The Supreme Court of India listed eight points that are required to be considered while deciding the permanent alimony amount during the hearing of a divorce settlement case.

A bench of Justices Vikram Nath and Prasanna V Varale laid down the formula amid heated debate in the country around alimony, harassment and extortion by wife and in-laws. The debate was triggered by recent death of a techie from Uttar Pradesh state, who died by suicide after accusing his wife and her family of extortion.

Now, the new formula will work as a go-to guide for all courts in the country while deciding alimony amount in divorce cases.

&nbsp;Here are the eight factors that the Supreme Court of India has listed:

The apex court however clarified that these factors must not be taken as a straight jacket formula' but a "guideline".

Citing a previous judgment in the alimony matter (Kiran Jyot Maini v Anish Pramod Patel), the Supreme Court noted that it was “necessary to ensure that the amount of permanent alimony should not penalise the husband but should be made with the aim of ensuring a decent standard of living for the wife."

Meanwhile, in a separate case, the Supreme Court noted Wednesday (Dec 11) that the laws against marital cruelty were increasingly being misused by women, saying the provisions can’t be used as a "personal tool to unleash vendetta".

A video is doing rounds on social media in which a judge can be seen reprimanding a woman&nbsp;lawyer who is demanding over Rs 6 lakhs ($7147) per month as alimony from her clients&nbsp;ex-husband.&nbsp;

The viral video is of court proceedings from the Karnataka High Court where the judge refused to entertain the woman’s request for alimony, saying she could start earning if she wanted to spend so much.&nbsp;

The woman’s lawyer tried to secure a monthly maintenance amount of Rs. 6,16,300 from her ex-husband, which the judge discarded as an unreasonable demand.&nbsp;

The video is from August 20 when the case was being heard on the issue of non-filling of the expenditure of a woman named Radha Munukuntla.&nbsp;

In the video, the woman’s lawyer claimed that she needs Rs 4 to 5 lakh per month for treatment of her knee pain, physiotherapy, medicines and other related expenses. For her “basic needs” of bangles, sandals, slippers, watches etc, she demanded Rs 50,000 per month and Rs 60,000 on top for food.

The woman’s lawyer also points out how her ex-husband wears “all branded clothes” – like Calvin Klein t-shirts that cost Rs 10,000 each – whereas she has to make do with old dresses.

The ex-husband is currently paying for their children's school and tuition fees, as per the video. Hence, the woman asking for such a whopping amount of alimony has no responsibility for the kids, as per the court.

“Please don’t tell the court that this is what a person requires,” the judge said in response to the petition.&nbsp;

“Six lakh, sixteen thousand, three hundred per month? Does anybody spend this much? A single lady for herself?” the judge asked.

“Well if she wants to spend, let her earn. Not on the husband,” the Karnataka High Court judge continued.

The judge also asked the woman’s lawyer to explain to her that her demand was unreasonable. “You have no other responsibility of the family. You don’t have to take care of the children,” she pointed out, adding that alimony should not be a punishment to the husband.

The video of judge’s take on the petition has been widely appreciated by netizens.

"We are dismissing the criminal appeal with the conclusion that Section 125 CrPC would be applicable to all women and not just married women," Justice Nagarathna stated.

The landmark judgment came&nbsp;on the petition by Mohd Abdul Samad who was previously directed by a family court to pay a monthly allowance of ₹20,000 ($240) to his divorced wife. Samad had challenged the direction in Telangana High Court. The high court upheld the direction to pay maintenance, but modified the amount to ₹10,000 ($120).&nbsp;

He then moved the Supreme Court.

The petitioner invoked the Muslim Women (Protection of Rights on Divorce) Act, 1986 Act, the controversial law formulated by the then-Prime Minister Rajiv Gandhi's government to pacify the Muslim conservatives enraged after Supreme Court's progressive verdict in Shah Bano case.&nbsp;

The petitioner in the current case argued that "if the divorced woman has sufficient means, she cannot file for maintenance under Section 125 CrPC, however, that is the case with Section 3 of the Act".&nbsp;

According to the New York Post, the substantial divorce settlement was determined using the yearly minimum salary over the course of the couple's marriage.

Ivana Moral, the wife, received the compensation, which judge Laura Ruiz Alaminos estimated in recognition of her 25 years of married service. In 2020, the couple divorced. The man must now pay the wife $527 in alimony each month, as well as $422 and $633 each for the couple's two kids, who are now 20 and 14, reported NYP.&nbsp;

The report quotes Moral as saying that she and their daughters were "left with nothing" when the couple split, sharing her struggles. "Clearly this was a case of abuse to be completely excluded financially (by her ex-husband) with nothing left after my marriage ended," Moral said, adding that despite investing all of her "time, energy, and love" in the family, she and their daughters were left with "nothing".

She continued that she had been bound by a "separation of goods agreement" at the time of their marriage, allowing the husband to retain his wealth and divide their shared assets.

In the Velez-Malaga court hearing in southern Spain, it was revealed&nbsp;that the husband—who is unnamed in the lawsuit—reportedly has a lucrative gym company and a number of high-end assets worth $6.4 million.

Moral expressed her hope that this case will serve as an encouragement to other women and serve as an example of how "we may claim for housekeeping" in spite of such (division of commodities) agreements.

"Since I don’t have any financial support or earning, I only know how I arranged the money for so long. Thus, I deserve much more alimony for spending a quality life.” Her counsel argued that since Shami's annual income stood at $850,000 (Rs 7 crore) for the financial year 2020-21, according to income tax returns, the demand for $12,300 (Rs 10 lakh) as alimony was not unjustified.
