The Supreme Court on Friday granted bail to academic- activist Shoma Kanti Sen, who was arrested in June 2018 in connection with the Elgar Parishad-Maoist links case.

A bench of Justices Aniruddha Bose and Augustine George Masih directed that she be released on bail on such conditions as the special court may consider fit and proper.

It said the conditions shall include that Sen shall not leave the state of Maharashtra without the permission of the special court.

"The appellant (Sen) shall inform the investigation officer of the NIA about the address where she shall reside during the period she remains enlarged on bail," the bench said while pronouncing the order.

It said she shall use only one mobile phone number during the bail period and share it with the investigating officer.

"The appellant shall also ensure that the mobile remains active and charged round the clock so that she remains constantly accessible throughout the period she remains enlarged on bail," it said.

"During this period, that is the period during which she remains on bail, the appellant shall keep the location status, that is GPS of her mobile phone, active 24 hours a day and her phone shall be paired with that of the investigating officer of the NIA to enable him at any given time to identify the appellant's exact location," the bench said.

It directed that while on bail, Sen shall report to the station house officer of the police station, within whose jurisdiction she shall reside, once every fortnight.

"In the event there is breach of any of these conditions or any other conditions that may be imposed by the special court independently, it would be open for the prosecution to seek cancellation of bail granted to the appellant before the special court…," the bench said.

The case relates to alleged inflammatory speeches delivered at the Elgar Parishad conclave held at Shaniwarwada in Pune on December 31, 2017 which police claimed triggered violence the next day near the Koregaon-Bhima war memorial located on the city's outskirts.

SC grants bail to activist Shoma Kanti Sen in Elgar Parishad-Maoist links case

The Supreme Court of India on Friday granted bail to two activists — Vernon Gonsalves&nbsp;and Arun Ferreira — in the Bhima Koregaon case.

Gonsalves and Ferreria were sent to jail in 2018 on charges of inciting violence under the Unlawful Activities (Prevention) Act, 1967.

They were arrested in connection with the caste-based violence that broke out near the Koregaon-Bhima war memorial in Pune and for having alleged links with the outlawed outfit, Communist Party of India (Maoists).

The Bombay High Court in December 2021 rejected their bail plea, following which the activists approached the top court to seek relief.

<h2>SC grants relief </h2>

A bench of Justices Aniruddha Bose and Sudhanshu Dhulia granted bail to the two activists considering that they have been under custody for almost five years.

Although the allegations against them are serious, that alone cannot be the sole ground to deny bail and justify their continued detention pending the trial, the apex court said.

The advocates of the plaintiff argued that the National Investigative Agency (NIA) had insufficient material to implicate the appellants.

<h2>SC gives bail with strict conditions </h2>

While granting bail, the court spelled out some strict conditions considering the seriousness of the offences they have allegedly committed, reports LiveLaw.

The judges have asked Gonsalves and Ferreira not to leave Maharashtra without obtaining the trial court's permission.

Further, they have been ordered to surrender their passports and inform the NIA of their residential addresses and mobile phone numbers.

They are also restricted to using only one mobile connection each during the period of their bail.

The court further directed that the phones of Gonsalves and Ferreira be paired with the NIA investigating officer's (IO) device so that their locations can be tracked at all times.

They shall keep the location status of their mobile phones active 24 hours a day, &amp; their phone shall be paired with NIA's IO to enable him to identify, the court stated.

They have also been asked to report to the investigating officer once a week.

“Their phones must remain charged round the clock to ensure the battery does not drain out. If there is any breach of these conditions, or if any attempt is made to threaten witnesses, the prosecution has the right to seek cancellation of bail," the bench said in its verdict.

Swamy is an accused in the Elgar Parishad case. He&nbsp;was facing investigation for his links to Maoist and Naxalite groups in India.&nbsp;

His death is being hyped up by a section of the media, social media and some politicians. But what is the truth?

Here are some of the facts that you should&nbsp;know.

So what really happened?

Elgar Parishad case&nbsp;accused Fr Stan Swamy, 84, suffered a cardiac arrest in&nbsp;Holy Family Hospital on&nbsp;July&nbsp;3. He passed away on July&nbsp;5.&nbsp;

What is the case he was involved in?

At the heart of the Elgar Parishad case is the incitement of people and giving of provocative speeches during a meeting of the same name, organised&nbsp;by Kabir Kala Manch on&nbsp;December&nbsp;31,&nbsp;2017 at&nbsp;Shanivarwada, Pune, in the western Indian state of Maharashtra.

The accused&nbsp;promoted enmity between the caste groups, which led to violence resulting in loss of life and property.&nbsp;

The&nbsp;&nbsp;case was registered on&nbsp;January&nbsp;8,&nbsp;2018.

During investigation, it was revealed that senior leaders of CPI (Maoist), a proscribed terrorist&nbsp;organisation,&nbsp;were in contact with organisers of Elgar Parishad to spread their ideology of Maoism&nbsp;or&nbsp;Naxalism&nbsp;and encourage unlawful&nbsp;activities.&nbsp;

The&nbsp;case&nbsp;was&nbsp;later&nbsp;transferred&nbsp;to&nbsp;National Investigation Agency (NIA).

The role of Stan Swamy emerged during the investigation, as he was found to be a member of CPI (Maoist) and actively involved in furthering its activities.

He was found to be in communication with CPI (Maoist) cadre. He was also convener of Persecuted Prisoners Solidarity Committee (PPSC), a front organisation&nbsp;of CPI (Maoist).&nbsp;

Arrest and case: Was Swamy given due legal process?

Swamy was arrested on&nbsp;October&nbsp;8,&nbsp;2020 by NIA. He was&nbsp;duly informed of grounds of arrest in terms of relevant sections of law.

He was examined by the medical practitioner and accordingly,&nbsp;his health condition was certified to be stable.

He was also subjected to medical check-up.&nbsp;He has made no complaints about his ill-treatment&nbsp;at&nbsp;the hands of the investigation officers during his production before the concerned NIA&nbsp;court, according to the government.&nbsp;

He was sent on judicial custody to Central Jail in Taloja, Mumbai.&nbsp;&nbsp;

In between, his bail applications before the High Court of Bombay was&nbsp;rejected.&nbsp;&nbsp;

Was his health condition taken into account?&nbsp;

According to the government, Swamy was provided with&nbsp;all&nbsp;the&nbsp;necessary requirements related to entitlement of accused in detention.

From his arrest to production before a special court, all the necessary medical formalities after his arrest were complied with. Care and attention were given for his safety and comfort during the air journey from Ranchi to Mumbai.&nbsp;&nbsp;

During&nbsp;his&nbsp;judicial&nbsp;custody,&nbsp;Fr&nbsp;Stan&nbsp;Swamy&nbsp;was&nbsp;kept&nbsp;in&nbsp;a&nbsp;separate&nbsp;cell&nbsp;of&nbsp;prison&nbsp;hospital&nbsp;with&nbsp;all&nbsp;necessary&nbsp;precautions&nbsp;and&nbsp;two&nbsp;attendants&nbsp;as&nbsp;per&nbsp;advice&nbsp;of&nbsp;medical&nbsp;officer&nbsp;of&nbsp;Taloja&nbsp;Central&nbsp;Prison in&nbsp;Mumbai.&nbsp;

He&nbsp;was&nbsp;provided&nbsp;with&nbsp;all&nbsp;facilities&nbsp;including&nbsp;wheel&nbsp;chair,&nbsp;walker,&nbsp;walking&nbsp;stick,&nbsp;straws,&nbsp;sipper,&nbsp;mug,&nbsp;commode&nbsp;chair,&nbsp;battery&nbsp;cells&nbsp;for&nbsp;his&nbsp;hearing&nbsp;machines,&nbsp;dental&nbsp;treatment,&nbsp;visiting&nbsp;psychiatrist&nbsp;and&nbsp;telemedicine, the government said.&nbsp;

Was he taken into custody?

No. Considering his age, no police custody was obtained by NIA during investigation, as sufficient evidences were already on record.&nbsp; &nbsp;&nbsp;

Did he get proper medical treatment?&nbsp;

On&nbsp;May&nbsp;21,&nbsp;2021, Fr Stan Swamy had filed criminal appeal before High Court of Bombay, regarding which Maharashtra had filed medical report of Board of Doctors constituted by JJ Hospital.

He was advised by court to be treated in JJ Hospital; however, he refused to get admitted in JJ Hospital.

Subsequently, High Court allowed his plea to be shifted and treated in Holy Family Hospital, Bandra, along with&nbsp;one attendant as per the protocol.

The Maharashtra government was directed to provide protection during the treatment.&nbsp;

Swamy remained admitted in hospital since&nbsp;May&nbsp;28,&nbsp;2021 for treatment in respect of ailments.

The duration of his stay in the hospital was extended till&nbsp;July&nbsp;6,&nbsp;2021.&nbsp;

The letter was seized during nationwide raids conducted by the Pune police in connection with the case following which these activists were arrested, he said.

The Pune police recently filed its charge sheet against five activists - Surendra Gadling, Shoma Sen, Mahesh Raut, Rona Wilson and Sudhir Dhavale, who were arrested in June.

The letter in question, dated September 25, 2017, is addressed to Surendra (who police claim is Surendra Gadling) by one comrade Prakash, the official said.

A portion of the letter reads, "We must intensify nationwide protests using students. State forces will be soft against students which will gradually put the state at a disadvantage while acting against us. Congress leaders are very much willing to assist in this process and have also agreed to fund further agitations.... In this regard, you can contact our friend at (the phone number of Digvijaya Singh as per police)".

A senior official associated with the probe said the letter had been made part of the charge sheet and is under investigation.

Asked if Digvijaya Singh would be summoned for questioning, senior police officer in Pune Suhas Bavche said several numbers had cropped up in the letters seized during the raids and the ownership of these numbers and their roles in the case are being probed.

"If someone's role is established, whatever is needed to be done as part of the investigation, will be done," Bavche said.

Shivaji Bodakhe, Joint Commissioner of Police (Law and order) informed that, as of now, no notice had been issued to any one.

The prosecution had yesterday told court that charges related to "sedition and waging war against the state" had been added against all the accused arrested for Maoist links in connection with the Elgar Parishad.

Government pleader Ujjwala Pawar had told court yesterday that sections 124 (A) (sedition), 121 (waging or attempting to wage war) and 121 (A) (conspiracy) of the Indian Penal Code (IPC) had been added to the charge sheet.

The Elgar Parishad was held on December 31, 2017 in Pune to commemorate 200 years of the 1818 Koregaon Bhima battle in which East India Company forces, comprising a large number of Dalit soldiers, defeated the Peshwa army.

Asked if Digvijaya Singh would be summoned for questioning, senior police officer in Pune Suhas Bavche said several numbers had cropped up in the letters seized during the raids and the ownership of these numbers and their roles in the case are being probed. "If someone's role is established, whatever is needed to be done as part of the investigation, will be done," Bavche said. The prosecution had yesterday told court that charges related to "sedition and waging war against the state" had been added against all the accused arrested for Maoist links in connection with the Elgar Parishad. Government pleader Ujjwala Pawar had told court yesterday that sections 124 (A) (sedition), 121 (waging or attempting to wage war) and 121 (A) (conspiracy) of the Indian Penal Code (IPC) had been added to the charge sheet. The Elgar Parishad was held on December 31, 2017 in Pune to commemorate 200 years of the 1818 Koregaon Bhima battle in which East India Company forces, comprising a large number of Dalit soldiers, defeated the Peshwa army.
