young women sedatives in the 1970s to facilitate sex - prompted a new district attorney to reopen the case and eventually charge Cosby.

Judge Carolyn Nichols, a member of Monday's panel, said that absent a written agreement or a court-approved deal granting Cosby immunity, Castor's successors were within their rights to prosecute Cosby.

"How can an elected district attorney bind that office in perpetuity?" she asked.

Cosby's first trial in June 2017 ended in a mistrial after the jury could not agree on a verdict. At that trial, O'Neill permitted only a single other accuser to testify.
