Delhi Court on Saturday (Jun 29) sent Delhi Chief Minister Arvind Kejriwal to judicial custody till July 12 in a Central Bureau of Investigation (CBI) case related to excise policy matter.&nbsp;

Vacation Judge Sunena Sharma of Rouse Avenue Courts passed the order after Kejriwal was produced in court on the expiry of his three days of CBI custody.&nbsp;

The CBI arrested Kejriwal from Tihar jail in connection with the now-scrapped liquor policy earlier this week - on the same day when the Delhi HC stayed the decision to grant regular bail to Kejriwal, previously&nbsp;allowed by a trial court.&nbsp;

The CBI had sought the court to place Kejriwal under 14 days of judicial custody, stating that as an influential politician he could tamper with evidence and influence witnesses if released from detention.&nbsp;

The CBI further said in its motion that while Kejriwal has been evasive and dishonest in responding to the agency's inquiries, more jail questioning of him is not necessary at this time.&nbsp;

Notably, Kejriwal was arrested by the CBI on June 26 and remanded to CBI custody till June 29. On Saturday, CBI did not seek an extension of its custody of Kejriwal, but rather asked that he be sent to judicial custody.

Excise policy case: Delhi court sends Arvind Kejriwal to judicial custody till July 12

Leader of the Aam Aadmi Party (AAP), Manish Sisodia, was denied bail by the Delhi High Court on Tuesday in connection with proceedings filed by the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI) over the Delhi excise policy scam case.

Referencing Section 3 of the Prevention of Money Laundering Act (PMLA), Justice Swarana Kanta Sharma denied the bail request, stating that the prosecution had established a prima facie case of money laundering.

The Court denied Sisodia's request for bail, stating that his actions amounted to a "great betrayal of democratic principles".

The Court also found that Sisodia destroyed significant evidence, including electronic evidence. The solitary judge in question in this case referred to two allegedly broken mobile phones.

The Court also considered the fact that Sisodia was a top AAP leader, had a prominent position in the Delhi government, managed several ministries, and was an influential figure.

The court said that Sisodia was involved in the crucial destruction of electronic evidence and is an influential person as he is a powerful leader of the party. The court said that the possibility of Sisodia influencing material witnesses cannot be ruled out.

"This court is of the opinion that petitioner has not been able to make out a case for grant of bail in his favour," the judge stated.

The Bench went on to say that Sisodia utilised fraudulent methods to indicate that the Delhi excise policy had public&nbsp;support when, in fact, the policy was designed to benefit only certain people.&nbsp; 
 
The court said that pre-drafted emails&nbsp;were sent “under the guise of public comment by various people under his direction. “Corruption in this case originated from the applicant’s desire to frame the policy. The dissemination of false information by portraying it as a form of feedback constitutes corruption,” the court added.

According to Justice Sharma, Sisodia abused his position and violated the public trust in this instance. The Court stated that neither the CBI nor the ED were responsible for the case's delay. However, the Court disagreed with the trial court's findings that all of the defendants in the case conspired to postpone the trial.

Sisodia's bail request in the CBI and ED charges against him was recently denied by the trial court, which prompted his current petition before the High Court. This is the second round of bail applications filed by Sisodia.

On March 31, 2023, Sisodia's bail request in the CBI case was refused. On April 28, 2023, the trial judge denied his bail plea&nbsp;in the ED case.

The Delhi High Court maintained the trial court's orders, which were further upheld by the Supreme Court in October 2023. However, the Supreme Court stated at the time that Sisodia could apply for bail again if the trial moved too slowly. He then filed a second set of bail pleas.

Sisodia has been in jail since February 26, 2023. He is being investigated by the CBI and the ED in connection with the Delhi excise policy case.

Delhi High Court denies bail to AAP leader Manish Sisodia in Delhi excise policy case

Aam Admi Party (AAP) leader Atishi on Saturday (Apr 6) hit out at the Enforcement Directorate stating that the probe agency has established no money trail in the Delhi excise policy scam probe, yet it arrested AAP leaders on the basis of mere doubt.

She then asked the ED to take stern action against BJP leaders over alleged money laundering.

The Delhi minister also accused the BJP of filing false cases against AAP through central agencies like ED, the Central Bureau of Investigation, and the Income Tax and Election Commission.

Her remarks come following a showcause notice sent by the Election Commission on Friday (Apr 5) over her claims where she alleged that the BJP, through one of her close aides, approached her to join the saffron party or else be ready to be arrested by ED within a month.

"ED has been investigating the money trail in this so-called liquor scam. ED is still investigating the money trail linked to any leader of AAP, but they didn't get a single penny of proceeds from crime from any AAP leader," Aishi said during a presser on Saturday.

"The Supreme Court has continuously asked ED, where is the money trail linked to AAP?... But ED has no answer for this. Justice Sanjiv Khanna says the money trail has not been proven, it's debatable. But many AAP leaders have been arrested under this case even after no money trail," she said.

After EC notice, AAP’s Atishi slams ED, asks agency to take action against BJP over ‘money laundering’

The Aam Aadmi Party on Monday (Mar 25) launched a mass social media campaign called 'DP (Display Picture) campaign' over the arrest of Delhi Chief Minister and party supremo Arvind Kejriwal in connection with the Delhi excise policy scam case.

Delhi Minister Atishi during a press briefing said that all the party leaders and workers changed their display pictures on their respective social media profiles to that of Kejriwal showcasing him behind bars.

The picture showcases the text "Modi Ka Sabse Bada Dar Kejriwal&nbsp;(Modi's biggest fear Kejriwal)" written on it.

Atishi&nbsp;further called on people to back the campaign by changing their pictures on social media stating that this would help save the constitution and democracy in the country.

"AAP will start a DP campaign for a wider outreach of Kejriwal's vision. All leaders, legislators and karyakartas of APP will change their DP on all social media to a picture showing Kejriwal behind bars with a slogan reading 'Modi ka sabse bada dar Kejriwal'," Atishi said.

Atishi further alleged that the Indian prime minister was "trying to crush Kejriwal due to fear of defeat" adding that AAP was waging a battle against "dictatorship" in the country.

In a case in which even after two years of investigation not even a single rupee proceeds of crime were recovered from any of the AAP leaders. Arvind Kejriwal was arrested after the ECI announced the dates of Lok Sabha elections in a case whose investigation has been on for two years," Atishi said while addressing a press conference at party headquarters in Delhi.

"Why did Prime Minister Narendra Modi arrest Arvind Kejriwal after the Lok Sabha election dates were announced? He was arrested because PM Modi knows, if there is any leader in this country who challenges him, it is Arvind Kejriwal," she added.

Kejriwal was remanded to the custody of the Enforcement Directorate for seven days, i.e., until March 28.

AAP launches DP campaign over party supremo Arvind Kejriwal’s arrest

A court in Delhi on Saturday (Mar 23) extended the Enforcement Directorate custody of Bharat Rashtra Samithi (BRS) leader K Kavitha till March 26.

She was arrested on March 15 by the Enforcement Directorate in connection with the Delhi excise policy-linked money laundering case.

While extending the police custody, Special Judge Kaveri Baweja sought the probe agency's response to the bail plea moved for Kavitha.

The ED has alleged that Kavitha, who is former Telangana Chief Minister K Chandrashekar Rao's daughter, was one of the significant members of the 'South Group' that is accused of paying the Aam Aadmi Party recompenses worth Rs 100 crore in exchange for a massive share of liquor licences in Delhi.

"Further, K Kavitha and her associates were to recover the proceeds of crime paid in advance to AAP and to generate profits/proceeds of crime from this entire conspiracy," stated ED.

After producing Kavitha in court, the investigation agency stated that she was confronted with the statements of four people along with a forensic report of the data that was extracted from her phone.&nbsp;

The ED also told the court that raids were conducted at the house of her nephew in Hyderabad.

"A search was also conducted at the residence of K Kavitha in Hyderabad. During the search proceedings, the ED officials were obstructed by the relatives and associates of K Kavitha," said ED in a statement.&nbsp;

Kavitha was arrested following a raid at her Hyderabad residence by the probe agency.

Delhi court extends ED custody of K Kavitha till March 26 in excise PMLA case

'Conman' Sukesh Chandrashekhar, who is at present lodged in Tihar Jail over his alleged involvement in Rs 200 crore ($23.9 million) money laundering case, on Saturday (Mar 23) threatened to expose Delhi Chief Minister Arvind Kejriwal following his arrest.&nbsp;

He stated that he would become an approver against the AAP supremo and his team.

"I will become an approver against Kejriwal and his team. I will expose him. I will make sure he is brought to task," Chandrasekhar said.

"All the evidence has been given. Truth has prevailed. I welcome him to the Tihar jail," he said on being asked if he had any evidence regarding the Delhi chief minister.

Chandrashekhar's remarks came hours after Kejriwal was remanded to the custody of the Enforcement Directorate for seven days, i.e., until March 28.

He was arrested on Thursday (March 21) in connection with the Delhi excise policy scam case by the central probe agency.

Sunita Kejriwal, the wife of Delhi Chief Minister Arvind Kejriwal, on Saturday (Mar 23) read out her husband's message from prison stating that he would be out soon.

"There are several forces within and outside India that are weakening the country. We have to be alert, identify these forces and defeat them," said Sunita Kejriwal in a video address.

"...Women in Delhi must be thinking that Kejriwal is behind bars. Who knows if they would get Rs 1,000? I appeal to them to trust their brother, their son. There is no jail that can keep him behind bars for long. I will come out soon and keep my promise..." the message further read.&nbsp;

Chandrasekhar is accused of cheating and extortion from Aditi Singh, wife of former promoter of Religare Enterprises Shivinder Mohan Singh.

He was arrested in October 2019 over his alleged role in a case related to the misappropriation of funds at Religare Finvest Ltd.

Chief Minister Arvind Kejriwal on Tuesday moved the Delhi High Court challenging the summons issued to him by the Enforcement Directorate in an excise policy-linked money laundering case.

The petition of the AAP national convenor, who has been asked to appear before the agency on March 21, is listed for hearing on Wednesday before a bench of Justices Suresh Kumar Kait and Manoj Jain.

He has moved the court against the latest summons, the ninth issued by the ED asking him to appearing before it for questioning under the provisions of the Prevention of Money Laundering Act (PMLA).

Arvind Kejriwal has repeatedly refused to appear in response to these summonses, calling them illegal.

The case pertains to alleged corruption in formulating and executing the city government's excise policy for 2021-22, which was later scrapped.

Following a recommendation by Lt Governor VK Saxena, the CBI registered an FIR over alleged corruption which subsequently resulted in the money laundering probe.

The agencies have claimed that irregularities were committed while modifying the excise policy and undue favours were extended to licence holders.

AAP leaders Manish Sisodia and Sanjay Singh are in judicial custody in the case.

Arvind Kejriwal's name has been mentioned multiple times in the charge sheets filed by the ED in the excise policy case. The agency has alleged that the accused were in touch with Arvind Kejriwal for formulating the excise policy that resulted in undue benefits for them in return for which they paid kickbacks to the Aam Aadmi Party.
