A top Pakistani court has named three senior lawyers as amici curiae in the case of Kulbhushan Jadhav as it ordered the Pakistan government to give "another chance" to India to appoint a counsel for the death-row prisoner.

Jadhav, the 50-year-old retired Indian Navy officer, was sentenced to death by a Pakistani military court on charges of espionage and terrorism in April 2017.

India approached the International Court of Justice against Pakistan for denial of consular access to Jadhav and challenging the death sentence.

The Hague-based ICJ ruled in July 2019 that Pakistan must undertake an "effective review and reconsideration" of the conviction and sentence of Jadhav and also to grant consular access to India without further delay.

A two-member bench of the Islamabad High Court (IHC) comprising Chief Justice Athar Minallah and Justice Miangul Hassan Aurangzeb appointed the three lawyers on Monday as it held a hearing of the petition filed by the Pakistan government to appoint a lawyer for Jadhav.

Amicus Curiae is a lawyer appointed by a court to assist in any matter or case.

The court also ordered a larger bench to be set up for the case. It also directed the registrar of the court to fix the proceedings at 2 pm on September 3 before a larger bench.

The Pakistan government in its petition has claimed that Jadhav refused to file a review petition or an application to reconsider the verdict against him by the military court.

We feel that in order to ensure the effectiveness of the review and reconsideration of the conviction and sentence of Commander Jadhav, a reasonable opportunity ought to be extended to the latter and the Government of India to arrange legal representation and to file a petition.

"We, therefore, at this stage restrain ourselves from appointing a counsel on behalf of Commander Jadhav and advise the Government of Pakistan to extend an opportunity to Jadhav and the Government of India for arranging legal representation in terms of Article 32(1)(c) of the Convention and in accordance with the applicable laws,? the court order said.

The court also asked the Pakistan government to communicate the order to the Indian government. Responding to the judge's remarks, Pakistan's Attorney General Khalid Javed Khan said an ordinance was issued to give an opportunity to India and Jadhav to file a review petition against the sentence.

"We will contact India again through the Foreign Office," he said.

He told the court that Jadhav was being taken care of and was in good health.

On July 16, Pakistan provided consular access to Jadhav, but the Indian government said the access was "neither meaningful nor credible" and he appeared visibly under stress.

In New Delhi, External affairs ministry spokesperson Anurag Srivastava last month said Pakistan has once again exposed its "farcical" approach by denying available legal remedies to Jadhav against his death sentence which is also in contravention of the ICJ verdict, and asserted that India will explore further options in the case.

The IHC on Thursday constituted a two-member bench to hear a review petition filed by the Pakistan government.

The bench, comprising IHC Chief Justice Athar Minallah and his fellow judge Justice Miangul Hassan Aurangzeb, &nbsp;would take up the government plea on August 3, the Pakistani media, including the Geo News, reported.

In a unilateral move, Pakistan filed the petition in the IHC on Jul 22, seeking appointment of a "legal representative" for Jadhav.

However, the main parties, including the government of India, were not consulted ahead of the filing of the application by the Ministry of Law and Justice under an ordinance which was enacted on May 20.

Under the 'International Court of Justice Review and Reconsideration Ordinance 2020', which was enacted on May 20, a petition for the review of a military court's decision can be made to Islamabad High Court through an application within 60 days of its promulgation.

The ordinance was approved by the parliament this week.

Through the amendment, the verdicts of military courts would now be challenged in a civilian court within a timeframe of six months. In the case of Kulbhushan Jadhav, his six months appeal time would start from the day of International Court of Justice(ICJ) judgement and not his initial sentence that was on April, 10, 2017.

There hasn't been any reaction from India since the amendment is still to take place, but it could be considered a positive development in the case given that Pakistan still has to fully implement the ICJ order.&nbsp;

The amendment, if passed, will be a major reform process which can make the Pakistan military court more transparent because the amendment opens the gate for others in Pakistan to appeal against the military court orders and judgements.

On April, 26, 2017, the High Commission of India in Islamabad had transmitted to Pakistan, on behalf Jadhav’s mother, an “appeal” under Section 133 (B) and a petition to Pakistani government under Section 131 of the Pakistan Army Act. India received no information on the status of the appeal.

Pakistan set to amend Army Act for Kulbhushan Jadhav to appeal

International Court of Justice (ICJ) President Judge Abdulqawi Yusuf at the United Nations General Assembly (UNGA) on Wednesday said that the top world court has found that Pakistan committed a violation in the Kulbhushan Jadhav case by not granting his consular access to India.&nbsp;

"In its judgment (in Jadhav case), the Court found that Pakistan had violated its obligations under Article 36 of the Vienna Convention and that appropriate remedies were due in this case," Yusuf said as reported by news agency ANI.

Yusuf said that Pakistan wrongly stated that its provisions were not applicable to prisoners suspected of espionage.

Pakistan, last week, said it has provided consular access to Indian national Kulbhushan Jadhav and has now initiated "logical and legal steps" in the case.

"Pakistan granted consular access to Kulbhushan Jadhav. Now logical and legal steps has been initiated in the matter," Pakistan foreign office spokesperson Mohammed Faisal told a press briefing.&nbsp;

India has rejected Pakistan's allegations about Jadhav's involvement in spying and subversive activities and said he was kidnapped by from Iranian port of Chabahar, where he was running a business.&nbsp;

Pakistan had announced in April 2017 that Jadhav has been given death sentence by a military court after which India moved the Indian Court of Justice.&nbsp;

The ICJ in July had asked Pakistan to comply with the Vienna Conventions and provide consular access to Jadhav and to ensure "effective review and reconsideration of his conviction and sentences".

Pakistan had first offered the consular access to Jadhav in August but India had insisted that the consular access should be "effective and unhindered."

Pakistan violated Vienna Convention in Jadhav case: ICJ tells UN

Calling Pakistan an "uncivilised" nation, former Attorney General Mukul Rohatgi said the world has seen that its Army was a "rogue Army".

The senior advocate's statement comes after being asked to respond on the verdict of International Court of Justice (ICJ) to continue its stay on the execution of the Indian national Kulbhushan Jadhav, held in a Pakistani jail on allegations of spying.

"The ICJ has judges from different parts of the world, including China, which has seen the charade. Pakistan is not a civilised nation and the world has seen its Army was a rogue Army. The ICJ said that Pakistan must review, it's a dignified way of saying they must recall that judgement and send Jadhav back to India," senior advocate, Rohatgi told ANI.

He continued, "The world has seen that what Pakistan was saying was completely wrong. There was no trial, a military trial was farcical. There was no legal assistance and no consular access. It was a trial in isolation."

The ICJ on Wednesday continued its stay on the execution of the Indian national Kulbhushan Jadhav, held in a Pakistani jail on allegations of spying, and called for an effective review and reconsideration of the conviction.

Jadhav, 49, was purportedly "arrested" from Balochistan by Pakistani security forces on March 3, 2016, after he allegedly entered the country from Iran, as claimed by Islamabad.

India has held that Pakistan, which faces several problems on its border with Iran, has been using Jadhav's case to blame India for its problems in Balochistan. It has used proxy groups such as Jaish al Adl against Iran, while Iranian officials have spoken of Pakistan's sponsorship of terror activities along the Iran-Pakistan border.

It was on March 25, 2016, that then Foreign Secretary of Pakistan, Aizaz Ahmad Chaudhry, had informed the Indian High Commissioner in Islamabad of Jadhav's "arrest."

Since then, Pakistan has not offered any explanation as to why Islamabad took over three weeks to inform the Indian High Commissioner about Jadhav's arrest.

Jadhav was sentenced to death by a Pakistani military court on April 11, 2017.

Following this, India on May 8, 2017, approached the ICJ against Pakistan "for egregious violations of the Vienna Convention on Consular Relations, 1963" in the matter.

India alleged that Pakistan is in breach of Article 36(1) (b) of the Vienna Convention, which obliged Pakistan to inform India of the arrest of Jadhav "without delay".

Calling Pakistan an "uncivilised" nation, former Attorney General Mukul Rohatgi said the world has seen that its Army was a "rogue Army".
