A court in the US sentenced an art dealer to two years and three months imprisonment on Tuesday (May 30) after he was found involved in a scheme which was aimed at the sale of fake Andy Warhol paintings. 
 
Daniel Elie Bouaziz,69, was sentenced in Fort Pierce federal court in South Florida. In February, he pleaded guilty to a single count of money laundering, while prosecutors decided to drop 16 other counts which are related to embezzlement and fraud. 
 
A fine of $15,000 was imposed on Bouaziz, and the court will hold a restitution hearing on August 16. Prosecutors stated that Palm Beach County's Danieli Fine Art and Galerie Danieli's owner Bouaziz sold counterfeit artworks in October 2021 to a customer, which included pieces purportedly by Warhol. 
 
He also sold fake paintings by Keith Haring, Henri Matisse and Roy Lichtenstein.

The customer was told by Bouaziz that the pieces, which were being sold by him for prices ranging between $75,000 and $240,000, were all authentic originals and that some pieces have been signed by the artists themselves, stated investigators. 
 
Officials stated that Bouaziz was made a down payment of $200,000 by the customer which was deposited into the account of Bouaziz, and then the comingled funds were transferred to other accounts. In reality, the paintings were reproductions purchased in online auctions.

<h2>Appeal for 'reasonable' sentence to&nbsp;Bouaziz</h2>

The judge was appealed to give a “reasonable” sentence to Bouaziz, considering his age and poor health. 
 
“While Bouaziz may (have) been generous to some, as countless people claim in their letters of support to this court, he was defrauding others,” stated Assistant US Attorney Sarah Schall. 
 
“Bouaziz won people over with his philanthropy, high-end vehicles, ties to the local synagogue, invitations to lunch, history as an opera singer, art events and more,” he added.

In a sentencing memorandum, federal prosecutors noted that Bouaziz “knew some of the pieces he sold were not genuine”. They added that, in one instance, he sold fraudulent art for $25,0000 to an undercover agent. 
 
The prosecutors said that Bouaziz had won over many people in Palm Beach with his luxury cars, invitations to art events and lunch and his philanthropy. They added that Bouaziz's generosity belied a darker reality. “Bouaziz painted a picture of himself that he wanted others to see and believe,” they stated. 
 
Bouaziz was charged in June after an investigation which involved serving search warrants at his galleries, reviewing his financial records as well as undercover purchases of what has been deemed to be fraudulent art.

Andy Warhol's nephew will put two works by his late pop artist uncle on the market for the first time Tuesday in New York, with both expected to sell for hundreds of thousands of dollars at auction. The two paintings were created when Warhol, the son of a working-class family of Eastern European immigrants, was a 20-year-old art student in his native Pittsburgh, Pennsylvania.

The self-portrait 'Nosepicker 1: Why Pick on Me'&nbsp;and 'Living Room',&nbsp;both from 1948, will be auctioned off Tuesday evening at New York's Phillips.

Warhol's much more famous 'Shot Sage Blue Marilyn',&nbsp;which shows the likeness of iconic actress Marilyn Monroe, was auctioned off in May for $195 million -- a record for 20th-century artwork.

Phillips estimates that 'Nosepicker 1'&nbsp;will sell for between $300,000 and $500,000 -- while 'Living Room'&nbsp;will go for $250,000-$450,000.

"These two paintings have been in the family for over 70 years. And we've enjoyed them for many years," said James Warhola, the 67-year-old nephew of artist, illustrator and filmmaker Warhol, who died in 1987.

Warhola's father was the older brother of Warhol -- who chose to drop the "a" from his last name.

"My parents have passed, so it's time that we will be selling them and splitting the proceeds," Warhola told AFP, noting he has six siblings.

The youthful self-portrait of Warhol with a finger up his nose, as well as the painting of his Pittsburgh living room, have been exhibited several times around the world, but nearly vanished.

According to Phillips, in the late 1970s, the Warhol family had their car stolen with the two works inside.

"Fortunately for the family and for art enthusiasts across the globe, the car was recovered, with the artworks completely unscathed," the auction house said.

These early Warhol works are not expected to reach anywhere close to the soaring price of the Marilyn Monroe pop art image sold last May 9 at auction.

"We cannot believe that his artwork has become so valuable," Warhola told AFP.

"In fact, I think my uncle Andy would be, like, flattered."

Pop music and art converge on the US Supreme Court on Wednesday as it hears whether a photographer should be compensated for a picture she took of Prince used in a work by Andy Warhol.

The case, Andy Warhol Foundation for the Visual Arts v. Goldsmith, could have far-reaching implications for US copyright law and the art world.

It stems from a black-and-white picture taken in 1981 by celebrity photographer Lynn Goldsmith of Prince, a then up-and-coming young musician from Minneapolis.

In 1984, as Prince's "Purple Rain" album was taking off, Vanity Fair asked Warhol to provide an image to accompany a story on the musician in the glossy magazine.

Warhol used one of Goldsmith's photographs to produce a silk screen print image of Prince with a purple face in the familiar brightly colored style the artist made famous with his portraits of Marilyn Monroe.

Goldsmith received credit as the photographer and was paid $400 for the rights for one-time use.

After Prince died in 2016, The Andy Warhol Foundation, set up after the artist's death in 1987, licensed another image of the musician made by Warhol from the Goldsmith photo to Vanity Fair publisher Conde Nast.

That portrait -- Warhol had actually made 16 in total -- featured Prince with an orange face rather than a purple face.

Conde Nast paid the Foundation a $10,250 licensing fee.

Goldsmith did not receive anything and is claiming that her copyright on the original photo was infringed.

"This time, no credit or payment to Goldsmith," her lawyers said in a brief. "Copyright law cannot possibly prescribe one rule for purple silkscreens and another for orange ones."

Split rulings

The Warhol Foundation countered by arguing that Warhol's "Prince Series" is "transformative" is and therefore not infringing on any copyright.

"Goldsmith is asking for something remarkable here," the Foundation said in its brief.

"She wants the Court to hold that the works of Andy Warhol -- universally recognized as a creative genius who pioneered the twentieth century Pop Art movement -- are not transformative, and therefore are illegal."

Two lower courts issued split rulings, sending the case to the Supreme Court.

In 2019, a US District Court judge in Manhattan ruled in favor of the Warhol Foundation.

"The Prince Series works can reasonably be perceived to have transformed Prince from a vulnerable, uncomfortable person to an iconic, larger-than-life figure," the judge said.

"The humanity Prince embodies in Goldsmith's photograph is gone," the judge said. "Moreover, each Prince series work is immediately recognizable as a 'Warhol' rather than as a photograph of Prince."

An appeals court disagreed last year, however, saying "the district judge should not assume the role of art critic and seek to ascertain the intent behind or meaning of the works at issue."

What counts, the court said, is whether the new work "remains both recognizably deriving from, and retaining the essential elements of, its source material.

It said the Warhol series "retains the essential elements of the Goldsmith photograph without significantly adding to or altering those elements."

After hearing oral arguments on Wednesday, the nine judges on the Supreme Court will decide whether Warhol's work is transformative, and deserving of protection, or infringing.

They will issue their ruling by June 30.

Auction house Christie's announced Saturday that the most complete skeleton of a Deinonychus will go on sale this spring in New York.

The species, that inspired Jurassic Park’s velociraptor, was discovered in 1964 and is expected to fetch $4 million to $6 million.&nbsp;

Deinonychus will be on display from April 30 through May 11, and up for auction on May 12. Dubbed the "Terrible Claw," it was excavated from Wolf Canyon, Montana seven years ago.

James Hyslop, Christie's head of science and natural history, told news agency Reuters “What's really nice about this skeleton is it's the most complete one known. There are 126 of the original fossil bones, including all of the claws that make this raptor so iconic and famous.”

He said another iconic item that is expected to sell for a record price is Andy Warhol's iconic sage-blue background portrait of Marilyn Monroe.

Alexander Rotter, Christie's chairman of 20th and 21st-century art, told news agency AFP "Andy Warhol's Marilyn is the absolute pinnacle of American Pop and the promise of the American Dream encapsulating optimism, fragility, celebrity, and iconography all at once."

Monroe, who died at the age of 36 due to a drug overdose, was the muse of the silkscreens created by Warhol.

The "Shot Sage Blue Marilyn" portrait, inspired by the 1953 movie "Niagara" directed by Henry Hathaway, is "categorically one of the greatest paintings of all time" as per Rotter.

Warhol sold his painting, "Silver Car Crash (Double Disaster)", for a record price of $104.5 million in 2013.
