A Delhi court on Tuesday deferred to August 29 the hearing on the Enforcement Directorate's plea seeking cancellation of bail of Rajiv Saxena, accused-turned-approver in the AgustaWestland money laundering case.

Counsel for Saxena Geeta Luthra filed the reply on the agency's application and informed Special Judge Arvind Kumar that the Supreme Court will take up on August 26 a petition of the ED challenging a Delhi High Court order allowing her client to travel abroad.

The ED had on July 15 approached Kumar's court cancellation of the bail granted Saxena on February 25.

The agency has alleged that despite turning an approver, he has been in touch with other persons who are involved in the case.

Saxena has a mala fide intent to shield other accused persons and prevent a successful prosecution, the agency has submitted.

The ED has stated he failed to join the investigation citing frivolous reasons after being called by it around 25 times.

Without intimating the investigation officer, Saxena left for Mumbai as he had checked out of the address known to the agency, the plea has contended.

"It is now clear that he has hidden his role and culpability in the case. He has acted in bad faith and contrary to the condition, he provided selective evidence with regard to other persons. He willfully failed to disclose all the facts within his knowledge and give documentary evidence in his possession in a clear attempt to shift liability," the ED counsel has said.

The Central Bureau of Investigation and the ED had earlier issued summonses to Saxena to join the probe.

The Dubai-based businessman was extradited to India on January 31 in connection with the Rs 3,600-crore scam case relating to the purchase of 12 VVIP helicopters from AgustaWestland.

The court had asked the All India Institute of Medical Sciences (AIIMS) Director Randeep Guleria to constitute a board of expert doctors for Saxena's treatment.

Accordingly, the board will carry out tests on him on July 11 to ascertain whether he can be treated in India or not.

The ED, while challenging the Delhi High Court order in the apex court, had said that permitting Saxena to go abroad might "hamper the probe".

The court had also said that Saxena must stand trial if something comes out against him during the investigation into the case.

The apex court will take up the matter on July 17.

Sources also said that the ED was annoyed with Saxena for his "incomplete disclosure" of information. It may approach the concerned court seeking withdrawal of his approver status in the case.

Soon after the aircraft landed, Talwar was taken into Enforcement Directorate (ED) custody, sources said.

Rajiv Saxena was picked up by UAE state security from his residence this morning at 9:30 am (UAE time) on Wednesday and illegally extradited to India around 5:30 pm (UAE time).

Geeta Luthra and Prateek Yadav, lawyers of Rajiv Saxena said when they asked to speak to UAE state security and demanded to understand what happened, they were told he is on flight and can’t be stopped. When they queried this further they were told “Ask the Indian Government".

They further added, "There were no extradition proceedings started in the UAE and he was not allowed access to his family or lawyers or essential daily medicine. He was boarded onto a private jet from a private terminal at Dubai International Airport".

The ED had sought eight days custody of Saxena before special judge Arvind Kumar, who allowed the agency to interrogate him for four days.

During the hearing, Saxena's lawyer claimed that his client was suffering from cancer.The agency, however, said that this was needed to be verified.

Counsel of Rajiv Saxena had earlier also claimed that the manner in which Rajiv Saxena was been brought to India was "illegal"&nbsp;and therefore the request for the remand was also "illegal".&nbsp;

According to sources a two-member Enforcement Directorate team headed by an Inspector General rank officer and officials of Ministry of External Affairs and Research and Analysis Wing (R&amp;AW) had accompanied both the accused to Delhi from Dubai in the aircraft which landed at the Indira Gandhi International (IGI) Airport in New Delhi around 2.30 am.

Soon after the aircraft landed, Talwar was taken into Enforcement Directorate (ED) custody, sources said.

Rajiv Saxena, an accused in AgustaWestland chopper deal scam, was extradited from Dubai, UAE, to India on Wednesday, making it second such catch for the investigating agencies after <a href="http://www.wionews.com/india-news/agustawestland-scam-christian-michel-named-mrs-gandhi-son-of-italian-lady-in-probe-ed-tells-court-187221">Christian Michel</a>. &nbsp;

According to sources, Saxena is likely to land in Delhi on Wednesday night.

In December last year, the UAE government had extradited Christian Michel, a British national and alleged middleman in the Rs 3,600 crore VVIP chopper deal scam.

“Saxena is likely to land here at 9.30 pm,” said sources.

The Enforcement Directorate (ED) in December last year, in reply against Dubai-based businessman Saxena’s bail plea, had informed the court about the request for his extradition from Dubai as he had failed to join the investigation even after repeated reminders.

On October 6 last year, a court in Delhi had issued a non-bailable warrant (NBW) against Saxena after the ED informed the court that he was not joining the investigation even after repeated summons. Saxena’s name figured in a charge sheet filed against his wife Shivani, currently out on bail after being arrested by the ED.&nbsp;

Geeta Luthra and Prateek Yadav, lawyers of Rajiv Saxena said when they asked to speak to UAE state security and demanded to understand what happened, they were told he is on flight and can’t be stopped. When they queried this further they were told “Ask the Indian Government".
