Hollywood producer, Harvey Weinstein, who was found guilty in his sexual assault trial, may soon be a free man. 
According to Page Six, The State of New York Court of Appeals has approved the convicted sex offender`s request for permission to appeal. 
 
Page Six reports that Harvey`s attorney, Arthur L. Aidala, spoke to them, and said, "Harvey lives to fight another day. 
"The action comes after the Appellate Division, First Department court denied an appeal request in June after a five-judge panel said that trial Judge Jim Burke`s decisions were appropriate and did not call for overturning Weinstein`s conviction. But now, Weinstein will have another opportunity at arguing the judge made mistakes. Earlier, Harvey received a 23-year term for rape and sexual abuse. 
 
Adiala told Page Six, "This isn`t about whether [Weinstein] is innocent or guilty, but if he got a fair trial or not a fair trial. It`s about whether the trial judge followed the law". 
 
Page Six further reports that the defence claims that Harvey was never charged with the actions that Aidala said, "a number of witnesses testified to". 
 
She also added that during the jury selection process, one juror lied about having published a book about sexual predators. 
 
All paperwork from both sides will be submitted by early next year and oral arguments are likely to begin in spring next year. 
 
Adiala told Page Six, "We would hope we would get a decision in late spring early summer of 2023," and that Harvey could "be a free man in 2023 or 2024.

"We reject (the) defendant`s arguments, and affirm the conviction in all respects," a unanimous five-judge panel of the Appellate Division in Manhattan said, finding no errors that would warrant overturning Weinstein`s conviction or sentence. 
 
Juda Engelmayer, a spokesman for Weinstein, said Weinstein will appeal the decision to New York state`s highest court, the Court of Appeals. "We are disappointed and sad for Mr. Weinstein," Engelmayer said. 
 
The verdict was considered a landmark in the #MeToo movement where women came forward to accuse dozens of powerful men of sexual misconduct. Many view the accusations against Weinstein, which surfaced in 2017, the key spark for that movement. 
 
Weinstein, 70, has denied any non-consensual sexual encounters. 
 
He made seven arguments for overturning his conviction, including that rape charges were based on insufficient evidence. 
 
Manhattan District Attorney Alvin Bragg, whose predecessor Cyrus Vance first criminally charged Weinstein, welcomed Thursday`s decision, and said he was "grateful to the brave survivors in this case for their remarkable courage and candor." 
 
Weinstein is jailed in California, where he was extradited last year and awaits trial on 11 charges of alleged misconduct toward five women in Beverly Hills and Los Angeles between 2004 and 2013.

According to a news report by an international media organisation, on June 15, a judge in Buffalo (New York) has approved to move Weinstein to Los Angeles and the transfer is expected sometime in July. But Weinstein, who is in prison in upstate New York, has been fighting this extradition since April this year. His lawyers have continued to object the extradition move, this time in Los Angeles.

Weinstein’s lawyers have mentioned in a petition last month that the movie producer is suffering from a massive cataract in his right eye and an active lesion in the left. They mentioned in the petition that in order to prevent him from going blind, Weinstein needs to be treated and it could take anywhere between six to nine months. His team of lawyers have also asked that the extradition should be delayed until after the treatment is over and once the medical staff gives a go-ahead for him to be transferred.&nbsp;

 
The report also said that as per the law, Los Angeles prosecutors have 120 days to bring Weinstein to trail once he is transferred. However, his lawyers argue that the District Attorney’s office knows it cannot bring Weinstein to trail within that time frame because he is not medically fit to stand trial.&nbsp;

 
Reacting to the content of the petition this week, prosecutors said that the L.A County Sheriff’s Department can provide adequate care to Weinstein and that the District Attorney’s office has no problem with the 120-day deadline to start with the proceedings of the trail.&nbsp;

In a massive relief for Harvey Weinstein, three women namely Louisette Geiss, Sarah Ann Thomas and Melissa Thompson have dismissed their claims against him.

These women had led the front of accusing the former Hollywood movie mogul of sexual misconduct. This change comes in the wake of a settlement plan that was approved in January by a Delaware judge overseeing the bankruptcy of The Weinstein Company.

Their complaint was aimed not only at <a href="https://www.wionews.com/topics/harvey-weinstein">Harvey Weinstein</a> but also board members of his former company as well as Miramax. At the time, US District Judge Alvin Hellerstein rejected 17 of 18 claims — all but a sex trafficking count against Weinstein, later convicted of sex crimes and sentenced to 23 years in prison.

The Weinstein Co. henceforth worked with stakeholders on a settlement that included establishment of a $17 million sexual misconduct claims fund for victims. Under the settlement plan, a sexual misconduct claims examiner reviews each claim that's filed, along with the documents and statements offered in support of it, and assigns a "point award." Those points will be used to determine how much money each woman receives. Accusers get the choice of releasing or not claims against Harvey Weinstein, but those who don't will only receive 25 percent of their allotment from the victims fund.

Other accusers, meanwhile, have objected to the settlement and are now pursuing an appeal.
