The appeals court while backing the findings of US National Labor Relations Board's (NLRB) gave the ruling. This came after an organising campaign by the United Auto Workers (UAW) union at Tesla’s Fremont automobile plant in California.

Musk tweeted, “Nothing stopping Tesla team at our car plant from voting union … But why pay union dues &amp; give up stock options for nothing?”

The UAW president, Shawn Fain, welcomed the ruling but also said it exposed “our broken US labour law”.&nbsp;“Here is a company that clearly broke the law and yet it is several years down the road before these workers have achieved a modicum of justice,” Fain said.

Earlier, Tesla won in a lawsuit filed by investors in February related to a Tweet&nbsp;by Musk from 2018 that suggested funding was available for the company to go private. Musk claimed in a tweet that he has "funding&nbsp;secured" to take the electric vehicle manufacturer private at a price of $420 per share. Investors contended that the tweets caused stocks to soar over a 10-day period. 
 
After winning the lawsuit, Musk had tweeted, “Thank goodness, the wisdom of the people has prevailed!” “I am deeply appreciative of the jury’s unanimous finding of innocence in the Tesla 420 take-private case.”

In addition, Musk won in a defamation case brought by a British caver.&nbsp;The Tesla founder&nbsp;was sued by Vernon Unsworth for $190 million in damages, but Elon Musk won. Musk argued in court that the term "pedo man" was prevalent in South Africa, where he was raised.

Musk acquired Twitter in 2022 for $44 billion. In the argument on Friday, Tesla had contended that the tweet about organising wasn't a threat and was instead just a reflection of the reality that union employees at other automakers weren't given stock options.&nbsp;

Elon Musk’s Tesla company reportedly hired a PR consultancy firm to monitor their employees’ activities on social media, especially Facebook, when some workers sought to form a union at the company’s factory in Fermont, California, between 2017 and 2018.

CNBC, quoting invoices and other documents, reported that MWW PR closely monitored discussions alleging unfair labour practices at Tesla, and about a sexual harassment lawsuit.

The PR firm monitored the social media platform "for commentary on organizing efforts, and to conduct research specifically on organizers, going on to develop labour communication plans, media lists, and pitches based on their reconnaissance," CNBC said.

Responding to the report, MWW PR told CNBC that it "consulted with Tesla in 2017-2018 on a broad employee communications engagement during a period of rapid growth at the company."

"It is a common practice to review media coverage and public social conversation about a company to gain insights into issues and perceptions of stakeholders about the brand," the firm said.

Musk has been a staunch opponent of union formation and has often clashed with the Democrats and President Joe Biden for their pro-union stance.

In 2017, Tesla fired a union activist, Richard Ortiz, and in 2018, Musk tweeted a comment found to have violated federal labour laws.

The National Labour Relations Board ordered Tesla to reinstate Ortiz and to have Musk delete his tweet, which they said threatened workers’ compensation. Tesla has appealed the administrative court’s ruling and his tweet remains.

The agency also investigated charges by the workers that Tesla intimidated and harassed them and violated workers&#39; rights under federal labour law.

Tesla has denied the allegations.

The company must respond to the charges by Sept. 14. The NLRB has scheduled a hearing for Nov. 14 before an administrative law judge in Oakland, California.
