The CBI on Friday told the Delhi High Court that the 2G spectrum case allegedly involving former telecom minister A Raja, DMK lawmaker Kanimozhi and others was "a case of monumental loss and a shame to the nation". 
 
Challenging the acquittal of the DMK leaders and others, Additional Solicitor General Tushar Mehta told a bench of Justice SP Garg that huge loss to the public exchequer had been caused due to the spectrum allocation scam. 
 
"This is a case of monumental loss and a shame to the nation," Mr Mehta said. 
 
The ASG also opposed the plea of the accused seeking more time to file their response saying "delaying tactics" were being adopted by them to prolong the proceedings. 
 
The high court has now posted the CBI's plea challenging their acquittal by a special court in the 2G spectrum case for August 2 while the Enforcement Directorate's (ED) plea has been fixed for August 6. 
 
During the hearing, lawyers for some of the accused in the case said that a number of charge sheets have been filed in these cases and they should be heard separately. 
 
The high court had earlier issued notices to Mr Raja, Ms Kanimozhi and others on the CBI's plea challenging their acquittal by a special court in the 2G spectrum case.

A similar order was passed by Justice Garg on the plea of the ED challenging their acquittal in the money laundering case arising out of the 2G scam case. 
 
The court had also allowed the interim plea of the ED for maintaining status quo with regard to the properties worth around&nbspRs.&nbsp223 crore which the agency had attached in the money laundering case. 
 
The ED did not want the properties to be released from attachment, a consequence of the acquittal in the money laundering case, saying that third party rights might be created in them. 
 
On March 19, the ED moved the high court challenging the special court's order acquitting all the accused in the money laundering case arising out of the 2G scam. 
 
Yesterday, the CBI too challenged in the high court the acquittal of the accused in the case. 
 
A special court on December 21 last year had acquitted Mr Raja, Ms Kanimozhi and others in the CBI and ED cases. 
 
Besides Mr Raja and Ms Kanimozhi, the special court had acquitted 17 others, including DMK chief M Karunanidhi's wife Dayalu Ammal, Shahid Balwa and Vinod Goenka of STPL, Asif Balwa and Rajiv Aggarwal of Kusegaon Fruits and Vegetables Pvt Ltd, film producer Karim Morani, P Amirtham and Sharad Kumar, Director of Kalaignar TV in the ED case. 
 
The ED, in its charge sheet, had alleged that&nbspRs.&nbsp200 crore was paid by Swan Telecom (P) Ltd (STPL) promoters to DMK-run Kalaignar TV. 
 
On the same day, the trial court had acquitted Mr Raja, Ms Kanimozhi and 15 others, including former Telecom Secretary Siddharth Behura, Raja's erstwhile private secretary R K Chandolia, Swan Telecom promoters Shahid Usman Balwa and Vinod Goenka, Unitech Ltd MD Sanjay Chandra and three top executives of Reliance Anil Dhirubhai Ambani Group (RADAG) -- Gautam Doshi, Surendra Pipara and Hari Nair, in the CBI's 2G case. 
 
The CBI had alleged that there was a loss of&nbspRs.&nbsp30,984 crore to the exchequer in allocation of licences for the 2G spectrum which were scrapped by the top court on February 2, 2012. 
 
Special Judge O P Saini, however, had held that the prosecution had "miserably failed" to prove the charges. 
 
The special court, which was set up on March 14, 2011 for hearing 2G cases exclusively, had also acquitted Essar Group promoters Ravi Kant Ruia and Anshuman Ruia and six others in a separate case arising out of the 2G scam probe. 
 
The first case, prosecuted by CBI, had 17 accused, while the second matter, pursued by ED, had 19 undertrials. The third one had eight accused including Essar promoters.

In the CBI case, Raja, Kanimozhi and 15 others were tried under provisions of the IPC and the Prevention of Corruption Act dealing with offences of criminal conspiracy, cheating, forgery among others.

A Delhi court on Tuesday granted Karti Chidambaram interim protection from arrest till July 10 in two cases filed by the CBI and ED in the Aircel-Maxis matter arising out of 2G spectrum cases.

Special Judge O.P. Saini granted relief to the son of senior Congress leader P. Chidambaram after the Enforcement Directorate (ED) sought time to argue on Karti’s application seeking anticipatory bail.

“A related matter is pending before the Supreme Court and that will be taken up for hearing on July 2,” advocate Nitesh Rana, appearing for the ED, said while seeking adjournment.

The submission was supported by the CBI counsel who requested the court to put up the matter for the next date.

The court on April 16 granted interim relief to Karti till May 2 after considering that both the investigative agencies had sought time to file their responses on his anticipatory bail plea.

Karti had filed a plea seeking protection from arrest in the Aircel-Maxis matter, in which the CBI and the ED lodged cases in 2011 and 2012.

The matter pertains to grant of Foreign Investment Promotion Board (FIPB) clearance to firm M/S Global Communication Holding Services Ltd. for investment in Aircel.

In September 2015, the CBI had filed its status report regarding a probe into the FIPB approvals in the case. The agency had in June 2016 also issued a notice to A. Palaniappan, director of Chess Management Services, a company promoted by&nbspKarti.

Court extends interim protection from arrest to Karti in Aircel-Maxis case

Former telecom minister <a href="http://www.wionews.com/topic/a-raja">Andimuthu Raja</a>, who was recently <a href="http://www.wionews.com/india-news/2g-scam-entire-case-was-cooked-up-says-a-raja-27393">acquitted in the 2G spectrum scam case</a>, said Congress didn&#39;t not come to his rescue during the difficult times he faced during the trial.

&quot;Congress remained aloof from this matter to save the government. They should have come forward and said nothing is wrong,&quot; Raja said in an interview to WION on Thursday.

Raja was the telecom minister in the Congress-led UPA government from May 2007 to November 2009. He resigned in 2010 after the then Comptroller and Auditor General (CAG) Vionod Rai indicted the minister for not distributing the 2G spectrum in a transparent manner leading to a loss of Rs 1.76 lakh crore to the exchequer.

Raja hit back at the former CAG. &quot;Vinod Rai is a blatant liar. They wanted to train their guns only at me. No one came to hear my side of the story,&quot; the DMK leader said.

Explaining how he was acquitted in the 2G scam, Raja said the investigators could not corroborate the evidence. &quot;Whatever you accuse me of, you have to present evidence for that. But all the documents were in my favour, the investigators couldn&#39;t prove anything so I was acquitted,&quot; Raja said.

He also said that members of former Prime Minister Manmohan Singh&#39;s Cabinet were not true to him. &quot;Those who failed in court wanted to use the Prime Minister&#39;s Office (PMO). He didn&#39;t even know about spectrum availability. Dr Singh remained silence because of the Supreme Court and media,&quot; Raja said.

&quot;There were variations within the Cabinet regarding 2G. Nobody in the government defended the policy of the government. Cut-off date was not Raja&#39;s brainchild. It was the brainchild of then secretary and officers. In fact I was against the cut-off date,&quot; he added.

The CBI, during the course of its investigation, had alleged that the decision to advance cut-off date for accepting the applications for grant of 2G spectrum licences was taken to &quot;favour&quot; Unitech - a charge which was never accepted by Raja.

The DMK leader also said that he will seek a ticket for 2019 Lok Sabha elections. &quot;I will always be part of politics,&quot; Raja said.

Raja was also grateful to his party chief M Karunandhi. &quot;Karunanidhi came to jail to console me.&quot;

BJP leader Subramanian Swamy, who unearthed the 2G spectrum case, on Thursday, snubbed the verdict in the multi-crore scam while saying that the government needs loyal officers, not sycophants.

All accused in the 2G spectrum allocation scam cases - including former telecom minister A Raja and Dravida Munnetra Kazhagam (DMK) MP Kanimozhi - were, earlier in the day, acquitted by a Special CBI court.

He further called upon Prime Minister Narendra Modi to take a lesson from this and &quot;set up war council for fighting corruption.&quot;

This is a big condemnation of the government controlling of the case. This is not a setback at all. It is an aberration as the law officers were not serious on fighting against corruption... We must now fight corruption on war footing,&quot; he said.

He further said that a special team should be set up, which would set aside this judgment.

The verdict was announced nearly seven years after the first arrest was made by the CBI in 2011.

The alleged scam relates to the granting of 2G spectrum licence allocations in 2007-08, which caused, according to a report by the Comptroller and Auditor General of India, a loss of Rs 1.76 lakh crore to the public exchequer.

It was among the major corruption scandals that came to light during the second term of the UPA government headed by former prime minister Manmohan Singh.&nbsp;
