Indian Air Force officer accused of raping junior gets pre-arrest bail

A Wing Commander in the Indian Air Force (IAF), who was accused of raping a junior officer in Jammu and Kashmir (J-K), was grantedpre-arrest bail by the High Court, media reports said on Saturday (Sept 14).
Last week, the Jammu and Kashmir Policefiled a first information report (FIR) after the victim- a woman Flying Officer in the air force- alleged rape by the Wing Commander.
According to a report by NDTV on Saturday, the J&Khigh courtordered the police not to file a chargesheet in the case without its permission.
The high court order
"This court has allowed the investigation to continue. However, we direct that the chargesheet shall not be filed without the permission of this court," the order by the single-judge bench of the court said.

The complaint against the Wing Commander
According to the Flying Officer, the incident happened during a New Year party at the officers' mess at the Srinagar Air Force Stationon December 31 last year.
The victim, aged 26, said that the Wing Commander asked her whether she received the New Year's gift. When she said no, her seniorsaid the gifts were in his room and took her there.
When the Flying Officer asked where her senior officer's family was,he said they were elsewhere. The woman then alleged that she was forced to perform a sexual act on the Wing Commander.
“I went into a mental shock being new to the atmosphere in the forces. I was embarrassed and… broken to that extent … lacking courage to report. I can’t describe the mental agony, being an unmarried girl… treated in such a heinous manner… the incident and nightmares put me in the dilemma of whether to discuss or be quiet, finally, I took a call and decided to fight,” the woman said.
“It took two months for Station to assemble an Internal Committee (IC)… on April 2, 2024, Internal Committee assembled. The bias of Station authorities to aid the sexual offender was very heartbreaking for me… Medical examination was not done till the time I insisted multiple times. It was done on the last day of the investigation by the Internal Committee,” she added.
The Flying Officer also pointed out that she was forced to approach the police after her pleas were ignored by the IAF.
Accused cannot leave J-K without permission
As per the NDTV report, the high court said that the accused Wing Commander has to give a surety of $596 (Rs 50,000), and cannot leave Jammu and Kashmirwithout the permission of his Commanding officer, and cannot contact any prosecution witness.
