Britney Spears has launched a legal bid to remove her father from a controversial guardianship controlling her finances and replace him with an independent accountant, according to court documents filed Monday.

Mathew Rosengart, who was appointed as the pop star's attorney this month, had pledged to move swiftly to remove Jamie Spears after the singer delivered two emotional testimonies to a Los Angeles court labeling the conservatorship as "cruelty."

"If the court doesn't see this as abuse... I don't know what is," said Spears, 39, telling the court via telephone earlier this month that she wanted her father removed and to "press charges" against him.

The Los Angeles Superior Court website on Monday listed a new petition to "Appoint Conservator of Estate (Successor)", and California-based accountant Jason Rubin is listed as "Nominee."

Rosengart argued in the petition that as a recent judge's ruling found "Ms. Spears has sufficient capacity to choose her own legal counsel, she likewise has sufficient capacity to make this nomination," The New York Times reported.

At a brief hearing later Monday, Judge Brenda Penny said she will rule in late September on the bid to remove Jamie Spears from control of an estate estimated to be worth $60 million.

Jamie Spears' removal has been a longstanding demand of devoted global fans campaigning under the #FreeBritney slogan.

Spears was placed under a unique legal guardianship largely governed by her father after she suffered a highly public 2007 breakdown.

But the "Toxic" singer has become increasingly vocal and public in opposing the conservatorship since emotional court testimonies and social media posts in which she slammed the system as "cruelty" and accused her father and others of profiting from the system.

Spears alleged in court that she had been prevented from having a contraceptive IUD removed, despite wanting more children, and forcefully put on medication that made her feel "drunk."&nbsp;

She recently wrote on Instagram that she was "not gonna be performing on any stages anytime soon with my dad handling what I wear, say, do, or think."

Following a July 14 hearing, Rosengart told AFP his team would be "filing a petition as soon as possible to move Mr Spears," while also calling on the singer's father to step down voluntarily.

But Jamie Spears' lawyer told the court he would not be standing down, and disputed Britney Spears' account of the conservatorship.

A previous petition to remove Jamie Spears from his role last year was rejected by the judge.

A court hearing has been set for September 29.

Britney Spears files to replace her father as guardian

Singer Britney Spears on Wednesday won the right to choose her own lawyer to help her end a <a href="http://13.235.153.162/photos/from-lithium-intake-to-being-forced-to-go-on-tour-britney-spears-her-slew-of-shocking-revelations-on-conservatorship-393602">13-year-long conservatorship</a> and tearfully pleaded for the court to oust her father immediately from the role of controlling her business affairs. Her father, Jamie Spears, has been a major figure in the conservatorship since he set it up in 2008 when his daughter had a mental health breakdown. He is currently the sole person in charge of her $60 million estate.

"You're allowing my dad to ruin my life," Spears told the Los Angeles judge by phone. "I have to get rid of my dad and charge him with conservatorship abuse," she added.

Speaking for about 10 minutes on Wednesday, Spears, 39, said she had always been "extremely scared of my dad."
She said she was fed up with multiple psychological evaluations in the last 13 years and wanted the conservatorship brought to an end without another one.

“I’m not a perfect person .. but their goal is to make me feel like I’m crazy," Spears said. Details of Spears` mental health issues have never publicly been disclosed.

Last month she called the legal arrangement abusive and stupid in a 20-minute public address.
Los Angeles Superior Court judge Brenda Penny on Wednesday approved former federal prosecutor Mathew Rosengart to represent Spears going forward. The singer`s court-appointed attorney stepped down last week.

Rosengart, who has previously represented Hollywood stars Sean Penn and Steven Spielberg, said his goal was to end the conservatorship.
“Does anybody really believe Mr. Spears’ continued involvement is in the best interest of Britney Spears?,” Rosengart said. “If he loves his daughter, it is time to step aside.”

Rosengart`s first job is likely to be filing a formal document asking for the conservatorship to be terminated. Spears on Wednesday posted a video of herself doing cartwheels to celebrate getting what she called "real representation."

"You have no idea what it means to be supported by such awesome fans!!!! God Bless you all!!!!!," she wrote on her Instagram account, adding the #FreeBritney hashtag.

In June, the pop star complained of being prevented from marrying or having more children and said she was compelled to take medication against her will. Jamie Spears` attorney on Wednesday said that many of the singer`s complaints were not valid.
“I’m not sure Ms. Spears understands she can in fact make medical decisions and can have birth control devices implanted or not," attorney Vivian Thoreen said.

Thoreen said Spears believes her father "is responsible for every bad thing that happened to her and that is the farthest from the truth.”
Outside the courthouse, dozens of fans held a rally, chanting "Free Britney" and calling for the conservatorship to end. A smaller rally took place near the Lincoln Memorial in Washington, D.C.

"If you look at her, she looks tired. She just wants her life back and I understand that completely," said fan Christina Goswick. Penny made no decisions on requests for 24/7 security following death threats against those involved in the conservatorship.

Jodi Montgomery, who is tasked with the pop star`s personal care, Jamie Spears, Ingham and the singer`s sister Jamie Lynn Spears have all received threatening calls and messages that have escalated since the pop star`s address to the judge on June 23, according to court documents.
The next hearing in the case was set for Sept. 29.

'Their goal is to make me feel like I'm crazy,' tearful Britney Spears tells court

A day after Britney Spears'<a href="https://www.wionews.com/entertainment/hollywood/news-britney-spears%E2%80%99-manager-of-over-21-years-larry-rudolph-quits-hints-she-is-retiring-396211"> longtime manager quit</a>, now the singer's court-appointed attorney too has resigned. The attorney was appointed by the court in her contentious conservatorship.&nbsp;

Lawyer Samuel Ingham, who has been representing the singer`s interests in the legal arrangement, filed documents in Los Angeles resigning from his position, according to a court filing. He gave no reasons but said he would continue in the role until a new lawyer is appointed for Spears.

Last month, the singer testified in front of a Los Angeles judge and opened up for the first time about the 13-year court-approved conservatorship which she has been put under. In the explosive hearing, the singer said she wanted to take back control of her own life, including choosing her own attorney.

Spears has yet to file the documents needed to start the process of ending the conservatorship.

Meanwhile Larry Rudolph, who has managed the singer`s career for 25 years, said Spears has been "voicing her intention to officially retire" and that he was stepping down.

"As her manager, I believe it is in Britney`s best interest for me to resign from her team as my professional services are no longer needed," Rudolph said in the letter, which was sent to Spears` father Jamie and her co-conservator Jodi Montgomery.

Spears, 39, has not performed in public since her last world tour ended in October 2018.

The singer`s testimony last month has thrown the conservatorship into disarray.

Both Jamie Spears and Montgomery have denied responsibility for many of the problems she complained about, while Bessemer Trust, the financial company that was chosen last year to help manage her business affairs, has also asked to be removed.

Montgomery said in a statement on Tuesday that Spears has asked her to continue in her role as temporary conservator of the pop star`s personal and medical affairs, and that she had agreed.

The next court hearing in the conservatorship is due to take place next week.
