The Apex Court on Thursday asked the Supreme Court Arguing Counsel Association seeking interest-free loans for lawyers to file an affidavit detailing their credentials and other details.

A bench headed by Chief Justice SA Bobde asked if it`s a registered association.

The association has filed a plea seeking direction to the Centre to form a scheme to disburse interest-free loans up to Rs 20 lakh to lawyers.

"We want to know about the Association, is it a registered Association, is it a one-man show, who is running it. We have to know all this because it is an Article 32 petition," the bench said.

The counsel appearing on behalf of the petitioner said that all members in the Association are from the Bar.

"Petitioner`s members are the regular practitioner of the Supreme Court having more than 10 years experience. The member of this association is the real face of this institution, who argues before this Court. They are coming from across the country and started practice, after purchasing their offices and houses. They have taken loan for offices and houses," the plea stated.

"In the present pandemic situation normal work of the courts is suspended from the last 6 months and further there are no chances to start the work smoothly, consequently, petitioners are unable to pay the monthly installment of the loan amount of their offices and housing loan, therefore, petitioner seeks indulgence of this court for direction to give relaxation in payment of monthly installment as well as for the direction to the respondent (Centre, RBI, and UCO Bank) to give interest-free loans up to Rs 20 Lakhs," it added.

To this, the CJI said "We are glad you are doing good work but we want to know about the Association."

Criticism is not the best form of correction as it can be damaging and discouraging, said Chief Justice of India (CJI) SA Bobde here on Saturday, while speaking at an event here on Saturday.

"In know, there are people who believe that criticism is the best form of correction. With utmost respect, I do not agree. Criticism can be damaging. Criticism can be discouraging," said Chief Justice Bobde.

"A healthy solution of problems arrived at impersonally is probably the best way," he added.

In the backdrop of the police encounter of four accused of gang-rape and murder of Telangana veterinarian, CJI Bobde said that justice must never take the form of revenge.

"Recent events in the country have sparked off the old debate with new vigour. There is no doubt that the criminal justice system must reconsider its position and attitude towards laxity and eventual time it takes to dispose-off criminal matters," he said.

"But I don't think justice can ever be or ought to be instant and justice must never ever take the form of revenge. I believe justice loses its character of justice if it becomes revenge," added he.

Chief Justice Sharad Arvind Bobde on Tuesday said that the Constitution of India is based on plurality and popularity through which a billion voices speak.

"Our Constitution is based on plurality, popularity. Through our Constitution, a billion voices speak and articulate many things," Chief Justice Bobde spoke at a special function organised by the Supreme Court Bar Association (SCBA) on the Constitution day.

He said that over the years, the Constitution has facilitated a "social revolution".

The Constitution Day is celebrated to mark the adopting of the Indian Constitution by the Constituent Assembly on this day in 1949.

It came into force on 26th January 1950, marking the beginning of a new era in the history of the Indian Republic.

The day was first celebrated in 2015 as a mark of tribute to India's first Law Minister Bhim Rao Ambedkar, who played a pivotal role in the drafting of the document.

The declaration regarding it was made by Prime Minister Narendra Modi on October 11, 2015, while laying the foundation stone of Statue of Equality in Mumbai.

The Constitution of India, one of the longest written Constitutions of the world, constitutes of a Preamble, 22 parts with 395 articles and 8 schedules.

Emphasising that the strength of the institution lies in the Bar, Chief Justice of India Sharad Arvind Bobde on Thursday asserted that mental well-being of members of the Bar and Bench is important.

While speaking at the feliciation function organised by the Supreme Court Bar Association (SCBA), Chief Justice Bobde said "We must not live in hubris where only physical well being is important. Wellbeing is not only restricted to physical well-being but also mental. It is important for members of the Bar and Bench."

He also stressed that the strength of the institution lies in the Bar. "The Bar is the mother of Bench, after all, most of the judges start their career from it," he added.

"For 19 years I was a judge and the memories of being an advocate are fresh in my mind. I was part of the Bar for 22 years, so believe me when I say I know it all," he said.

New CJI, Bobde, has succeeded Justice Ranjan Gogoi who retired on November 17 after remaining in office for over 13 months.

Bobde was elevated as a judge of the Supreme Court of India on April 12, 2013. He will retire as CJI on April 23, 2021.
