Shrugging off her responsibility, RJD chief Lalu Prasad&#39;s daughter Misa Bharti has put the onus of running a company being probed for money laundering on her husband and a dead CA, even though the ED has said that the duo &quot;actively conspired&quot; to launder Rs 1.2 crore using shell firms.

The agency, in its chargesheet filed against the couple in December, had said they were &quot;party and actively connected with proceeds of crime including its concealment, possession, acquisition or use and projecting or claiming it as untainted property, and thus are guilty of offence of money laundering.&quot;

A special court in Delhi took cognisance of the chargesheet - called the prosecution complaint under the Prevention of Money Laundering Act - and summoned the couple as accused in the case. 
They are scheduled to appear before the court tomorrow.

The case is related to the purchase of a farm house in Delhi by Misa Bharti and her husband in the name of their company - Ms Mishail Packers and Printers Pvt Ltd - &quot;using?Rs 1.2 crore involved in money laundering in the year 2008-09.&quot;

Misa has been questioned by the Enforcement Directorate in connection with the case. She gave brief replies and told the agency that the day-to-day business activities of the firm were &quot;looked after by her husband Shailesh Kumar and the financial records of this company were maintained by the CA of the company, late Sandeep Sharma.&quot;

Hence, she said, her husband and the deceased CA &quot;would be in a better position&quot; to answer questions about the company and the farmhouse purchased by it.

The agency has recorded Misa&#39;s statement under the PMLA.

Misa reiterated the answer and put the responsibility of taking care of business and financial activities of the firm on her husband and the CA when she was questioned by the Investigating Officer of the case about the shares of the company in 2009, purchased by her at a nominal value of Rs 12 per share.

Shailesh Kumar, in his statement to the ED, said he, as one of the directors of the firm, &quot;supervised the day-to-day functioning of the company, guiding his manager and other employees.&quot;

He, however, told the ED that the &quot;financial matters&quot; of the company were handled by the CA and his company was &quot;investing in purchasing agricultural land in anticipation of the proposed new master plan of Delhi.&quot;

The ED, in the chargesheet, said Misa and Kumar have &quot;actively connived and conspired with Rajesh Kumar Agarwal (another accused in the case) and late Sandeep Sharma for the money laundering of Rs 1.20 crore through the shell companies controlled by Jain brothers and Santosh Kumar Shah (alleged hawala and shell company operatives) by providing funds in advance to them for making investment in their company and thus knowingly were party and actively connected with proceeds of crime including concealment, possession, acquisition or use and projecting or claiming it as untainted property.&quot;

It said that, based on these evidences, the couple are &quot;guilty of offence of money laundering.&quot; It added that the two were the directors of the firm and were &quot;in-charge and responsible for the conduct of the business of their company.&quot;

&quot;They have failed to provide the source of unaccounted money provided to Jain brothers and others for making investment in their company,&quot; the chargesheet said. It said the couple as well as their company &quot;have committed an offence of money laundering.&quot;

The ED is probing Bharti and her husband as part of its criminal probe in a Rs 8,000 crore money laundering case involving shell companies and two Delhi-based alleged entry operators Surendra Jain and Virendra Jain, referred previously as Jain brothers.

The Jains were arrested by the ED in the case.

The agency had also arrested Rajesh Agarwal, an accountant who mediated and provided a cash amount of &quot;Rs 90 lakh to the Jain brothers in advance so as to invest in Ms Mishail Packers and Printers Pvt Ltd as share premium&quot;.

The agency said the Jain brothers, Agrawal and the daughter and the son-in-law of Lalu Yadav were the &quot;key persons behind the money laundering of Rs 1.20 crore&quot;.

RJD supremo Lalu Prasad, who is lodged in a jail here after his conviction by a CBI court in a fodder scam case, would move the Jharkhand High Court for bail within the next few days, his lawyer said.

Prasad&#39;s lawyer Prabhat Kumar told PTI that Prasad&#39;s lawyers will move the high court either on Friday or next Monday.

An official of Birsa Munda Central jail said certified copies of the CBI court&#39;s judgment sentencing the 16 fodder scam convicts, including Prasad, were handed over to them on Saturday.

Replying to a query on whether the RJD chief would move the court for parole following his sister&#39;s death, Kumar said it was not under consideration.

&quot;No, it is not under consideration,&quot; the lawyer said.

Prasad was sentenced to three-and-a-half years in jail by the CBI court on January 6 for fraudulent withdrawal from Deoghar treasury between 1990 and 1994 when he was the Bihar chief minister.

The jail official remained tight-lipped when asked about the veracity of reports that RJD supremo has been given the job of a gardener in the jail with his daily wage being Rs 93.

&quot;We cannot tell that,&quot; he said, adding that a job is allotted according to the requirement of the jail and not the wish of an inmate.

Kumar said he was not informed about the kind of job Prasad has been asked to do.

On December 23, the former Bihar chief minister was convicted in the case relating to illegal withdrawal of Rs 89.27 lakh from the Deoghar treasury.

This was the second conviction of the former Union minister in the scam that was reported for the first time 21 years ago.

Earlier, the 69-year-old RJD leader was convicted of fraudulent withdrawal of Rs 37.7 crore from the Chaibasa treasury in September 30, 2013, and was awarded a five-year jail term.

He was granted bail by the Supreme Court after having spent over two-and-a-half months in jail.

Prasad is an accused in three more fodder scam cases in Ranchi relating to the &quot;fraudulent&quot; withdrawal of Rs 3.97 crore from the Dumka treasury, Rs 36 crore from the Chaibasa treasury and Rs 184 crore from the Doranda treasury respectively.&nbsp;

As per reports, Devi had passed away due to severe aortic stenosis (constriction of the heart valve, which led to frequent breathlessness), acute myocardial infarction (heart attack) and left ventricle dysfunction.

The cremation will reportedly be&nbsp;held on Monday at her husband&#39;s native village Chakrapan in Gopalganj district, media reports said.&nbsp;

Tejashwi Yadav, Lalu&#39;s son, said the family had tried to communicate the news of Gangotri Devi&#39;s death to Prasad through the prison authorities in Ranchi.

He, however, expressed apprehension that his father might not be able to get parole in time, due to the legal procedure involved and the day being a Sunday.

&quot;As of now, we are making arrangements to take the body to her village home, where the last rites will be performed,&quot; Yadav, who had accompanied his mother Rabri Devi and elder brother Tej Pratap to his deceased aunt&#39;s house, said.

75-year-old Gangotri Devi, who was four years elder to Lalu, had not been keeping very well for a while now.&nbsp;

Lalu Prasad&#39;s wife Rabri Devi said his sister had been fasting and praying for her brother which is when she fell ill.

&quot;Yesterday, she spent the entire day praying for the release of her brother. When she learnt that he was sentenced to jail for a long period, she was shattered,&quot; Rabri Devi said.

Along with Convicts Phool Chand, Mahesh Prasad, Bake Julious,Sunil Kumar, Sushil Kumar, Sudhir Kumar and Raja Ram were also sentenced to 3.5 years in jail and Rs 5 lakh fine each.

Fodder scam: Court to pronounce quantum of sentence for Lalu today

Former Bihar chief minister Lalu Prasad Yadav was on Saturday convicted by a special CBI court in the 1996 fodder scam case along with 14 others co-accused in the case. Lalu Prasad Yadav was taken into custody immediately after the verdict and sent to a jail in Ranchi.

Former Bihar chief minister Jagannath Mishra, who was also a co-accused, has been acquitted along with seven others.&nbsp;

The quantum of sentence for the guilty will be pronounced on January 3.

After the verdict, Lalu Prasad tweeted that &quot;truth had been made to appear as a lie.&quot;

&nbsp;&quot;Truth can be made to appear as a lie, as ambiguous or a half lie by concerted onslaught of bias driven propaganda. But blurred layer of bias and hatred will still be removed, come what may! In end Truth will win,&quot; the Rashtriya Janata Dal (RJD)&nbsp; chief wrote on Twitter.

His son Tejashwi said the verdict was a conspiracy by the Bharatiya Janata Party (BJP) and Bihar Chief Minister Nitish Kumar to defame Lalu Prasad. He said they would challenge the verdict in the high court.

The case relates to the alleged fraudulent withdrawal of Rs 95 lakh from the Deoghar treasury between 1991 and 1994 when&nbsp;Lalu was chief minister of Bihar. &nbsp;The CBI has accused Lalu of being aware of the scam and keeping the file of inquiry against the accused pending for 16 months.

There were 34 accused in the case, out of which 11 died during the course of the trial and one turned CBI approver and admitted the crime.

Overall, in the fodder scam cases, more than Rs 900 crores was reportedly syphoned off from the state exchequer over a period of two decades under the pretext of medicines and fodder for cattle.

Lalu Prasad was convicted and sentenced to five years of imprisonment in one of the five fodder scam cases against him. The former Bihar chief minister faces four other fodder scam cases.

The scam came to light in 1996. The CBI filed chargesheets against Prasad and 55 other co-accused in 1997.

The RJD&nbsp;chief had been convicted in one of the fodder scam cases in 2013 on charges of embezzling Rs 37 crores. He was disqualified from the Lok Sabha and from contesting elections after that verdict.

The case against Lalu was revived after the Supreme Court in May ruled that the RJD leader will stand separate trial in all four fodder scam cases, setting aside the Jharkhand High Court order which had dropped the charges of criminal conspiracy, criminal breach of trust and prevention of corruption against him on the grounds that a person convicted in one case could not be tried in similar cases.

The RJD chief has alleged that he is innocent and that the Bharatiya Janata Party (BJP) governments since the time of Atal Bihari Vajpayee have been harassing him and his family by misusing the CBI for the past 25 years.
