A special court on Monday issued a notice to the CBI on an application by <a href="https://www.wionews.com/india-news/mehul-choksi-fugitive-and-absconder-enforcement-directorate-tells-bombay-high-court-223892">fugitive diamond merchant Mehul Choksi</a> who termed the investigation into the PNB scam case as ''incomplete" and sought further probe.

The plea filed by Mehul Choski's counsel Vijay Agarwal came up for hearing before Special CBI Judge UM Mudholkar, who posted the matter for hearing to June 17.

"There has been an incomplete investigation of various vital aspects by the investigating officer. The IO has submitted an incomplete charge sheet before the court without making proper and complete investigation," the application said.

It contended that the incomplete investigation led to the "failure" of Choksi's business.

"The failure of the applicant's business was termed as 'fraud'&nbsp;by the CBI. The flaws were on the part of the bank and the auditors and not the accused," the plea submitted.

The petitioner claimed that "false" FIRs were filed by the Central Bureau of Investigation (CBI) against him on February 2 and February 15, 2018.

Speaking to ANI, Choksi's counsel Vijay Agarwal said, "We moved an application in the court today contending that no lapses were made on the part of my client. In fact, they were made on the part of Punjab National Bank (PNB) officers and auditors... We explained several lapses to the judge during the hearing, which had been ignored by the investigating officer."

Mehul Choksi and nephew Nirav Modi are key accused in the Punjab National Bank (PNB) fraud case.

They fled the country a year ago. The scam is estimated at two billion US dollars.

Choksi was granted citizenship of Antigua and Barbuda on January 15, 2018.

On March 22, Choksi had moved an application before the Prevention of Money Laundering Act (PMLA) court, stating his long history of heart ailment and a blood clot in the brain as the reason for not being able to appear before it.&nbsp;

On March 29, Modi's bail was rejected by Chief Magistrate Arbuthnot&nbsp;on the grounds that there was a "substantial risk he would fail to surrender".

Nirav's problems have been exacerbated by the fact that the US has charged him with violating Racketeer Influenced and Corrupt Organisations (RICO) Act in an American bankruptcy court.

He is believed to have been living in the UK on an Investor Visa, applied for in 2015 at a time when the so-called '"golden visa"&nbsp;route was relatively easier for super-rich individuals to acquire residency rights in the UK based on a minimum of 2-million pound investment.

He was arrested by uniformed Scotland Yard officers on March 19. Indian authorities have been&nbsp;trying to extradite him since then.

During his first court appearance a day later, it emerged that the diamantaire accused of defrauding PNB via fraudulent Letters of Undertaking (LoUs) had been in possession of multiple passports which have since been revoked by the Indian authorities.

UK court extends Nirav Modi's remand till May 24

The Enforcement Directorate (ED) Friday said it has attached a factory in Thailand worth over Rs 13 crore of a Gitanjali group company, owned by absconding diamond jeweller Mehul Choksi, in connection with the alleged USD 2 billion PNB fraud case.

The agency said it has issued a provisional order for attachment, under the PMLA, of the factory premise owned by Abbeycrest (Thailand) Limited which is a "group company" of the Gitanjali group of companies.

"Investigations under PMLA revealed that Abbeycrest (Thailand) Limited is the beneficiary of the LoUs (Letters of Undertaking) issued fraudulently and unauthorisedly from the PNB to the tune of Rs 92.3 crore.&nbsp;

"During the probe, this overseas property has been identified and after gathering concrete evidence of ownership it has been attached," the ED said in a statement.

The value of the property is Rs 13.14 crore, it added. The ED is probing this case under the Prevention of Money Laundering Act (PMLA).

Officials said ED investigators will soon get issued Letters Rogatories (judicial requests) for the legal formalisation of the attachment of the foreign-based asset.&nbsp; 
Choksi, his nephew and diamond jeweller Nirav Modi, and others are being probed under various criminal laws after the fraud came to light, following a complaint from the Punjab National Bank (PNB) that they allegedly cheated the nationalised bank to the tune of over Rs 13,000 crore, with the purported involvement of some of its employees.

Both Choksi and Modi are absconding since the case was registered by the ED and the Central Bureau of Investigation (CBI). Choksi was last reported to be in the Caribbean nation of Antigua and Barbuda.

"With this attachment, the value of attachment/seizure in the PNB scam is to the tune of Rs 4,765 crore (approx). Further investigation is in the process," the ED said.&nbsp;
